These Guidelines supersede any previous Guidelines.
GUIDELINE FOR LONG-TERM OUT -OF -SERVICE
1. Permit shall be obtained from the City of Edmonds.
2. All product shall be removed from the UST, all sludge shall be
cleaned out of tank, and tank shall be inspected by Edmonds Fire
Department.
3. Electrical power shall be removed from all equipment connected to
USTs.
4. Vent lines -shall remain open and all other openings to tanks shall
be secured by locking.
GUIDELINE FOR ABANDONMENT IN PLACE
1. A request in writing to the Edmonds Fire Department for permission
to abandon in place shall take place prior to applying for a permit.
2. Apply for and receive a permit for removal from the City of Edmonds.
NOTE: Tank remover must have a Washington State Contractor's Li-
cense as an excavator.
3. All sources of ignition shall be avoided during commodity removal
and excavation of tank.
4. Provide a minimum of two (2) fire extinguishers with a minimum class
rating of 20:BC within 50 feet of the removal operation.
5. Remove all product from the tank.
6. Commodity, or mixture of commodity and water, shall NOT be drained
into a street, gutter, sewer, or dumped at excavation site.
7. Inert the tank with CO by a method such as dry ice at the ratio
of 1.5 lbs. per 100 gailons.
8. The area adjacent to the excavation shall be barricaded against the
entrance of unauthorized persons.
9. The atmosphere of the tank shall be tested to assure that the LEL is
below 20%.
10. Remove all flammable liquid from all connected lines; use particular
care in emptying product lines to avoid spilling product into the
excavation.
11. The tank shall be opened upi preferably with non -sparking tools, to
accommodate cleaning of sludge from tank.
Guideline for Abandonment in Place (Con't)
12. Requests for inspection by the Edmonds Fire Department shall be a
minimum of 24 hours in advance.
13. Take soil samples from beneath the UST prior to filling the tank
with the inert material.
14. Fill the UST with an inert material such as two sack$' concrete slur-
ry.
15. Remove any fill pipes.
16. Remove all vent lines and piping that is possible.
17. Submit completed Contractor's Certificate to the Edmonds Fire Depart-
ment within five (5) working days.

8. The area adjacent to the excavation shall be barricaded against the
entrance of unauthorized persons.
9. The tank shall be opened up, preferably with non -sparking tools, to
accommodate cleaning of sludge from the tank.
10. Remove all flammable liquid from all connected lines; use particular
care in emptying product lines to avoid spilling product into the
excavation.

Guideline for Removal (Con't)
11. Request for inspection by the Edmonds Fire Department shall be a
minimum of 24 hours in advance.
12. Soil samples may be taken either before or after the tank has been
removed. Soil samples need to be analyzed at a laboratory for the
appropriate by-products.
13. Once the tank has been removed, the Edmonds Fire Department inspec-
tor shall examine the condition of the tank's exterior as well as
the excavation.
14. Contractor - shall supply the Edmonds Fire Department with a completed
Contractor's Certificate within five (5) working days, plus. -c-opies
of soil sample results if inspector deems necessary.
15. If contamination is noted by contractor, he shall notify the Depart,.-
ment of Ecology within 24 hours. (Telephone: 867-7000)�_ollwa6
16. Any soil that appears to be contaminated (as detected by odor, dis-
coloration or instrumentation) will be separated and stockpiled at
thesite on suitable material. All contaminated soil shall be prop-
erly disposed of as directed by the Fire Marshal or the City Environ-
mental Officer.

current landscpaing company, who now occupies that space?

the code. The most recent action on this matter was on April 23, 1990
when I advised Kathleen C. Healy to proceed with prosecution on this
case.
Generally speaking, tanks are removed as a condition of sale because of
the potential liability. In this case the buyer apparently was not
aware of the tanks still being on site because the seller choose not to
disclose that information. Prior to the tine of transfer of ownership,
we had communicated with the former owner the need for the tank remov-
al, and we have been working on obtaining compliance since the new
owner took possession.

connection secured against tampering. Vent lines shall
remain open and be maintained in accordance with the
requirements of this article for vent lines.
A permit is required to remove, abandon, place temporarily out
of service or otherwise dispose of any flammable or combustible
liquid tank. Permit applications should be made at the Community
Development Office, 250-5th Avenue North, Edmonds.

