GENERAL CRITICAL AREAS REPORT REQUIREMENTS Critical Areas Reports identify, classify and delineate any areas on or adjacent to the subject property th ' at may qualify as critical areas. They also assess these areas and identify any potential impacts resulting from your specific development proposal. If a specific development proposal results in an alteration to a critical area the critical 'areas report will also contain a mitigation plan. DEFINITION AND STUDY REQUIREMENT — SEISMIC HAZARD AREA It appears that this property contains or is adjacent to a Seismic Hazard Area. • Seismic Hazard Areas are areas subject to severe risk of damage as a result of earthquake -induced ground shaking, slope -failure, settlement, soil liquefaction, lateral spreading, or surfacer faulting. Settlement and soil liquefaction conditions occur in areas underlain by cohesionless, loose, or soft -saturated soils of low density, typically in associatiorf with a shallow ground water table (see ECDC 23.80.020.C.). • In addition to the general requirements for Critical Areas reports referenced above, specific Critical Area report requirements for Seismic Hazard Areas are provided in ECDC 23.80'.050. subsections A through E, and H. DEVELOPMENT PROPOSALS ASSOCIATED WITH SEISMIC HAZARD AREAS Development is restricted within a Seismic Hazard Area. The following activities are allowed in a seismic hazard area as consistent with ECDC 23.40.220 - Allowed activities, Chapter 19.10 ECDC - Building Permits — Earth Subsidence and Landslide Hazard Areas, and Chapter 18.30 ECDC - Storm Water Management, and do not require submission of a critical area report: o Construction of new buildings with less than 2,500 square feet of floor area or roof area, whichever is greater, and which are not residential structures or used as places of employment or public assembly; o Additions to existing single -story residences that are 250 square feet or less; and o Installation of fences. Other projects that will intrude into seismic hazard areas will require a report by a licensed Geotechnical Engineer per ECDC 23.80.050.A. Activities proposed to be located in seismic hazard areas shall meet the standards of ECDC 23.80.060, Development Standards — General Requirements. FREQUENTLY FLOODED AREAS On the * Flood Insurance Rate Map, Panel 1292, this site is in an area determined to be outside the 500-year floodplain (zone X), but it is very near a special flood hazard area inundated by 100-year floods (zone AE), with a base flood elevation determined as elevation 8 (see flood map for elevation datum). I checked with Don Fiene, Assistant City Engineer, and former Stormwater Engineer, and he has stated that Dick Slye's basement (260 Beach Place north of this site) was totally flooded during the 1996-1997 rain on snow event, and the apartments had some flooding too. Therefore, it would be prudent to consider the base flood elevation and roundwater levels 9 (including tidally influenced water levels) in the design of any new structures or improvements. I FISH AND WILDLIFE HABITAT CONSERVATION AREAS The site is adjacent to Puget Sound, which is a mapped Fish and Wildlife Habitat Conservation Area, considered a water of the state, and is home to fish that have been federally designated as endangered or threatened. No specific buffer is required along Puget Sound by our Critical Areas regulations. This site appears to drain through Olympic Beach Park to the Puget Sound. The narrow strip of grass and landscaping in the park, which is about level with this site, appears to reduce the impact development on this site would have on Puget Sound water quality. As of the field visit in September 2005, and prior to the demolition of the house, the site had no native vegetation. The City would like to retain and increase native vegetation along Puget Sound to improve Fish and Wildlife Habitat Conservation Areas. With any development proposal, if there is a concern regarding the impact of the proposal on the Fish and Wildlife Habitat Conservation Area, the City reserves the right to require recommendations from the Washington Department of Fish and Wildlife, require erosion control measures, require planting of native plant species to mitigate for loss of vegetation and take other measures needed to protect the Fish and Wildlife Habitat Conservation Area. ALLOWED ACTIVITIES Certain activities are allowed in or near critical area buffers as specified in ECDC 23.40.20. Dear Mr. McIntosh: STREET FILE The City of Edmonds Planning Division has reviewed your request dated May 16, 2005, for an exemption from the requirement to obtain a Shoreline Substantial Development Permit (SDP). The purpose of the project is to allow the demolition of a residential structure (a "cottage") located on property recently obtained by the City of Edmonds. The project is also intended to restore the property to be compatible with the adjacent, public beach, while enhancing public access (see attached letter). Upon review