L Upon the stipulation and joint motion of the City of Edmonds, and Bert and Anna
Loper, husband and wife, ("Lopers")the Hearing Examiner of the City of Edmonds hereby orders
that s fine of $,30,000 be levied with respect to the Lopers use of certain real property located at
23625 and 23637 Hwy. 99, Edmonds, Washington and the subject of the above -referenced
enforcement actions.
2. A conditional use permit formally issued with respect to the aforementioned real
property and numbered CU-98-185 has previously been revoked by Order of the Hearing
Examiner.
3. The above -referenced fine as levied fully satisfies any and all obligations of the
Lopers with respect to their use of the Property and the alleged violations of City ordinance in
such use which arise on or before August 2001.

SETTLEMENT AGREEMENT
NVFEEREAS, the City of Edmonds Washington ("Cityl has initiated an enforcement
action with respect to certain real property� owned by Bert Loper and Marcella Loper, husband
and wife,� and Anna Loper, a single woman, and the Loper Family Trust ("Lopors") at 23625 and
23637 Hwy. 99, Edmonds, Washington, ("Property") legally described on the attached Exhibit A
(berein'Troperty'� "Lot A" and "Lot B'), and
' � VVHEREAS, this matter is set before the Edmonds. Hearing Examiner on the motion of
the City in files No- CU-98-185; ADB-98-142; AP-99-152 and DA-99-104, and
WHEREAS, it is the desire of the parties to stipulate to certain matters and thereby
finally resolve this enforcement action, settling all matters relating to them with respect to the
Property which have ansen on or before the date of execution of this Agreement NOW,
I ERBFORE,
The City and the Lopers have entered into this Settlement Agreement under the terms. and
conditions set forth herein.
Obligation of IMers.
1.1 Lopers hereby stipulate to payment of a fine of $30,000, tender of which is made
contemporaneous with the execution of this Agreement. By their tender, the Lopers agree and
stipulate that such fine has been lawfully incurred with respect to civil violations detailed in the
above referenced City files.
1.2 AJI use of a structure currently located on the site, straddling Lots A arid B has
ceased, and the Lopers promise that the* Property shall not be used for the conduct of'any
business enterprise whatsoever until such enterprise has been properly licensed by the City of
Edmonds, and any and all structure utilized in such business have been inspected by the City's
Building and Fire Departments in accordance with the State Building and Fire Code.
.1.3. The Property, while in Lopers' ownership, shall not be used for vehicular or other
storage in violation of the laws of the State of WashiDgton or the zoning provisions of the City of
Edmonds. Nothing herein shall be interpreted to limit the legal and equitable remedies which the
City may utilize in the event that the Lopers violate either. the terms of City ordinance or the
terms of this Settlement Agreement, with respect to violations occurring following the date of
execution hereof.
1.4 Drainage from the parking lot paved without permit on Lot B shall be retained
and properly channeled in accord with city, state and federal requirements.
1.5 The existing buildings on the Property shall be demolished within the life of a
currently issued demolition permit, but in no event later than December 31, 2001. All junk

vehicles shall be removed from the Property, both Lots A arid B of the described within s
(60) days of the execution of this Settlement Agreement, and said Lots shall be kept free of the
storage of such junk vehicles and any similar debTI's. or material firom and after the date of
execution of this Agreement, so long as the Lots remain in the Lopers' ownership.
1.6 The Lopers authorize their legal counsel to execute any documents necessary to
confam the terms of this Settlement Agreement with the Edmonds Hearing Examiner, enter the
fine agreed upon herein and execute any documents necessary to confirm the entry of such fine
and its payment before the Edmonds Hearing Examiner.
2. Undertakin-gs of Ci
2.1 Upon confirmation that the payment tendered by the Lopers has been made, i
any check tendered has cleared the bank, the City shall dismiss any- and all pending enforcem
actions of any Idnd or nature whatsoever, civil or criminal, and relating to the use. of Property
the Lopers and which arose on or before the date of execution of this Agreement.
2.2 The City waives and releases the Lopers from any civil or criminal claim
out of. the, Lopers use of the Property on or before the date of execution of this Agr
except as specifically detailed below.
7.3 The City reserves from its waiver and release, the following rights and/or
of action:
2.3.1 Any condition concealed by the Lopers and which could not, in I he
exercise of reasonable diligence by the City have been discovered.
2.3.2 Any environmental claim arising under the laws of the State of
Washington, the laws of the United States, or civilly with respect to any soil or groundwater
pollution which negatively impacts City -owned property or Tights -of -way adjacent to the subject
Property.
2.4 U
pon confamation that the t3O,OOO fine has been paid and deposited with,
City, the. City shall., cause at its cost, the entry of an Order confirming a fine with the Hear
Examiner by aggreed-upon order. The City shall prepare all documents necessary to confim si
understanding-
3. R�2�. This Agreement shall be specifically enfbrceable by the City of Edmc
with respect to the promises of the Lopers contained in Paragraphs 1.2 through 1.6 above.
City, at its option, may bring civil enforcement actions, criminal actions, or pursue U30unc
relief in Superior Court, or such other remedies as. it, in its sole discretion, shall d
appropriate, if the Lopers violate the terms of this Agreement, or otherwise violate City or L4
law in the.exercise of business activities on the subject Property on and after the date of
Agreement or violate the terms of the Agreement.

