Mr. Hubbard reported that in checking the property, he had found fences along the
street set back, apparently in anticipation of increased r/w. After further discussion
of the right -of --sway, Mr. Dave Fry, agent for Wick Homes, aareed to deed the requested
201 right-e-of-way. It was then moved by Mr. Hubbard, seconded by Mr. Sater, that the
Planning Commission direct a letter to the Board of Adlustment advising them that they
would approve a subdivision request after it has been to the Board of Adjustment for
its approval of a variance in lot width and area for each lotl subject only to the
dedication of 201 from the north side for street right-of-�way. Motion carried.
Mr. Sater asked Mr. Larson to check with the Council on a study of streets in the area,

Affidavits of Poster and Publication were presented, as well as note of notice to
adjacent property owners. Mr. Bennett read the recommendations of the City Health
Officer and the City Engineer. Mr. Larson noted that no sidewalks had been required
because of anticipated sewers in the near future. Mr. Haines noted that this replats
a portion of Division B.
Mr. Middleton stated that there has been only one preliminary plat, in 1961, presented

in three divisions by Stewart Peterson. He platted Division A,. then Division B1. both

of which were recorded and improved, though the final part of Division B was never
f inished. It was then taken over by Sherwood & Roberts. Because of failure of the
end of the cul"ode-"sac because of the fill condition,, it was replatted 'in the manner
shown,, and will be repaved and curbed with new storm sewers. It will necessitate
vacation of the end of the present cu1~de--&sac and rededication of the new cul�deo-sac.
Mr. Larson agreed that thi s would make a better cul-de-o-sac because of f irmer ground.

Mr. Henshaw, representative of Sherwood & Roberts, stated that the plat is still in
the preliminary planning stage, and that as soon as they have a final determination
of the course they are to follow, they intend to make arrangements with Mr. Halverson
to assure them -in writing that -'Eheir property will be put in the same or similar
condition as now exists. He later pointed out that Mr. Halverson's concern was not
drainage but rrradp and the rockery and landscaping that now exists. Mr. Larson said
that from the standpoin-L of the city, this is all a part of the engineering require-*-
ments, ut that the developers are still not relieved of their responsibility toward
property owners .
At the request of the Planning Commission, Mr. Murphy checked the City Code regarding

Mr. Middleton said that a good forty percent of the land is not useable because it is
too steep. He didn't think there could be any further development of these large lots,
It was pointed out that the plat is in an RS-20 zone, so that only two lots have enough
footage for further subdivision. Mr. Haines questioned whether a policy would now be
established Permitting lots which could later be subdivided and served by access roads.
Mr. Bennett said that they wanted to firm up the subdivision code so that preliminary
plats show access roads to future subdivisions in a plat.
Mr. Bennett then asked Mr. Larson to report in the near future the results of his
studies on this problem,

In a discussion of the zoning on the Harry Head property, located at the northerly
intersection of 76th Ave, W. with Highway 99,, and zoned CG on the east portion and
RML on the west 150 ft *'P Mr. Sater reported that in 1962 a rezone came before the
Planning Commissi & on, and it appeared at the time that a certain amount of sewerage
seepage was evident, and it was felt, therefore, that perhaps multiple zoning would
only add to the problem. Under the present zoning,, Mr. Head would be required to
place a greenbelt through the middle of the property. Mr. Head, he added, had at
the ta'Lme of the original rezone request, agreed to dedicate 301 to widen 78th Ave. W.

Mr. Sater then moved that the Planning Commission,, on its own motion, set a public
hearing for the 15th day of September to rezone from RML to BN the west 1501 of this
property. Mr. Haines seconded the motion, and commented that it has been the policy
of the Planning Commission not to divide property under one ownership into more than
one zone,
Mrs. Wynakos,, Mrs. Brewer, Mr. 01szewski, and Mr. Rawlins, all of whom adjoin the
Head property outside the cloty limits, expressed concern for screening, access and
traffic on 78th Ave,. W. Mr. Bennett explained that BN zoning would require only a
fence for screening and would permit access'.. but CG zoning would require a greenbelt
with no access. After further discussion of the possibilities,, and with the idea
that the hearing should allow more flexibility in deciding which commercial zoning
might be best for this property, Mr. Sater and Mr. Haines amended their motion -to
rezone the property from RML to CG. Motion carried.
Mr. Bernard Kosher, instigator of the petition to amend the sign requirements in BN
zones, proposed to change the petition to read "...one free standing sign not exceeding
50 square feet ion area and signs not exceeding 100 sq,, in area attached to the
building." Mr. Harve Harrison added that he felt this wording would stand a better
chance of being passed. However, the Planning Commission felt that since there were
about twenty-five signatures on the petition, it should stand as submitted. The
Planning Commission then compared the wording and requirements for signs in each zone
and decided that the requirements should be made more consistent.,
Therefore, Mr. Thompson amended his original motion to state that September 15, 1965
be set as a public hearing date for File No, ZO-10-."65, to consider amending the zoning
ordinance regarding signs in BN, BC, and CW zones. Mr. Sater amended his second, and
the motion carried,
