11. FINDINGS OF FACT AND CONCLUSIONS
A. SITE DESCRIPTION
1. Site. Development and Zoning:
a. Facts:
(1) Size and Shape: The subject property i& approxii-nately 9,375square
feet in area and gcrorally rectangular in shape with approximately
75-feet of frontage On 104th StreeT SW, frontage on JoArth J?lj1C.e
West and approximately 115-feet in depth along the north property
line and 135-feet in depth along the south property line which is
adjacent to 241st Street Sotithwest (see Exhibit A. Attachnients 3
and 4).
(2) Land 'Llse: The subject property is currently developed with an
oxisting detacbed single-f�Lmily residence (see Exhibit A, Attachment
4
(3) Zoning: The subject site is zoned Single-Farnily Residential - 8,000
squarc feet minimum lot size URS-8) (see Exhibit 0.
2. Neighboring Development and Zoning:
a. Facts:
(1) North: The area is developed with. single-family re,,ddences and
zoned RS-8 (see Exhibit A, Attacbment 1).
(2) South; The arca is developed with single-family rapidenceF and
zoned RS-8 (see Exhibit A, Attachment 1). -

B. STATE ENVIRONMENTAL POLICY ACT QSEPA)
1. a. Fact, The applicaLion is exempt frorn SEPA pursuant to WAC 197-11-

standards of this Chapter pursuant to the procedures set forth in
ECDC Chapter 20.85 (Variances), Chapter 20.85 of the ECDC sut5
forth tile mechanism whereby a provision of the Code may be varied
ori a case.by-cue basis if the application of the provision would
result in an unusual and unreasonable hardship.
(2) ECDC Section 20.85,010 establishes the decisional criteria with
which a variance request must Comply in order to be granted by the
Hearing Examiner. These cfiteria include., a special circunistance
must exist (special circumstances include: sjzc., shapc, topography.
location or surroundings of tile Property and public necessity for
public structures), no special privilege is granted; the propos'al is
inconsistent with the Comprehensive Plan and the Zoning Code; the
proposal will not be detrimental; and, the, proposal is thc inininiam
necessary to allow reasonable use of thesubjcct property.
(3) Variancc may be used to modify bulk standard.-;. They may not be.
used to modify use or proccdural rcquircments.
(4) The applicants reque.-�t to modify the minii-nurn required streCt.
setback requircmcm for the RS-9 zone from 25-feet to 20-feet for die
construction of an approximate 936 square foot dcuiched accesisory
building with attached carport (see Exhibit A, Attachments 2, 4 and
5).
(5) The setback requirements for the. R,9-8 zone, also requirc a mininiurn
7.5-foot setback from side property lines. The applicant has sliown a
5-foot setback from the north property line which is a side setback,
but has not requested a variance for this gctback- Thercfore. the
proposed accessory structurc does not meet the L-ninimuni required
setback fromside property iines (see Exhibit A, Attachment 4).
(6) The subjoct property is also required to have a !�treet setback of 25-
feet from the-, South property linc, which is adjacent to 24 1 st Street
Southwest. The proposed drawings for the accessory stnicturc do
not provide a dimension for this setback (see Fxhibit A, Attachment
4).
(7) The applicants declarations in response to the required review
criteria are contained on Exhibit A, Attachment 5-
(S) The applicant has not indicated what tile pr�)poscd licight of thr,
accessory structure will be. The maximum pen-nitted neight for an
accessory structure in an RS-9 zone is 15-fect above average
building grade.
b. Conjusigns:
(1) SpIcial Circumstances - Spec!,W eircurnstances do not cxist on the
subject property which would preclude the reasonal)le use of the
subject property as a single-family residence. The subject property
contains considerable developable area which the applicant could us

without the necessity of being granted a variance. The need for the
variance appears to be directly related to the size of the proposed
accessory structure and not duc to any specific con�traints on the
placement of the proposed accessory structure related to sorne unique
feature of the property itself, which limits the options for the
applicant to enjoy reasonable of the site.
However, some case could be made re-garding special circumstances
of the subjact propffrty related to the subject property having streets
abutting what, would be traditionally considered the front property
line (104th Place West) and the rear property line (104th Street SW).
Typically, propertics that tend to havc two street setbacVs are corner
lots, However, in this situation, the streets abutting the subject site
are opposite each odicr, which results in a pinching down effect
toward the center of the site. The site is large Enough though to
accommodate a garage over 26 feet in depth if it is attached to the
bouse or a gtydge with a depth of 23 �i frct If tliere is 5 feet of
clearance between the house and a detached garage.
(2) Special Privilege - Approval of the requestedvarianer, would appear
to providc the applicant with a special plivilege. The applicant"s
have riot provided any information to show that other properties in
the vicinity of the subject property have been granted similar
privileges. It is acknowledged that there w-e otli8r garageF in the
vicinity which are closer than 25 feet froni the right -of -way,
Howevcr, tho5,e 8aragrs may have been built under different
regulations lyefore those properties were annexed to the City of
Edmonds. That does nut. serve as a basis for grant of a variance.
(3) Zoning Code and the Commehensive Plan - The requested variance
is not consi5tent with the Comprehensive Plan (see Section E below)
or the Zoning Code.
(4) Not Detrimental - Approval of the requested variance could result in
establMing a precedent in the neighborhood that when applicd to
another property could be specifically detrit-nental to adjacent
property owners or the public as a whole,
(5) Minimum Reguirpd - It appears that there is sufficient vacant ;.11*ea oil
the subject propelty whereby the applicant could construct a
narrowar garage ,,tructure or place it in a mannef thrit could cornply
with the required setback&
Additionally. since the proposecl stlu�-ture jippearx to be of slifficiellL
size to accommodate three buys plus an attuchcd carport, the
proposcd garagr, would appear to be somcwhat lar er than a typical

Furthermore, the depth of the garagc. could be reduced in depth and
still provide sufficient depth to park a vehicle and comply with the
minimum street setback requirements.
Therefore, the request as submitted does not appear to be the
minimum necessary to allow lie applicant to maintain rea.sonable
use of the subjut property.
D. TECHNICAL COMMITTEE
1. a.. Facts:
(1) The Engineering Division has submitted comments related to the

subject application. these comments are provided a� Fxhibit A,
Attachment 6.
(2) Even though specific comments were not provided by all
Departments or Divisions within the City. it is still die apPliCiltitS
responsibility to comply with applicable City development
regulations at the time of auy building permit submittal.
b. Conclusio1q: The applicant should comply with all mquirements placed on
the proposed dcvclupmeat by othcr Doparti-nentsMivisions of (lie City.
E. COMPREHENSIVE PLAN (ECDC)
a. Fact; The subject property is designated as "Single Family Snuill Lot."
b. Conclusion: The proposed use of die subject property is consistclit with
the typical uses envisioned with single-family development. therefore, it i's
consistent with the existing Comprehensive Plan Lind "ex designation for
the subject site,
2, a, Facts: The Comprehensive Plats, Residential Development section,
identifies goals and policies which relate to "Residential Development" in
the City. Specific goals and policies are discussed in detail below;
(1) Soction B statcs as a goal of the City that- "High quality residential
development which Is appropriate to the diverse lifestyles of
Edmonds re.Fidents should be maintained and promoted. . - -
(2) page 31, subsection B.5.0 5t4tos, "Stable property miues nuist not

structure and is not related to a requeA to seek relief from the required