of the project, the City has concluded that the proposed work is exempt from the need to obtain a Shoreline Substantial Development Permit. In reaching this conclusion, we reviewed pertinent sections of the Washington Administrative Code (WAC) that potentially relate to this type of project, including the following: WAC 173-27-030(6): (6) "Development" means a use consisting of the construction or exterior alteration of structures; dredging; drilling; dumping; filling; removal of any sand, gravel, or minerals; bulkheading; driving ofpiling,- placing of obstructions; or any project of a permanent or temporary nature which inteiferes with the Incorporated August 11, 1890 Sister Citv - Hekinan, Japan SM-401-93 Page 2 is normal public use of the surface of the waters overlying lands subject to the act at any stage of water level WAC 173-27-040(2)(p): (p) A public or private project, the primary purpose of which is to improve fish or wildlife habitat orfish passage, when all of the following apply: (i) The project has been approved in writing by the department offish and wildlife as necessary for the improvement of the habitat or passage and appropriately designed and sited to accomplish the intended purpose; (ii) The project has received hydraulic project approval by the department of fish and wildlife pursuant to chapter 75.20 RCW,- and . (iii) The local government has determined that the project is consistent with the local shoreline master program. The local government shall make such determination in a timely manner and provide it by letter to the project proponent. The basis for the exemption is that the project does not appear to meet the definition of "development" under the Shoreline Management Act. We reach this conclusion because (1) the project does not include grading, excavation or filling that requires a City of Edmonds grading permit, and (2) the site is to be restored to a natural state, with the only "improvement" being an unpaved . public pathway to allow the public improved access to the ad acent public beach. j Although this project does not directly fall under the emption of WAC 173-27-040(2)(p), it is clearly consistent with this type of activity. This project is consistent with the City of Edmonds Shoreline Master Program (Chapter 23.10 ECDC), particularly the following policies: 23.10.060 Shoreline use element goals and policies Goal A. 7. Encourage restoration of shoreline areas that have been degraded or diminished in ecological value and functions as a result of past activities or catastrophic events. Goal A.9. Encourage increased accessibility to theshoreline for a variety of users and activities. 23.10.075- Public access element goals and policies Policy B.3. The city should maintain public shorelines, waterways and tidelands in public ownershipfor continuedpublic access and use. Polic B.4. The city, where practicable, should acquire key shoreline parcels that y become available; such parcels are those integral to necessary expansion of existingprime beach areas. Although this project is determined to be exempt from the requirement to obtain a Shoreline Substantial Development Permit, this determination assumes the following conditions: 1. The demolition and site work are not sufficient in scope to require a City of Edmonds grading permit. SM-2001-93 Page 3 91 2. After demolition, all demolition material will be removed from the site. Any hazardous materials will be handled and disposed of according to Best Management Practices. 3. Demolition and site restoration will ineet the standards for "land surface modification" under the City of Edmonds Shoreline Master Program, Chapter 23.10.210 ECDC (attached for your reference). A "restoration "plan" is required to be submitted with the demolition permit, including (1), a plot plan of the property depicting the proposed native vegetation plantings and natural pathway providing public access to the beach, and (2) a schedule for project completion, including references to appropriate Best Management Practices to avoid erosion or impacts on adjoining property. Should any of the assumptions and conditions listed above be proposed to be modified during the project, this office shall be notified immediately so that a determination can be made as to whether the Shoreline exemption is still valid. The regulations of this section apply to proposed land surface modifications landward of the ordinary high water mark. See ECDC 23.10.195 through 23.10.205 for regulations that apply to land surface modifications waterward of the ordinary high water mark (breakwaters, dredging and filling) and ECDC 23.10.190 regarding land surface modification incidental to the construction of a bulkhead or other shoreline protective structures. B. Land Surface Modification Landward of the Ordinary High Water Mark. Land surface modifications landward of the ordinary high water mark may be permitted only if no unique or significant natural area of flora or fauna will be de stroyed and only for the following purposes: 1. The land surface modification is proposed by a public agency to improve public safety, recreation Pr access, or is intended to improve a condition of the natural environment. 