4. MeEgers/Sole A=eement. This is the sole. agreement between the parties. Any prior
understanding, written or oral, shall be deemed merged --�rith its provisions. It shall not be
amended except in writing with the express written consent of the parties hereto.
5. Jurisdiction and Venue.
This Agreement shall be. interpreted in accordance with the laws of the State of
Washington. Snohomish County, Washington shall be the venue for any action necessary to
interpret or einforce the terms of its provisions.
6. Mutual Waiver and Release.
Each party does hereby waive and release the other; promising to indemnify and hold
harmless the other party, its officers, agents or employees, for any claim which the other may
have against such party, its officers, agents or employees, which arose prior,to the date of
execution of this Agreement with respect to. the subject site and the City's enforcement actions
brought with respect theTato, PROVIDED, HOWEVER, that the parties specifically reserve
claims which they may have regarding conditions which have been fraudulently concealed,
whichcould not i the exercise of reasonable investigation, been discovered and/or which relate
to environmental claims arising under the provisions of State or Federal law, or the- common law

2. Uniform Building Code (1997 Edition) Section 3306 in regards to the fill and grading without first applying for

3. Edmonds Community Development Code (ECDC) Section 18.95 in regards to the illegal paving of a parking
lot without first applying for and being granted an approved permit.
4. ECDC Section 19.00.080 in regards to the alteration or remodelling, addition and paving without a valid
building permit.
5. ECDC Section 20.105.060 in regards to any and all violations of the ECDC being subject to criminal
fines/penalties as set forth in Chapter 5.50 of the Edmonds City Code — Civil penalties authorized by ECDC are
not in lieu of criminal penalties, or alternative to criminal penalties, but are sanctions that may be imposed in
addition to criminal penalties.
6. ECDC Section 20.110.030(A)(H) in regards to the maintenance of a nuisance by allowing accumulation of
junk, litter, salvage materials, attractive nuisances, vehicle parts and junk vehicles upon front, side and rear
yards.
7. ECDC 20.110.050 (C) in regards to the unauthorized storage or retention of junk motor vehicles or parts
thereof constituting a public nuisance.
8. Edmonds City Code (ECC) Section 4.11.020 in regards to unauthorized operation of a motor vehicle wrecking
business without a current and valid state license issued by the Washington State Department of Motor
Vehicles or Failure to diesplay such license prominently in the place of business.
9. ECC Section 4.11.040 in regards to operation of a motor vehicle wrecking business in violation of any
provision of ECC Chapter 4.11.
10. ECC Section 4.11.060. criminal penalties authorized pursuant to ECC 5.50.020 for failure to comply with any
provision of ECC Chapter 4.11.
11. ECC Section 4.72.020 in regards to unlawfully conducting, operating, engaging in or practicing business within
the City without first obtaining a business license.
Description of Violation:
I . Addition onto the southeast comer of the building and Remodel of the existing tailor business without building
permit and Architectural Design Board Approval,
2. Unpermitted Site Grading and Paving of the upper parking lot.
3. Unlawful and unpermitted storage of nuisance items including Junk vehicles and parts thereof.
4. Unlicensed Used Car Business and Unlawful maintenance of an unlicensed motor vehicle wrecking business.
Corrective Action Required:
1 Submit for and obtain approved building permits for the addition & remodel or obtain a demolition permit to
remove that unpermited addition and remodel.
2. Submit for and obtain building pen -nits for the paving & site grading or remove that unpermitted fill and paving
and return site to original grade.
3. Removal or complete enclosure of all junk vehicles and nuisance items on the site or obtain an approved
Conditional Use Permit so that the junk vehicles and various nuisance items may remain stored outdoors.
4. Obtain Architectural Design Board approval for unpermitted Addition and Remodel.
5. Obtain Architectural Desgin Board approval for unpermitted Parking Lot Plan.
6. Cease and Desist all activities regarding unlicensed auto sales or obtain an approved City Business License to
operate a used car lot and salvage operation.
7. Obtain and show proof of all necessary licensing requirements for motor vehicle wrecker business.
The person to whom this Notice is issued is being assessed $100.00 per " or portion of a day, during which
the violation continues.
This Notice of Civil Violation has been issued pursuant to ECDC 20.110.040 (13)(2) for repeat violation. No Order
to Correct Violation has been issued and civil penalties shall accrue immediately upon the DOSting or personal
receipt of this Notic . A prior Order to Correct Violation was issued and posted on February 18, 1999.
This civil penalty has not been imposed in lieu of criminal prosection for the violations set forth above. These
matters have been referred to City Prosecutor for consideration of criminal charges and any such charges and
related prosecution and/or imposition of criminal penalties shall be wholly separate from the requirement to
respond to this Notice of Civil Violation, implement the required corrective action, and make payment for the civil
penalty imposed herein. However, your immediate response to this Notice of Civil Violation and initiation of
corrective action may be considered by the City Prosecutor in determining whether to file criminal charges.
If correction in not made b 5:00 P.M. (time) August 16. 1999 (date) an
abatement notice will be issued warning of impending City abatement of the violation. Any and all costs, including
incidental costs, will be added to the monetary penalties assessed against the person to whom the Notice is issued.
The imposed monetary penalties are payable to the City of Edmonds Development Services Department at 121 5tb
Ave. N., Edmonds, WA 98020 during normal business hours.
This decision is appealable to the City of Edmonds Hearing Examiner by filing a written notice of appeal and
application fee of $ 100.00 with the Development Services Director no later than July 23. 1999at 5:00 p.m.

