The City of Edmonds Engineering Division recently received a complaint about flooding on property southeast of your trailer sales lot. An investigation of the matter by Jerry Hauth, the Hydraulics Engineer, indicated that fill material placed at the south side of your trailer sales lot is the major contributor to the flooding problem. Before any fill material is placed on property in Edmonds, a fill permit must be obtained from the city's Building Division. We have no record of a fill permit for the activity occurring on your property. As part of the permit, a storm water and erosion control plan must be submitted. Because you did not obtain this permit, and because the placement of fill was not reviewed by the City, recent heavy rains have resulted in nearby flooding. For the permit, you must submit a grading plan that indicates elevations both before and after fill was placed, as well as cross sections of the fill area to substantiate volumes. In addition, a temporary erosion and storm water control plan Must be submitted. By January 9, 1987, please have your engineer come in with the grading and erosion control plans to apply for the permit. On January 23, we received a phone call from an engineer, Max Meyring, who indicated that he was working on a drainage plan for a fill permit for you. Because we assumed the matter would be taken care of, we did not involve the City Attorney. To date, we have had no further response from either Mr. Meyring or from you. The problem has not been resolved, and the potential for additional downstream flooding remains. You are still in violation of the Edmonds Community Development Code, which requires a permit for fill placed on any property in the city. The 1.72 acre site is presently undeveloped. A mobile home sales operation, granted under CU-7-84, is located on the adjacent property to the north. In late 1986, the City investigated a complaint regarding an illegal fill taking place on the subject property, and causing flooding to the properties to the southeast. It was discovered that approximately 820 cubic yards of soil had been placed on the site. The Applicant intends to use the fill area for additional parking for mobile home Surrounding development is commercial to the north and west. Multifamily development is found to the east and south, with a mix of some single family homes. B. Pursuant to our phone conversation, I will summarize in this letter the testimony I gave at the last hearing, which I believe was held April 16, 1987. I am a partner of Prince Company, the partnership which owns an 11-unit apartment house at 23030 76th Avenue West, Edmonds, Washington, 98020. The apartment house is back from the street with a narrow driveway. At its west end, our property abuts the mobile home sales property. The first point of my testimony was to find out the physical relation of the property affected by the fill and our property. Although the application is in the name of 23005 Highway 99, it was explained at the hearing that the fill site is actually south of the southern boundary of my property. The engineer testifying for the applicant, Max Meyering, testified there was more than 100 feet between the southwest corner of our property and the closest part of the fill site. 1k, Mr. Duane Bowman May 18, 1987 Page 2 I expressed concern about the change in relationship between the properties along Highway 99 and those along 76th Avenue which occurs by fill and grading of the properties along Highway 99. This seems to me to increase the chance of additional water flowing onto our properties and, if extended in close proximity to our property, would adversely affect its appearance and usefulness. I was very concerned that nothing be permitted which would increase the possible flow of water from the subject property to our property. Mr. Meyering testified there would be no additional runoff to our property because of the physical location of the fill site and also the existence of a natural swale on the subject property which would preclude any additional runoff waters reaching our property. I urge the hearing examiner that if the permit is granted it be conditioned upon (1) preserving the natural swale on the subject property which prevents storm water from reaching our property; and (2) that the grading be done in a way which did not increase the amount of water flowing towards our property 1 .1 from that which existed before the fill. While it was obvious to me at the hearing that the other witness's property was much more affected by the illegal fill than my own, I believe it is important that no permit issue which would change the natural condition with respect to storm water or increase the storm water flowing towards our property when compared to circumstances existing before the fill. FINDINGS OF FACT 1. The Applicant has requested -approval of a conditional use permit for the grading of approximately 820 cubic yards of earth at 23005 Highway 99, Edmonds, Washington. The fill has been placed on the site and it is the intent of the Applicant to use the area for additional parking for a mobile home sales operation that is located adjacent to the fill. The area would be used for the mobile home storage. (Bowman testimony.) 2. The site is 1.72 acres of land and it is undeveloped. Adjacent to the site is the mobile homes sales operation that was granted under conditional use permit CU-7-84. The mobile home sales operation is located north of the subject property. (Staff report.) 3. The subject property is located on the southeast corner of the intersection of Highway 99 and 230th Street S.W. The property is zoned General Commercial (CG). The properties to the north, south and west are also zoned CG. The property to the east is zoned RM-2.4. (Staff report.) 4. The subject property and the surrounding area are designated in the Comprehensive Plan of the City of Edmonds as Highway 99 Commercial Area. (Staff report.) 