Your letter dated November 19, 1980 regarding the excessive
driveway slope at 312 Highland Drive arrived today.
I do not understand some of your comments and others are
not relevant to the issue. You enclosed a profile drawing of the
driveway prepared by Group Four, Inc. which you state shows slopes
from 15',', - 20%. 1 checked this drawing and it appears to me that
they indicate that sectionsof the driveway have slopes in excess
of 25%.
The facts of this issue are:
1) Mr. Suydam or his builder had been notified at the time
the Building Pertnit was issued that the driveway slope
could not exceed 14%;
2) During construction our inspector noted the driveway
slope as appearing to be excessive and notified the
buiider;
3) Prior to paving, the slope was checked and found to be
greater than 2570 and Mr. Suydam was notified and methods
to correct the problem were recommended;
4) The driveway was paved with a very slide -prone surface
with slopes in excess of 25%;
5)�: The City Engineer does not have the authority to grant
t ! he variance which you request.

Gentlemen:
Mr. Suydam has asked me to respond to your letters of May 23, 1979 and
September 4, 1980 regarding driveway slope.
The existing site purchased by Mr. Suydam had excessive slopes as well
as existing highrrobkeryz,at the sidewalk, or west side of the site.
Our only choice for entering the site was at the southwest corner due
to this condition. Every effort was made to reasonably lower the build-
ing site to minimize final, .driveway slope, as indicated on our site
plan submitted for building permit. Enclosed invoices from sub -contractors
will show substantial costs for earth removal ($9j173.26) and rockery
($19,554.86) in order to accomplish this. In my opinion, a further lower-
ing of the driveway would have been economically unreasonable and may have
as well created an undesirable uphill condition above the driveway.
Actual driveway profile as ordered by Mr. Suydam is enclosed which shows
extensive cuts as welJ_a.s-_the_driveway section indicating slopes ranging
from approximately - 15% - 20%. _�)kctual grades appear slightly higher than

Despite previous correspondence with the Building Depart-
ment advising you of certain violations that occurred at 312
Highland Drive, you have taken no action to correct these
deficiencies. As you were previously advised the deficiencies
include the fact that the driveway slope must meet City stan-
dards and that you must comply with the City's drainage ordi-
nance.
Please be advised that ordinances of the City provide
that any person violating any provision of the Edmonds City
Code is guilty of a misdemeanor and, upon conviction thereof,
may be punished by fine up to $250 or jail time of 90 days
or both such fine and jail time. In addition, each continuing
day of violation may be considered a separate offense subject
to the penalties as set forth above.
If within 10 days from the date of this letter you have
not submitted all information required for the City to approve
your drainage plan as required by ordinance number 1714 and
have not.suibmitted sufficient plans which show compliance with
the City's maximum driveway slope standards, the City will have
no choice but to issue a criminal citation. Please understand
that the City * has no particular desire to do this, however, I
am sure you will agree that the City may not insist on other
people complying with City ordinances and not insist on you
complying also.
By carbon copy of this letter I am requesting the Building
Official and the Public Works Director to advise me if you have
complied. If not a criminal citation will be issued. I trust
that �he latter is not necessary.

On May 23, 1979, which was prior to your driveway being paved,
we wrote a letter to you suggesting a possible solution for your excessive
driveway slope ( copy attached).
Due to the slope and the sight restrictions there is a definite danger,
duri.,ng icy conditions, for a'vehicle to slide into the public street and
possible hit a pass-ing vehicle or pedestrian.
Unless you met the conditions as authorized in our May 23, 1979 letter,
I do not have the authority to.grant a variance from the 14% maximum allow-
able slope.
I again recommend that'you employ a competent -engineer to design a
ski.,d resistant pavement. -
Prior to considering any vari ' 'ance you must submit a- plan and* profile
of your dri.veway from the centerline of the street to your garage. The
requi'red scale of your -plan must be not less than 1-inch equals 10 feet
horizontal and 1-inch equals 5 feet vertical.

