DECLARATION OF COVENANT
Private Stormwater Facility
WHEREAS, the undersigned Declarant(s) have installed a stormwater facility that uses
lawn and other landscaped features to manage the storrawater runoff from said property known
as a "low impact development best management practices (LID BMP)" in lieu of other required
more conventional stormwater systems; and
WHEREAS, the City of Edmonds has allowed installation of the LID BMP, subject to the
execution and recording of this Declaration of Covenant; NOW, THEREFORE,
THE UNDERSIGNED DECLARANT(S), being the owners of the real property ("the
Property") located at the following address: 23917 74th Avenue W.
in the City of
Edmonds, Washington, and legally described on Exhibit A attached hereto and incorporated
herein by this reference as if set forth in full, hereby covenants and agrees, on behalf of
himself/herself/theirselves/itself and his/her/their/its successors and assigns, as follows:
I Declarant(s) warrant that he/she/they are the owners of the property described on Exhibit
A and have the authority to impose this covenant on the property and bind all future
owners, successors, and assigns of the Declarant(s). The Declarant(s), future owners,
successors, and assigns of the Declarant(s) shall be referred to collectively as "Owners."
2. The Owners of the property described on Exhibit A agree that the property contains a
stormwater management facility called a "LID BMP," which was installed to mitigate the
stormwater quantity and quality impacts of some or all of the impervious or non-native
pervious surfaces on the property. "Low impact development" means development
conducted in a way that seeks to minimize or completely prevent alterations to the natural
hydrology of the site. Low impact development includes site planning and design to
reduce alterations of natural soil and vegetation cover, minimize impervious surfaces, and
specific practices that help to replicate natural hydrology such as permeable pavements,
green roofs, soil amendments, bioretention systems, and dispersion of runoff.
3. The Owners of the property described on Exhibit A shall maintain the size, placement,
and design of the LID BMP as depicted on the approved site plan, Exhibit B, and design
details shall be maintained and may not be changed without written approval either from
the Engineering Division of the City of Edmonds or through a future development permit
from the City of Edmonds. Plant materials may be changed to s ' uit individual preferences,
but chemical fertilizers and pesticides must not be used. Mulch may be added and
additional compost should be worked into the soil over time. All costs of such
maintenance and repair shall be the sole responsibility of the Owners.
4. The Owners of the property described on Exhibit A shall inspect LID BMPs annually for
physical defects. After major storm events, the system shall also be checked to ensure
that the overflow system is working properly. If erosion channels or bare spots are
evident, they shall be stabilized with soil, plant material, mulch, or landscape rock. A
supplemental watering program may be needed the first year to ensure the long-term
survival of any vegetated areas. The Owners also shall maintain all vegetation and soils
that are part of the LID BMP so it functions as designed on a year-round basis.
The City of Edmonds is hereby granted by the Owners the right, but not the obligation, to
enter upon the property described on Exhibit A at all reasonable times for the purpose of
inspecting the private stormwater LID BMP facility. If, as the result of any such
inspection the City of Edmonds determines that the LID BMP is in disrepair, requires
maintenance or repair, or is otherwise not functioning as provided in the BMP site plan,
the City Engineer or his designee shall have the right, but not the obligation, to order the
Owners of the property described on Exhibit A to maintain or repair the same.
6. If the City of Edmonds determines that the LID BMP requires maintenance or repair
pursuant to Section 5, the City of Edmonds shall provide notice to the Owners of the
deadline within which such maintenance or repair must be completed. Said notice may
further advise that, should the violator fail to perform required maintenance or make
repairs within the established deadline, the work may be done by the city or a contractor
designated by the City Engineer and the expense thereof shall be charged to the Owners.
The City's officers, agents, employees, and contractors shall have the right, which is
hereby granted by the Owners, to enter upon the property described on Exhibit A in order
to perform such work. The Owners shall bear the cost of all work performed.
7. The Owners shall indemnify, defend and hold harmless the City of Edmonds, its officers,
officials, employees and agents from any and all claims, demands, suits, penalties, losses,
damages, judgments, attorneys' fees and/or costs of any kind whatsoever, arising out of
or in any way resulting from the approval of the LID BMP, the installation and presence
of the LID BMP, and the acts or omissions of the Owners, their officers, employees,
contractors, and agents relating to the construction, operation and maintenance of the LID
BMPs on the property, except for the City's intentional and willful tortious acts, and
waive and release the City of Edmonds from any and all claims for damages and
injunctive relief which the Owners may themselves have now or in the future, by reason
of the construction, maintenance and operation of said LID BMPs.
8. This covenant shall run with the land and be binding upon the Declarant(s), as the owner
of the property described on Exhibit A, and on Declarant's successors and assigns as to
such property.

