HALL MAYOR APPEAL: Appeal of Hearing Officers decisi ' on on a short plat with respect to compliance with ECDC Section 18.80.010 in association with a proposed short plat (File No. . S-95-42), (see Exhibit A, Attachments 2 and 3). REVIEW PROCESS: Appeal 'of approval of a Short Subdivision, Hearing Examiner conducts public hearing and makes final decision. MAJOR ISSUES: a. Compliance width Edmonds Community Development Code (ECDC) Chapter 18.80.010 (STREET STANDARDS). b. Compliance with Edmonds Community Development Code (ECDC) Chapter 20.105 (APPEALS AND COURT REVIEW). & 'DESCRIPTION OF PROPOSAL: Sonshine Homes proposes to divide one existing lot with a total lot area of approximately 29,126 square feet (0.66 acres) into 3 lots (see Exhibit A, Attachment 4). The applicant is also requesting a modification of the required lot width from 70 feet to 67.4 feet. The appellant lives in the immediate vicinity of the subject property. His request is based primarily on his belief that the Engineering Division conditions placed on the Sonshine Homes development are inadequate. He further contends that serious safety'flaws exist with the current proposal and that these have not been addressed in the Engineering Divisions conditions on the development (see Exhibit A, Attachment 2). Incorporated August 11, 1890 Sister Cities International — Hekinan, Japan 0 File No. AP-95-100 Page 2 SUMMARY OF RECOMMENDATION AND DECISION: Staff Recommendation: Partial approval of appeal Hearing Examiner Decision: Partial approval of appeal PUBLIC HEARING: After reviewing the official file which included the Planning Division Staff Advisory Report; and after visiting the site, the Hearing Examiner conducted a public hearing on the application. Ile hearing on the Goodman appeal application was opened at 9:06 am., August 8, 1995, in the Plaza Room, Edmonds Library, Edmonds, Washington, and closed at 9:37 a.m. Participants at the public hearing and die. exhibits offered and entered are listed this report. A verbatim recording of the hearing is available in the Planning Division. HEARING COMMENTS: The following is a summary of the comments offered at the public hearing. From the City: Kirk Vinish, Project Planner, reviewed the staff report and recommended partial approval of the appeal. Jim Walker, City Engineer, stated that at recent hearings regarding traffic in the area, neighbors indicated they did not want the street widened. Also the City doesn't want the street widened along just one parcel unless there is some prospect that the entire street can be widened in the future. From the Appellant: Robert Godman Appellant, said there are currently 4 residences on the street and this proposal will add 2 dwelling units so there will be 6 dwelling units on the streets. He submitted a traffic count (Exhibit B) which indicated there are now 250 trips per day on the street and he is concerned about safety if additional traffic occurs. He appealed to the City to enlarge the street to a full residential street in accordance with City standards. He noted that many people use this street to gain access to Highway 99. Kathleen Goodman said the street is so narrow there is no place to walk when the school bus or other large vehicles are on the road. From the Community: Margaret Johnson said the road started out as just on access to the Hanson property, but was later cut through. She noted that people who use the road tend to drive slowly. She also said the Fire Chief has indicated there is no fire danger with the way the road now exists. File No. AP-95-100 Page 3 Response from the Applicant: Al Thom, owner of the subject property, said he understands and appreciates the concerns. He said the street is 750 feet long and additional pavement along his property won't solve the whole problem. He felt that if he is required to remove the existing trees' to widen the road that will fly in the face of retaining the sense of neighborhood which now exists. He said that if the whole neighborhood is willing to fund the entire street improvement, that would be o.k., but he was not for a partial improvement. He noted that the existing street already has caution signs and speed bumps installed. He suggested the street be made one way to address safety issues. He said if the street is a one-way street the trees can be retained. He was concerned that if the street is to be widened the street will become busier. Response from the Appellant: Robert Goodman said that increased traffic will come from the proposed homes and he didn't expect much additional traffic from the surrounding neighborhood. Response from the City: Jim Walker, City Engineer, said there is no sidewalk plan for that area now and therefore, a LID would need to be approved to have a sidewalk installed along this street. He noted that before a street can be made into a one-way street the issue would have to go through a public hearing before the City Council. He closed by pointing out that less than 10% of the entire projected trips on the street will be attributed to the two new homes. WRITTEN COMMENTS: No written comments were submitted by members of the general public. A. Site Description 1. Site Development And Zoning: a. EaM: (1) &M: The total size of the subject property is 29,126 square feet.. Ile size of the proposed lots is: (a) Lot 1: 10,865 net square feet, 10,865 gross square feet. (b) Lot 2: 8,889 net square feet, 10,257 gross square feet. (c) Lot 3: 8,004 net square feet, 8,004 gross square feet. (2) Land Use: The subject property is currently developed with a single-family residence, accessory buildings and approximately 94-feet of linear frontage on 78th Avenue West. The applicant has applied to further subdivide the property into three (3) lots to allow the development of two (2) additional single-family residences (see Exhibit A, Attachments 4 and 5 ). 