During review and inspection of the subject site, it was found that the site contains and/or is
adjacent to an Erosion Hazard Area, pursuant to Chapters 23.40 and 23.80 of the Edmonds
Community Development Code (ECDC).
GENERAL CRITICAL AREAS REPORT REQUIREMENTS
Critical Areas Reports identify, classify, and delineate any areas on or adjacent to the subject
property that may qualify as critical areas. They also assess these areas and identify any
potential impacts resulting from your specific development proposal. If a specific development
proposal results in an alteration to a critical area, the critical areas report will also contain a
mitigation plan. You have the option of completing the portion of the study that classifies and
delineates the critical areas and waiting until you have a specific development proposal to
complete the study. You may also choose to submit the entire study with your specific
development application.
Please review the minimum report requirements for all types of Critical Areas that are
listed in ECDC 23.40.090.D. There are additional report requirements for different types
of critical areas (see below).
Note that it is important for the report to be prepared by a qualified professional as
defined in the ordinance. There are options on how to complete a critical areas study,
and there is an approved list of consultants that you may choose from. You may contact
the Planning Division for more information.
General Mitigation Requirements for all Critical Areas are discussed in ECDC 23.40.110
through 23.40.140.

REVOCABLE LICENSE
TIUS LICENSE AGREEMENT is entered into by and between the undersigned ROSE
LESMITH, owner of certain real property described as Lot 9 of Seawood Fourth Addition
subdivision, City of Edmonds, Washington, and STEVEN and DEBORAH KIM, husband and
wife, owners of certain real property described as Lot 8 of Seawood Fourth Addition
subdivision, City of Edmonds, Washington, ("Grantors") -and EGIDIYUS KLIMAS, owner of
certain real property described as Lot 15 of. Edmonds Village Estates subdivision, City of
Edmonds, Washington, ("Grantee"). The legal descriptions of the Grantors' properties are
attached as Exhibits A and B.
RECITALS
WHEREAS, the Grantee has built a retaining wall which extends onto the Grantors'
properties without seeking permission to enter the properties and without seeking the necessary
permits from the City of Edmonds; and
WHEREAS, the retaining wall is also located in a native growth protection area, depicted
on the face of the plat, Seawood Fourth Addition; and
WHEREAS, the City of Edmonds has begun a code enforcement action against the
Grantee; and
WHEREAS, the City of Edmonds 'informed the Grantee by letter dated October 27, 2009,
that the retaining wall would have to be removed and the site restored to its preexisting
condition; and
WHEREAS; the Grantee must obtain permission from the Grantors to enter their
properties to perform such restoration work; NOW, THEREFORE,
IN CONSIDERATION OF the terms and conditions set forth below, the Grantors and the
Grantee agree as follows:
TERMS
License to Use Propeqy. The Grantors hereby authorize Grantee to enter into said
properties for the sole purpose of removing a retaining wall previously installed
without the Grantors' permission from the western portion of said properties and for
the purpose of restoring the native growth protection area to its preexisting condition
before the installation of the retaining wall, including replacement of soil,
reveget.ating the disturbed area, and restoring the slope. This revocable license does
not authorize the use of wheeled or treaded machinery; only hand-held tools and
equipment may be utilized.
2. Term. This grant is a revocable license and may be revoked at any time by the
Grantors by the mailing or hand -delivering written -notice of revocation to Grantee,

provided however that said revocation shall be effective at the close of business on
the day received. This license shall automatically expire on

