Request: To divide one lot with a total area of approximately 31,345 square feet into three lots (see Attachments 2 and 3.) The applicant has also requested a modification (see Attachment 5) to reduce the required 7.5-foot side yard setback to 6.7 feet to allow the existing house to remain as it is while the road is created adjacent to it as shown in Attachment 3. 4. Review Process: Following the Comment Period, Planning Staff makes an administrative decision. 5. Major Issues: a. Decision Based upon the Findings of Fact and Conclusions, Attachments and Exhibits submitted with the application and during the comment period, the following is the recommendation of the City of Edmonds Planning Division: The proposed side setback modification is APPROVED to allow the existing house to remain in its same location as shown on Attachment 3. If the house is destroyed or the portion within the setbacks is demolished, any new construction shall meet the required 7.5-foot setback to the easement line. Also, any additions proposed for the existing house must meet the 7.5-foot side setback. This approval is subject to the conditions of the short subdivision given below. The Subdivision is APPROVED with the following conditions: 1. Prior to recording the applicant must complete the following requirements: a) Applicant is responsible to make sure that area of lots given is accurate and stays over 8,000 square feet after subtracting access easements. b) Civil plans must be approved prior to recording. In completing the civil plans you must address the following: (1) Complete the Engineering Division conditions listed "Required prior to Recording" on Attachment 4. The large (3-foot plus diameter) maple tree between the existing house and shop should be preserved unless an International Society of Arboriculture (ISA) certified arborist determines that the tree is unhealthy or too near the end of its life and would prove a hazard, or if the ISA certified arborist determines that proposed grading for a house on lot 2 would damage the trees roots so that it would become a hazard. The maple tree should be protected with fences or bales of hay around its drip line or as approved by Planning staff. The earth around these trees should not be compacted by storing equipment or materials within the drip line of the trees. 11. FINDINGS OF FACT AND CONCLUSIONS A. Compliance with the Subdivision Ordinance 1. Environmental Resources The environmental resources at this site are limited to the trees. The subdivision chapter section 20.75.085 states that a proposed subdivision should be designed to minimize significant adverse impacts. One large maple, over three feet in diameter, is located between the shop and the house, but closer to the shop. A number of fairly small pine trees and alders are growing on the west side of the shop. Another assortment of trees is growing along the north property line, but particularly where the fence line cuts south. Some of the trees are on proposed lot 1 with the existing house and will likely be unaffected by the proposal. Several S-04-22.doc / January 12,2001 / Staff Report Albert Cerauli File No. S-04-22 Page 4 of 8 2. others are along the setback areas along the northern property line. These are smaller trees that are growing close together and a future owner would likely want to thin. These trees are young enough that they could be easily replaced and are not thought to need formal protection. The large maple appears to be an asset to the area that could potentially be in the way of development, but could be preserved with some effort. Because of its age, it is possible that it may not live much longer, and because of its size, it is possible that virtually any construction would impact its roots. Therefore, the large maple tree between the existing house and shop should be preserved unless an International Society of Arboriculture certified arborist detennines that the tree is unhealthy or too near the end of its life and would prove a hazard, or if the ISA certified arborist determines that proposed grading for a house on lot 2 would damage the trees roots so that it would become a hazard. The maple tree should be -protected with fences or bales of hay around its drip line. The earth around these trees should not be compacted by storing equipment or materials within the drip line of the trees. The proposal minimizes grading because the site is quite level and the placement of the house and lots relate to the topography. C. No hazardous conditions exist at this site. d. The proposal includes a drainage plan and is designed to minimize off -site impacts on drainage. It is possible that the houses to the west of the subject property have a view cast to Lake Ballinger. The proposed subdivision will not change the location that a house can currently go on the site in a manner that would impact views, since a house could already be built to 25 feet high and to the 7.5 foot required side yards. Lot and Street Layout a. This criteria requires staff to find that the proposed subdivision is consistent with the dimensional requirements of the zoning ordinance and also that the lots would ultimately be buildable. Based on a review of the project and the analysis in this section staff agrees that a two -lot short -plat is a reasonable use of the property. Also the Fire Department has commented, "Fire hydrant required. Fire hydrant can be located on water main side of 76 1h Avenue directly across from access drive." 