16, 1989 a second letter was sent, again giving Mr. Olds specific code

I was encouraged to see that progress is being made to bring the
abandoned gas station into code compliance. Scmeone has removed all
the fuel dispensers from the site but it appears that was the extent of
the work. I again call your attention to specific requirements in the
Uniform Fire Code that pertain to the abandonment of underground tanks.
Section 79.115 (a) General - Tanks taken out of service as a re-
sult of a property's being abandoned or its use changed shall be
removed in accordance with the provisions of Subsections (e) and
(f) of this section, notwithstanding the time schedules stipulat-
ed. On all other properties, tanks taken out of service shall be
safeguarded or removed in accordance with this section.
(e) Aboveground Tanks Out of Service One Year. Any aboveground
tank which has been out of service for a period of one year shall
be removed from the property in a manner approved by the chief.
(f) Underground Tanks Out of Service One Year. Any underground
tank which has been out of service for a period of one year shall
be removed from the ground in a manner approved by the chief and
the site restored in an acceptable manner. When the chief deter-
mines that the removal of the tank is not necessary, he may permit
the tank to be abandoned in place.
1. Remove all flammable or combustible liquids from the tank and
from all connected piping, and
2. Disconnect the suction, inlet gage, vapor return, and vapor
lines, and
3. Fill the tank completely with an inert solid material ap-
proved by the chief, and
4. Cap or plug remaining underground piping, and
5. Retain a record of tank size, location and date of abandon-
ment.

ARTICLE 78
FIREWORKS
Definition
Sec. 78.101. For definition of FIREWORKS, see Section 9.108.
Permits for Manufacturing, Sale and Discharge
Sec. 78.102. (a) The manufacture of fireworks within the jurisdictional area is
prohibited except under special permits as are required by local and state regula-
tions. See Section 4.108.
(b) Except as hereinafter provided, it shall be unlawful for any person to
possess, store, to offer for sale, expose for sale, sell at retail or use or explode any
fireworks, provided that the chief shall have power to adopt reasonable rules and
regulations for the granting of permits for supervised public displays of fireworks
by a jurisdiction, fair associations, amusement parks, other organizations or for
the use of fireworks by artisans in pursuit of their trade. Every such use or display
shall be handled by a competent operator approved by the chief and shall be of
such character and so located, discharged or fired so as, in the opinion of the chief
after proper investigation, not to be hazardous to property or endanger any
person.
(c) Applications for permits shall be made in writing at least I O�days in advance
of the date of the display. After such privilege shall be granted, sale, possession,
use and distribution of fireworks for such display shall be lawful for that purpose
only. No permit granted hereunder shall be transferable.
Bond for Fireworks Display Required
Sec. 78.103. The permittee shall furnish a bond or certificate of insurance in an
amount deemed adequate by the chief for the payment of all damages which may
be caused either to a person or persons or to property by reason of the permitted
display and arising from any acts of the permittee, his agents, employees or
subcontractors.
Disposal of Unfired Fireworks
Sec. 78.104. Any fireworks that remain unfired after the display is concluded
shall be immediately disposed of in a way safe for the particular type of fireworks
remaining.
Exception
Sec. 78.105. Nothing in this article shall be construed to prohibit the use of
fireworks by railroads or other transportation agencies for signal purposes of
illumination, or the sale or use of blank cartridges for a show or theater, or for
signal or ceremonial purposes in athletics or sports or for use by military
organizations.
Seizure of Fireworks
Sec. 78.106. The chief shall seize, take, remove or cause to be removed at the
expense of the owner all stocks of fireworks offered or exposed for sale, stored or
held in violation of this article.

