ISSUE OUTLINE:
Planning staff is currently reviewing a building permit application (234 4 1h Avenue North) — located in
the BC Zone) that entails an addition to an existing single family home. In the BC zone, there are no
required se tbacks from adjoining property lines. A single family home is a permitted primary use within
the BC zone, with the exact language describing the use being:
"Single -Family Dwelling, as regulated in RS-.6 Zone"
The question here is, what does "as regulated in RS-6 zone" mean? Does this language mean that a single
family home in the BC zone is regulated as if it were actually in an RS- 6 zone, or is the language more
narrowly referr ing to the single use(s) that are specified in the RS-6 zone?
The permit applicant has requested that the city revisit the interpretation of the relevant code provisions.
RELEVANT CODE SECTIONS:
ECDC 16.50.010 Uses.
A. Permitted Primary Uses.

ECDC 16.50 BC — Community Business.
16.50.000 Purposes.
The BC zone has the following specific purposes in addition to the general purposes for business and
commercial zones listed in Chapter 16.40 ECDC.
A. To reserve areas for those retail stores, offices, service establishments and amusement
establishments which offer goods and services to the entire community;
B. To ensure compact, convenient development patterns by allowing uses that are operated chiefly
within buildings;
C. To allow for mixed -use development which includes multiple dwelling unit(s) that support business
uses.
ECDC 16.40 Business and Commercial Zones — Purposes.
16.40.000 Purposes.
The general purposes of the business and commercial (13 or Q zones are:
A. To provide for areas for commercial uses offering various goods and services according to the
different geographical areas and various categories of customers they serve;
B. To provide for areas where commercial uses may concentrate for the convenience of the public and
in mutually beneficial relationships to each other;
C. To provide for residential uses, community facilities and institutions which may appropriately
locate in commercial areas;
D. To require adequate landscaping and off-street parking and loading facilities;
E. To protect commercial uses from hazards such as fire, explosion and noxious fumes, and also
nuisances created by industrial uses such as noise, odor, dust, dirt, smoke, vibration, heat, glare and
heavy truck traffic.
ANALYSIS:
Historically, this language has been interpreted to mean that all regulations in the RS-6 zone are
applicable to single family homes in the BC zone. This would mean use of the structure as a residence, as
well as height, setbacks, etc. The issue here, however, is that this interpretation leads to contradictory
and confounding conclusions. For example, in the BC zone:
A commercial structure can be built up to the sidewalk, while a single family home must
be set back 20 feet.
A commercial structure can go as high as 30 feet with a pitched roof, while a single
family structure with the same roof can only be as high as 25 feet.
In the particular case generating this interpretat ' ion, an addition is proposed for an existing single family
home located in the BC zone. The north side of the home fronts on Edmonds Street, which requires no
setback in the BC zone. However, if a single family home is to be regulated according to all the standards
contained in the RS-6 zone, then a street setback of 20 feet is required. The existing home is
approximately 18.5 feet from Edmonds Street, so if a 20-foot setback is required, the upper -story addition
would need to be stepped back from the first story of the house.

It is important to look at the purposes of the BC and RS zones. The BC zone doesn't contain purposes
specifically addressing single family use, but it does reference the general commercial zoning purposes
which include:
1640.000 C. To provide for residential uses, community facilities and institutions which may
appropriately locate in commercial areas;
In addition, the RS zone contains the purpose:
16 20. 000 A. To reserve and regulate areas primarilyforfamily living in single-family dwellings;
The BC zone therefore is intended to permit residential uses under some circumstances, whereas the RS
zone is intended to reserve larger areas primarily for single family use. This is an important distinction.
Larger areas reserved for single family use should logically have the similar rules applied, such as
setbacks, height limits, use restrictions, and so on. However, it is also logical that a single family use
located in a larger area that has a mixture of uses (including commercial and other uses), shouldn't be
held to a higher standard — its impact should actually be less.
Another problem with applying RS-6 bulk standards to single family uses located in the BC zone is that
the reference to the RS-6 zone in only located in the BC section addressing uses. Normally, you would
expect to find bulk standards for different uses described in the site development standards for the zone,
which in the case of the BC zone is in ECDC 16.50.020. No mention or distinction of different bulk
standards for a single family use can be found in that section. Contrast this with the RM zone, for
example, which does contain different setbacks for single family uses in its site development standards
(ref. ECDC 16.30.030, footnote 2).
Applying single family setbacks to single family uses in the BC zone is likely to have other problems in
practical application. How would the city treat a building that had both a single family use and a
commercial use? Could the commercial use be located adjacent to the property line (i.e. with a setback of
"0"), but the single family use would have to observe an RS-6 setback?
Finally, the case in point shows that the old way of interpreting how setbacks apply to single family uses
would have a negative effect on maintaining and allowing single family uses to continue. This is
important in the context of the city's recent adoption of an updated downtown plan and an historic
preservation program, both placing a premium on the historic "character" of downtown — which includes
a number of single family homes. If these are to continue, regulations will need to support continuation
of single family uses and conversion of such structures to a mixture of uses. The issues surrounding
converting older homes to a mix of commercial and single family use will only be made more confusing
if the bulk requirements differ. according to what specific use or mix of uses is proposed within a
structure.

FAMILY DWELLINGS AND THEIR ACCESSORY USES, AS SPECIFIED IN THE RS-6 ZONE.
THIS IS NOT INTERPRETED TO MEAN THAT SUCH SINGLE FAMILY USES MUST
COMPLY WITH THE SITE DEVELOPMENT STANDARDS SPECIFIED IN ECDC 16.20.030.