5. Flood Plain Management a. This project is not in a FEMA designated Flood Plain. B. Compliance with the Comprehensive Plan I . The Comprehensive Plan has the following stated goals and policies for Residential Development. Residential Development B. Goal. High quality residential development which is appropriate to the diverse lifestyle of Edmonds residents should be maintained and promoted. The options available to the City to influence the quality of housing for all citizens should be approached realistically in balancing economic and aesthetic consideration, in accordance with the following policies: B.4. Support retention and rehabilitation of older housing within Edmonds whenever it is economically feasible. B.5. Protect residential areas from incompatible land uses through the careful control of other types of development and expansion based upon the following principles: B.5.d. Private property must be protected from adverse environmental impacts of development including noise, drainage, traffic, slides, etc. B.6. Require that new residential development be compatible with the natural constraints of slopes, soils, geology, vegetation and drainage. Compliance with the Residential Development goals and policies: The proposal retains existing housing stock and also allows for construction of two new homes within the constraints of the natural environment. C. Analysis of Requested Modification The applicant has requested a modification to a required setback as allowed in ECDC 20.75.075, which requires all criteria of a variance to be met if the requested modification is to be approved. The Criteria are as follows: a. Special Circumstances: That, because of special circumstances relating to the property, strict enforcement of the zoning ordinance would deprive the owner of use rights and privileges permitted to other S-04-22.doc / January 12,2001 / Staff Report 0 Albert Cerauli File No. S-04-22 Page 6 of 8 properties in the vicinity with the same zoning. Special Circumstances should not be predicated upon any factor personal to the owner such as age or disability, extra expense which may be necessary to comply with the zoning ordinance, the ability to secure a scenic view, the ability to make more profitable use of the property, nor any factor resulting from the action of the owner or any past owner of the same property. b. Special Privilegel That the approval of the variance would not be a grant of special privilege to the property in comparison with the limitations upon other properties in the vicinity with the same zoning. C. Comprehensive Plan and Zoning Ordinance: That the approval of the variance will be consistent with the intent of the comprehensive plan, the zoning ordinance and the zoning district in which the property is located. d. Not Detrimental: That the variance as approved or conditionally approved will not be significantly detrimental to the public health, safety and welfare or injurious to the property or improvements in the vicinity and the same zone. e. Minimum Variance:, That the approved variance is the niinirnum necessary to allow the owner the rights enjoyed by other properties in the vicinity with the same zoning. The Applicant has presented declarations as to the merits of their proposal (see Attachment 6). Additional Findings: a. The garage to the house to the south is quite close to the easement. 4. Conclusions: a. The special circumstance relating to this property include an existing legally placed home which with the proposed subdivision will be too close to the easement. Because the Comprehensive Plan encourages us to retain existing homes, this can only be done if the required side setback is reduced by 0.8 feet. The city of Edmonds has chosen to accommodate additional growth through infill, so we have to accommodate infill on lots that cannot meet current requirements, and therefore require some modifications. b. Providing some leniency on setbacks would not be a special privilege for this property owner, because the option has been provided for other property owners in the city and because other property owners in the area do not currently meet the 7.5-foot side setback. C. The proposal will be consistent with the intent of the Comprehensive Plan and the zoning ordinance. d. The modification will not be detrimental. The modification will allow an existing house to continue in existence. e. The 6.7 foot side setback appears to be the minimum necessary to allow the owner the rights enjoyed by other properties in the vicinity with the same zoning. If the house were to be