We understand that the development of a new single-family residence is proposed for the
subject property located at the above address in Edmonds, Washington. The existing
residence on the property is to be demolished to make way for this new residence. We
also understand that runoff on the driveway of the project is to be disposed by infiltration
into'a drywell, and roof runoff and water in footing drain is to be disposed by surface
dispersion over the backyard with a distribution trench and vegetated flowpath method.
At your request, we have completed a geotechnical investigation for the proposed
d6elopment. The purpose of this investigation is to characterize subsurface (sbil 'and
groundwater) conditions of the site, evaluate _impact of groundwater on footing drain
drainage, and determine infiltration rate of the drywell to dispose driveway runoff.
Presented in this report are our findings of the site subsurface conditions, conclusion and
recommendations.

SCOPE OF SERVICES
Our proposed scope of services for the geotechnical investigation comprises specifically
the following: i
1. Review geologic and soil conditions at and in the vicinity of the subject plat site
based on a published geologic map
2. Explore subsurface (soil and groundwater) conditions of the site with backhoe test
pits up to about 7 feet deep (a small backhoe is used due to limited site
accessibility).
3. Evaluate potential impact of groundwater on footing drain and surface dispersion
system to be used for onsite disposal of roof runoff and water in footing drain
based on subsurface conditions encountered by test pits.
4. Conduct one in -situ infiltration test, in accordance with the procedure outlined in
Washington State Department of Ecology 2012 Stormwater Management Manual
for Western Washington, to determine infiltration rate of the targeted soil stratum
for design of the drywell into which runoff over the paved driveway is to be
disposed.
5. Prepare a written report to present our findings, conclusion and geotechnical
recommendations.
A geotechnical staff from our office was on site to direct. subsurface exploration program,
examine soil and geologic conditions encountered, and maintain logs of the test pits.

SITE CONDITIONS
SURFACE CONDITIONS
The general location of the project site is shown on Plate I — Vicinity Map. The site is
situated the gentle to moderately -steep, west bank of Lake Ballinger. It is bounded by
74th Avenue West to the'west, backed into Lake Ballinger to the east, and is adjoined by
residential development to the north and south. The ground within the site generally
slopes down gently eastward towards Lake Ballinger. An existing house with an attached
garage currently occupying the western portion of the site. The backyard from the back
of the house to the lake is mostly covered by lawn grass and washed gravel.
GEOLOGIC SETTING,
The Geologic Map of the Edmonds East and Part of the Edmonds West Quadrangles,
Washington by James P. Minard, published by U. S. Geological Survey in 1983, was
referenced for the geologic and soil conditions at the residence site. According to this
publication, the surficial soil units at and in the vicinity of the project site are mapped, in
descending order towards Lake Ballinger, as Vashon Till (Qvt), Advance Outwash (Qva),
and Young Alluvium deposits, (Qyal).
The geology of the Puget Sound Lowland has been modified by the advance and retreat of
several glaciers in the past and subsequent deposits and erosion. The latest glacier
advanced to the Puget Sound Lowland is referred to as the Vashon Stade of the Fraser
Glaciation, which has occurred during the later stages of the Pleistocene Epoch and
retreated from the region some 12,500 years ago.

The deposits of the Vashon till soil unit were plowed directly under glacial ice during the
most recent glacial period as the -glacier advanced over an eroded, irregular surface of
older formations and sediments. This soil unit is composed of a mixture, of very -dense,
cemented, unsorted clay, silt, sand, gravel, and scattered cobbles and boulders. This soil
unit, however, was not encountered by the test pits excavated on the site. Instead, an
advance outwash deposit underlying a layer of organic silty peat was found at shallow
depth.

