Regarding the legatlity of the project, the City is applying to all pertinent agencies regarding this project. The City it not adding any new drainage to Lake Ballinger, only conveying the existing runoff in -a higher capacity line. 2) The City has requi.red storm water management detention for new development for over ten (10) years. There is no policy that allows uncontrolled surface water*to enter Lake Ballinger from new development. Furthermore, the City has completed extensive drainage basin plans that identify and find solutions for existing water quality prob.lems. 3) Regarding the issue of flooding and polluting.Lake Ballinger, the current water couese directs the water to Lake Ballinger. The current flooding/ponding occurs ih'street areas and yards in the vicinity of 242nd-Place and 76th Avenue and carries'sediment from yards and planter areas directly into the lake when major storms occur. The proposed project should, if anything, lessen this impact. 4) The City of Edmonds has been involved for many years in an , interlocal agreement with Mountlake Terrace for the Ballinger drainage basin, providingfinancial support and complying with regulations governing the basin.. 5) An underground catch basin system already exists. All new. developments are required to provide storm water detention on site. 6) The C.ity requires the use of grass -lined swales for water quality where practical. According to all the County, State and Federal regulations and requirements steming from our nation's Cleah Water Act regarding surface -water runoff draining into s.treams, rivers and lakes of the State of Washington, I don't believe that the proposed enlargement is legal. This 12" drainage pipe down 242nd S_.W. is symtomatic of the poor surface -water drainage policy the City of Edmonds has developed with the commercial development along Highway 99': which drains towards Lake Ballinger. That policy has been to use Lake Ballinger as the recipient of uncontrolled surface -water flooding. The stated purpose of the pipe enlargement is to relieve flooding. Without a proper surface -water drainage system to accompany the pipe enlargement it will actually add to the flooding and discharge of surface-.wAt.er pollutants into Lake Ballinger and the McAleer Creek drainage basin. The City of Mountlake Terrace is the lead agency in developing a surface -water management plan for the Lake Ballinger Drainage Basin. Presently it is managing the Phase III of the Lake Ballinger cleanup and flooding program. The City of Edmonds should enter into an inter -local agreement with Snohomish County, Lynnwood, and Mountlake Terrace in developing a proper watershed -surface -water management plan for the Ballinger Bowl (that triangle formed by S.R. 104, 76th S.W.,, and Highway 99) that would include: - an underground surface -water catch -basin system beginning at each of the commercial properties along Highway 99 (including runoff from S.R. 104, Highway 99 and 76th S.W.). - an above ground system of grass -lined drainage basins working gradually down to Lake Ballinger; -.a large one -hundred -year overflow basin system utlizing Mathey-Ballinger Park similar to other park -drainage systems found in South Snohomish County and, - a public -works system of sediment cleanout. The value to be used in computing the building permit and building plan review fees shall be the total value of all construction work for which the permit is issued as well as all finish work."' (Fair market labor and material.) The building standards magazine creates fair market new construction costs based on regional modifiers. For interior remodeling, alterations or repairs the building department asks that the owner provide a contractors bid for the work or a cost breakdown (fair market labor and material.) Mr. Boye did not provide the City with a bid or a fair market labor and materials breakdown, although he did indicate a $2,000 cost on the plot plan. The plan checker calculated the square footage of the inner dock to be 1100 square feet. The least price charged per square foot is $5.00, (decks are calculated at this price, it is logical to calculate docks at this price).
