5. The proposal protects the critical area ftinctions and values consis.tent with the best
available science and results in no net loss of critical functions and values; and
6. The proposal is consistent with other applicable regulations and standards.

mitigate its impacts on critical areas and/or does not comply with the criteria in ECDC 23.40.160 and
the provisions of the City of Edmonds critical area regulations. See attached findings of

Thank you for your response to the mailing for the Natural Yard Care Neighborhoods Program. We are
sorry you will not be able to attend any of the workshops, but appreciate your input.
Currently, Lake Ballinger supports a population of both native "yellow" water lilies (Nuphar
polysepalum) and fragrant water lilies (Nymphaea odorata). Fragrant water lilies have white or pink
flowers, are native to the Eastern US,and can grow aggressively in Washington lakes. However, fragrant
water lilies have not yet been placed on the State Weed List, nor has the State Department of Agriculture
banned the sale of fragrant water lilies in local nurseries.
While neither the City of Edmonds nor the City of Mountlake Terrace has in place a program to control
the water lily population in Lake Ballinger, it is input from citizens such as yourself that helps the cities
plan future efforts within the lake. In the meantime, you are free to control the water lily population
along the shoreline of your property by mechanical harvesting. You can find more information on the

The subject property adjacent to Lake Ballinger which has been designated as Environmentally
Sensitive by the City of Edmonds. Lake Ballinger itself has been idenfied as a Class I wetland.
Development adjacent to wetlands are regulated under the Critical Area section of the Edmonds
Community Development Code. An environmental checklist and SEPA determination will be
required of all development permit applications.
Wetland Study
To determine the location of the I 00-foot wetland buffer and 15 -foot building setback, a wetland
delineation performed by a wetland scientist must be done on -site. The wetland delination must
be perfon-ned under a 3-Party Agreement with the City (ECDC Section 20.15B. 140.D.). A
licensed surveyor must then prepare a drawing that identifies the wetland boundary and
associated buffer and setbacks on a site plan showing the location of the proposed development.
If the property owner wishes to apply for a specific development permit which they feel
would not impact the Critical Area located on the site, they may submit their proposal to
the Planning Division for review. If the Planning Division finds that the proposed
development permit will not adversely impact a Critical Area or its buffers, a conditional
waiver may be issued on a project by project basis.