0 0 File No. AP-95-100 Page 4 (3) Zoning: - The subject property is zoned RS-8 (single residential family with a minimum 8,000 square foot lot size requirement) (see Exhibit A, Attachment 1). (4) Terrain and Vegetation: The subject property slopes gently from the west to east with a moderate bank along the southern property line. Vegetation on the remainder of site consists of ornamental landscaping and several large stands of healthy trees located on the proposed lot 2. 2. Neighboring Development And Zoning: a) Fact: (1) 'Me adjacent properties to the north, south, east, and west and are currently zoned as single-family (RS-8) (see Exhibit A, Attachment 1). (2)The adjacent properties to the east, north, and south are currently developed as single-family homes. The property to the west is developed with several residences on one lot and is legally nonconforming. B. History 1. a) Facts (1) The following is a chronological account of the development of the property located at 23627 78th Avenue West. The purpose is to clarify what development has taken place on the property, as well as outline the appeals that have taken place. (a) March 27, 1995: Sonshine Homes applies for a 3-lot short plat. (b) May 12, 1995: Staff conducted a public hearing on the proposed 3-lot short plat. The Hearing Officer denied the requested modification of lot width and approved the short plat with the conditions from the Engineering Division noted on Exhibit A, Attachment 5 of the Preliminary Review of the Proposed Short Subdivision (see Exhibit A, Attachment 4). (c) June 14, 1995: Appellant files an appeal of the City of Edmonds decision approving with conditions the Sonshine Homes 3-lot short plat (see Exhibit A, Attachment 2). C. Edmonds Community Development Code (ECDC) Compliance 1. a) Facts: (1) The fundamental site development standards pertaining to Residential development in a RS-8 zone are set forth in Chapter 16.20.030. (2) The existing development conforms to all RS-8 requirements (see Exhibit A, Attachment 4). File No. AP-95-100 Page 5 b) Conclusion: The proposal complies with the development standards for the RS- 8 zone as set forth in Chapter 16.30 2. a) Facts: The following is a review of the appellants issues, comments of the City Engineering Division and staff comments. (1) Appellant Comments: "78th Ave. West between 236th and 238th does not meet the 40foot minimum width in all areasjor City of E&nonds standardsfor a "Right of Way" (see Exhibit A, Attachment 2). (2) Engineering Comments: "Public right-of-way has been dedicated to a width of fortyfeet on 78th Ave. W.from 236th St. S.W. to 240th St. S.W. as shown on the Official Street map. ... The City Council amended the Official Street Map, reducing the plan line right-of-way of 78th Ave. W. tofortyfeetfrom 236th St. S.W. to 238th St. S.W." (see Exhibit A, Attachment 3). (3) Staff Comments: It appears that the 40-foot minimum right-of-way standard, as required on the Official Street Map, has been met. (4) Appellant Comments: "The City of Edmonds has erected telephone poles on 78th Ave. W. Between 236th and 238th rendering a large portion of this "right-of-way" inaccessible and decreasing the "right-of-way" to less than 25-feet in some areas" (see Exhibit A, Attachment 2). (5) Engineering Comments: "Poles which are used by P.UD., GTE, and Chambers Cable are erected in the right-of-wayfrom 236th St. S.W. to.238th St. S.W. This is very typicalfor these utilities in order to provide service to their customers. As public andfranchised utilities, these companies are allowed to use the public rights-of-wayfor this purpose" (see Exhibit A, Attachment 3). (6) Staff Comments: The current location of the utility poles does not have any direct bearing on the requirements for street improvements. The available right-of-way remains at 40-feet. If the pavement width needed to be extended the P.U.D. would be requested to move the poles as part of the road system improvements. (7) Appellant Comments: "The pavement width on 78th Ave. W. does not meet the 22 foot minimum width requirement of the City of Edmonds and is injact less than 14 feet wide in some areas" (see Exhibit A, Attachment 2). (8) Engineering Comments: "The pavement width on 78th Ave. W. from 236th St. S.W. to 238th St. S.W. does not meet the minimum 22 -foot standard required in the ECDC" (see Exhibit A, Attachment 3). File No. AP-95-100 Page 6 (9) Staff Comments: ECDC 18.00.00 states, "The reconstruction of existing facilities shall conform to the standards as closely as is practical and economically feasible." ECDC 18.80.010 Table of Street Standards states that for all zones exceeding 16 units on a street, the minimum right-of-way width and pavement width is dependent on design. The City Engineer has stated that the design as proposed is sufficient to accommodate the traffic levels anticipated (see Exhibit A, Attachment 4). 