Current WA state application for daycare license through DSHS for Extended
Program does not exceed the specifications established for previous business.
The current occupancy is classified as A3 and no separation is required to E
occupancies, including daycares and church schools.
Please be aware of following restrictions: 1) care for children has been approved
only for ages 2 Y2yrs and older. 2) The occupant load for the daycare shall not
exceed 50. Automatic fire sprinklers will be required for either or both of these
conditions and change of use would be required with city approvals.
Fire Dept approves existing plans.

The following plans have been evaluated under the 2006 International Codes and
Edmonds Community Development Code.
Pre-school changes to increase hours of operation and to accommodate daycare may
require Building Division change of use, including, potentially, additional fire detection
and/or fire protection systems or modifications.
1) Clarify extent of entire area on plans included in daycare activities. Show if
activities are limited to OFFICES/SUNDAY SCHOOL ground level or will
include other church areas and basement level areas. Provide square
footage calculations for this area.
a. Religious educational rooms which are accessory to places of religious
worship and have occupant loads less than 100 shall be classified as A-3
occupancies.
b. The use of a (portion of a) building for educational, supervision, or
personal care service for more than 5 children older than 2 1/2years of
age shall be classified as E occupancy.
2) Indicate current level of WA State licensing for activities and indicate new
level and type of State license.

,,Hi John,
I received a response to your comments from Edmonds Lutheran Church for their conditional use permit application
(PLN20070066). I put it in the interoffice mail to you.
I assigned the review to you in Bitco for Monday, but have no clue how long your review might take or if that's a reasonable
amount of time, so feel free to reassign it to another date if necessary. Let me know if you'll need any additional info from

Re: Your August 30, 2007 letter to Ms. Mary Sheldahl, requesting additional
information to complete our Conditional Use Permit Application, File No. CU-
2007-66
Dear Ms. Machuga,
We have numbered our following paragraphs to correspond to the numbered paragraphs
of your referenced August 30, 3007 letter.
I . re: Criteria Statement:
We are attaching to, and incorporating into this letter as Addendum "A"
our description of how the proposed expanded enrollment and hours of operation
of our preschool program meets each of the applicable Conditional Use Permit
criteria.
We wish to have the requested permit be personal to Edmonds Lutheran
Church and its successors, not to run with the land.
2 It is intended that the extended preschool program will operate five (5) days a
week, Monday through Friday. The intended hours of operation will be as follows:
Morning Hours: '
7:00 to 9:00 AM - morning extended. Preschool activities
9:00 to 12:00 noon "Core" preschool curriculum
Afternoon Hours:
12:00 noon to 1:00 PM lunch
1:00 PM to 3:00 PM nap/rest time
3:00 PM to 6:00 PM afternoon extd. Preschool activities
3. Our extended preschool would not be operated on weekends, so there will be no
conflict with our weekly church worship services. Accordingly, our requested permit
does not present any questions concerning the sufficiency of our abundant on -site
parking.
V, t <Dfz
db
Finally, your office forwarded to us a copy of Fire Marshal John J. Westfall's
August 9, 2007 memorandum to you. In that memo the Fire Marshal raised several
questions. In response to those questions, we are attaching a drawing of our 84 1h Ave. W.
facility. The drawing outlines in blue the 20 feet by 40 feet building space (800 square
feet) used by the preschool and also the outdoor fenced play area. The adjacent
restrooms are outlined in green. Finally, we have indicated an additional interior space
not presently used by the preschool, but which, in the future, might be occasionally used
by the preschool as an ancillary space. We have not included the square footage of the
outdoor fenced play area, nor of the restroom areas, nor of the possible future ancillary
space in the stated 800 square foot figure.
All the indicated preschool areas are on ground level. While our indoor preschool
area appears to us to meet your definition of A-3 occupancies, it also appears to us to
meet your definition of "E occupancy". We seek clarification from you as to the proper
classification.
We are presently applying to the State of Washington for appropriate licensing of
our extended preschool program. We will keep you advised at that process proceeds.
Please call us if you would like any supplemental information concerning this
response
Sincerely yours,
Edmonds Lutheran Church

