Dear Mr. Thompson,
After review of your encroachment permit application and letter submitted on November
27th, a determination has been made to deny your request to locate a fence within the
City right-of-way along 1 OOh Avenue. The City does not feel that the requirements of
Chapter 18.70, Edmonds Community Development Code (ECDC) have been met. The
proposed fence location is not seen to be in the public interest, safety and convemence. It
has also been. determined that the proposed fence could pose a safety hazard for vehicular
traffic as it would create sight distance problems for vehicles traveling along 10e
Avenue.

CRITERIA OF PERAHT APPROVAL
The applicant shall follow the noted conditions on the building permit. For applications that do not require a
building permit the following criteria shall be maintained at all times.
> Provide safe pedestrian travel for sidewalk encroachments. Maintain a clear zone. of 44 inches

> Exterior light fixtures, banners and flags must be a minimum of 7 feet above City right-of-way.
> Maintain clear. lanchngs on th exterior side of all required exit doors of 44 inch or no less than width of -
door, measured toward the street.
> No projections into City alleys are permitted unless the projection exceeds 15 fed above pavement
surface.
> Do not block illumination from City light fixtures or hang objects from City light standards.
> Architectural projections from buildings must be approved by the Design Board and conform to Uniform
Building Code requirements. A building permit shall be required for such projections.
> Maintain 3 feet of clearance around fire hydrants, standpipes, manholes, water meters, blowoffs,
cleanouts and valves.
>, Bistro dining tables and chairs must be placed in accordance with City Ordinance No. 3293.

Re: Encroachment Permit for Fence Construction
The enclosed application for Encroachment Permit and Building Permit for fence
construction is requested for the three lots at 23910, 23920 and 23926 Firdale Avenue.
The three lots are bordered on both the West by 1 00th Avenue which connects to 8th NW
in Shoreline and the East by Firdale Avenue. Both busy streets with the associated noise of
the traffic interrupting the owners peace and quiet.
The location of the fence and encroachment on the City Right of Way is shown on the
accompanying site plans. Presently, on the West side of 100 Avenue there is a level area
about 4 to 5 feet wide before it drops off to the lots. Because of this drop it would block
out very little noise to construct a fence on the property line and thus we are proposing
that the fence be built at the edge of the drop off. Further, it would benefit the City of
Edmonds to have a fence to block the drop off from anyone Wling down the hill.
I have checked with all utilities and all the utilities are either in the road or on the West
side of 100 Avenue, so we would not be blocking access to any utility work. There is an
extruded curb on the East side of 100 Avenue that blocks all drainage from coming down
the hill and no erosion problem will be created. Further, the land that the houses are on is
an old gravel pit and has excellent perkability.

and harmless from any and all claims, demands, losses, damages or expenses resulting from
the construction, maintenance, use, repair or removal of the structure installed hereunder,
including any loss, damage or expense &rising out of (1) loss or damages to property and (2)
injury to or death. of persons.
C. The Owner must remove or relocate any part of the encroachment
within ten (10) days or such other time as specified in the notice after receipt of it from the
City Engineer, or the City Engineer may cause such work to be done.and the reasonable cost
thereof shall constitute a lien upon the property.
� d. Whatever rights and obligations were acquired by the City with reVect
to the easement shall remain and continue in fall force and effect and shall in no way be
affected by city's grant of permission to construct and maintain the encroachment structure.

the parties with respect to the subjed matter hereof and supersedes and replam all other
agreements, oral or written, between the parties with respect to the Subject matter. -

Is there a HOA (home owners association) for the short plat? If so they should be the applicant --the
HOA will have assessment ability, the ability to raise funds, from all three lots.
Do not see why you can't have one permit recorded against three lots. Each lots complete legal
should be attached as an addendum to the permit as well as a description of the ROW area in use
within the permit.

IF we approve the encroachment permit:
The current owner will have to have the encroachment permit recorded against
the property. It will then run with the property to subsequent owners.
The current owner will have to provide the insurance and when the property
changes hands, the new owner will have to provide insurance. When the property
changes hands, I assume the coverage will be cancelled for the property in question,
in which case the insurance company would be required to. provide us written notice of
its cancellation.
Yes, we will need an encroachment permit that is recorded against each lot. I
don't know if one permit would suffice if recorded against all lots? Or if we would need
three permits. Scott ..... Can you answer this?
I don't know if the fence was disapproved during the short plat process. Lyle ... do
you know? However, it is likely that I will not approve it. It is difficult to convince me
that a private fence in the City ROW serve the public interest, safety and convenience
as required by the ECDC. If you want to explain/show me the specifics, I will let you
know if I think I will approve or not.