3. Conclusions: (1) The amount of required street right-of-way is consistent with the Official City Street Map. (2) The location of the existing utility poles does not prevent the City from utilizing the 40-feet of right-of-way in the future. (3) In reviewing the comments provided by the City Engineer (see Exhibit A, Attachment 4) it seems that the determination not to require 22-foot pavement width was influenced by two pieces of information: 1) input received from the neighborhood during a previous study, and 2) field data. Both of these sources of information understandably influenced the Engineering Divisions decisions on these matters. However, ECDC Title 18 does not appear to give staff the authority to reduce street standards for this project. Standards may be exceeded for example, to insure adequate emergency vehicle access, or as was noted above take into consideration the practicality and economics of street improvements, but there does not appear to be any authority in the ECDC for reducing street standards due to input from residents. Additionally, as can be seen on the Official Street Map, the stretch of road just prior to 238th Street SW has been widened and a portion between 236th Street SW and 238th Street SW has dedicated right-of-way. The applicant has not provided documentation supporting the conclusion that improving the road width is impractical or excessively costly. Therefore, the appellants concerns seem to have some support in the ECDC and the required pavement width should be extended to 22-feet along the frontage of the proposed development. File No. AP-95-100 Page 7 DECISION: Based on the foregoing findings and conclusions, the appeal is partially approved and the pavement width shall be increased to 22 feet along the frontage of the proposed development. REQUEST FOR RECONSIDERATION: Section 20.100.010.G allows for the Hearing Examiner to reconsider his decision or recommendation if a written request is filed within ten (10) working days of the date of the initial decision by any person who attends the public hearing and signs the attendance register and/or presents testimony, or by any person holding an ownership interest in a tract of land which is the subject of such decision or recommendation. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordina�ces governing the type of application being reviewed. B. APPEALS: Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or recommendation shall be made. The appeal shall be made in writing, and shall include the decision being appealed along the name of the project and the date of the decision, the name of the individual or group appealing the decision, their interest in the matter, and reasons why the appellant believes the decision to be wrong. The existing property address is 23627 78th Ave. W. and extends 108 feet to the east. More generally, this property is located in the NE 1/4, SE 1/4, Section 3 1, Township 27 N., Range 4 E., of the Willamette Meridian in Snohomish County, Washington. Existing Conditions and -Drainage An existing house is located on the parcel; a carport and a concrete pad are also exists but are going to be removed. The house is accessed by a circular driveway off of 78th Ave. W. on the west side of the property. The house was built in 1946 and there has been minimal improvements to the Lot since 1977. Sixty percent of the property is covered with cedar, fir, fruit, and other deciduous trees with some blackberry and other underbrush ground cover. The property slopes form west to east; the west 100' of the property is approximately 6% slope, and the rest of the property to the east property line is at approximately 15% slope. The existing drainage is sheet flow across the property to the east. There is minimal off -site drainage on to the property. Proposed Development The house sets on the north west section of the property and will be subdivided into Lot I of the 3 lot short plat. An access road for Lots 2 and 3 will run east off of 78th Ave W., and will have a turn around-. The storm water run-off from the roof drains and the access road will be collected and detained in an underground detention pipe. Per the City of Edmonds standards, the peak rate of runoff was limited to the predeveloped I JOB NO. 94-101 -A 0 0 condition ten-year, twenty-four hour design storm, While maintaining the predeveloped condition peak runoff rate for the one -hundred year, twenty-four hour storms. Downstream Analvsis The runoff from the property sheet flows to the east + 13 0 feet to 77th Ave W. where the water is collected in a type I catch basin on the north side of the cul-de-sac. The runoff flows +35 feet to the east in a 12" RCP to another type I catch basin, the flow continues flowing southeasterly ± I 10 feet in a 12" RCP to another catch basin, and then flows south +25 feet to a ditch approximately 5 feet wide and 3 feet deep. The flow continues 8 feet to a 12" RCP that runs + 16 under a driveway then into a ditch that continues south for +150 feet. The flow enters a 24" RCP that flow southeast to a catch basin, from there the flow travels south east +40 feet in a 24" RCP that goes under 238th Pl. SW where it enters another catch basin and flow +200 feet east in a 24" RCP that connects to a 36" RCP that runs south approximately 1100 feet down 76th Ave. W. then turns to the east and flows approximately 600 feet to Ballinger Lake.
