He cited Sections 20.10.070(A)(2) and 20.10.070(A)(5) of the design guidelines. Staff makes no recommendation on this proposal The Board members referred to the neon sign which was recently placed on Richard's Restaurant which is located in the same area. Mr. Jacobs said that on a comparative basis, the Richard's sign uses the brightest red which can be put on a sign. The colors for the proposed sign are clear yellow, aqua and white and the effect will be much different. He presented a picture of the business logo which they are trying to match for the sign. He displayed a picture of what the sign would look like and described which parts would be lighted. Boardmember Young inquired why a neon sign is necessary for this building. When the Board was reviewing the sign proposal for Provinces, staff made the point that the neon sign was consistent with the vintage style of the building. But, he questioned why the applicant for this proposal did not choose a wood type sign to be consistent with the other signs on the building. Mr. Jacobs said the applicant wanted to use the neon look to more closely represent the business logo. Boardmember Young said he would feel better about allowing the neon sign if it were to be located on a different style of building. Boardmember Goodrick inquired how the brilliance of the proposed sign could be compared to that of the Anthony's sign. Mr. Jacobs said the red color used in the Anthony's sign is 40 percent more visible than the colors being proposed for this sign. Boardmember Goodrick said she does not consider the Anthony's sign to be excessively brilliant, and the proposal is acceptable to her. Boardmember Frank requested clarification as to what portions of the sign would be illuminated. Mr - Jacobs described where the neon lighting would be. Boardmember Frank said she felt more comfortable with the proposal now that it is clear what portions will be illurainated, However, she said she still has a concern with setting a precedence for neon signs in the waterfront area. Boardmember Oaklief noted that the Board has approved neon sip requests for the waterfront area in the past. He said there is a difference between this sign and the red at the top of the Richard's sign. He said the Board has taken some "flack" from the public because of the red neon wave on that building. The height of the proposed sign is lower and, the sign is smaller. He felt the proposal is more in line with what the Board has approved in the past. Boardmember Young added that the sip which was approved for Richard's is the outer limits of what the Board would ever want to approve along the waterfront area. Mr. Bissell advised that Magic Living Homes is a new manufactured home dealer which is replacing a manufhctured home dealer which was located at the same site. The applicant has applied to place a new fteestanding sign on the existing freestanding sign poles, It will include a reader board sign. This was discovered during a business license review. The applicant is now trying to correct this situation by applying for a permit. He farther explained that the law requires that if somebody does something on their property without the necessary review or permit the body reviewing the application must review it as though there had been nothing done. The Board cannot bias their decision based on this mistake. Boardmember Young pointed out that the design guidelines discourage the use of freestanding signs. Do these guidelines apply even though the applicant is requesting to replace an existing freestanding sign? Mr. Bissell said the ECDC states that when there is a change in color or size of a sign, it is considered to be a new sip and all of the regulations for a new sign apply. The Board may determine that since the old business needed a freestanding sign, the new business needs it as well. On the other hand, Boardmember Young pointed out that the Board could assume that this is a different type of business which may not require a freestanding sign. Boardmember Oaklief inquired if the flags would be considered as an advertising structure. Mr. Bissell said the flags do not have wording on them so they cannot be classified as part of the sign area. The car, which was approved earlier, is clearly more of an identification structure because it advertises the car dealership where the flags do not advertise any particular business. Mr. Springer said the sign design being proposed is used by this company nationally. They feel it is important to use this same sign to maintain the identity. This company has three other sites in the northwest and all three use this same sign. This is merely a case of replacing the plastic in the signs on the site. If the Board looks at the site, itself, they will see that the only structures are houses, There are no business structures that would be appropriate for signage. Therefore, a freestanding sign is necessary in this case. Boardmember Young inquired how the sign went up without City approval. W. Springer said CSI has changed ownership. Since most locations allow changes to the face of a sign without approval, the previous owner assumed that they did not need a permit. Boardmember Young inquired when the sign change was made. Mr. Springer indicated that it was made in November or December of 1995. Boardmember Young noted that the sip went up without any consultation with the City and then a letter was written just a few weeks ago asking for permission to have the sip. He said he finds this distasteful. Mr. Springer said they were asked by the City to write this letter and treat this application a i s a new proposal. The City made it clear that this would be an attempt to address an earlier mistake on the part of CSI. Mr. Bissell concurred. . Boardmember Young said he agrees that the Board cannot be biased in their decision. However, he noted that the Board has been discouraged from making site visits since this information cannot be used as part of the record. Boardmember Young inquired regarding upkeep of the landscaping. Nk. Springer said they have done a carefid job of taking care of the landscaping. He presented some pictures of the site to identify the existing landscaping. Boardmernber Goodrick said that having reviewed the information in the packet and visiting the property� she would have voted on approval of the sign. It is in compliance with the Code even though the applicant overlooked the fact that it was done without going through the proper channels. Boardmember Frank suggested that this was an honest mistake since it involved the replacement of the face of an existing sign. Although the sip meets the design guideline standards, in her opinion, the colors appear garish —especially given the location. Boardmember Oaklief said that for this location along Highway. 