ARTICLE 79
FLAMMABLE AND COMBUSTIBLE LIQUIDS
Division I
GENERAL PROVISIONS
Scope
Sec. 79.101. (a) General. The storage, use, dispensing and mixing of flamma-
ble and combustible liquids shall be in accordance with this article, except as
otherwise provided in other laws or regulations. This article also applies specifi-
cally to all flammable and combustible liquids as defined in Section 79.102,
except those that are solid at 100T or above. When heated, sprayed or mixed,
Class II or Class III liquids may assume the characteristics of lower flash point
liquids. Under such conditions the appropriate provisions of this article for the
actual flash point shall apply.
EXCEPTIONS: 1. The transportation of flammable and combustible liquids
when in conformity with the Department of Transportation (DOT) regulations on
file with and approved by the Department of Transportation.
2. Alcoholic beverages in retail sales or storage uses, provided the liquids are
packaged in individual containers not exceeding 4 liters. J
3. Medicines, foodstuffs and cosmetics, containing not more than 50 percent by
volume of water -miscible liquids and with the remainder of the solution not being
flammable, in retail sales or storage uses when packaged in individual containers not
exceeding 4 liters.
4. Storage and use of fuel -oil tanks and containers connected with oil -burning
equipment. Such storage and use shall comply with Article 61 and the Mechanical
Code.
5. Liquids without flash points that can be flammable under some conditions,
such as certain halogenated hydrocarbons and mixtures containing halogenated
hydrocarbons.
6. Mists, sprays or foams -except flammable aerosols inpontainers as may be
included under Division II.
(b) Liquids With Unusual Burning Characteristics. Additional require-
ments may be necessary for the safe storage and use of liquids which have unusual
burning characteristics, which are subject to self -ignition when exposed to the air,
which are highly reactive with other substances, which are subject to explosive
decomposition, or have other special properties which dictate safeguards over and
above those specified for a normal liquid of similar flash point classification. See
Article 80.
(c) Alternate Materials or Methods. In particular installations, the provisions
of this article may be altered in accordance with Section 2.301 at the discretion of
the chief after consideration of the special features such as topographical condi-
dons, barricades, walls, adequacy of building exits, nature of occupancies,
proximity to buildings or adjoining property and character of construction of such
buildings, capacity and construction of proposed tank and character of liquids to

unless they are used in a closed machine approved for the purpose or in a separate
well -ventilated room constructed in accordance with Section 79.804.
Waste Petroleum Products and Flammable or Combustible Liquids
Sec. 1 79.113. Flammable or combustible liquids or any waste liquid containing
crude petroleum or its products shall not be discharged into or upon any street,
highway, drainage canal or ditch, storm drain, sewer or flood -control channel,
lake or tidal waterway, or upon the ground.
Sources of Ignition
Sec. 79.114. In locations where flammable vapors may be present, precautions
shall be tWen to prevent ignition by eliminating or controlling sources of ignition.
Abandonment and Status of Tanks
Sec. 79:115. (a) General. Tanks taken out of service as. a result of a property's
being abandoned or its use changed shall be removed in accordance with the
provisions of Subsections (e) and (f) of this section, notwithstanding the time
schedules stipulated. On all other properties, tanks taken out of service shall be
safeguarded or removed in accordance with this section.
(b) Permits. For permits to remove, abandon, place temporarily out of service
or otherwise dispose of any flammable or combustible liquid tank, see Section
4.108.
(c) Tanks Temporarily Out of Service. 1. Underground tanks. Underground
tanks temporarily out of service shall have the f ill line, gage opening, vapor return
and pump connection secured against tampering. Vent lines shall remain open and
be maintained in accordance with the requirements of this article for vent lines.
2. Aboveground tanks. Aboveground tanks temporarily out of service shall
have all connecting lines isolated from the tank and secured against tampering.
Vents shall remain open and be maintained in accordance with the requirements of
this article for vents.
(d) Tanks Out of Service 90 Days. 1. Underground tanks. Any underground
tank not used for a period of 90 days shall be properly safeguarded or removed in a
manner approved by the chief.
A. Maintaining tanks. Tanks shall be safeguarded in accordance with the
following:
(i) Remove all flammable or combustible liquids from the tank, and
(ii) Cap or plug all piping, including fill line, gage opening, vapor return and
pump connection, and secure against tampering, And
(iii) Vent lines shall remain open and be maintained in accordance with require-
ments of this article for vent lines.
Tanks which are to be placed back in service shall be tested in a manner
approved by the chief.
B. Removing tanks. Tanks shall be removed as follows:
(i) Remove all flammable or combustible liquid from the tank and connecting
piping, and

(ii) Disconnect piping at all tank openings, and
(iii) Remove sections of connected piping which are not to be used further and
cap or plug all tank openings.
(iv) -The tank shall be gas freed or inerted prior to removal."
2. Aboveground tanks. Any aboveground tank not used for a period of 90
days shall be properly safeguarded in accordance with Subsection (c) 2 or shall be
removed from the property in a manner approved by the chief.
(e) Aboveground Tanks Out of Service One Year. Any aboveground tank
which has been out of service for a period of one year shall be removed from the
property in a manner approved by the chief.
EXCEPTION: Tanks located at refineries, bulk plants and terminals that are in
operation.
(f) Underground Tanks Out of Service One Year. Any underground tank
which has been out of service for a period of one year shall be removed from the
ground in a manner approved by the chief and the site restored in an acceptable
manner. When the chief determines that the removal of the tank is not necessary,
he may permit the tank to be abandoned in place.
Tanks shall be removed from the ground in accordance with Subsection (d) I B.
Thnks shall be abandoned in place as follows:
1. Remove all flammable or combustible liquids from the tank and from all
connected piping, and.,
2. Disconnect the suction,inlet, gage, vapor return, and vapor lines, and
3. Fill the tank completely with an inert solid material approved by the chief,
and
4. Cap or plug remaining underground piping, and
5. Retain a record of tank size,1ocation and date of abandonment.

I don't know exactly when this business became inactive, but I was
notified around the middle of July, 1989 of its status. On July 21,
1989 1 talked to the property owner Mr. Howard Olds and advised him of
the steps he should take. On August 23, 1989 a letter was sent to Mr.
Olds outlining specific actions that are required by Code. On November
16, 1989 a second letter was sent, again giving Mr. Olds specific code
sections that apply to this situation. If I do not receive a permit
application for the removal of the underground tanks at this site, I
will turn the matter over to the City Attorney.
If you want this matter expedited, just give Chief Weinz or myself a
call - it is ready to go to the attorney now.

Two weeks ago I asked the City Engineer Bob Alberts
if he knew what the policy was regarding storage tank
removal in service stations when the usage of the
station has changed.
He indicated he did not know if there was a policy
but then told me he had contacted you. From what
he said there appears to be no such policy.
At the corner of 241st S.W. and 76th Ave. W. a
service station has been in existence some twenty
years plus. The station is now changing usage -
the pumps have been removed and it will no longer
be a service station.
My concern in this instance is twofold: first that
the water table in that whole area some thirty years
ago was very high - what effect that has on metal
tanks over the years I'm not an experty. Secondly
there is a major drainage line from the Doce site
to Lake Ballinger running along the north side of
that property. It would be my assumption that should
a leak occur it would find its way to the lake.
I am surprised that we do not have a policy as I know
of several jurisdictions that require removal at the
change of usage otherwise there is no leverage in the
future to accomplish.

I was encouraged to see that progress is being made to bring the
abandoned gas station into code carpliance. Someone has removed all
the fuel dispensers from the site but it appears that was the extent of
the work. I again call your -attention to specific requirements in the
Uniform Fire Code that pertain to the abandonment of underground tanks.
Section 79A15 (a) General - Tanks taken out of service as a re-
sult of a property's being abandoned or its use changed shall be
removed in accordance with the provisions of Subsections (e) and
(f) of this section, notwithstanding the time schedules stipulat-
ed. On all other properties, tanks taken out of service shall be
safeguarded or remved in accordance with this section.
(e) Aboveground Tanks Out of Service One Year. Any aboveground
tank which has been out of service for a period of one year shall
be removed from the -property in a manner approved by the chief.
(f) Underground Tanks -.Out of Service One Year. Any underground
tank which has been out . of service for a period of one year shall
be removed fran the ground in a manner approved by the chie f and
the site restored in an acceptable manner. When the chief deter-
mines that the removal of the tank is not necessary, he may permit
the tank to be abandoned in place.
1. Remove all f lam-nable or ccobustible liquids frcm the tank and
fr(xn all connected piping, and
2. Disconnect the suction, inlet gage, vapor return, and vapor
lines, and
3. Fill the tank completely with an inert solid material ap-
proved by the chief, and
4. Cap or plug remaining underground piping, and
5. Retain a record of tank size, location and date of abandon-
ment.

Federal rules for underground storage tanks took effect December 1988,
establishing requirements'for new and existing tanks I which store pe troleum and
other hazardous substances. These rules are intended to protect the
environment, and particularly groundwater, from being contaminated as a result
of tank or piping leaks. Certain tanks are exempt from the rules, including
he I ating fuel tanks and small motor fuel tanks at farms and residences.
Congress intended that authority for the federal program be delegated to, the
states. The 1989 State Legislature passed H . ous6 Bill 1086, requiring Ecology
to establish a program at least as stri . ct as the federal rules so the state
can receive this authority. House Bill 10.86 also required Ecology to
encourage the delegation of the program responsibilities to qualified cities,
towns and counties.
Ecology must prepare several different rules, to be adopted by July 1, 1990.
The most significant rules affecting local governments are likely to be those
that deal with local delegation. Ecology has established an advisory
committee to assist in preparation of the rules. The committee provides broad
representation from the regulated community, local governments and
environmental groups. Local governments are represented by the Washington
Association of Counties and the Association of Washington Cities'.
The attachment provides a summary of the statutory requirements that are

Ecology mist "administer and enforce those program elements not delegated."

physical characteristics that make them especially vulnerable to threats from
leaking underground storage tanks ..... in these environmentally sensitive
areas, local requirements more stringent than the state-wide requirements Pay

used in designating local envirormLentally sensitive areas, as well as the
procedures for local government application for this designation and the
procedures for local govenmLent adoption and department approval of more
stringent rules in these designated areas, The local government adopting the

local ordinances and resolutions become effective when approved by Ecology.
A city, town, or county which has established, with Ecology approval, more
stringent requirements ray establish local tank fees not to exceed one-half of
the state tank fee, if such fees are necessary for enhanced program
administration or enforcement.

quires that "each pump shall have installed on the discharge an

Requirements for underground storage tanks - Flammable Liquids:
Following are excerpts from City of Edmonds Code:
1* Minimum Clearances: From foundations and structures;
one foot. From property lines; 3 feet.
2. Vent Pipes: Inside diameter of vent pipes not less than
1)4" height from ground not less-than.12 feeto
3. Depth and Cover: Set tank on firm foundation surrounded by
clean sand, earth or gravel well tamped. Cover shall con8i8t
of 2 feet of earth fill where no vehicular traffic is possible.
Where vehicular traffic is, or likely to beg cover shall
consist of 3 feet -of earth or 18 inches of earth plus 6 inches
reinforced concrete or 8 inches asphaltic concrete. When
concrete or asphaltic concrete is used it shall extend at
least one foot horizontally beyond the outline of the tank
in all directions.
4.. Fill Pipes: Not less than 5 feet from any building opening
..and provided with liquid tight cover which shall be.closed
except when being filled.

underground tanks but are merely a guide to plan locations for
such installations*