Addendum "A"
To
Edmond Lutheran Church's Nov.16 th letter to City of Edmonds
Planning Department
The expanded preschool enrollment and hours of operation of Edmond
Lutheran Church's Christian Pre -School program at its 23525 - 84 th Avenue
West property will be consistent with the Comprehensive Plan and the Zoning
Ordinance, and will not be detrimental to the public health, safety and welfare,
or to nearby private property or improvements.
1. Concerning the Comprehensive Plan:
ECDC 16.20.000 B expressly provides that the RS zone has the following specific
purposes, in addition to the general purposes of residential zones:
"B. To provide for additional nonresidential uses which complement and
are compatible with single-family dwelling use."
Consistent with that provision, ECDC 16.20.010 A, 2 provides that Churches are a
permitted Primary Use in RS-Single Family Residential zones. Furthermore, ECDC
17.100.040 expressly provides,
" The provisions of this chapter and the conditional use permit
criteria of Chapter 20.05 ECDC shall be liberally construed and
applied in order to permit, encourage and accommodate
churches within the neighborhood and all zones of the city, so
long as the negative impacisfrom the church are adequately
mitigated. "
The EDCD does not purport to either defme, or otherwise expressly limit the scope of
activities constituting "church" uses within the ' meaning of ECDC 16.20.010.
Edmonds Lutheran Church (hereafter "ELC") deems its Christian Preschool program
an integral part of the church's core mission of spreading the Gospel of Jesus Christ in
the Edmonds community. Accordingly Edmonds Lutheran Church believes that the
expanded preschool enrollment and hours of operation is a permitted Primary Use
under EDCD 16.20.010 A (2) -"Church". As a primary use, no conditional use permit
is required. However, ELC has elected to proceed with its application for such a
conditional use permit, but at the same time reserves its right to assert that Primary
Use right, should that become necessary in any subsequent proceeding.
With the forgoing reservation, Edmonds Lutheran Church has applied for this
conditional use permit and submits that the expanded preschool enrollment and hours
of operation will be a permitted Secondary Use under ECDC 16.20. 010 D. 1, " 1.
Preschools ***" The existence of that section of ECDC unequivocally establishes that
Pre-schools are uses," * * *which complement and are compatible with single-family
dwelling use", under ECDC 16.20.000 B.
The requested permit to expand the enrollment and hours of operation of the Church's
Christian preschool program will materially enhance the benefit of that program to
the single-family dwellings in the RS zone in which the church is located. Under the
church's present four-hour pre school program, a non -working adult must be available
to pick-up the student midday and provide childcare for the balance of that day. In
practice that reality has foreclosed from participation in the program all children both
of whose parents work out of the home, as well as children of working single parent
families. The requested expansion of the preschool's enrollment and hours of
operation will directly and materially benefit such presently foreclosed families and
children living in the residential zone around the church. The advantages of a
Christian preschool education will be available to them in their own neighborhood!
2 concerning the Zoning Ordinance:
Edmonds Lutheran Church (a "neighborhood church" under ECDC) will
meet all applicable requirements of the Zoning Ordinance. The Church is presently in
the process of obtaining all necessary State permits and approvals for the proposed
expansion of its Christian Preschool program' enrollment and hours of operation.
3. The proposed use will not be significantly detrimental to the public health,
safety and welfare, or to nearb-v Private property or improvements.
By its nature, the existence of a nearby Christian preschool program is a potential
benefit, not a detriment to the residents of the surrounding single family zone
because it makes nearby childcare available to those surrounding residents. The
increase in enrollment of eight students (from twelve to twenty) would have a
negligible effect on traffic on the streets surrounding the church facility,
especially so because the arrival of the students would be spread out over several
hours, as would also their departure. The church has abundant off-street parking
to accommodate several hundred vehicles, and the Preschool would never be
operating at the same time as our weekend church services.
The church property is situated at the Southeast comer of its single-family
residential zone. Immediately across the street to the south of the church property
is a commercially zoned shopping center, with the street between the two parcels
being a little trafficked side street. The property immediately to the East of the
church contains multistory apartment dwellings. Those dwellings are
approximately one hundred feet from the church building. Automobile traffic to
and from those apartments primarily uses Hiway 99, with little traffic passing the
church.
We submit that if the requested Conditional Use Permit is granted, the
surrounding property owners would have difficulty observing any difference in
the operation of the preschool at such tim6 compared with its present operation.

John,
I spoke with a lady early last year from the preschool about this project and she said that the children would be older
than 2 1/2 years. Since we are now under the 2006, a sprinkler system is required if the occupant load exceeds 50
(WAC amendment to 903.2.2). Of what I know of the project, I do not see any other major issues since the current
occupancy is an A3, has 2 exits, no occupancy separation required between A3 and E, etc. Can you add the spinkler
to your comments for the Planning Conditional Use Permit, since that is not routed to us? Thanks,

At this time there is a manual fire alarm system (not monitored) in the whole building with smoke detection in the
present pre school area.
After several attempts I was able to get an annual cert on the fire alarm.
There are two exits leading directly to the outside (south parking lot) from the existing pre school space.

Church preschool is proposing additional daycare hours. Attached with my comments are proposed
changes to program. A3 appears to be most restrictive for fire protection (12K s.f.) and E for auto
fire detection (>50 OL).
Existing OFFICE SUNDAY SCHOOL appears to be 2 hr FIR from rest of A2.1 church. Occupant
load from my records are showing 40 OL in that area. Last TI unshown is 2001 addition with
CHURCH SUNDAY SCHOOL spaces (97 UBC).
Any immediate thoughts or other information helpful from applicant?
Thank you,

Attachment One to Edmonds Lutheran Church's RECEIVED
Application for Land Use Permit AUG 0 3 2007
PERMIT COUNTER
Description of Proposed Use
Edmonds Lutheran Church is requesting a conditional use permit in order to permit
modification of its existing Christian Preschool program in two regards: 1) to extend
its hours of operation to approximately nine hours from its present maximum of
approximately four hours; 2) to increase its maximum enrollment to twenty students
from the present maximum of twelve. The church's existing facilities are entirely
adequate to accommodate the requested changes; no structural additions or
modifications will be required if the required permit is granted. Further, the church
has an overabundance of available parking space during all hours of the proposed
extension of the preschool's operations.
Under Edmonds Lutheran Church's present four hour preschool program, a non-
working adult must be available to bring each student to the program, to pick-up
the student midday and to provide child care for the remainder of the day. In
practice, that need has foreclosed from participation in the preschool program all
children both of whose parents work out of the home, as well as children of working
single parent households. Edmonds Lutheran Church desires to make the benefits
of a Christian Preschool Program available to those presently foreclosed children;
hence this application for permission to make the changes necessary to achieve that
goal.
Under the requested modifications, all preschool students will be required to attend
the Christian Preschool core program (of approximately four hours), while
attendance at the extended program hours will be optional. It is anticipated that
only a fraction of the total number students would attend both parts of the
preschool programs.