The deposits of the advance outwash soil unit, normally underlyijag the Vashon till soil
unit, are composed of stratified sand and gravel with very minor amount of silt and clay,
deposited by the meltwater of advancing glacial ice of the last glacier then overridden by
the still advancing glacier. Due to their generally granular composition, the advance
outwash deposits are of moderately high permeability and drains fairly well. The advance
outwash deposits are generally dense to very dense in their natural, undisturbed state. The
underlying fresh advance outwash deposits in their native, undisturbed state can provide
good foundation support with little settlement expected for light to moderately heavy
structures.
SOIL CONDITION
Subsurface conditions of the project site were explored with three test pits. These test
pits were excavated on October 1, 2015, with a rubber -tracked backhoe, to depths from
6.0 to 7.0 feet. The approximate locations of the test pits are shown on Plate 2 - Site and
Exploration Location Plan. The test pits were located with either a tape measure or by
visual reference to existing topographic features in the field and on the topographic

survey map, and their locations should be considered as only accurate to the measuring
method used.
A geotechnical engineer from our office was present during subsurface exploration, who
examined the soil and geologic conditions encountered and completed logs of test pits.
Soil samples obtained from each soil layer in the test pits were visually classified in
general accordance with United Soil Classification System, a copy of which is presented
on Plate 3. Detailed descriptions of soil layers encountered during site exploration are
presented in test pit logs on Plates 4 and 5.
Test Pits I and 2, located in the backyard behind the existing house, encountered a layer
of loose to medium -dense fill, from about 2.0 to 2.4 feet thick. This layer of fill is
underlain by a silty peat containing fragments of decayed roots and wood debris, about
1.4 to 1.5 feet thick. Underlying the silty peat to the depths explored is an advance
outwash deposit of medium -dense to dense, slightly -silty, fine to medium sand with trace
gravel and occasional cobble.
Test Pit 3, located next to the proposed drywell near the southwest comer of the project
site, encountered a thin layer of topsoil covering the ground. The topsoil is underlain by a
layer of weathered soil of medium -dense silty fme sand with trace gravel, about 4.0 feet
thick. Underlying the weathered soil to the depth explored is an advance outwash deposit
as encountered by the other two test pits.

GROUNDWATER CONDITION
Groundwater was not encountered by any of the three test pits excavated on the site. The
medium -dense to dense advance outwash deposit underlying the site at shallow depth is
of relatively high permeability and would allow stormwater to seep through easily.
Stormwater infiltrating into the advance outwash deposit would perch on a underlying
impervious soil unit on which the nearby Lake Ballinger is formed. - Therefore,
groundwater under the project site would be closely influenced by precipitation and water
level in the lake.

EWACT OF GROUNDWATER
Water in footing drain of the new residence is to be conveyed into the distribution trench
and disposed by surface dispersion over the vegetated. backyard. We estimate the depth
of the footing drain on the backside of the new residence will be at about, 18 to 24 inches,
which would put bottom of the footing drain at about Elev. 2.83.5 to 283.0 feet. The top
and bottom of the distribution trench will be at Elev. 282.3 and 280.3 feet. Based. on
these elevations and the subsurface conditions encountered by the test pits as described
above, it is our opinion groundwater should have little or no impact on footing drain or
the proper functioning of the distribution trench and surface dispersion system.
DISPOSAL OF DRIVEWAY RUNOFF
General
Storm runoff over the paved driveway is to be disposed onsite-by infiltration into a
drywell to be located near the southwest comer of the project site. The bottom of the

drywell should be excavated ay least one foot into the underlying advance outwash
deposit encountered by Test Pit 3. The infiltration rate of the advance outwash deposit
was determined by an in -situ infiltration test located next to the drywell.
In -situ Infiltration Test Pit
We performed one in -situ infiltration test on October 1, 2015, to determine the infiltration
rate in the targeted advance outwash deposit to be used for design of the drywell. The
location of the infiltration test, IT- 1, is shown on Plate 2. The test pit was excavated next
to Test Pit 3 with its bottom cut about 12 inches into the target advance outwash deposit.
Groundwater was not encountered by the pit. Dimensions of the test pit and soil
condition at bottom of 'the pit are presented in the table below:

Infiltration Test Procedure
The in -situ infiltration test was conducted in accordance with the procedure outlined in
Washington State Department of Ecology 2012 Stormwater Management Manual for
Western Washington.
The infiltration test pit was filled with water to at about, 24 inches deep for hours to soak
the soil underneath the pit. Clear tap water was used in the test. The infiltration test was

then conducted in the pit by falling head method with the initial water level at about 24
inches deep. A steel bar was placed across the top of the test pit and water levels from
the steel bar were measured in the beginning and at the end of a one -hour period.
Test Results
The initial infiltration rate, Kat initial, in inches per hour (iph), was thus determined. The
results of the infiltration test are presented in the table below:

Design Inffitration Rate
As shown in the equation above, the Kat initial value determined by the infiltration test is to
be modified according to correction factors include: site variability and number of
locations tested (CFv), uncertainty of test method (CF), and degree of influent control to
prevent siltation and bio-buildup (CF,n), are to. be applied on Kt initial value to get the
design infiltration rate, K,at'. According Table 3.3.1 of the DOE Manual, CF, = 0.33 to
1.0, CFt = 0.5 for small scale test, and CFm = 0.9. Use a middle value 0.65 for CF, thus,

CFT =(0.65) (0.5) (0.9) = 0.29. The K,a, value for the infiltration test was thus calculated
and is shown in the table above. Based on the above analysis we recommend an
infiltration rate no more than 2 25 iph of the targeted advance outwash deposit be used for
design of the proposed drywell.
DRYWELL CONSTRUCTION RECOMMENDATIONS
The bottom of the proposed drywell should be cut at least 12 inches into the underlying
advance outwash deposit of light -gray slightly -silty, fine to medium sand with some
gravel. This would require the drywell to be cut about 5.5 feet deep or more. The
drywell should be set back at least 5 feet from property lines and 10 feet from adjacent
building foundations or utility trenches.
The side walls (but not the bottom) of the drywell should be lined with a layer of non-
woven filter fabric (Mirafi. 140NS). The bottom of drywell should then be covered with a
layer of amended soil at least 12 inches thick if water quality control is critical. The
amended soil should have at least 40% of compost tilled into the rain garden ponds native
soil to achieve an organic content of 10% by dry weight.
The remaining drywell should then be filled with 3/4 to 1-1/2 inch, clean, washed gravel
to within about 12 inches of the top of drywell. The top of the gravel fill should also be
covered with a layer of the same filter fabric. The rest of the drywell may be filled with
onsite clean soil tamped to a non -yielding state. A. 6-inch perforated rigid PVC pipe, with
its end capped, should be inserted in the center of the drywell to disperse water into the
drywell. -The trench of the tightline carrying* stormwater from the driveway catch basin to

the dispersion pipe should be constructed with a clay dam to prevent water in the drywell
from flowing back to the catch basin.
LIMITATIONS
This report has been prepared for the specific application to the subject project for the
exclusive use by Almark Corporation, and its associates, clients, representatives,
consultants and contractors. The conclusions and interpretations in this report, however,
should not be construed as a warranty of the subsurface conditions. The scope of this
report does not include services related to construction safety precautions and our
recommendations are not intended to direct the contractor's methods, techniques,
sequences or procedures, except as specifically described in this report for design
considerations.
Our, recommendations and conclusion are based on the geologic and soil conditions
encountered by the test pits excavated on the site, our experience and engineering
judgment, and the infiltration test results. The conclusions and recommendations are
professional opinions derived in a manner consistent with the level of care and skill
ordinarily exercised by other members of the profession currently practicing under similar
conditions in this area. No warranty, expressed or implied, is made.
The actual subsurface conditions of the site may vary from those encountered by the test
pits excavated on the site. The nature and extent of such. variations may not become
evident until construction starts., If variations appear then, we should be retained to re-
evaluate the recommendations of this report, and to verify or modify them in writing prior

PROJECTSUMMARY.
The project site consists of about 9,430 square feet of land and is currently occupied by a single family
residence located in the western half of the lot. The vegetation consists primarily of lawn and small shrubbery,
with one tree located along the southern property line. The site is bordered by single family lots to the north
and south, while 74th Avenue W. borders the site's western boundary and Lake Ballinger borders the eastern
boundary. Access to the site is from 74th Avenue W. via an existing asphalt driveway. The site generally
slopes east towards Lake Ballinger, at approximately 9-10%. Run-off from the site sheet flows in the same
direction, with no signs of a defined channel.
Existing Features Summary:

