You are the owner in a lot in the Skelton's Lake McAleer Five Acre
Tracts. As you should be aware, drainage from the property is required
to be contained in an offsite detention/retention facility. This
facility was required as a condition of your subdi.vision and lot to be
located on the property located at 23302 - 76th Avenue.
Over the past year, we have attempted to work out an arrangement for a
joint maintenance agreement so that the City can approve the new
proposed drainage area and release the old drainage area. We have
attempted to assist you in putting together a joint maintenance
agreement. Unfortunately, we have received only one signed agreement
to date.
Until a joint maintenance agreement is agreed upon, your subdivision is
not in compliance with the existing requirements. If the retention
system is not maintained properly, the City could commence civil
enforcement proceedings charging property owners with days of
violation. It should be noted that any problems you have concerning
the changes to the detention system that have occurred would be a
matter between you and the owner of 23302 - 76th Avenue (Albert
Cerauli).
We strongly recommend that you meet together at your earliest
convenience to resolve between yourselves any questions or issues that

WHEREAS, pursuant to review by the City of Edmonds Engineering Department it
has been detemuned that the dramge area and easement should be relocated m order to
permit more efficient use of the property and a better functioning storm water retention area,
WHEREAS, the owners of lots 1, 2, 3 and 4 of Short Plat S-9-84 and the owner of
Tract 17 9 Lot 6 of Skelton's Lake McAleer Five (5) Acre Tracts -wish to rededicate such
easement and to again -provide for its joint and private maintenance, and
WHEREAS, in consideration dedication of a new easement the City deems it
appropriate to release the rights granted. under the previous Joint Maintenance Agreement,

THE UNDERSIGNED OWNERS of Lots 1, 2, 3 and 4 of Short Plat S-9-84
(hereinafter "Benefitted Lots") and the owner of Tract 17, Lot 6 of Skelton's Lake McAleer
Five (5) Acre Tracts recorded in the Land Records of Snohomish County in Volume 6 of
Plats, Page 21 Snohomish County, Washington (hereinafter "Burdened Estate") do hereby
dedicate and agree as follows:
1. DRAINAGE RETENTION EAS The undersigned owner of the Burdened
Estate hereby dedicates to the City of Edmonds and to the future owners, agents,

transferee, assigns and others with a significant beneficial interest in said Burdened
Estate as an easement legally described below for a drainage and retention area and
necessary appurtenances in andover the following described area:
The west fifty (50) feet of Tract seventeen (17),
Block six (6) Of Skelton's Lake McAleer Five (5)
acre tracts in accordance with the plat thereof
recorded in Volume 6 of Plats, Page 21 of the
records of Snohomish County, Washington.
The drainage and retention area shall be'used to collect and retain storin water and
other drainage waters from the private road, driveways and land of the Benefitted
Lots. The owners of the Burdened Estate and Benefitted Lots on behalf of themselves
and the ffiture owners, assigns and transferees of said Burdened Estate and Beriefitted.
Lots promise that under no circumstances shall the flow of said drainage waters be
changed or altered so as to impede their flow into the drainage and retention area.
. The owners' covenant that their use of.Burdened Estate and Benefitted Lots shallin
no way be inconsistent with the purpose of this easement.
2. JOINT CE A . Ile owners of the Benefitted Lots in
consideration of the dedication by the owner of the Burdened Estate agree to jointly
maintain, repair, and reconstruct said drainage -easement in order to maintain it in
accordance with the existing standards established for storm water detention and/or
retention areas by the City of Edmonds, Washington. The reasonable costs of such
maintenance, repair or reconstruction shall be born equally by the owners of
Benefitted Lots. In the event that any emergency maintenance, repair or improvement
is required, any Benefitted Lot owner or the owner of the Burdened Estate may
proceed to make the maintenance, repairs or improvement or construction or

reconstruction of the easement area in accordance with City standards and provide
written notice to the other owners of their respective share of the costs. Such repairs
shall be undertaken at the order of the City Engineer of the City of Edmonds. The
owner of a benefited lot shall have runety (90) days from the date of written notice
to make his/her share of the payment. If any owner fails to make payment within
said period, the. property owner who has effectuated the maintenance, repairs or
improvement, including construction or reconstruction may file notice of the unpaid
portion of the expenses with the recorder of Snohomish County, -Washington, and
upon filing, said notice shall constitute a lien against the property of the nonpaying
party. Any unpaid amount shall bear interest at the prejudgment interest rate
established by RCW 19.52.020 . In the event of dispute, thereasonable cost of
the disputed maintenance, repair or improvement shall be determined and assigned
by arbitration.
3. HOLD HARNOLESS AND INDEMNMCAUM. . The undersigned property
owners on behalf of themselves, their heirs, transferees and assigns agree to
indemnify and hold harmless the City of Edmonds, its officers, agents and employees
against any cost, claim or liability arising from or out of the injury or death of any
I-e person or damage to real or personal property occasioned by the flooding of the storm
water detention area created herein, without respect to whether it is alleged or
claimed that the negligence of the City of Edmonds or its representatives caused or
contributed there to. This promise to indemnify includes the reasonable costs of legal
defense by counsel of the City's choosing.
4. SPECMC PERFORMANCE. The obligations established by this easement and
agreement shall be specifically enforceable by the City of Edmonds or any other party
named herein.

4 a. Property owners must obtain a permit to install side sewers on
>4 their property. A licensed side sewer contractor must be employed to
construct side sewers'in the public right-of-way.
b. The side sewer contractor assumes full reponsibility for each
installation for one year.
C. Commercial establishment requires a minimum of a six inch (6")

0 d. Side sewers may not be installed closer than thirty inches (30")

M e. Side sewer lines must be laid at a minimum grade, of 2% (1.15
0 and maximum grade of 100% (45'). 0
f. No turn in side s8wer greater than 45 (1/81bend) is 0 allowed
between cleanout. All 90 turns must be constructed of a 45 (1/8
bend) and wye with removable cap.
g. No down spouts, footing drains or floor drains can be connected
to side sewer system.
h. Pea gravel is required for bedding when installing sewer lines
through other than granular soil.
i. Cleanouts are required at 30"-60" from each plumbing exit line
and at minimum intervals of 100! along sewer 'line run.
j. Trenches within City right-of-way must be restored to original
conditions. Contractors shall be responsible for right-of-way failure
due to poor compaction of fill.
k.- Side sewer must be left uncovered qntil inspected and approved
by the City.
