City staff investigated the complaints, and it appears that the fence across your street frontage exceeds the three feet height allowed by the Edmonds Community Development Code. A copy of the applicable code is enclosed. It also appears that the fence may encroach upon the public right-of-way. If the required permit had been obtained, staff wo ' uld have investigated prior to construction. Your cooperation in revising the fence is imperative. A. A fence permit shall be required for any fence over three feet in height which is also within 10 feet of any street right-of-way or access easement or within 30 feet of any cor- ner. Height shall be measured from the top of the fence to the lowest original grade. B. A fence permit shall be required for any fence within a critical area or its buffer. C. Unless a variance is first obtained, no fence or hedge shall be more than six feet in height as measured from the top of the fence to the lowest original grade. D. When a retaining wall three feet in height or greater is contiguous to and below a proposed fence, the proposed fence may be constructed for the purposes of safety not greater than four feet above the top of the retaining wall or the finished grade, whichever is less, without the necessity for z variance. Edmonds, WA 98026 Subject: Sight obstruction in rig ht-of-way. adjacent to subject acid ress Dear Mr. and Ms. Eriksen: Mailed 11/4/97 As per our discussion on November 3, 1997, 1 would like to confirm the following: The Engineering Division has received complaints regarding the fence at 23405 - 84th Ave. W. The City Traffic Engineer investigated the complaints and determined that the fence is in the City right-of- way. In addition, the location of the fence causes sight distance problems. Immediate action is required by the property owners to relocate the fence. The property owners agreed to fill out a STREET USE PERMIT (please see the attached form) and start relocating the fence after the permit is issued.