Dear Sirs:
This is concerning Edmonds building permit no. ?90047 for
construction of 312 Highland Dr. Edmonds. The only problem remaining
to date is with the driveway slope as the lot drainage, etc. has
been taken care of, inspected and signed off.
First I will explain the circumstances leading up to this
problem. This is the first house we have everhad built. I had
a general contractor hired by the hour and then sub -contracted
everything else myself. The general Contractor was unaware of the
1416 grade restriction for driveways. Also a site plan with a top-
ographical survey was submitted with thebbuilding plans to the
Building Dept. and when you compute the driveway slope right off
of the site plan with the elevations given; you come up with a
,.!!l?pe of 17%.'These plans were approved by you. Also this problem
was -not -brought to our attention until the house was 80% complete.
To begin with this lot was very steep with access only at the
southwest corner. Unaware of the 14% restriction myself, but wanting

of dirt excavated. This war-, at a cost of just under $10,000 to put
this house at the exact elevation as shown on the site plan. In
excess of $25,000 was spent for the 15 ft. high rock wall necessary
from the excavation.
I have met with inspectors on the driveway and all they would
suggest is to apply for a variance as they thought it was over 20%.
There is one sl13ht hump in the driveway at which your inspector
measured a drop of 22" in a distance of 100" and said the slope to
be 22%. 1 constest that figure because the driveway maintains a
constant grade except for that slight hump. It is constant for a
distance of 120 ft. until it levels out and measuring 100 ft. of
this it drops 17-:f' ft. for a grade of 171%. This 1?e', is consistent
with the figure you compute off of the site plan and is less of a
grade than what is necessary for a variance. Itis more than the 14%
allowe;1, but as you at the Building and Engineering depts. can see
we had no alternative as it would not have been economically feasible
to excavate the house lower and have a rock wall of around 20 ft.
I maintain that the driveway slope is less than 20% and var-
iance is not required.You at the Engineering and Building depts.

have gone tremendous expense and effort to get it where it is at
and do not think it could have been done better due to the steepness

Despite previous correspondence with the Building Depart-
ment advising you of certain violations that occurred at 312
Highland Drive, you have taken no action to correct these
deficiencies. As you were previously advised the deficiencies
include the fact that the driveway slope must meet City stan-
dards and that you must comply with the City's drainage ordi-
nance.
Please be advised that ordinances of the City provide
that any person violating any provision of the Edmonds City
Code is guilty of a misdemeanor and, upon conviction thereof,
may be punished by fine up to $250 or jail time of 90 days
or both such fine and jail time. In addition, each continuing
day of violation may be considered a separate offense subject
to the penalties as set forth above.
If within 10 days from the date of this letter you have
not submitted all information required for the City to approve
your drainage plan as required by ordinance number 1714 and
have not.submitted sufficient plans which show compliance with
the City's maximum driveway slope standards,,the City will have
no choice but to issue a criminal citation. Please understand
that the City has no particular desire to do this, however, I
am sure you will agree that the City may not insist on other
people complying with City ordinances and not insist on you
complying also.
By carbon copy of this letter I am requesting the Building
Official and the Public Works Director to advise me if you have
complied. If not a criminal citation will be issued. I trust
that the latter is not necessary.

Your request for a variance from the 14% maximum slope for
driveway has been investigated and from a cursory inspection
it appears that portions of your driveway exceed 25% slope. The
Edmonds City Code allows a maximum of 14% driveway slope with a
variance o f up to 20% under certain conditions.
I recommend that you have your engineer and architect design
a driveway which they consider to be the best solution for access
to your residence. If the final slope is between 14% and 20%, and
you meet the following conditions, this office has the authority
to approve a variance.
a. There are no other economically and/or environmentally
reasonable alternatives.
b. The driveway will not present a traffic, pedestrian or
safety hazard.
c. The Police and Fire Chiefs concur in allowing the increased
driveway slope.
d. The public health, safety and general welfare will not be
adversely affected.
Prior to considering the authorization of any driveway slope which
exceeds 14%, a detailed design of the proposed construction must be
submitted to this office.

I am writing in reference to the driveway slope at a house we are
building for ourselves at 312 Highland Drive in Edmonds. Joe Hattendorf
who has been at the place advises that our driveway slope is possibly
greater than the 14jo allowed. Although we are not unhappy with the
present slope we can not lessen it as to do so we would have to
undercut a 15 ft. rock wall. This rock wall holds the bank back on the
side of the driveway.
Joe Hattendorf did not recommend cutting the slope down because
of this rock wall but recommended we write this letter to ask for a variance
due to hardship. Thank you.