for a fence along 100th in the unused portion of the Right of Way. Listed on the

already been approved, the lots have all had SFR permits issued and the
buildings have been finaled. I don't know if any of the lots have been sold or
not. As it stands we have Janris Const. listed as the owner of all three lots.
How will this work? Will the (future) property owner(s) need to provide us with
the insurance certificates? Or will we require that Janris provide it in -perpetuity
even though the properties will all be sold to individuals? Can we do that?
Will we require an Encroachment permit for EACH lot?
It has been suggested that the fence he is proposing was brought up and
denied during the short plat process. Is this true?
I need to give Mr. Paul Thompson from Janris a call tomorrow.

CRITERIA OF PERMIT APPROVAL
The applicant shall follow the noted conditions on the building permit. For applications that do not require a
building permit the following criteria shall be maintained at all times.
> Provide safe pedestrian travel for sidewalk encroachments. Maintain a clear zone of 44 inches minimum.
See definition of clear zone below.
> Exterior light fixtures, banners and flags must be a minimum of 7 feet above City right-of-way.
> maintain clear landings on the exterior side of all required exit doors of 44 inches - . or no less than width of -

Re: Encroachment Permit for Fence Construction
The enclosed application for Encroachment Permit and Building Permit for fence
construction is requested for the three lots at 23910, 23920 and 23926 Firdale Avenue.
The three lots are bordered on both the West by I 00th Avenue which connects to 8th NW
in Shoreline and the East by Firdale Avenue. Both busy streets with the associated noise of
the traffic interrupting the owners peace and quiet.
The location of the fence and encroachment on the City Right of Way is shown on the
accompanying site plans. Presently, on the West side of 100 Avenue there is a level area
about 4 to 5 feet wide before it drops off to the lots. Because of this drop it would block
out very little noise to construct a fence on the property line and thus we are proposing
that the fence be built at the edge of the drop off. Further, it would benefit the City of
Edmonds to have a fence to block the drop off from anyone falling down the hill.
I have checked with all utilities and all the utilities are either in the road or on the West
side of 100 Avenue, so we would not be blocking access to any utility work. There is an
extruded curb on the East side of 100 Avenue that blocks all drainage from coming down
the hill and no erosion problem will be created. Further, the land that the houses are on is
an old gravel pit and has excellent perkability.

ENCROACHMENT AGREEMENT
This ENCROACHMENT AGREEMENT ("Agreemenf) is entered into between the
CITY OF EDMONDS ("City') and TAr.I(ZLS e7pJS-raO U J � -,T-N C-
("Owner[s]"), in accordance with Chapter 18.70 of the Edmonds Community Development
Code.
1. The Provertv. Owner is the owner of that certain real property located * at

particularly described in Exhibit "X' attached hereto andlincorporated herein by reference.

2. The Essimen�t. The City currently owns an existing easement over, under,
and across Owner's property for street� alley, sidewalk, other
which is described in Exhibit "B" attached hereto and incorporated by reference.
3. The Encroachment. The City hereby covenants and agrees and grants its
permission to Owner or Business Owner to allow A - F13Q C-19-r
to remain in a portion of the City right-of-way/easement. A plat map showing the location of
the encroachment is attached as Exhibit "C" and incorporated by reference. This Agmement
is subject to the following terms and conditions:
a. The encroachment shall be installed and maintained in a safe and
sanitary condition at the sole cost, risk, and responsibility of the owner and its successors in
interest.

b. The Owner shall agree at all times to indemnify and hold the City free
and harmless from any and all claims, demands, losses, damages or expenses resulting from
the construction, maintenance, use, repair or removal of the structure installed hereunder,
including any loss, damage or expense arising out of (1) loss or damages to property and (2)
injury to or death of persons.
C. The Owner must remove or relocate any part. of the encroachment
within ten (10) days or such other time as specified in the notice after receipt of it from the
City Engineer, or the City Engineer may cause such work to be done and the reasonable cost
thereof shall constitute a lien upon the property.
d. Whatever rights and obligations were acquired by the City with respect
to the easement shall remain and continue in full force and effect and shall in no way be
affected by city's grant of permission to construct and maintain the encroachment structure.
4. Entire Agreement. This Agreement constitutes the entire agreement between
the parties with respect to the subject matter hereof and supersedes and replaces all other
agreements, oral or written, between the parties with respect to the subject matter.
S. Notices. Any notice which is required or may be given pursuant to this
Agreement shall be sent in writing by United States mail, first class, postage pre -paid,
registered or certified with return receipt requested, or by other comparable commercial
means and addressed as follows:

6. Waive . City's consent to or approval of any act or omission by Owner shall
not constitute a waiver of any other default by Owner and shall not be deemed a waiver or

by City of any default must be in writing and shall not be a waiver of any other default
conceming the same or any other provision of the Agreement.

