Bud Klein stated that due to the depth of property and set back of

building that a hydrant is necessary under City Ordinance #1568. There

Is a,60 foot right-of-way on 76th Avenue West and therefore the west

side of the building Is 100 feet over the distance allowed by the City

Code.

Ass1t. Klein stated that exceptions could be made, provided that It

would not be materially detrimental to the public health, safety,
moral or welfare, or Injurious to the property or improvement in the

vicinity of the applicant's property with particular emphasis on fire
M
protection.
Mr. DiPangrazio stated that he did not feel It wise to have a hydrant
on his property with tire trucks pulling in and out on private property.
He also stated that the cost is a factor In asking for relief.
It was noted that fire hydrants existed 250 feet south of the south
property line and 250 feet north of the north property line of this
proposed project.

The building is 17,930 square feet and consists of 20 units. Albers
stated that he felt that the hydrant Is necessary because of distance
and better protection for the 20 units.

Payne stated that he felt that the Fire Department was giving the
applicant the best determination possible under the ordinance.

Questions were asked about the detector check valve and Klein stated
that this was a requirement of the Water Department.
motion was made by Payne that a fire hydrant be installed as per the

Fire Department requirements. Albers seconded and the motion carried