The proposed project is to redevelop the site by removing the existing structures and constructing a new single
family residence and associated site paving totaling approximately 3,333 square feet of new and replaced
impervious area. Access will be provided by a renovated driveway located at the western boundary of the site.
Landscaping and lawn will surround significant portions of the new house and will stabilize the site upon
building construction. See the submitted civil construction plans for exact building locations.
Summary of Project Minimum Requirements:
5.1 Small Site Minimum Requirement #1 — Preparation of Stormwater Site Plan. The proposed site
development consists of disturbing approximately 0. 147 acres of land and creating approximately 3,333 square
feet of impervious surfaces by constructing a new single family residence and associated site paving. The
project is classified as a Category I Small Site Project, per the City's classification system, as it involves less
than 5,000 square feet of new and replaced impervious surfaces. A site development plan has been prepared
and is submitted alongside this report.
5.2 Small Site Minimum Requirement #2 — Construction Stormwater Pollution Prevention. A summary of
the site's proposed grading and erosion control measures along with a grading estimate are included in section
D. Grading and Erosion Control Summary. The grading quantities are estimated to be 100 CY of cut and 100
CY of fill. The total site disturbance area of the project is less than one acre, thus a formal Notice ofIntent
application for NPDES coverage will not be made to the Department of Ecology.
5.3 Small Site Minimum Requirement #3 — Source Control of Pollution. No extraordinary measures are
required for the proposed single family residence as the pollution generating impervious surfaces associated
with the project are below the 5,000 square feet threshold.

5.4 Small Site Minimum Requirement #4 — Preservation ofNatural Drainage Systems and Ouffialls. The
project site is located in the Lake Ballinger watershed basin. Runoff currently sheet flows east towards Lake
Ballinger across the existing lawn. The project proposes to infiltrate and disperse stormwater runoff onsite,
reducing the site's impact on the downstream system.
5.5 Small Site Minimum Requirement #5 — Onsite Stormwater Management. Through a collection of pipes,
catch basins and downspout connections, the site's impervious surfaces will be collected and routed to an
onsite drywell and dispersion trench. See additional discussion for on -site stormwater management in Section
C.
5.6 Small Site Minimum Requirement #6 — Runoff Treatment. This project is exempt due to its

5.7 Small Site Minimum Requirement# 7 —Flow Control. For this project flow control has been provided by
an onsite drywell and dispersion trench. These drainage facilities are sized per the city of Edmond's LID
simplified sizing tables, and volume III of the Department of Ecology's stormwater manual. See section C for
stormwater sizing details.
5.8 Small Site Minimum Requirement #8 — Wettand Protection. A wetland (category 4) exists on the eastern
quarter of the lot, adj acent to Lake Ballinger. A 3 5' wetland buffer is shown on plan, and with the exception of
a dispersion trench, no new construction is proposed within the area. The encroachment of the dispersion
facility within the extent of the buffer is limited to 25% per section 23.50.040-8C of the City of Edmonds
Development Code.

STORM DRAINAGE SUMMARYAND CALCULATIONS.
Site runoff will be collected onsite in a system of roof and area drains and routed to an onsite drywell and
dispersion trench. The drywell is sized per the city of Edmond's LID simplified sizing table, see next page, and
the dispersion trench is sized per volume III of the Department of Ecology's stormwater manual.
The drywell is designed to accommodate runoff from the driveway exclusively. The driveway is sloped to a
type one catch basin with separator, set five feet back from the proposed garage. Runoff is then routed directly
to a drywell located at the southwest comer of the lot. A minimum infiltration rate of 0.5 in/hr has been
assumed for the sizing of this facility.
The dispersion trench is sized in order to accommodate runoff from the building roofs. Downspouts are routed
alongside the proposed residence and combined in a type one catch basin located within the dispersion trench.
The trench is located within the wetland buffer, east of the proposed residence.
Areas of new paving for the patio and walkway will slope away from the building into the adjacent lawn.
These areas are mitigated by sheet flow dispersion, incorporating a minimum vegetated flow path of 10 ft.

GRADING AND EROSION CONTROL SUMMARY.
The project will require minor grading in order to construct the proposed single family residence and
associated site paving. Standard erosion control measures are proposed to be used during construction. The
primary erosion and sediment control "best management practice" (BMP) during construction will be
proper soil stabilization methods. Exposed soils shall be stabilized by application of effective BMP's that
protect the soil from the erosive forces of raindrops, flowing water, and wind.
Appropriate BMPs include, but not limited to, temporary and permanent seeding, sodding, mulching, plastic
covering, erosion control fabrics, matting, soil application of polyacrylamide (PAM), the early* application of
gravel base on areas to be paved, and dust control. The contractor shall select a soil stabilization method best
suited for the particular situation. Stock piles must be stabilized and protected with sediment trapping
measures. In addition, site containment of exposed soils shall be sustained by using silt fence barriers along
the down -slope boundaries of the site's disturbance areas.

