you need. one.

WHEREAS, pursuant to a Joint Maintenance Agreement dedicated as a requirement
of the approval of Short Plat S-9-84 an easement was created setting aside a drainage
retention area including hold harmless agreement, and intended for recording in the Land
Records of Snohomish County, Washington,
WHEREAS, pursuant to review by the City of Edmonds Engineering Department -it
has been determined that the drainage area and easement should be relocated in order to
permit more efficient use, of the property and a better functioning storm water retention area,
WHEREAS, the owners of lots 1, 2, 3 and 4 of Short Plat S-9-84 and the owner of
Tract 17, Lot 6 of Skelton's Lake McAleer Five (5) Acre Tracts wish to rededicate such
easement and to again -provide for its joint and private rnainteAmce, and
WHEREAS, in consideration dedication of a new easement the City deems it
appropriate to release the rights granted. under the previous Joint Maintenance Agreement,

THE UNDERSIGNED OWNERS of Lots 1. 2, 3 and 4 of Short Plat S-9-94
(hereinafter "Benefitted Lots") and the owner of Tract 17, Lot 6 of Skelton's Lake McAleer
Five (5) Acre Tracts, recorded in the Land Records of Snohomish County 'in Volume 6 of
Plats, Page 21 Snohomish County, Washington (hereinafter "Burdened Estate") do hereby
dedicate and agree as follows:
1. DRAINAGE RFTENUON EASFAlENT. The undersigned owner of the Burdened
Estate hereby dedicates to the City of Edmonds and to the future owners, agents,

transferee, assigns and others with a significant 6;eficial interest in said Burdened
Estate as an easement legally described below for a drainage and retention area and
necessary appurtenances in and over the following described area:
The west fifty (50) feet of Tract seventeen (17),
Block six (6) of Skelton's Lake. McAleer Five (5)
acre tracts in accordance wiffi the plat thereof
recorded in Volume 6 of Plats, Page 21 of the
records of Snohomish County, Washington.
The drainage and. retention area shall be used to collect and retain storm water and
other drainage waters from the private road, driveways and land of the Benefitted
Lots. Ile owners of the Burdened Estate and Benefitted Lots on behalf of themselves
and the ftiture owners, assigns and transferees of said Burdened Estate and Benefitted
Lots promise that under no circumstances shall the flow of said drainage waters be
changed or altered so as to impede their flow into the drainage and retention area.
Ile owners' covenant that their use of Burdened Estate and Benefitted Lots shall *in
no way be inconsistent with the purpose of this easement.
2. JOH-TY NIADFMNANCE AGRFENW-.NT. Ile owners of the Benefitted Lots in
consideration of the dedication by the owner of the Burdened Estate agree to jointly
maintain, repair, and reconstruct said drainage easement in order to maintain it in
accordance with the existing standards established for storm water detention and/or
retention areas by the City of Edmonds, Washington. The reasonable costs of such
maintenance, repair or reconstruction shall be born equally by the owners of
Benefitted Lots. In the event that any emergency maintenance, repair or improvement
is required, any Benefitted Lot owner or the owner of the Burdened Estate may
proceed to make the maintenance, repairs or improvement. or construction or

reconstruction of the easement area in accordance with City standards and provide
written notice to the other owners of their respective share of the costs. Such repairs
shall be undertaken at the order of the City Engineer of die City of Edmonds. The
owner of a benefited lot shall have ninety (90) days from the date of written notice
to make his&er share of the payment. If any owner fails to make payment within
said period, die property o wrier who has effectuated the maintenance, repairs or
improvement, including construction or reconstruction may file notice of the unpaid
portion of the expenses with the recorder of Snohomish County, Washington, and
upon filing, said notice shall constitute a lien against the property of the nonpaying
party. Any unpaid amount shall bear interest at the prejudgment interest rate
established by RCW 19.52.020
. In the event of dispute, the. reasonable cost of
the disputed maintenance,'repair or improvement shall be determined and assigned
by arbitration.
HOLD HAP-AffMS AND RMOMMCATION, . The undersigned property
owners on behalf of themselves, their heirs, transferees and assigns agree to
indemnify and hold harmless the City of Edmonds, its officers,. agents and employees
against any cost, claim or liability aris' from or out of the injury or death of any

person or damage to real or personal property occasioned by the flooding of the storm
water detention area created, herein, without respect to whether it is alleged or
claimed that the negligence of the City of Edmonds or its representatives caused or
contributed there to. This promise to indemnify includes the reasonable costs of legal
defense by counsel of the City's choosing.
SPECIFIC PERFORMANCE The obligations established by this easement and
agreement shall be specifically enforceable by the City of Edmonds or any other party
named herein.

SUBJECT: Fill/Retaining Wall Permit at 23220-76th Ave. W.
A review of the plans that were submitted for the subject permit raise
some issues that concern me. The proposed fill is to be placed on top
of the infiltration trench that was installed with the subdivision.
The trench is suppose to retain the runoff that is generated by the
road and driveways within the subdivision. Therefore, the catch basin
in the road and the infiltration trench in Mr. Kang's yard are the
responsibility of the four homeowners within the subdivision.
Because of my involvement in the subdivision, I am somewhat familiar
with the soils characteristics of the area. Generally, the soil in
that area is the Alderwood type. One of the characteristics of the
Alderwood type is limited permeability. The top few inches of granular
material has hard pan under it at a depth of 20 to 40'inches. The
result is a very marginal soil for water absorption and dispersal.
The construction of a retaining wall will cause an impermeable barrier
(the wall) to be placed into the shallow layer of water carrying
granular material. This would be comparable to constructing a dam by
restricting any water flow in the direction of the wall.
Infiltration systems typically have a short life expectancy. They are
plugged by whatever may wash into them. In this case, any material
that is washed off of the cars or driveways will ultimately end up on
the infiltration trench. When this is combined with a tendency for the
system to be inundated by saturated soil (from either restrictions or
just poor soil), this seems like a system that is apt to fail.
Since this system is the responsibility of the four homeowners in the
subdivision, some consideration of future maintenance and repairs
should be anticipated. The placement of fill and asphalt over the
infiltration trench will make any repairs to the system very costly and
difficult. Should the applicant obtain adequate engineering, he may be
able to address the aforementioned concerns. Until that time, I
recommend denial of this permit for the reasons listed herein.