7. Successors and Assigns. This Agreement shall be binding and inure to the
benefit of the parties hereto and their respective legal representatives, successors, and assigns.
Owner agrees to incorporate this agreement by reference in any subsequent deeds to the
property, but any failure to do so does not invalidate this provision.

After review of your encroachment permit application and letter submitted on November
27th, a determination has been made to deny your request to locate a fence within the
City right-of-way along I OOh Avenue. The City does not feel that the requirements of
Chapter 18.70, Edmonds Community Development Code (ECDC) have been met. The
proposed fence location is not seen to be in the public interest, safety and convenience. It
has also been determined that the proposed fence could pose a safety hazard for vehicular
traffic as it would create sight distance problems for vehicles traveling along 100'h
Avenue.

CRITERIA OF PERMIT APPROVAL
The applicant shall follow the noted conditions on the building permit. For applications that do not require a
building permit the following criteria shall be maintained at all times.
> Provide safe pedestrian travel for sidewalk encroachments. Maintain a clear zone of 44 inches minimum.
See definition of clear zone below.
> Exterior light fixtures, banners and flags must be a minimum of 7 feet above City right-of-way.
> Maintain clear landings on the exterior side of all required exit doors of 44 inches or no less than width of
door, measured toward the street.
> No projections into City alleys are permitted unless the projection exceeds 15 feet above pavement
surface.
> Do not block illumination from City light fixtures or hang objects from City light standards.
> Architectural projections from buildings must be approved by the Design Board and conform to Uniform
Building Code requirements. A building permit shall be required for such projections.
> Maintain 3 feet of clearance around fire hydrants, standpipes, manholes, water meters, blowoffs,
cleanouts and valves.
> Bistro dining tables and chairs must be placed in accordance with City Ordinance No. 3293.
> Merchandise racks, espresso carts, flower planters, benches must not be located within the "clear zone".
> Ramps require a separate building permit and must conform to UBC standards.
Clear Zone Definition: Clear Zone refers to an area 7 feet in height and 44 inches in width providing
level, safe walking surface along the public sidewalk (i.e. measuring 44 inches from edge of street tree grates
or newspgper stands toward place of business and from the ground Mp to a height of 7 feet).

Re: Encroachment Permit for Fence Construction
The enclosed application for Encroachment Permit and Building Permit for fence
construction is requested for the three lots at 23910, 23920 and 23926 Firdale Avenue.
The three lots are bordered on both the West by I 00th Avenue which connects to 8th NW
in Shoreline and the East by Firdale Avenue. Both busy streets with the associated noise of
the traffic interrupting the owners peace and quiet.
The location of the fence and encroachment on the City Right of Way is shown on the
accompanying site plans. Presently, on the West side of 100 Avenue there is a level area
about 4 to 5 feet wide before it drops off to the lots. Because of this drop it would block
out very little noise to construct a fence on the property line and thus we are proposing
that the fence be built at the edge of the drop off. Further, it would benefit the City of
Edmonds to have a fence to block the drop off from anyone failing down the hill.
I have checked with all utilities and all the utilities are either in the road or on the West
side of 100 Avenue, so we would not be blocking access to any utility work. There is an
extruded curb on the East side of 100 Avenue that blocks all drainage from coming down
the hill and no erosion problem will be created. Further, the land that the houses are on is
an old gravel pit and has excellent perkability.

ENCROACHMENT AGREEMENT
This ENCROACHMENT AGREEMENT ("Agreement") isentered into between the

("Owner[s]"), in accordance with Chapter 18.70 of the Edmonds Community Development
Code.
1. The PrRertv. Owner is the owner of that certain re * al property located at

particularly described in Exhibit "A7 attached hereto andlincorporated herein by reference.

