Subject: Ornamental Fish Ponds in City Right -of -Way
Addressing the concerns of the property owners responding to a City of Edmonds
letter dated June 11, 2007, directing said owners to remove the ornamental ponds
that were placed within the city right-of-way, Assistant City Engineer Don Fiene
concluded that said ponds in this instance are considered landscape features and
as such, are not required to be removed for the right-of-way.
This conclusion is in no way intended to establish a precedent for structures built
within the City of Edmonds rights -of -ways, and does not confer any rights to the
property owners, present or subsequent, to have said features repaired, replaced,
or moved if the city subsequently requires the use of of said right-of-way, for any
purpose.

The City of Edmonds has become aware that you have constructed an encroachment on pubfic
right-of-way, specifically, a pair of ornamental fish ponds. After a recent inspection, it appears a
violation of Section 18.70 of the Edmonds Community Development Code (ECDC) has
occurred. Any improvements placed in the public right-of-way will require an Encroachment
Permit. However, due to the nature of the encroachment, it is unlikely that such a permit would
be issued.
We request that you remove both the ponds and their supporting rockery from the public right-
of-way. The right-of-way of 101s'Place SW is fifty feet wide. Your ponds should be set back a
minimum of twenty-five feet from the center of night -of -way.
We understand that you may not have been aware of this ordinance. However, to comply with
the code, you will need to take corrective action by June 30, 2007. If you have any questions,