3. Permits. Grantee shall be required to obtain any and all necessary permits and
approvals from the City prior to removal of the retaining wall or performing any
restoration work within the native growth protection area. 'Grantee shall be required
to comply with all permit or approval conditions for the removal and restoration in
addition to the conditions set forth in this license.
4. Conditions. Grantee shall comply with all conditions outlined in the City of
Edmonds' letter dated October 27, 2009, including but not limited to, obtaining a
building permit, submitting a restoration plan pursuant to Edmonds Community
Development Code (ECDC) 23.40.240.B, and submitting a geotechnical report
consistent with ECDC 23.80.050.
5. Notice. Grantee shall provide 48 hours written notice to Grantors prior to beginning
removal and restoration work.
6. Plantings. Grantee shall not plant vegetation during the hot summer months unless
Grantee waters the plants. Grantors shall allow access for purposes of watering plants
if they are planted during the summer months. Any revegetation should preferably be
performed in September or October. Grantee shall replace all revegetation if it dies
or is sickly within 5 years of planting at no expense to the Grantors. Grantee shall
cover exposed slopes with a minimum of 2 inches of straw mulch and berm up the
straw mulch where the fill meets the new block wall.
7. Staking. Grantee shall stake the catch points of the 4:1 slope in the native growth
protection area and notify the Grantors when a City inspection should be performed
to ensure the original slope will not be further disturbed as a result of the restoration
work.
8. Costs - Liens. All removal and restoration work contemplated by this License shall
be at the Grantee's sole cost and expense. No portion of such cost shall ever be or
become the responsibility of the Grantor while this License is in effect. Grantee shall
not suffer any lien to be placed on the Grantors' properties as the result of any
construction contemplated herein, and in the event any such lien is filed by any
cont ractor, subcontractor, supplier or materialman of Grantee, Grantee agrees to
immediately satisfy and secure the release thereof, regardless of whether or not
Grantee disputes the amount claimed by the contractor, subcontractor, supplier, or
materialman.
9. Indemnification. To the maximum extent permitted bylaw, Grantee shall indemnify,
defend, and hold the Grantors harmless from any and all. claims, suits, losses, or
liability for injuries to persons or damage to property caused by or arising out of

Grantee's acts, errors, or omissions in the exercise of any rights or obligations granted
by this License. The indemnity obligations of Grantee shall survive expiration or
revocation of this License as to any claim, suit, loss, or liability for any injury or
damage occurring prior to such expiration or revocation.
10. Use Permissive and Personal. Grantee acknowledges that the use authorized by this
License is personal to Grantee and is permissive. Grantee expressly acknowledges
that no such use shall be grounds for any claim of adverse possession or prescriptive
use against the Grantors or any successor in interest to the Grantors' properties. This
License may not be transfer -red by Grantee to any other person or party.
11. Entire Agreement. This License represents the entire agreement between the parties
concerning its subject matter and supersedes all previous discussions, representations
and agreements, oral or otherwise. This License may be amended only, by a�ten,.

The purpose of this report is to evaluate the soils on the sloped portions of the
above properties in order to properly engineer the removal of a portion of large
block retaining wall and restore the toe of the slope for long term stability. Only
a narrow strip at the toe of the slope approximately ten feet wide will require
restoration. Related engineering plans for the wall removal and restoration
have been prepared in association with this evaluation.
Each of the above parcels has an existing single family residence. The.slope
restoration will not affect any structures on the parcels.
Based on field investigations and soil logs in the undisturbed portion of the
sloped area, the restoration may be completed with confidence that the restored
portion will have long term stability equal to better than the natural vegetated