2. The Easement. The City currently owns an existing easement over, under,
and across Owner's property for street, alley, sidewalk, other
which is described in Exhibit "B" attached hereto and incorporated by reference.
3. The Encroachment. The City hereby covenants and agrees and grants its
permission to Owner or Business Owner to allow A fr" C-a-
to remain in a portion of the City right-of-way/easement. A plat map showing the location of
the encroachment is attached as Exhibit "C" and incorpomted by reference. This Agreement
is subject to the following terms and conditions:
a. The encroachment shall be installed and maintained in a safe and
sanitary condition at the sole cost, risk, and responsibility of the owner and its successors in
interest.

b. The Owner shall agree at all times to indemnify and hold the City free
and harmless from any and all claims, demands, losses, damages or expenses resulting from
the construction, maintenance, use, repair or removal of the structure installed hereunder,
including any loss, damage or expense arising out of (1) loss or damages to property and (2)
injury to or death of persons.
C. The Owner must remove or relocate any part of the encroachment
within ten (10) days or such other time as specified in the notice after receipt of it from the
City Engineer, or the City Engineer may cause such work to be done and the reasonable cost
thereof shall constitute a lien upon the property.
d. Whatever rights and obligations were acquired by the City with respect
to the easement shall remain and continue in full force and effect and shall in no way be
affected by city's grant of permission to construct and maintain the encroachment structure.
4. Entire Agreement. This Agreement constitutes the entire agreement between
the parties with respect to the subject matter hereof and supersedes and replaces all other
agreements, oral or written, between the parties with respect to the subject matter.
5. Notices. Any notice which is required or may be given pursuant to this
Agreement shall be sent in writing by United States mail, first class, postage pre -paid,
registered or certified with return receipt requested, or by other comparable commercial
means and addressed as follows:

6. Waiver. City's consent to or approval of any act or omission by Owner shall

by City of any default must be in writing and shall not be a waiver of any other default
concerning the same or any other provision o IL the Agreement.

7. Successors and. Assins. This Agreement shall be binding and inure to the
benefit of the parties hereto and their respective legal representatives, successors, and assigns.
Owner agrees to incorporate this agreement by reference in any subsequent deeds to the
property, but any failure to do so does not invalidate this provision.

This project consists of three new SFR's and associated walk and driveways being
built on three 8,000 s.f. lots created as a short plat in the late 90's. The plat concept
was for a detention pipe discharging to the Firdale drainage system. As the site is
underlain by a deep deposit of Everett soils, the new impervious is being infiltrated in
accordance with the King County Design manual that states that all lots on outwash
soils shall be evaluated and if feasible infiltrated. The total proposed new impervious
is 10,871 s.f. for all three lots. A TIR Worksheet is attached as Figure 1 and a site
vicinity map is aftached as Figure 2.
2. Preliminary Conditions Summary
The site is in the City of Edmonds and bounded by 100th Ave W and Firdale Ave W.
The site is underlain by Evereft soils.
3. Off -Site Analysis
All flows will be infiltrated. Any overflow of the system will flow in the same drainage
path as it does now to the system along Firdale as originally proposed by the short
plat.
In summary the off -site topographical and vegetative conditions suggest no unusual
drainage or erosion problems.
4. Retention/Detention/Water Quality Analysis and Design
No off -site flows are coming on -site within the area of development. On site flows
are being infiltrated in infiltration trenches. The 98KCSWDM requires residential
sites with less than 22,000 s.f. to be evaluated for infiltration.
The site was evaluated using three soil log holes and three infiltration tests. The
tests showed the soils to be course sand and gravel draining much in excess of the
maximum design rate of 20 in/hr. All holes drained within 5 minutes and could not
actually be kept filled. No mottling or evidence of water was observed in any of the
holes to 4' depth.
The roof downspouts are going to infiltration trenches and the drive runoff is being
sheet flowed to a separate catch basin and infiltration system for each lot. These are

5. Conveyance Systems Analysis and Design
The only conveyance is by 4" PVC as directed in the KCSVVDIVI required downspout
infiltration details.

.Silt fence had been provided on the design drawing downstream of any proposed
disturbance.
The required construction entrance is shown on the plan.

