Subject: Claim from Pacific Park Apart s at 23231 Highway 99
The building manager of the subject apartment complex submitted plans May 1, 2001, to install
carports at the subject site. Part of their package included a site plan that included the carport
locations. The original site plan was unreadable and we asked the applicant to resubmit a site
plan and to be sure they showed all the utilities. During the review process Public Works
advised us they had a public water and sewer main that ran through the site and they did not want
the contractor to construct the carports over those utilities. We noted on the drawings, " posts
shall not be placed over any utilities".
May 25, 2001 the permit was issued.
On June 4, 2001, Public Works received a call to locate utilities at the subgect site. Jim Waite of
Public Works called the contractor and told him not to construct the carports because the City
has utilities in the area and he had not seen the drawings. The contractor stated he had not seen
the drawings either.
Construction started some time after the June 4, 2001.
On June 8, 2001 revised footing plans were submitted to the Building Department for a smaller
spread footing. One of the posts was positioned right over the water main and the contractor
could not achieve the proper depth. Since the Building Department was unaware of
Engineering's requirement not to construct over the utilities, they approved the smaller footing.
At no time was the contractor given a variance to construct the carports over the
watermain. The contractor proceeded to construct the new footing.
On June 11, 2001 Public Works and Engineering were advised the carports had been constructed.
A field inspection was conducted and based on that inspection, it was determined that the
contractor bad contructed carports over the public utilities at 3 different sites.

June 14, 2001; A stop work was issued by the Building Department. The contractor was advised
to remove the carports that were built within the utility easement and over the utilities.
The City Engineering Division talked to the Apartment Manager and the contractor numerous
times over the phone and informed both of them why the carports had to be relocated. We
pointed out to them the drawings indicated they were not to construct over the utilities. The
contractor indicated they were given approval by the Building Department because they received
approval of the smaller spread footer. I explained to both parties, the Building Department only
approved the design and not the installation location with regard to utilities.
July 25, 2001; Engineering staff and Public Works Sewer Department met with the contractor
and the apartment manager on site to discuss the problem and what could be done to resolve the
issue. We told the manager and contractor again the carports could not be located within the
utility easement because the Public Works crews would not be able to repair/replace any of the
line without damaging the carport. We restated the issue about the note on the drawing not to
construct over the utilities. During our meeting I noticed that some of the electrical work had
been completed since the stop work order had been issued on the specific carports.
September 21, 2001; City staff met the with contractor and apartment manager to discuss the
options to resolve the issue. The options were:
1. Relocate carport
2. Transfer ownership of the utilities: Installation of commerical double detector check
assemblies would be required to protect the public main. Potential cost $20,000.
3. Relocate utilities away from the carports.
4. Excute written agreement that the apartments would pay for any relocation or
damage to carport if the City had to work on the utilities.
We advised the representatives that option 4 was not really an option to us. They stated they
would get back to us on their decision.
Apartment Manager decided to relocate the carports and submitted drawings that indicated the
relocation of those carports in question. The resubmittal was approved.

This letter will confirm the terms of our settlement agreement regarding the
current dispute with the City of Edmonds, the Pacific Park Apartments and Pinnacle
Realty Management Company ("Pinnacle").
The Apartment, its ownership group and Pinnacle agree to execute a full release
of all claims they may have against the City as of this date in exchange for a mutual
release of all current claims the City may have against the Apartment, its ownership and
Pinnacle.
According to your letter of July l't and your voice mail message to me today,
upon the receipt of this letter today, the City will halt all collections actions against the
property and the parties will work towards entering a final settlement document within
the next several days.
Please contact me or have a representative from the City Attorney's Office
contact me directly so we may draft the final documents. If you prefer, I can send to you

I was contacted by a Mr. Jonathan McQuade, of Pinnacle Realty, on June 13, 2003 regarding the
civil fines accumulated to date regarding the carports that were constructed at 23231 Highway 99,
Edmonds. I offered a proposed settlement agreement to resolve the outstanding fines by, -Which
both parties walk away from any claims against each other. Mr. McQuade said he would relay
the offer and subsequently called me back on June 18, 2003 and said my offer was rejected and
suggested two other alternatives which were completely unacceptable to the City.
Therefore the City of Edmonds intends to turn this matter over for collection on June 27, 2003. A
copy of the original Notice of Violation is enclosed. Please note that since you failed to appeal
the notice of violation, there is no litigation recourse available to you. Further, once the matter is
turned over to collections, the amount due is collected at a rate of 150% of fines owed pursuant to
RCW 19.16.500.
I strongly suggest that my offer to resolve -this matter be reconsidered. I will be leaving on an
extended vacation starting June 25, 2003. Dave Gebert, City Engineer has been designated to
handle this matter in my absence.

In reply to your letter dated May 30, 2003, please refer to copies of the enclosed
Notice(s) of Civil Violation(s) issued on June 12, 2002 for the carport violations at the
subject property. The corrective action on the Notice required that final project 4pproval
be granted which as you know, occurred on April 23, 2003 (the day the carports were
removed). Thus, pursuant to the Notices, fines were assessed at $100.00 for each carport
for 298 days (298 days x $100 fine per day x 3 carports = $89,400.00).
In response to the reference of Mr. Gebert's letters, I note that none of the letters rescind,
suspend or stay the penalties imposed by the Notices of June 12, 2002.
The City desires to meet with Mr. Dwyer and his representatives in this matter to reach
an equitable agreement and resolution. Please contact my office to schedule for a
mutually agreeable day and time to meet and discuss this matter.