Site Geology Information - Topographic Data:
As part of a previous residential remodel permit for the property at 23621 99th
Place W., a formal topographic survey was prepared for the site which mapped
the lower portions of the sloped area. This survey was prepared in 2007 by
Richard Vaisvila, P.L.S. It is the basis for the topography used for the
restoration design.
Based on field observations during the site visit by this office, the upper portion
of the sloped area was mapped. While not as precise as a formally surveyed
topographic map, it is sufficient for the restoration plan. The following general
measurements represent the geometry of the slope:
Total height: 20 feet (approx.)
Total horizontal extent: 80 feet (approx.)
Average slope: 25 percent
Note that the horizontal extent represents a projection of the slope to the
original toe of slope through the area removed when the wall was constructed.
The surface of the undisturbed slope is vegetated with a wide mixture of larger
(up to 12 inch) established trees of various types, smaller younger trees, brush
and some areas of minor ground cover and duff.
The surface in detail is characterized by a very irregular "hummocky" pattern
with irregularities of up to two feet typical. This is the result of long term surface
disturbances caused by individual trees falling over time and surface water
erosion or gravity slope failures in patchy small areas caused by the varying
ground cover or other surface conditions.
Attached is a portion of the Slope Restoration Plan showing the slope
topography.
Site Geology Information - Subsurface Data:
The source of information to evaluate subsurface soil information was a pair of
two hand excavated soil logs in the undisturbed portions of the slope. The
material found was a uniform very loamy sand to depths up to two feet.
Additional information was gained by the observation of the cut soils at the toe
of the wall area, representing a depth from original surface of two to four feet.
These soils were of the same type as found on the surface of the upper sloped
area.
A reference to the Snohomish County Soil Survey indicates that the series
represented is the Alderwood Series. This series is comprised of a deeper
dense clay layer overlain at depths of two to ten feet by a porous sandy or
loamy material. The varying depths would be the result of original glacier
placement, followed by surface erosion over time.
Attached are the Soil Logs and an extract with map from the Soil Survey.
Site Geology Information - Site History:
The level portions at the top and bottom of the slope represent more or less
original surface, with minor cuts and fills to allow house construction. The
sloped area is likewise in original or near original condition. The residences all
appear to have been constructed within the last twenty years.
Note that the surface vegetation would represent a second growth forest, with
possible thinning of unstable trees during residential construction.
The topography of the steep slopes observed during the site visit indicates no
evidence of catastrophic slope failure in any area. Long term very slow surface
movement has probably occurred historically along the steep slope, but has
been un-noticed in its earlier rural or undeveloped uses. Significant movement
of the surface soils down the slope, especially in an undeveloped condition,
would be measured in decades. No areas of obvious surface erosion or tell tale
exposed surface soils were observed.
A specific indicator was observed which supports the above very slow
movement of the soils. While not predominating, several younger (40 years old
or less) "curved trees" were noted, indicating general slight surface movement.
It is the restricted limits of the affected trees which provides actual evidence of
inherent surface soil stability. This stability is provided by the geometry of the
undisturbed slope, and the inherent strength of the undisturbed loams at the
surface.
Site Geology Information - Seismic Hazard:
Seismic hazards for slopes may be comprised of either general soil saturation
or classic seismic liquefaction. With general saturation, failure occurs in either
a direct diagonal slippage (shear failure) or at a saturated layer of loose silts
which semi -liquefy and "pour" out of their original location in the hillside. The
soils of this area do not appear susceptible to this mode of failure due to the
generally dense impervious nature of the deeper soils and positive slopes which
prevent surcharged saturation. While the above cause of hillside failure is not
limited to seismic movement, a seismic event could possibly trigger a failure
which would not otherwise have occurred, however this is unlikely. As noted
above, there is no indication on the site of this mode of failure occurring
previously on this site or in the surrounding area. Based on the above, the
possibility of hillside failure by this mode of seismic failure is low.
The second mode of failure is caused by a water saturation of a uniformly
graded larger grained non -cohesive soil, which in.this condition is subject to
seismic movement.. For the slope areas in question, the possibility of full
saturation of any layer is not present. In addition, the soils as noted are not of
the type allowing this type of movement. The possibility of seismic movement
is, of course, more significant with a sloping site, however, the possibility of
seismic liquefaction failure for this hillside is negligible.
Based on the soils underlying the site, the potential for seismic liquefaction
settlement is very low. No special mitigation measures are recommended for
slope restoration on this site to mitigate seismic liquefaction.
Geotechnical Engineering Information - Slope Stability Studies and Opinions of
Slope Stability:
No previous slope stability studies are known to have been prepared for this
site.
As noted above, the site appears stable and not subject to long term erosion or
catastrophic failure.
The topography observed during the site visit indicates no evidence of
catastrophic slope failure in any portion of the hillside. Long term very slow
surface movement has occurred as is typical with any hillside with significant
slopes. Some of the younger trees indicate the telltale curve of their lower
trunks. The movement is very limited and would not produce a noticeable result
within the lifetime of any proposed structures. Significant movement of the
surface soils down the hillside would be measured in decades or centuries. No
areas of obvious surface erosion or tell tale exposed surface soils were
observed on the hillside. The hillside above this site will not be disturbed by the
construction.
Reference slope stability, it is the opinion of this office, based onconsiderations
discussed above, that the existing slopes are geologically stable for the
intended use, and restoration with similar soils with proper compaction and
revegetation may be permitted.
Geotechnical Engineering Information - Proposed Angles of Cut and Fill Slopes
and Site Grading Requirements:
Only slight to moderate earthwork will be required to restore the base of the
sloped area. The following guidelines are provided for general information.
The normal maximum cut or fill slope with this type of material would be 2:1. All
finished slopes are specified at 25 percent or 4:1, representing a conservative
slope design.
During temporary excavations a vertical cut face is acceptable. While not likely
