PERMIT REQUIRED: A permit is required for -retaining walls made of any material
(concrete, masonry, ecology block, steel, railroad ties, etc.), unless
specifically exempted as described in this handout. Any retaining
wall located in a Critical Area or its buffer, or in the designated
Earth Subsidence Landslide Hazard area (ESLHA), as defined by
the Edmonds Community Development Code, must obtain a permit
regardless of height, mass or length.

CRITICAL AREAS RECONNAISSANCE REPORT: STUDY REQUIRED (CA-2006-0041)
During review and inspection of the subject site, it was found that the site may contain or be
adjacent to critical areas, including Erosion Hazard Areas and Landslide Hazard Area pursuant
to Chapter 23.40 of the Edmonds Community Development Code (ECDC). There is an existing
single family house on the lot, and it is located at the toe of a steep slope. The LIDAR map
indicates the slope is approximately 65 percent, which qualifies as a Landslide Hazard Area.
GENERAL CRITICAL AREAS REPORT REQUIREMENTS
Critical Areas Reports identify, classify and delineate any areas on or adjacent to the subject
property that may qualify as critical areas. They also assess these areas and identify any
potential impacts resulting from your specific development proposal. If a specific development
proposal results in an alteration to a critical area the critical areas report will also contain a
mitigation plan. You have the option of completing the portion of the study that classifies and
delineates the critical areas and waiting until you have a specific development proposal to
complete the study. You may also choose submit the entire study with your specific
development application.
Please review the minimum report requirements for all types of Critical Areas which are
listed in ECDC 23.40.090.D. There are additional report requirements for different types of
critical areas (see below).
Note that it is important for the report to be prepared by a qualified professional as defined
in the ordinance. There are options on how to complete a critical areas study and an
approved list of consultants that you may choose from. You may contact the Planning
Division for more information.
General Mitigation Requirements for all Critical Areas are discussed in ECDC 23.40.110
through 23.40.140.
STUDY REQUIREMENT — EROSION HAZARD AREA
It appears that this property contains or is adjacent to an Erosion Hazard Area.
Erosion Hazard areas include Alderwood and Everett series soils on slopes of 15 percent or
greater. among others.
0 Landslide Hazard Areas are further defined in ECDC 23.80.020.A.
In addition to the general requirements for Critical Areas reports referenced above, specific
Critical Area report requirements for Erosion Hazard Areas (which are one of the
Geologically Hazardous Areas) are provided in ECDC 23.80.050.
Note that Stable Erosion Hazard Areas may have limited report requirements at the
director's discretion. At a minimum an erosion and sediment control plan prepared in
compliance with the requirements in ECDC Chapter 18.30 shall be required.
DEVELOPMENT PROPOSALS ASSOCIATED WITH EROSION HAZARD AREAS
Development is restricted within an Erosion Hazard Area.
• Projects that will intrude into these areas will require a report by a licensed Geotechnical
Engineer or other qualified professional.
• Development standards are given in ECDC 23.80.060 and 23.80.070.
STUDY REQUIREMENT — LANDSLIDE HAZARD AREA
It appears that this property contains or is adjacent to a Landslide Hazard Area.
• A Landslide Hazard Area is any area with a slope of forty percent (40%) or steeper and with
a vertical relief of ten (10) or more feet (except areas composed of consolidated bedrock).
• Landslide Hazard Areas are further defined and illustrated in ECDC 23.80.020.13.
In addition to the general requirements for Critical Areas reports referenced above, specific
Critical Area report requirements for Landslide Hazard Areas are provided in ECDC
23.80.050.
DEVELOPMENT PROPOSALS ASSOCIATED WITH LANDSLIDE HAZARD AREAS
Development is restricted within a Landslide Hazard Area and its buffer.
• Projects that will intrude into these areas will require a report by a licensed Geotechnical
Engineer.
• The criteria that are applied depend on the amount that the buffer is reduced.
• The buffer can be reduced to a minimum of ten (10) feet (with an additional 15' building
setback per ECDC 23.40.280) if a report is prepared that meets the standards listed in
ECDC 23.80.050). The alteration must also meet the requirements listed ECDC 23.80.060.
• In addition, proposals to reduce the buffer to less than ten (10) feet must comply with the
design standards listed in ECDC 23.80.070.A.3.
ALLOWED ACTIVITIES
Certain activities are allowed in or near critical area buffers as specified in ECDC 23.40.20. If
you have any questions about whether your proposed development qualifies as an allowed
activity, please contact a Planner for more information.
EXEMPT DEVELOPMENT PROPOSALS

The City of Edmonds has completed its review of the plans submitted by CG Engineering on
January 5, 2009 for the aforementioned project. With this letter, the City approves the design.
The City of Edmonds is willing to take over the operation and maintenance of this proposed
system if all the following conditions are met:
I . The system shall be constructed per the approved plan by a licensed contractor with a
current City of Edmonds business license. This includes the erosion and sediment control
0 provisions in the plans. It is important that these provisions are adhered to strictly since
the pipe will be installed in a critical area (steep slope).

The constructed system shall be inspected and approved by our)4gineering Inspectors.
The City will waive the normal inspection fee for the first visit. The property owner shall
be responsible for any additional inspection fees should the Inspectors have to return to
verify that a deficiency, if any, has been fixed.
4. A one year maintenance bond shall be required for the storm systems. This means if there
is a problem with the system within one year of completion that requires repair, the
property owner has the obligation to repair it to City engineering standards at no cost to
the City.
5. The City shall have access after the approved construction work is completed to survey the
physical location of the proposed pipe in order to develop a proper easement document.
6. The legal owner of the property shall sign the easement dedicating the assets (newly
constructed stormwater system) and an easement for maintenance and reconstruction to the
City of Edmonds. This dedication is subject to acceptance of the completed system by the
City upon its determination that all conditions have been met. -

Hi Mike,
Chuck Warner has completed all the storm improvements at the Harter residence at 23005 108th
Ave W. Jerry Shuster and I made a site visit (yes, Jerry was in the field) to inspect the final product.
The City was not called out for some of the inspections near the end of the project and so I'm hoping
you may have some documentation of your inspections/site visits that you could forward to us.
We are specifically hoping for photos of the concrete anchor for the structure at the top of the slope.
Any other pictures you may have would be great for our records as well.
I will be on vacation for the next couple of weeks so if you send anything via e-mail, please send to
both Jerry and myself.