99 the proposed sign fits in. But, he felt the flags along the fence were excessive, and he recommended the sign be approved without the flags. They are not tied into the signage and would be a distraction. He said he would vote in favor of the proposal bemuse it does at least have an understated reader board with yellow rather than white illumination. However he does not see why a used car dealership can get by without a reader board and a manufactured home dealer cannot. Boardmember Frank noted that there is a different atinosphere along Highway 99 than in other areas of the City, and different signage is appropriate to meet the needs of this unique area. Boardmember Young said the Board is trying to improve the appearance along Highway 99. Boardmember Oaklief noted that reader boards and freestanding signs are as intrusive as you can get. But, he is especially concerned that this propsal is being combined with flags, as well. Bissell advised that several months ago a fire damaged the existing Dairy Queen restaurant at the intersection of 76th Avenue West and 212th Street Southwest. The owner is proposing a difibrent style of building, using the new style Dairy Queen has established fo-r.their corporate image. They are also proposing a site orientation change. Mr. Bissell described"'ihe site design of the project including vehicle access and parking, pedestrian access, landscapini and trash enclosures. He explained that the arrangement of the pedestrian access was difficult. -'The applicant has placed the building close to the street with parking to the rear or side of the building. In order to provide a drive through service, it is necessary to have a driveway between the4iieet and the building. He noted that this has impeded the pedestrian traffic from the intersectiow'd 212th Street and 76th Avenue. This issue is of particular concern since it is anticipated that students will be patronizing this restaurant when the new high school is built. �&. Bissell indicated that the Engineering Department has requested that the turning radius be increased by the drivq through on the south side of the building. This may cramp the applicant's ability to add additional landscaping in this area. Bissell explained that the applicant has provided three sign options, none of which meet the ECDC standards. The applicant is aware of the need for a variance to proceed with signage, but would like the ADB to approve one of the three options contingent upon the applicant obtaining a variance. Each of these signs is approximately 45 square feet for a total of 90 square feet where 57 square feet will be allowed. With option 2 . the applicant has stated that the freestanding sign will be retained. be allowed. Option 3 proposes a 16.5 foot tall wall mounted sign where a 14 foot tall sign would The area of the sign would be less than 57 square feet. With option 3 the applicant has indicated that the existing freestanding sign would be removed. '1*&. Bissell said the applicant has request6 ' d final approval for both the building design and the signage. The building could be approved with a separate motion contingent upon the applicant receiving a variance. This would enable the applicant.to proceed through the variance process at the same time as the building permit process. Boardmember Young inquired if the phrase . Ohot eats, cool treatsr would be included on the building signage, Mr. Bissell said it would not since ' that would exceed the allowed amount of signage. Ms. Bookwalter pointed out that Dairy Queen is.-Arying to go with a new image similar to the drive in restaurants from the 50's. This type of signage was a typical way of advertising a product in the 1950's. The applicant would like to have as much signage as would be allowed. Boardmember Young clarified that there would be no freestanding sign if the sign variance is allowed and one of the three options is used. Ms. Bookwalter said the free standing sip would be removed. They would love to have a roof sign, but staff has indicated it would not be possible. She provided a picture of a new A&W Restaurant and another dri4-.i.n restaurant to illustrate the development trend. Boardmember Goodrick inquired why the sign in option 3 could not be reduced in height to meet the standards without a variance. Ms, Stenchfield said the., � Code calls for an I I foot clearance over a drive through area. If this sign were lowered to the height limit, the I I foot clearance would not be possible. Ms. Bookwalter added that if the taller sign is approved,ithey will agree to remove the freestanding sip. She indicated that her preference would be option 3. Boirdmember Goodrick agreed. Nis. Bookwalter said they have attempted to eliminate some of the square footage from the sign in option 3. Regarding the turning radius as mentioned previously by sm% Ms. Bookwalter said they now propose an eight foot landscaping area against the building in the northeast comer of the property. This allows more radius for cars to get around the building. But, this win prohibit them from putting additional landscaping between the drive isle and the parallel parking. Boardmember Frank inquired where the applicant anticipates pedestrians from the high school will access the business. Mr. Bissell said it is very likely they will use a dro ss walk from the comer of 212th Street and 76th Avenue West. The applicant has worked hard tolocate the building so that the pedestrian traffic can be channeled to the path of least resistance. TvIs. . B,00kwalter indicate that there would be a cross walk striped on the pavement to indicate a pedestrian crossing. Boardmember Oaklief discussed the proposed site plan with the applicant and Board. He expressed his concern that the site design be changed to allow a safer pedestrian access to the building. He suggested that the drive aisles be reconfigured to accommodate the traffic in a safer manner. John Barker, 1560 28th Avenue West, Seattle, said he is the father of three kids who love to go to Dairy Queen. He shares the chairman's concerns about separation of vehicular and pedestrian b-affic. Anything that can be done to keep the drive lane and pedestrian lanes separate would be a noble efforL He said he personally feels that drive lanes have a lot of distractions.