City of Edmondsq or the City is attempting to unlawfully harass and extort money from Pacific
Park.
First, neither Mr. Dwyer or Pacific Park are.aware that civil penalties in the amount of
$89,400 have accumulated against Pacific Park Apartments for enforcement action taken on the
carport issue. Rather, the information pTovided to W Dwyer and Pacific Park by the City
expressly stated that removal of the carports needed to occur before April 5, 2003, not July 12,.
.2002 as your letter suggests.
For example, in a letter from David Gebert dated January 6, 2003 to Pacific P&k

SUBJECT: Carport Demolition — Permit Ws 2003-0181, 2003-0182, 2003-0183
The Engineering Division verified removal of the carport footings and backfill with rock on
4/4/2003, 4/7/2003 and 4/8/2003. Lyle Chrisman, Engineering Program Manager, received a
phone call from a lady affiliated with the Pacific Park Apartments a few days following
inspection, stating that a water line had been hit during removal of the footings. No further
phone calls or inspection requests were received regarding repair of a water line.
A final Engineering inspection was performed April 23, 2003. At that time most of the asphalt
patches were a little raised and there did not appear to be any soft spots.

This law firm represents Pacific Park Apartments in connection with its dispute with the
City of Edmonds over the location of certain carports at Pacific Park.
As you know, Pacific Park constructed several carports on its property after receiving
approval from the City. Nevertheless, despite the City's approval of the plans and despite the
carports being built in accordance with the plans, the City now demands that some of these
carports be torn down and relocated. The purported reason for the City's demand is that the
carports were built over the City's water utility easement.
It is undisputed that throughout the planning process and construction of the carports the
City was well aware of the location of the carports and the utilities, yet said nothing to Pacific
Park. It was only after construction of the carports was completed that the City decided to raise
an objection. The City's silence regarding the location of the carports and utilities, coupled with
its approval of the plans showing the locations of the carports (overthe utilities) and the various
on -site inspections that allowed construction to go forward, caused Pacific Park to reasonably
rely on the approved plans and the City inspectors to build the carports.
Remarkably, rather than owning up to its mistakes, the City is trying to force Pacific Park
to shoulder all the costs related to relocating the carports. Even more remarkable is that the City

threatened to fine Pacific Park $100 per day unless the carports were removed. Because of the
City's demands and threats, Pacific Park has been forced to remove the carports at a substantial
cost. Unfortunately for the City, it is the one that is responsible for these costs and all damages
suffered by Pacific Park.
The City's action in approving Pacific Park's construction plans was a land use decision,
under the Land Use Petition Act (LUPA). Thus, if the City mistakenly approved the plans, then
the City's exclusive recourse was to follow the procedures outlined in that Act. Unfortunately
for the City, the time has long since elapsed for it to challenge the location of carports. See
Chelan County v. Nykriem, 146 Wn.2d 904 (2002) (holding that an allegedly void building
permit, if not timely challenged under LUPA, will be deemed valid).
Therefore, pursuant to the decision in Nykriem, the carports Were validly constructed.
The City's action in forcing Pacific Park to demolish the carports amounts to a governmental
taking. We, therefore, demand compensation and other damages related to their removal.
Be advised that we will take all necessary steps to vindicate Pacific Park's rights through
litigation and will hold the City liable for all costs associated with the removal and relocation of
the carports. We will also be seeking lost rent during the time Pacific Park was unable to charge
tenants for those spaces. At this point, the City is liable to Pacific Park in excess of $70,000.
Pacific Park, however, is willing to discuss an alternative resolution to this matter as such
discussions may be in the best interests of all concerned. Please contact me within five (5) days
of your receipt of this letter. If I do not hear from you, I will assume the City prefers to have this
matter litigated and we will proceed accordingly.

We appreciate the time you took to meet with Engineering and Public Works personnel to
discuss the problems and issues with the placement of carports over City -maintained utilities. As
Lyle Chrisman from the Engineering Division discussed with you and your contractor, the
drawings and building permit specified the carport posts were not to have been installed over the
utilities. In addition, prior to start of construction, the Public Works Department representative
told your contractor that the carports were not to be installed over the utilities or easement. Since
our Public Works crews must have access to their utility lines for maintenance, the carports will
have to be relocated to areas where no utility easements exist.
Please take the appropriate action to relocate the three affected carports by August 17, 2001. In
addition, a revised site plan must be submitted for approval. Be sure to show any and all utility
locations around the new sites. We will expedite our review so this work can be done
expeditiously. Once the resubmittals have been approved, your contractor will need to call for
all required inspections.

A water quality discharge problem was brought to my attention on January 4, 2000.
Storm maintenance crews observed a significant amount of an oily substance in a catch
basin on 77 1h Ave. during routine maintenance. This residue was traced back through the
drainage system and found to originate from a trash storage area in the east parking area
of the apartments. This storm drain system flows directly into Lake Ballinger. The
system is intended for storm runoff only and the water receives no treatment downstream.
This means that fish and wildlife habitat are impacted by any pollutant discharges.
The discharge of untreated waste into the water of the State constitutes a violation of
RCW 90.48.080 of Washington State Pollution Control Law and could be subject to
enforcement action which includes significant monetary fines. However, at this time we
would only like to solicit your cooperation in cleaning this area up and taking appropriate
actions to insure any pollutants are properly contained and disposed of. We request that
this situation be corrected as soon as possible. Maintenance crews will be re -inspecting
this system within two weeks.

During routine maintenance Storm Division crews discovered an oily substance
in a catch basin on 77' Ave. which was traced to a trash storage area at the
apartment complex. Attempts to contact the manager were unsucessful, so a
letter was sent out on January 1 Ot' informing them of the problem.
I was contacted on January 14 by the Pacific Park maintenance person (Bill) who
insured me the area would be cleaned up by the 18t'.
A follow-up inspection by the Storm lead on January 25 showed the area had
indeed been cleaned up with no additional pollutants leaching into the storm
water system.