for this project, for deeper excavations, with potential cuts up to eight or ten feet
in depth, it is recommended that cuts be backsloped at 1:1 or flatter at depths of
more than four feet, per standard practice.
Site grading should follow standard practice as regards erosion control,
stockpiling of soils, and minimizing the areas to be cleared and disturbed to that
necessary for approved restoration.
Significant structural fill will be required for the restoration. It is recommended
that for the replaced soil the following guidelines should be followed. Place
non -clay materials in maximum 6" lifts, and mechanically compact to
approximately 95 percent. Revegetation of finished slope areas should follow
good landscaping practice. Specifications for new vegetation are provided on
the Slope Restoration Plan.
Geotechnical Engineering Information - Structural Foundation Requirements
and Estimated Foundation Settlement:
While no building foundations are proposed as part of this project, a foundation
bearing pressure of 2,000 PSF is suitable for undisturbed soils for this site.
While no formally designed retaining walls are proposed for this project, it is
possible that a minor rim wall one block in height may be placed at the restored
toe of slope. Should formal wall calculations be required, a lateral resistance
factor of 0.40 for lateral loading may be safely used for design of structural
retaining walls.
Long term settlement is not a concern for this project, however the properly
placed soils at the toe of the slope should experience no significant settlement
over the lifetime of the adjacent residences.
Geotechnical Engineering Information - Soil Compaction Criteria:
Loam soils on site are suitable for all structural fill in a dry or damp condition.
Compaction in restored area should be to approximately 95%, uniformly and
mechanically compacted.
Formal soil testing of soil compaction is not required. Spot observations by the
project engineer during soil placement will be sufficient to verify adequate and
proper soil compaction.
Geotechnical Engineering Information - Proposed Surface and Subsurface
Drainage:
Since this is restoring a portion of original hillside, no drainage measures are
proposed or felt necessary. The steep surface slope and moderately porous
soils will allow drainage equivalent to original conditions.
Geotechnical Engineering Information - Proposed Use of On Site Sewage
System(s)
This site is served by public s6wer.and..does not require the use of OSS
systems (drainfields).
Geotechnical Engineering Information - Lateral Earth Pressures:
As mentioned above, no significant retaining walls are proposed as part of the
slope restoration.
Due to the dense nature of the in place soils, as well as the reliably compacted
replaced soils, an active design lateral pressure for retaining walls of 35 PCF is
suitable, with an at rest lateral pressure for foundation walls of 60 PCF
recommended. All walls over 4 feet in total height must be designed by a
licensed engineer and use the 1.5 safety factor per accepted practice. All walls
with a soil surcharge will require consideration of the surcharge, to be
determined as part of the specific wall design.
Geotechnical Engineering Information - Vulnerability of Site to Erosion:
Undisturbed bare soils on site are moderately subject to erosion. Disturbed
soils are subject to significant erosion. Disturbed soils on or near the slope
areas are subject to heavy erosion. For the above reasons the exposure of
disturbed soils on or near the slope areas should be protected with straw or
tarping if left exposed for more than one Week during the wet season. All
disturbed areas must have properly installed silt fencing on their downhill side.
A standard stabilized rock construction entrance will be used on site to prevent
mud and silt from the site entering the street drainage system. The latter may
be omitted if suitable equivalent measures are in place relating to the driveway
construction at 23621 99th Place W.
With the use of erosion control measures, as mentioned above, the proposed
construction should be able to take place without significant erosion to the site,
or the transporting of silts off site.
Geotechnical Engineering Information - Suitability of On -Site Soils for Use as
Fill:
The native loam materials on -site are suitable for structural fill in damp or dry
weather, with mechanical compaction required in structural fill areas, as noted
above. Note minor quantities of clay in. some existing soils prevents their use
for deep structural fills over one foot deep. Clay soils may be used for non-
structural fill, with the understanding that long term settling may occur
proportional to the depth of the fill. This may be evaluated on a case by case
basis during construction.
Geotechnical Engineering Information - Laboratory Data and Soil Index
Properties:
Field testing was done of soil samples encountered. Used were both wet and
dry techniques. The soils were found to be a loams and dense loams, in the
areas and depths indicated above.
Formal laboratory testing of soil samples was not deemed necessary for the
evaluation of site soils for this site and type of construction.
Geotechnical Engineering Information - Building Limitations:
The construction of the restored slope area may take place during wet weather
provided the above specified erosion control measures are strictly employed.
Arbitrary wet weather restrictions based on specific dates for this site and its
development are not recommended.
Providing the above recommendations and construction criteria are adhered to
in the design and placement soil fill at the toe of the slope and related site work,
no site related building limitations are recommended for these sites.
Note that no dewatering procedures should be required for the site.
Summery:
The site is suitable for slope restoration and fill construction. Drainage of
impervious surfaces is not considered in that none exist for this project.
Statement of Risk: (Intended to comply with TIVIC Risk Statement
Requirements)
The general slope of the site is typi cally about 25 percent in the construction
area. The total difference in elevation of these construction areas is up to
approximately 3 to 5 feet. The steep lower slope is vegetated and is not
projected for disturbance. The level of projected disturbance, combined with
the stable soils noted above, indicate that the site, and the surrounding
properties (which are all similar), is not by definition a "geologic hazard" area
and that additional studies and construction restrictions relating to geologic
hazard areas do not apply to this project.
In addition, the construction as proposed is so minor as to not pose a threat to
public health, safety and welfare. The construction may occur with no greater
threat to the site or to adjacent properties than if the site were level.
The plans and specifications submitted for the proposed slope restoration and
fill have been reviewed and conform to the conditions and recommendations in
this evaluation, specifics noted above, and provided that the conditions and
recommendations are satisfied, the construction and development will not
increase the potential for soil movement; and the risk of damage to the
proposed development, and from the development to adjacent properties, from
soil instability will be minimal (a very low possibility of risk).