5. The Edmonds Community Development Code (ECDC) 18.40.040 establishes that no person shall perform grading involving more than 500 cubic yards of material on any lot, or contiguous lots, without first obtaining a conditional use permit. (ECDC.) 6. In order for a conditional use permit to be granted within the City of Edmonds the criteria as set forth in ECDC 20.05.010 must be met. These criteria include: A. The proposed use must be consistent with the Comprehen- sive Plan of the City of Edmonds; B. The proposed use in its location must be consistent with the purposes of the zoning ordinance in which the pro- perty is located; and, -2- HEARING EXAMINER RE: CU-15-87 C. The proposed use must not be significantly detrimental to the public health, safety or welfare, nor injurious to nearby private properties or improvements. (ECDC. ) 7. Subsequent to the placement of the fill on the subject pro- perty, owners of property in the area complained to the City that flooding was occurring because of the improper drainage on the subject site. Included in the flooding was significant flooding of the property southeast of the subject property. (Payne testimony.) 8. The Applicant submitted a grading plan showing drainage of the subject property in the filled area. According to the Applicant's representative, uncontrolled water flow not directly associated with the fill area, was the cause of the flooding of the properties. (Meyring testimony.) 9. The City submitted that the Applicant must submit an erosion control and drainage plan for review and approval by the City Engineer for the material that has been placed on the site. If, according to the City, it is determined that drainage is unable to be controlledr the fill material must be removed. (Staff report and Bowman testimony.) 10. The owner of the property west of the subject propertyr which is developed with an apartment house, expressed concern about the changing grade between the properties on Highway 99 and those on 76th Avenue, which is west of the subject property. According to the witness, the changing grade increases the chance of additional storm water flowing on to his property from the subject property, and this could have an adverse impact on his property. The witness submitted that the permit, if granted, should be conditioned upon: (1) preserving the natural swale of the subject property which prevents storm water from reaching the witness's property; and (2) the grading be done in a manner which does not increase the amount of water flowing towards the witness's property. (wicks testimony and Exhibit 9.) 11. The Planning Department of the City of Edmonds recommended approval of the conditional use permit subject to the following conditions: 1. All excavation and grading shall comply with Chapter 70 of the Uniform Building Code. 2. The Applicant shall submit an erosion control/drainage plan for review and approval by the City Engineer prior to issuance of grading permit. The Applicant shall comply with all requirements of the City Engineer. -3- HEARING EXAMINER RE: cu-15-87 3. The Applicant shall obtain a grading, permit from the Building Department and comply with all conditions of permit approval. 4. Any grading work shall be done during normal working hours of the -City of Edmonds, 8 a.m. to 5 p.m., Monday to Friday. 5. The Applicant shall be responsible for keeping -all streets clean and free of debris. 6. The Applicant shall be responsible for providing verifi- cation of the total amount of excavated material prior to finalization of the grading permit. (Staff report.) 12. The Applicant's Engineer submitted that with the drainage done in accordance with the Drainage Plan as submitted in Exhibit 4, attached hereto and by this reference hereby incorporated as part of these findings, storm drainage will be controlled in the fill area and no increased water problems will occur to the Payne or Wicks properties or to any other properties in the area. According to the Applicant, the main source of drainage problems in the area is from the Butler Enterpri-ses'property which is southwest of the subject property. (Meyring testimony.) CONCLUSIONS 1. The application is for the approval of a conditional use permit for the grading of approximately 820 cubic yards of earth at 23005 Highway 99, Edmonds, Washington. The filling has been done prior to the issuance of any permit. 2. In order for a conditional use permit to be granted in the City of Edmonds the criteria as set forth in ECDC 20.05.010 must be satisfied. With conditions the application satisfies these criteria. 3. The requested conditional use permit as conditioned does not conflict with the zoning ordinances of the City of Edmonds, nor the CG zone. It is consistent in that it creates an area that will be used for display for the mobile home sales operation immediately to the north of the subject property. 4. The requested conditional use permit is consistent with the Comprehensive Plan of the City of Edmonds and the goals and policies of the Highway 99 commercial area. It is consistent because it provides a parking area more clearly defined and will eliminate confusion of driveways, streets and parking areas and create storage areas that can be landscaped. 5. with conditions and control of storm drainage, the conditional use permit will not be detrimental to the public, nor to nearby -4- CU-15-87 HEARING EXAMINER RE: private properties or improvements. 6. Should an unacceptable erosion control or drainage plan be submitted, the conditional use permit shall terminate. 3. The Applicant shall obtain a grading permit from the Building Department and comply with all conditions of permit approval. This should be done even though the grading has already been completed. 4. Any additional grading work shall be done during normal working hours of the city of Edmonds, which are 8 a.m. to 5 p.m., Monday to Friday. 5.
