The above project has been determined to be exempt fr4/the requirement to obtain a Shoreline
Substantial Development Permit under WAC 173-27-040(2)(g), which states:
Construction on shorelands by an owner, lessee or contract purchaser of a single-family
residence for their own use or for the use of their family, which residence does not exceed
a height of thirty-five feet above average grade level and which meets all requirements of
the state agency or local government having jurisdiction thereof. "Single-family
residence" means a detached dwelling designed for and occupied by one family including
those structures and developments within a contiguous ownership which are a normal
appurtenance. An "appurtenance" is necessarily connected to the use and enjoyment of a
single-family residence and is located landward of the ordinary high water mark and the
perimeter of a wetland. On a state-wide basis, normal appurtenances include a garage;
deck; driveway; utilities; fences; installation of a septic tank and drainfield and grading
which does not exceed two hundred fifty cubic yards and which does not involve
placement of fill in any wetland or waterward of the ordinary high water mark. Local
circumstances may dictate additional interpretations of normal appurtenances which shall
be set forth and regulated within the applicable master program. Construction authorized
under this exemption shall be located landward of the ordinary high water mark;
Robert Fritzen, Shoreline Planner with the Department of Ecology, has stated that this has been
interpreted to include additions and remodels to existing single-family houses, provided that they
are normal appurtenances to single-family dwellings.
STREET HLE
This exemption is not being sent to the Department of Ecology because it appears to City staff
that it is not subject to U.S. Army Corps of Engineers section 10 permit under the Rivers and
Harbors Act of 1899 (the provisions of section 10 of the Rivers and Harbors Act generally apply
to any project occurring on or over navigable waters. Specific applicability information should
be obtained from the Corps of Engineers.) Nor does the project appear to City staff to require a
section 404 permit under the Federal Water Pollution Control Act of 1972. (The provisions of
section 404 of the Federal Water Pollution Control Act generally apply to any project which may
involve discharge of dredge or fill material to any water or wetland area. Specific applicability
information should be obtained from the Corps of Engineers.) Robert Fritzen has advised us that
per WAC 173-27-050, no letter is required to be sent to Department of Ecology.
While this letter provides an exemption from the need to obtain a Shoreline Substantial
Development Permit from the City of Edmonds, it does not evaluate whether other State and
Federal approvals are required and leaves that responsibility to the applicants.

A. INTRODUCTION: Geoffrey and Maureen Baris have applied for an Accessory Dwelling
Unit (ADU) Permit to obtain approval to add an Accessory Dwelling Unit (ADU) to their
home at 24103 74th Ave. W. The ADU that will be within an addition to the existing
residence as shown by the floor plans (Attachment 2). This review consisted of evaluating
the proposed ADU for compliance with the ADU criteria provided in ECDC Chapter 20.2 1.
The review determined that the ADU application meets all of these criteria.
B. ANALYSIS: Section 20.21.030 of the Edmonds Community Development Code provides
the following criteria by which the Accessory Dwelling Units are to be reviewed.
1. Location and Appearance: Accessory Dwelling Units must be located within or
attached to single-family dwelling units and the design of the ADU must be incorporated
into the design of the primary residence so the single-family character and appearance of
the residence is maintained. Accesory Dwelling Units must be located within or
attached to single-family dwelling units. New entrances are to be placed at the rear or
side of the home whenever possible. (ECDC 20.21.030.D)
The site plan (Attachment 1) shows the existing Barris residence affd the proposed
addition onto the east side of the house. This two-story addition consists of adding
living area to the primary residence on the upper, main floor and adding an accessory
dwelling unit within the lower floor portion of the addition. Refer to the lower floor and
main floor plans (Attachment 2). Access to the ADU is provided by a door to the
outside at the rear (east) side of the house. The ADU can also be accessed by a stairway
within the house.