during slope restoration construction may be directed to this office.

Dear Mr. Steve and Mr. Klimas,
Thank you inquiring about the potential of tree removal on your property. Because your property contains a slope of
over 25% (approximately 25% slope across the two properties), a tree cutting permit would normally be required for
any tree removal, pursuant to Edmonds Community Development Code (ECDC) 18.45.030.A.3. The two trees are
at the base of the slope, which qualifies as a geologically hazardous area ("erosion hazard").
I met with Mr. Klimas and agree that there are two trees that appear to be hazardous (see photos, attached). These
two trees may be removed without a tree cutting permit pursuant to ECDC 18.45.030.F. I have attached a map that
shows the general location of these trees that I observed to be hazardous. These two trees are leaning at an
approximate 75' angle and are located at the base of the slope near the Klimas property. They are approximately 50
feet tall and are located approximately 20 feet from the house. Because it is unclear whose property these two trees
are on (they are both located very near a fence), the two property owners will need to work together on this to
authorize any tree removal if they both wish to remove the two trees.
If you plan to remove future trees, please contact the Planning Division to inquire about a Tree Cutting permit which
may be required. You may also wish to collaborate with a geotechnical engineer if you have slope stability
questions.

1. Applicant shall provide 48 hours written notice to the neighbors (LeSmith and Kim)
prior to beginning removal and restoration work.
2. Applicant shall not plant vegetation during the hot summer months unless Grantee
waters the plants. The neighbors shall allow access for purposes of watering plants if
they are planted during the summer months. Any revegetation' should preferably be
performed in September or October. Applicant shall replace all revegetation if it dies or
is sickly within 5 years of planting at no expense to the neighbors. Applicant shall cover
exposed slopes with a minimum of 2 inches of straw mulch and berrn up the straw mulch
where the fill meets the new block wall.
3. Applicant shall stake the catch points of the 4:1 slope in the native growth protection
area and notify the neighbors when a City inspection should be performed to ensure the
original slope will not be further disturbed as a result of the restoration work.

SILT FENCE
Purpose
Use of a silt fence reduces the transport of coarse sediment from a c . onstruction site by providing a
temporary physical barrier to sediment and reducing the runoff velocities of overland flow.
Condillons of Use
Silf fence maybe used downslope of all disturbed areas. Silt -fence ismot iiatended to treat concentrated
flows, mr. is it intended to treat substantial amounts of overland flow.

Maintenance Standards
1, Any damage shall be repaired immediately.
2. If coacentrated flows are evident uphill of the fence, they must be intercepted and conveyed to a
sediment trap or pond.
3. It is iinportant to check the uphill side of the fence for signs of the fence clogging and acting as a
barri.-r to flow -and then causing channelization of flows parallel to the fence. If this occurs, replace
the fence or remove the trapped sediment.
4. Sediment must be removed when the sediment is 6 inchesbigh.
5. If the filter fabric �(geotextile) has deteriorated due to ultraviolet breakdown, it shall� be -replaced.
