I have checked the.file and find that a home occupation permit was approved for your address in 1983. A copy of the staff report, your application, and criteria for approval of home occupations in the City of Edmonds are all enclosed. As indicated on your application, you stated that you wanted employee visits of one or two times per month, and that you wished to have one employee meeting with 5 to 10 persons per month. The enclosed staff report includes a condition of approval that no employee visits are permitted to the home, including meetings. Thus, you should have no employees reporting to your home, nor should you be having meetings. When I talked to you on the phone yesterday, a secretary answered. You stated on the accompanying application that there would be no employees at the residence besides yourself. Employees are not permitted to work at the residence, as noted on the criteria included in Chapter 20.20 of the Edmonds Community Development Code. You should not have any employees at your home at any time. If you cannot meet these conditions of approval, you must move your business -to a commercial space, and your home occupation will be invalid. In order for the Planning Division to sign off on your business license, we need some proof that you have complied with the conditions of approval for your home occupation --that is, that there are no employees at your residence. A signed, notarized statement that there are no employees at your home will be sufficient. You are currently in violation of the Edmonds Community Development Code, as at least one employee regularly comes to your home. Chapter 20-20 of the Edmonds Community Development Code regulates home occupations. They are permitted in the City upon approval of a conditional use permit, and are subject to certain regulations listed in the code. In 1983, the City issued a conditional use permit for a home occupation to Delores Montanari. The request was to use the home as an office for a parent/child supervisory service. Paperwork for the City's approval is enclosed. The City approved the home occupation, subject to the condition that there be no employees at the residence. In November of 1987, Ms. Montanari applied for a business license. A copy is enclosed. As noted in the "Number of Employees" space, there are 6 employees associated with this business. I called the number listed on the business license, and a woman answered who identified herself as an employee of the business. She told me she comes to the home to work for the business. On November 10, 1 sent a letter to Ms. Montanari (please note that the name has changed from Maneshi to Montanari). A copy is enclosed. I asked her to cease having employees work at her home and to cease having employee meetings there, as the home occupation permit was condtioned on this not happening. I told her to submit a notarized statement stating that no employees come to the home, or move the business to a commercial space. I received no response to this request, so I sent two certified,letters requesting the same thing. I did not get a response. I called Ms. Montanari at her daytime workplace, and told her to submit the statement. She told me to send a copy of the November 10 letter, and would sumit the notarized statement. I sent the letter on February 24. As I have not recieved a response, I called her last week.' She once again told me she would sumbit a statement. I have not heard from her on this. I would appreciate your sending her a letter requesting that she comply. An Investigation Report is attached, which notes code section violations.