demolished in the future, the lot has adequate area to meet current setbacks, and any new construction should do so. D. Compliance with the Zoning Code With the approval of the above modification, staff fffids this project to comply with the provisions of the Zoning Code, see section II.A.2.b. E. Environmental Assessment: Is this site identified on the City's Environmentally Sensitive Areas Map (Shoreline area only)? No. 2. Is an Environmental Checklist Required for this application? No. G. Critical Areas Review: Critical Areas Review number: � CA-1992-0132 2. Results of Critical Areas Review: The property does not appear to contain any critical areas as defined by ECDC 20.15B. As a result� a waiver from the requirement to complete a study was issued. H. Comments: One letter of comment was received from James Deal, representing Arlie and Julie Mabbott who live directly south at 23304 — 76th Avenue W (see Attachment 7). Their concerns center around the easement that the applicants propose to use across the north 7.5 feet of their property. They state that they understood the Ceraulis to have abandoned the easement. They also believe there is not 26.7 feet between the center of the existing road and the existing Cerauli house. At a site visit, Mr. Cerauli told staff that his understanding was that the adjacent lot did not have an easement over his property, but that he still had an easement over their property, and had used their driveway at times to access his back yard. Checking the title report and the copies of recorded documents attached to it, staff finds that on Assessor's recorded document number 9006210097 (see Attachment 5) it appears that both the Arlie and Julie Mabbott and Al Cerauli have stated that they both have the right to use an easement for ingress, egress and utilities which is described on pages 519 and 520 and appears to be adequately shown on the preliminary plat, as the southern 7.5 feet of the Cerauli property (extending 238.12 feet from the easterly property line) and the northern 7.5 feet (together with a turnaround) of the Mabbott property (extending 223.12 feet ftom the easterly property line). Nothing in the title report shows that the easement has been vacated or voided. The City does not adjudicate adverse possession of easements, but will honor any injunctive orders from Snohomish County Superior Court. Regarding the distance to the house, the surveyor is showing the 20-foot easement, with the southern line falling roughly in the center of the existing road on the Mabbotts' property. However, it is slightly south of the centerline, so it is likely true that it is less than 26.7 feet between the centerline of the road and the Cerauli house. The surveyor is licensed in the state of Washington and has signed the drawing, so it is assumed to be an accurate distance between the house and the edge of the proposed easement. 111. RECONSIDERATIONS AND APPEALS The following is a summary of the deadlines and procedures for filing reconsiderations and appeals. Any person wishing to file or respond to a recommendation or appeal should contact the Planning Department for ftirther procedural information. A. Request for Reconsideration Section 20. 100.0 1 O.G allows for City staff to reconsider their decision if a written request is filed within ten (10) working days of the posting of the notice required by this section. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed. B. Appeals S-04-22.doc / January 12,2001 / Staff Report Albert Cerauli File No. S-04-22 Page 8 of 8 Section 20.105.040 and 20.105.020 describes how appeals of a staff decision shall be made. The appeal shall be made in writing, and shall include the decision being appealed along with the name of the project and the date of the decision, the name of the individual or group appealing the decision, their interest in the matter, and reasons why the appellant believes the decision to be wrong. The appeal must be filed with the Community Development Director within fourteen (14) calendar days after the date of the decision being appealed. C. Time Limits for Reconsideration and Appeals The time limits for Reconsiderations and Appeals run concurrently. If a request for a reconsideration is filed before the time limit for filing an appeal has expired, the time "clock" for filing an appeal is stopped until a decision on the reconsideration request is completed. Once the staff has issued his/her decision on the reconsideration request, the time clock for filing an appeal continued firorn the point it was stopped. For example, if a request is filed on day 5 of the appeal period, an individual would have 9 more days in which to file an appeal after the staff issues their decision on the reconsideration request. IV. LAPSE OF APPROVAL Section 20.075. 100 states, "Approval of a preliminary plat or preliminary short plat shall expire and have no further validity at the end of five years, unless the applicant has acquired final plat or final short plat approval within the five-year period."