OPERATION AND MAINTENANCE GUIDELINES:
Operation and Maintenance Requirements: These guidelines are intended to provide operation and
maintenance instruction for the new single family residence located at 23917 74h AVE W. and its storm
drainage control facilities. The owner is responsible for maintenance of storm drainage facilities within the
property. The owner is not responsible for maintenance within the public right-of-way.
This manual is not comprehensive. Although it explains the intended operation of the various components of
the drainage system, and suggests a routine of inspection and maintenance, it cannot anticipate every problem.
Once a historical record of maintenance is established, it may be prudent to alter the routine. It is
recommended that maintenance records be kept, and that the records be reviewed periodically.
Concept of Operation: The drainage design is shown and described in the final site development engineering
plans and report. The approved site development plans and report should be retained by the owner and used as
a referenceto identify drainage facilities outlined in this manual.
Conveyance Systems. The design objective in pipe sizing was to convey the I 0-year storm without the water
surface exceeding the overflow elevation of the proposed facilities. Frequent overtopping of the pipe system in
a particular area might indicate a downstream blockage. Overtopping of the drain systems at the yard drains or
cleanouts is an indication that maintenance is required.
Recommended Inspections of Facilities. The following are inspection guidelines for the drainage system. The
inspections should occur prior to the winter rain season, leaving sufficient time to correct any detected
maintenance problems, and at the end of the season to determine the effect of the season's runoff. Once a
historical basis is developed the frequency of inspection may be modified as necessary.

intended to be conditions for determining if maintenance actions are
required as identified through inspection. They are not intended to be
measures of the facility's required condition at all times between
inspections. In other words, exceedence of these conditions at any time

Stormwater Dispersion Trench in Wetland Buffer
Dear Mark:
The purpose of this letter is to respond to Item #1 of the September 3, 2015 Plan
Review Cominents from Sean Conrad, Associate Planner with the City of Edmonds;
It is my undet!,itanding that as part of the Proposed project, a stormwater dispersion
trench must tc installed within the outer portion of the 35-foot standard buffer of
W6tIand A, a 0,ategory IV wetland. The Edmonds Community Development Code
(ECDC 23.50 040.F.8.c) allows dispersion trenches within the' outer 25% of
Category IV ti;Jffers provided that:
i. No otil i or location is feasible; and
Per the storm-vater engineer, the dispersion trench must be located within the
wetland buffei due to topographic constraints and the presence of a 10-foot wide
City of Edmords sewer easement. The trench was designed to be as far from the
wetland as po;12sible and would be installed within the existing yard immediately
adjacent and downslope of the sewer easeme'nt.
ii. The 10(',zition and function of such facilities willi. not degrade the functions or'
valuez. of the wetland.
'The dispersior trench would be installed within an existing mowed lawn and would
not require thE removal of any significant native vegetation. In addition, since the
trench has been designed to convey runoff from non -pollution generating surfaces
(i.e., the roof ol: the house) there should be no Post -construction water quality
degradation wilbin the wetland,

On October 7, 1993, 1 spoke with Reiter's Construction regarding the specifics of the
proposed project. The contractor said that he does not know the extent of the project until
the decking and stringers are removed from the dock. At that time the pilings are inspected
and it is determined whether or not they will need to be replaced.
Since SEPA review would not be required for a repair of decking and stringers, it does not
seem reasonable, nor the intent of SEPA regulations, to require SEPA because the pilings
may possibly be replaced. Nor does it seem reasonable, nor the intent of SEPA, to stop the
project in progress and require a SEPA review should the contractor find that the pilings
need to be replaced. Since the dock is not going to be altered in size, shape, or location,
the City of Edmonds makes the following decisions:
SHORELINE MASTER PROGRAM:
After review of the project, speaking with the contractor about the project, and
review of WAC 173-14-040 it was determined that the subject project is exempt
from requiring a Shoreline Substantial Development Permit.
SEPA:
After review of the project, speaking with the contractor about the project, and
reviewing WAC 197-11-800(3), it was determined that the subject project is a
Categorical Exemption of the State Environmental Policy Act.