5.1.1 DOWNSPOUT INFMTRATION SYSTEMS

Downspout infiltration systems are trench systems intended only for use in infiltr
downspout drains. They are not designed to directly infiltrate s urface water that could transport sediment
or pollutants, such as from paved areas.
0 BASIC REQUIREMENTS
1. Single family subdivision'projects subject to Core Requirement #3 must provide for individual
downspout infiltration systems on all lots smaller than 22,000 square feet if feasible.
2. The feasibility or applicability of downspout infiltration must be evaluated for all subdivision single
family lots smaller than 22,000 square feet. The evaluation procedure detailed below shall be used to
determine if downspout infiltration is feasible or whether downspout dispersion can be used in lieu of
infiltration. This procedure shall also be used to evaluate all projects proposing to apply roof
downspout controls as flow control BN?s per Section 5.2.
3. For subdivision single family lots greater than or equal to 22,000 square feet, downspout infiltration is
optional, and the evaluation procedure detailed below is only required if downspout infiltration is
being proposed voluntarily. Note: If downspout infiltration is not required or provided on these lots,
then a downspout dispersion system must be provided per Section 5.1.2 (p. 5-9).
C1 PROCEDURE FOR EVALUA71NG FEASIBILITY
1 . A soils report must be prepared by a geotechnical engineer. The report must reference a sufficient
number of soils logs to establish the type and limits of soils on the project site. The report should at a
minimum identify the limits of any outwash We soils (i.e., those meeting USDA soil texture . classes
ranging from coarse sand and cobbles to medium sand) versus other soil types.
2. On lots or sites with no outwash type soils, a downspout dispersion system per Section 5.1.2
be used in-lie��en—.H-dewnsp nfilmation triesired to qualify fAr flAW
control sizing credits, it must be shown to be feasible as described below.
3. On lots or sites containing outwash type soils (coarse to medium sand), additional site -specific testing
must be done. Individual lot or site tests shall consist of at least one soils log, a minimum of 4 feet in
depth (from proposed grade), identifying the SCS series of the soil and the USDA textural class of the
soil horizon through the depth of the log, and noting any evidence of high groundwater level, such as
mottling. Note: This testing is also required on lots or sites where downspout i.rfiltration is being
proposed in soils other than outwash.
4. if site -specific tests indicate less than 3 feet of permeable soil to the seasonal high groundwater
table, then a downspout dispersion system per Section 5.1.2 may be used in lieu of infiltration. If
downspout infiltration is still desired to qualify for flow control sizing credits, the minimum 3-foot
depth to groundwater may be met by using fill material as allowed in the design criteria below.
5. On lots or sites with more than 3 feet of permeable soil to the seasonal high groundwater table,
downspout infiltration is considered feasible and mandatory if the soils are outwash type soils and the
infiltration trencb can be designed to meet the minimum design criteria specified below. Voluntary
provision of downspout infiltration must also meet these design criteria in order to be approved as
feasible.
0 DESIGN CRITERIA
Figure 5.1.1A (p. 5-7) shows a typical downspout infiltration system, and Figure 5.1.1.13 (�. 5-8)
--presents,analternative ftifg�ra�on �y§teni for sites with coarse sand and cobble soils. These systems shall
be designed as specified below.

General
1. Downspout infiltration trenches shall be the following minimum lengths (linear feet) per 1,000
square feet of roof area based on soil type:
Coarse sands and cobbles: 20 LF
Medium sand: 30 LF
Fine sand, loamy sand 75 LF
Sandyloarn 125 LF
Loam 190 LF
2. Maidmurn length of trench shall not exceed 100 feet from the inlet sump-
3. Minimum spacing between trench center lines shall be 6 feet.
4. Bater fabric shall be placed over the drain rock prior to backfilling.
5. Infiltration trenches may be placed in fill material if the fill is placed and compacted under the
supervision of a geotechnical engineer, and if the measured infiltration rate is at least 8 inches per
hour. Trench length. in fill shall be 60 linear feet per 1,000 square feet of roof area. Infiltration rates
shall be tested using the methods described in Section 5.4.1 (p. 5-53).
6. Infiltration trenches are not allowed on slopes steeper than 25 % (4: 1). A geotechnical analysis and
report may be required on slopes over IS% or if located within 200 feet of the top of steep slope or
landslide hazard area
7. Trenches may be located under pavement if a small yard drain or catch basin with grate cover is
placed at the end of the trench pipe such that overflow would occur out of the catch basin at an
elevation at least one foot below that of the pavement, and in a location which can accommodate the
overflow without creating a significant adverse impact per Core Requirement #1 (see Section 1.2.1).
intent: To prevent saturation of the pavement subgrade in the event of system failure.
Setbacks
1 . All trenches must be at least 5 feet from any structure, property line, or sensitive area (except steep
slopes).
2. All trenches must be at least 50 feet from any sensitive area steep slope. This setback may be
reduced to 15 feet based on a geotechnical evaluation, but in no instances may it be less than the
buffer width.
3. For sites with septic systems, infiltration trenches must be downgradient of the drainfield. This

1. The approved plans for.single family subdivision projects must show infiltration trench details and
the approximate location and size of each proposed downspout infiltration system and septic system
(if applicable). Alternatively, details of representative lots may be provided to depict approximate
locations of downspout infiltration systems and septic systems (if applicable).
2. If the proposed project is a subdivision, the following note conditioning single family residential
building permits on compliance with the approved infiltration systems shall be recorded with the plat
or short plat:
