INTRODUCTION Jesse and Eleanor Burdue, 24219 77th Pl. W, Edmonds, WA, 98020 and hereafter referred to as the Applicants, have requested approval of a home occupation permit to allow a printing business in the garage of the above mentioned address. The application was filed with the City of Edmonds on November 24, 2986. After consideration of the nature of the home occupation, on December 12, 1986, the Planning Division determined that a public hearing was necessary to allow surrounding neighbors an opportunity to comment on the proposed business. Section 20.95.050 of the Edmonds Community Development Code (ECDC) gives staff the authority to conduct public hearings. A notice of the public hearing was mailed to adjacent property owners as required by Code, and posted in the manner prescribed by the ECDC. A hearing on the request was held before the Code Enforcement Technician of the City of Edmonds on January 5, 1987. At the hearing, only the applicants were present and presented testimony. The following exhibits were submitted with the application and are made part of the record: Exhibit 1: Application Exhibit 2: Applicant's statement of information on request Exhibits 3-21: Petitions in support of home occupation signed by surrounding neighbors (18) After consideration of evidence presented by the applicants, and as a result of an inspection of the subject property and surrounding areas by the Code Enforcement Technician, the following Findings of Fact and Conclusions constitute the basis for the decision to approve the Conditional Use permit for the Home occupation. A_ ­ FINDINGS OF FACT The applicants have requested a Home Occupation permit to allow them to operate a printing press in their garage in conjunction with a printing business at 24219 77th Pl. W, Edmonds, WA. The subject property is located in an RS-8 single family residential zone district. Home occupations are allowed in this zone district with the approval of a Home Occupation permit, per Chapter 16.20.010 (B) of the Edmonds Community Development Code (ECDC). Home occupations must meet the criteria outlined in Chapter 20.20 of the ECDC, in order to be approved. Those criteria are: A. The area used for the home occupation shall be carried on entirely within a completely enclosed building. B. No one other than a member of the immediate family residing on the premises may be employed on the premises. C. Mechanical equipment can be used if it is compatible with a residential environment. D. The home occupation shall not generate any more traffic than is normal for a single family residence in the neighborhood. E. No goods shall be sold or rented on the premises except instructional materials pertinent to the home occupation (e.g., music books). The display or storage of goods outside the premises or in a window is prohibited. Customers may not visit the site to view the merchandise. No unreasonable amount of dust, odor, smoke, or noise shall be permitted. F. A sign is permitted if it does not exceed three square feet in size. It shall only contain the name and address of the residents. The Applicants stated that clients will be contacted over the phone. Clients may come to the residence for pick-up and delivery; however, they stated that this will happen no more than twice a week. Equipment for the home occupation consists of a telephone, desk, small scale printing press and accessory equipment. The printing press is stored and operated in the garage. The applicants stated that the garage has been insulated for noise. Exhibit 2, noted above, is a statement from the Applicants describing the proposed operation of the business, as well as their intent and sales method. In summary, they plan to augment their retirement income with the business, and do not intend to conduct the business full time. Jess Burdue is a retired commercial printer and plans to print on a part time basis with this proposed business. In response to concerns about noise from the printing press, staff has added a condition of approval to this home occupation which limits operation of the press to daylight hours. A second condition has been added requiring the applicants to move their printing business to a commercial location if the press operation cannot be limited to daylight hours, if complaints are received from the neighbors, and/or if the nature of the business is no longer appropriate for a residential neighborhood. rnNr.1 11qTnN C. The application in question is a request for a home occupation permit to allow a small scale printing business out of the residence located at 24219 77th Pl. W. Home occupations are allowed, as stated in Chapter 16.20.010 (B) of the ECDC. The applicable criteria are outlined above. The Applicants have demonstrated that their business will comply with the criteria for a home occupation. The proposed home occupation will be carried on inside a completely enclosed building. No other employees will be employed at the residence. With the garage insulation and limiting operating hours of the press to daytime, the press can be compatible with a residential environment. The requested home occupation thus appears to meet the criteria of Chapter 20.20 of the ECDC. DECISION The intent of a home occupation is to allow small scale businesses to operate out of residences in a manner that will not impact the neighborhood. There is no obvious detrimental impact identified with the requested home occupation. Based upon the preceding Findings of Fact and Conclusions; the testimony and evidence submitted at the public hearing; and, upon the impressions of the Code Enforcement Technician at a sit view, it is hereby ordered the requested home occupation is APPROVED, subject to the following conditions: 1.