In comparing the elevation drawings that show the addition to the house that will contain
the ADU (Attachment 3) and the photographs of the existing residence (Attachment 4),
it is apparent that the ADU is incorporated in the design of the primary residence and
that the single-family character and appearance of the residence will be maintained. The
house will appear larger and different, after the addition. However, this would be true
with any significant expansion to the home, even if the addition did not contain an
Accessory Dwelling Unit. After the addition of the Accessory Dwelling Unit, it should
not be apparent from the exterior that the house contains an additional unit.
2. Number of existing Accessory Dwelling Units on site: A single-family dwelling may
have no more than one accessory dwelling unit per lot (ECDC 20.21.030). The proposal
will result in only one ADU.
3. Size: Accessory Dwelling Units that exceed 800 square feet in area, require the
permission of the Planning Manager. At the discretion of the Planning Manager, an
ADU may be allowed to exceed 800 square feet if it is located only on one Door and
does not occupy more than 50% of the entire residence. The proposed ADU is 825.75
square feet in area. This is about 20% of the total area of the entire residence which is
approximately 4,083 square feet. The ADU is also located entirely on the lower floor.
A request to exceed the 800 square feet has been reviewed and approved by the
Planning Manager. ADU's are also only allowed to have two bedrooms. The proposed
ADU has one bedroom.
4. Parking: A single-family residence with an Accessory Dwelling Unit requires 3 parking
spaces. One of these spaces is allowed to be a tandem or stacked space. The residence
contains a two -car garage and the driveway pad in front of the garage can provide a
tandem space to meet the requirement for the third space. Refer to the elevation
drawings (Attachment 3) and the site plan (Attachment 1).
5. Occupancy: A requirement of ADU's is that the owner must reside in either the primary
dwelling or the accessory dwelling unit for more than six months out of the year. A
condition requiring the homeowners to sign an affidavit (Attachment 7) that states that
they occupy one of the units for more than six months of the year is a standard condition
for the approval of an Accessory Dwelling Unit and would be warranted in this case.
Another occupancy requirement of ADU's is that the total number of occupants in the
primary residence and in the Accessory Dwelling Unit may not exceed one "family," as
defined by the Edmonds Community Development Code (ECDC). This definition has
been included as Attachment 5 but briefly, means two or more persons who are related or
a group of five or fewer persons who are not related.
6. Safety, Lipht, Ventilation:, The proposed ADU addition will require a building pen -nit
application. The granting of this permit and the associated inspection by a City Building
Inspector will ensure that the Accessory Dwelling Unit meets the requirements of all life -
safety codes and standards.

C. PUBLIC COMMENT: The review of an Accessory Dwelling Unit permit requires public
notice of the staff decision. A public comment period for this application was provided from
November 4, 2004 to November 11, 2004. One comment letter was received and has been
included as Attachment 6. Following are the main concerns were raised in the letter:
1. Residency / concern that the owner will not live at the property:
A condition of approval of the permit is that the owner will be required to live at the
property for more than 6 months out of the year. See Section B.5 of the Staff Report
above and Section DA of the Staff Report below.
2. Appearance:
The ADU will be within an addition to the existing residence and meets the ADU criteria
having to do with appearance. See Section B. I of the Staff Report above.
3. The applicants do not meet the ADU "intentions":
What the letter is reffering to here are some general purposes for ADU's. These are not
criteria that are required to be demonstrated in order to be granted an ADU permit. The
criteria are listed above in Section B. 1-6 of the Staff Report.
4. Parking:
See above Section BA of the Staff Report addressing parking.
D. DECISION: Approved with the followin2 conditions:
1. A building compliance permit and inspection through the City Building Division is
required prior to occupancy of the Accessory Dwelling Unit.
2. The property owner(s) must have the covenant which provides notice to future
owners of the limitations of the Accessory Dwelling unit permit and the restoration
of the site to a single-family dwelling without an ADU in the event that any
condition of approval is violated, recorded with the Snohomish County Auditor
This form has been included at Attachment 8. A recording fee is required.
3. The Accessory Dwelling unit permit is transferable to future owners of the
residence unless there is a violation of any conditions of approval.
4. The property owners must sign and file with the City, a notarized affidavit that
states that they reside at the primary residence or the ADU for more than six
months out of the year. All new property owners must file their own affidavit of
occupancy with the City of Edmonds Planning Division. For an example of this
form see Attachment 7.
5. This permit shall expire automatically if any of the following issues arise:

a. The Accessory Dwelling unit is substantially altered and is thus no longer in
conformance with the plans and drawings reviewed and approved by the
permitting authority and building official.
b. The subject site ceases to maintain the required number of parking spaces.
c. The property owner ceases to reside in either the primary residence or the
accessory dwelling unit, the owner -occupied unit is rented, or the current (or
future) owner fails to file the affidavit required under ECDC 20.21.025.A. I with
the City.
This preliminary decision shall become final as conditioned above, unless a written appeal is
received as described in Section D of the Staff Report below.

Renuest for Reconsideration:
Section 20.95.050.13.2. provides for Staff to reconsider his decision or recommendation if
a written request for reconsideration is filed by the applicant within ten (10) working days
of the date of the initial decision. The reconsideration request must cite specific

appeal shall be made in writing, and shall include the decision being appealed along with
the name of the project applicant and the date of the decision, the name and address of the
individual or group appealing the decision, their interest in the matter, and reasons why
the appellant believes the decision to be wrong. The appeal must be filed with the
Development Services Director within fourteen (14) calendar days after the date that the
decision is issued. Appeals are presented to the Hearing Examiner.
Timeframeq:
The time limits for Reconsiderations and Appeals run concurrently. If a request for
reconsideration is filed before the time limit for filing an appeal has expired, the time
"clock" for filing an appeal is stopped until a decision on the reconsideration request is
completed. Once the staff has issued their decision on the reconsideration request, the
time clock for filing an appeal continues from the point it was stopped.