Mr. Dougherty:
The Engineering Division has reviewed the site drainage plan dated February 17, 1998. The plan you
submitted for 5500 square feet of impervious area is being returned with comments regarding the
drainage.
The City needs clarification regarding the legal boundaries of the Loper lot. Earlier submittals showed
the parcels to the north combined with the property shown in your submittal. Per my letter to Mel
Maertz, AIA, dated September 3, 1997 regarding this proposal, the design parameters were, "The plan
must be designed and signed by an engineer licensed in the State of Washington. The areas used for
the calculations must include all impervious surface and compacted gravel added since 1979." The
same letter stated, "It has been determined that in approximately 1987, nearly 2800 square feet of
asphalt surface was added to the site. In approximately 1994, over 3300 square feet of compacted
gravel was put in place. Earli.er.this year, nearly 3400 square feet of asphalt, over 800 square feet of
compacted gravel, and approximately a 300 square foot office was constructed."
Please verify that your calculations and design include all impervious surfaces added to the property
since 1977. Per the September 3 letter, Mr. Loper was required to submit a parking plan designed with
respect to the planned frontage improvements that will be constructed on SR99.
As this project is in violation, it is imperative that you expedite compliance with the required

My answer this morning is the same answer that I provided to you last Tuesday November 23rd, the 18 foot barrier free
stall length does not include the two foot overhang. With regard to the plan changes under permit application #99-40 for
the Sunset Building, you may redline the plans to expedite the process. You are incorrect in your assumption that I am
holding up your project. In fact the first I learned of your proposed plan changes was on 11/23 when Mr. Chrisman came
to me to discuss the matter. At that time I immediately responded to code questions posed by Mr. Chrisman on your

Dear Ms. Graf:
This plan with exception to the small retaining wall and the added catch
basin is exactly the same as approved this year. We have the
construction of that porition of Hwy 99 and elevations changes that
affected my client property held up until we get your approval. The
jurisdictions I have dealt with like Edmonds require a 18 foot deep H.C.
stall. Included in this can be a 2'-0" overhang from the face of the
wheel bumper. If we set the curb at 18 feef deep are you saying we need
a 20'-0" deep stall? I am simply trying to determn where to put our
curb. We have the room to do either, but we need a decision by Monday
as to not hold up construction further. As I told Lyle, we can provide
as-builts of all the site changes impacted due to this construction, but
any more time consuming resubmittals is forcing costly delays. Bob
Stills from the City of Lynnwood is very concerned about any further
delays on this portion of road way. Please give Lyle a verbel approval
to proceed with the changes you are requesting and we will correct the
drawings as directed.
