Dear Mr. Boye,
As Hydraulics -Engineer for the City of Edmonds, I would like to address
the comments made in your May 12, 1992 letter to the Hearing Examiner
regarding the proposed storm drain improvements.
1) . Regarding the legatlity of the project, the City is applying to all
pertinent agencies regarding this project. The City it not adding
any new drainage to Lake Ballinger, only conveying the existing
runoff in -a higher capacity line.
2) The City has requi.red storm water management detention for new
development for over ten (10) years. There is no policy that
allows uncontrolled surface water*to enter Lake Ballinger from new
development. Furthermore, the City has completed extensive
drainage basin plans that identify and find solutions for existing
water quality prob.lems.
3) Regarding the issue of flooding and polluting.Lake Ballinger, the
current water couese directs the water to Lake Ballinger. The
current flooding/ponding occurs ih'street areas and yards in the
vicinity of 242nd-Place and 76th Avenue and carries'sediment from
yards and planter areas directly into the lake when major storms
occur. The proposed project should, if anything, lessen this
impact.
4) The City of Edmonds has been involved for many years in an ,
interlocal agreement with Mountlake Terrace for the Ballinger
drainage basin, providingfinancial support and complying with
regulations governing the basin..
5) An underground catch basin system already exists. All new.
developments are required to provide storm water detention on site.
6) The C.ity requires the use of grass -lined swales for water quality
where practical.

PLANNING DCP'r
This'letter is -my personal imput into your fact-finding
procedure (file # SM-92-51) regarding the enlargement of the
drainage pipe along 242nd and discharging into Lake allinger.
According to all the County, State and Federal
regulations and requirements steming from our nation's Cleah
Water Act regarding surface -water runoff draining into
s.treams, rivers and lakes of the State of Washington, I don't
believe that the proposed enlargement is legal.
This 12" drainage pipe down 242nd S_.W. is symtomatic of
the poor surface -water drainage policy the City of Edmonds has
developed with the commercial development along Highway 99':
which drains towards Lake Ballinger. That policy has been to
use Lake Ballinger as the recipient of uncontrolled
surface -water flooding.
The stated purpose of the pipe enlargement is to relieve
flooding. Without a proper surface -water drainage system to
accompany the pipe enlargement it will actually add to the
flooding and discharge of surface-.wAt.er pollutants into Lake
Ballinger and the McAleer Creek drainage basin.
The City of Mountlake Terrace is the lead agency in
developing a surface -water management plan for the Lake
Ballinger Drainage Basin. Presently it is managing the Phase
III of the Lake Ballinger cleanup and flooding program.
The City of Edmonds should enter into an inter -local
agreement with Snohomish County, Lynnwood, and Mountlake
Terrace in developing a proper watershed -surface -water
management plan for the Ballinger Bowl (that triangle formed
by S.R. 104, 76th S.W.,, and Highway 99) that would include:
- an underground surface -water catch -basin system beginning at
each of the commercial properties along Highway 99 (including
runoff from S.R. 104, Highway 99 and 76th S.W.).
- an above ground system of grass -lined drainage basins
working gradually down to Lake Ballinger;
-.a large one -hundred -year overflow basin system utlizing
Mathey-Ballinger Park similar to other park -drainage systems
found in South Snohomish County and,
- a public -works system of sediment cleanout.

The building division has been advised that the subject dock has been
built. Prior to issuance of the dock permit (fee $59.50); it will be
necessary for you to schedule an inspection with the City building
inspector. The City will accept a letter from a licensed structural
engineer in lieu of a City inspection. The letter should state that
the construction meets the minimum requirements of the 1985 edition of
the Uniform Building Code.
The inspection is mandatory for two reasons; 1) Section 306 of the
Uniform Building Code requires an inspection on dock construction and
2) in order to have a valid use under the Community Development Code
the dock must be inspected. The City ordinance regarding
non -conforming structures has changed since you first applied for the
dock permit. The rebuilding of non -conforming docks is no longer
allowed by the code. In order for you to vest your dock as a legal
non -conforming use under the code, the dock must be inspected.
City inspection hours are Monday through Friday 9:00a.m. to 11:30a..m.
and 1:00p.m. to 4:30p.m. call 771-3202 for an appointment.

Section 304 (a) Fees, of the 1985 Uniform Building Code states; " the
determination of value or valuation under any provision of this code
shall be made by the building official. The value to be used in
computing the building permit and building plan review fees shall be
the total value of all construction work for which the permit is issued
as well as all finish work."' (Fair market labor and material.)
The building standards magazine creates fair market new construction
costs based on regional modifiers. For interior remodeling,
alterations or repairs the building department asks that the owner
provide a contractors bid for the work or a cost breakdown (fair market
labor and material.) Mr. Boye did not provide the City with a bid or a
fair market labor and materials breakdown, although he did indicate a
$2,000 cost on the plot plan.
The plan checker calculated the square footage of the inner dock to be
1100 square feet. The least price charged per square foot is $5.00,
(decks are calculated at this price, it is logical to calculate docks
at this price).
Based on this the permit fees are as follows:

RE: Dock Repair Permit
LARRY S. NAUGHTEN
MAYOR

DIRECTOR
On May 28, 1987 you applied for a dock repair permit. The planning and
building sections reviewed your application and the permit was ready to
be issued June 2, 1987. You were notified by phone that the permit was
ready; when you came in to get the permit you expressed disagreement
with the fee amount of $102.50. Table 3-A of the Uniform Building Code
sets the fee standards for permits; fees are required as part of the
permitting process.
A recent check of building divisions records indicates that the permit
has not yet been issued. Because of the time that has elasped since
your initial submittal the building division is requesting that you
schedule an appointment for the City inspector to examine existing
status of the dock.
Please be advised if repair 6. f--the dock has been done without issuance
of a permit you have violated Section 301 of the 1985 Uniform Building
Code. Violation of this code section subjects the offender to
penalties as outlined in Chapter 19 of the Edmonds Community
Development Code.
City inspection hours are Monday through Friday 9.:00a.m. to 11:30a.m.
and 1:00p.m. to 4:30p.m. Please contact the building division for
inspection within the next 5 working days. -

Sirs;
My wife and I reque9t a building permit for the purpose
of repairing the existing, non -conforming dock (17.40 of the
Community Code) at our home at 24325 76th W., Edmonds, WA on
Lake Ballinger.
Our dock was extenzively damaged by an arson fire on May
5th, 1987.
We plan to replace the surface boards and any damaged
supporting timbers of the inner dock in order to bring it back
to existing conditions before the fire.
The diagarm below describes the existing dock
configuration and the shaded area represents that portion to
be replaced.
