In the event the owner/developer/contractor fails to complete the indicated

improvements can be installed or completed immediately to City standards. The
institution shall not be liable to the owner for any disbursement of said funds to

that any legal action must be taken to enforce the provisions of this bond or to
collect said bond, that the prevailing party shall be entitled to collect its cost
and reasonable attorneys' fees as a part of the reasonable costs of securing the
obligation hereunder. In the event of settlement or resolution of these issues,
prior to the filing of any suit, the actual costs incurred by the City, including
reasonable attorneys' fees, shall be considered a part of the obligation hereunder
secured. Said costs and reasonable legal fees shall be recoverable by the
prevailing party, not only from the proceeds of this bond, but also over and above

We are requesting a waiver to the 10 foot setback requirement to 9
foot setback due the following conditions:
1. Site constraints and swale requirements allow placement of
the storm detention system at north side of our site where we only
have a limited amount of space to install the system.
2. The size of the pipe (36") makes it difficult to maintain a 10
foot setback.
We feel a 1 foot waiver will not restrict any future repairs since the
site will be relatively flat after completion.

Critical Areas Checklist
The Critical Areas Checklist contained on
this form is to be filled out by any person
preparing a Development Permit
Application for the City of Edmonds prior
to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or his/her representative,
must fill out the checklist, sign and date it,

review the checklist, make a precursory site
visit, and make a determination of the
subsequent steps necessary to complete a
development permit application.
With a signed copy of this form, the
applicant should also submit a vicinity map
or plot plan for individual lots of the parcel
with enough detail that City staff can find
and identify the subject parcel(s). In
addition, the applicant shall include
other pertinent information (e.g. site
plan, topography map, etc.) or studies in
conjunction with this Checklist to assist
staff in completing their preliminary
assessment of the site.

The following comments apply to the submittals:
ADB 92 239 The applicant has not addressed earlier comments regarding width of
driveways/one-way status. Earlier comments apply regarding stormwater
improvements and utilities to be provided on site. Applicant should show a typical
parking stall under the building to ensure that clear width of parking stalls is a *
minimum of 8'-6"
AD13 93 185 The application does not entirely address earlier concerns. Applicant
must provide detail of planting area at southeast corner of property, near Dayton
St. entrance, to ensure adequate sight distance. It must be determined that
crosswalk across Dayton St. is needed and safe. Proposed painted "No Parking"
zones could be curbed and landscaped. Applicant did not provide Sheet A-1, so
additional comments may apply.

The Engineering Division has completed initial review of the subject proposal. The
following comments apply:
• Revise storm detention calculations as noted on attached markups.
• Maintain minimum ten foot setback from storm drain to building.
• Construction of bioswale or other water quality amendment is required.
• Provide extruded concrete curb to separate parking/driveway areas from landscaping.
• Latecomer charge for water of $3,437.40 is due as partial reimbursement to installer
of eight inch water main.
• Add note "City to inspect existing curbs and gutters." "Remove and replace as
required."
• Seven foot wide sidewalks are required in this zone. Remove existing sidewalk and
replace.
• Maximum slope for handicap accessible parking stall is 2%.
• Show proposed location of mailboxes.

Dear Mr. Michel:
I have reviewed your account and will allow a credit for the billing period from
October 3, 1995 through January 8, 1996 using an average of 33.8 units per month in
accordance with our City policy. The policy states that the customer will be billed at the
retail rate based upon the average water consumption for the same period during the
previous year. In addition, the excess water' lost from the leak will be billed to customer at
the City's wholesale rate with a 15% surcharge added for administrative cost. Only one
leak credit will be granted in any three year period.

On 1- 10-96, 1 was called out on a service call to: 23 2 4th Ave. S., Edmonds, there was water
coming out of the ground in the garden. I replaced 2" check valve on the fire pumper line and this
solved the problem. Water was leaking past the check valve and draining through the automatic
drain on the pumper riser in garden.
in March, the owner sent a bill for $1,452.00 his estimated additional bill charges from
October 1995 to January 1996.
I have attached his copies of the bills for you to review and my question to you, if possible, is
can he get a refund for this amount or what ever you think is fair.

pattern, part; No. SM 5?-thru-curb Inlet, part; No. Sm-44, rolled curb type; or other
approved aquA, or as otherwise called for on -the plans.
5. 5tormwater retention/cletention facilities must; be constructed and maintained in
accordance with City of Edmonds requirements.
6. All road filLs shall be compactzel to a minimum of .95% of maximum density when tested
using the modified Proctor test. Compaction shall be accomplished in accordance with
Section 2-03.3(14)C. Method 15 or C
7. if cut; and fill slopes exceed a maximum of one foot, horizontal to two feet vertical,
a rock or concrete retaining wall will be required.
8. Approximate locations of existing utilities have been obtained from available records
and are shown for convenienre, The contractor shall be responsible for vcrif�,ing the. location
of all exioting Litillit�cs whether shown or not. The contractor shall call the Utility Locator
5arvice, 1-500-424-5555, two working days prior to any construction.
9. The contractor shall take all necessary precautions forth& safayof employees on the
project and shall comply with all applicable provisions of Federal, 5tate, am Municipal safety
iaws and building codes. He shall erect, and properiy maintain, at all timer, as required by the
conditions and progress of the w*ork, all necessary safeguards for protoctlon of workmen and

the prevention of accidents.

2. Temporary croolon/eedimentation control measures shall be Implemented prior to any eroding
or extensive land clearing. These facIlItleo shall be satisfactorily maintained until comotmotiorl
Is completed and the. potential for erosion Is mimimal.
3. All pipe shall be placed on stable earth. or If In the opimlon of the City Engineer, the existing
foundation Is unoatlofactory� then the unsuitable material shall be excavated and the vold
backfilled with a free draining granular material, free of debris and clay.
STORM SYSTEM
4.. All grates ( Inlet and catch basin) shall be dcIprcooed 0.1 foot; below pavementgrade.
All catch basinei to be type I unless otherwise noted.
The contractor ohall be responsible for adjurtime all manhole, Inlet, and catch basin frames
and grates to erode just prior to pouHne of curbs anti paving. All catch barlmewitha
depth over 5 feet to the flowline eshall be a Type 11 C13. All otructurea located outside of the
right-of-way shall have locking lids.
Catch basin frame and grate shall be Olympic Foundry part No. 5M 50G, Herringb6ne
patterm: part No. 5M E52, thru-curb Inlet, part; No. 5m 44, rolled curb type; or other
approved equal; or so otherwise called for on the plants.
5. 5tormwater ret-entlom/detentlom facilities must be cometructed and rflairltalned In
accordance with City of Edmonds requirements.
ro. All road fillo shall be compacted to a minimum of 95% of maximum density when tested
urine the modified Proctor test. Compaction shall be accomplished In accordance with