2. The land surface modification is part of a development on. the subject property and is to improve access to a pier, dock, or beach. . 3. The land surface modification is necessary to provide public pedestrian access or a public use area. . 4. The land surface modification is necessary for the structural safety of a structure. 5. There has been severe and unusual erosion within the one-year period immediately preceding the application and the land surface modification is to restore the shoreline to its configuration prior to this erosion. C. Land Surface Modification Landward of the Ordinary High Water Mark. Land surface modification landward of the ordinary high water mark is only permitted if it is necessary for an approved development or use of the subject property or if it is incidental to landscaping for an existing use on the subject property. D. Additional Regulations. All land surface modifications landward of the ordinary high water mark must comply with the following requirements: 1. The land surface modification. must be the minimum necessary to accomplish the underlying reason for the land surface modificatio.n. 2. Care must be taken to not create any direct or indirect adverse impacts on any adjoining property or the shoreline of statewide significance. 3. All surfaces exposed during land surface modification must be revegetated or otherwise covered as quickly as possible to minimize erosion. 4. During land surface modification activities techniques should ' be employed to prevent erosion and runoff onto adjacent properties or into the shoreline of statewide significance. 5. Except as is necessary during construction, dirt, rocks, and similar materials may not . be stockpiled on the subject property. If stockpiling is necessary during construction, it must be located as far as possible from the shoreline and strictly contained to prevent erosion and runoff. 6. Materials that will be deposited on the subject property must be clean and not contain organic or inorganic substances that could pollute or otherwise be detrimental to water quality or aquatic or shoreline habitats. 7. The city may require that land surface modifications be engineered and/or supervised by an engineer or similarly qualified professional. 8. The city may require that land surface modifications be restricted to limited times of the year. E. Land Surface Modifications in . Conservancy or Natural Shoreline Environments. Notwithstanding any other provision of this section, land surface modifications in conservancy or natural environments should not be allowed unless: 1. The city's cleaning operation is essential for both you and your neighbors. It cleans debris in lines to prevent plugs, prevents corrosion and potential future collapse, and achieves a better flow characteristic in the public sewer lines. We need to do this often --. perhaps even 3 times a year -- in some critical areas. The city's cleaning operations typically involves the utilization of a high pressure water jet. The problem which occurs at the home is the result of a high pressure surge through your internal plumbing system. A properly constructed plumbing system is designed to easily vent this additional pressure withoutany visible impact at your residence. An undersized venting pipe (or not having enough vents) cannot handle the pressure surge, and the only release that's available is then through your toilet (or another fixture). The Uniform Plumbing Code typically requires a 2" vent, and further requires a separate vent for each plumbing fixture which is connected to the sewer (a toilet, a sink, a shower). Your home may not have an adequate venting system (you either have a 1-1/4" vent, o ' r not enough of them), and you therefore may continue to experience the pressure surges or you may be experiencing a plugged vent. The city does not have a choice as far as discharging its responsibility in cleaning the public sewer line. The city's cleaning operation is essential for both you and your neighbors. It cleans debris in lines.to prevent plugs, prevents corrosion and potential future collapse, and achieves a better flow characteristic in the public sewer lines. We need to do this often -- perhaps even 3 times a year -- in some critical areas. The city's cleaning operations typically involves the utilization of a high pressure water jet. The problem which occurs at the home is the result of a high pressure surge through your internal plumbing system. A properly constructed plumbing system is designed to easily vent this additional pressure without any visible impact at your residence. The Uniform Plumbing Code typically requires a 2" vent, and further requires a separate vent for each plumbing fixture which is connected to the sewer (a toilet, a sink, a shower).
