Design Review Process
Design review for signs is considered a Type I decision subject to the requirements of ECDC 20.01.003.
Pursuant to ECDC 20.60.01 O.C, while a separate sign permit is required for each wall graphic, staff may
make a single design -review decision on wall graphics that consists of related murals or artwork.
Analysis:
1. Location. Two of the mural sites (BLD20120434 and BLD20120436) are located within the BD-1
and are therefore subject to the requirements of ECDC 22.43 — Design Standards for the 130- 1 Zone :30
The remaining mural is located in the BD-2 zone and subject to the general design requirements of *rn
EC -DC 20.11. The location of the three murals, mural name, and zone are detailed in the Table 1 rn
below:

Downtown/Waterfront Activity Center with a comprehensive plan designation of Downtown Mixed
Commercial. The murals satisfies the intent of ECDC 22.43, specifically treating blank walls' as well
as the following goals and policies from the Comprehensive Plan:
a. Downtown Design Objectives are found on pages 56-60 and are intended to encourage high
quality, well designed projects to be developed in the downtown waterfront area that reflect the
values of the citizens of Edmonds.
b. "Improve pedestrian access and way -finding by providing a variety in buildingforms, color,
materials and individuality of buildings" (page 57).
c. "Art should be integrated into the design of both public andprivate developments, with incentives
provided to encourage these elements" (page 5 8).
.d. "Public art and amenities such as mini park, flower baskets, streetfurniture, etc., should be ,
provided as a normal part of the public streetscape. Whenever possible, these elements should he
continued in. the portion of the private streetscape that adjoins the public streetscape" (page 5 8).
3. Sign type. The murals are considered wall graphics and wall graphics are conditionally permitted
sign types in the downtown business area. Review criteria for murals are contained within ECDC
20.60.01 O.C.3:
a. Quality ofthe materials used to create the ar6vork. Materials should be resistant tofading; no
fluorescent paints:
All three murals will be painted using Nova acrylic paint and products. Nova employs a tough,
durable, 100% acrylic resin suitable for use outdoors. The murals will also be treated with a clear
top coat to protect against dampness, fading due to LTV rays or weather damage. No fluorescent
paints are proposed for any of the murals.
b. Durability andpermanence, including ability to withstand age, vandalism and weathering.
Consideration should he given to anti -graffiti coating:
The murals will be painted on building walls that have been leased for ten years. All three murals
will be painted using Nova acrylic paint and products.. Nova employs a tough, durable., 100%
acrylic resin suitable for use outdoors. The murals will also be treated with a clear top coat to
protect against dampness, fading due to UV rays or weather damage.
Each spring, the murals will be examined by technical consultants retained by the Edmonds
Mural Society for sips of fading due to ultra -violet rays or dampness or weather damage. Any
damage will be immediately repaired in consultation with the technical consultant and artists
hired by the Edmonds Mural Society. Any graffiti on the murals will be painted over.
c. Compatibility of the artwork with architectural elements, other elements of the street, and
adjacent structures. Compatibility shall be determined by relationships of the elements ofform,
proportion, scale, color, materials, surface.treatment, an * d size and style of lettering. Lettering
shall be minimized, but may be consideredfor inclusion when necessary to the artistic content.
All three,murals are compatible with the character of the buildings on which they are being
placed as well as the downtown Edmonds streetscape. Only the mural at 504 — 5h Avenue South
contains letter, which is "It's an Edmonds kind of Day" reflect the theme of this year's murals.

Based on the facts and conclusions of this report, staff finds that the design review for BLD20120434,
through BLD20120436 is APPROVED.

The concept behind this mural is to show a little festivity happening in the park. Local
musicians playing while people enjoy a rest and do a little shopping at an outdoor market
which sells locally produced treats.
WNle doing my research for this project, I asked Edmonds what it wanted to be, and
what it wanted to look like. This is the answer I was given.

Maintenance Requirements
for Proposed Mural

This mural shall be painted on a building wall that has been leased by written contract for
a length of ten years, with an option to renew. The Edmonds Mural Society, by contract
with the landowner, is responsible for all maintenance and upkeep for this mural during
the time specified by the contract.
The Edmonds Mural Society shall maintain this mural in the following manner:
This mural shall be mounted in keeping with the finest methods of mural creation to date.
In specific, the wall shall be pressure -washed at least two weeks in advance of the mural
raising. Second, before mounting the mural, a layer of primer shall be applied to the wall
surface area. Finally, following completion of the mural, it shall be treated with a UV -
protective sealant to minimize fading or weather damage over the years.
The two main sources of damage to a mural are sunlight and dampness. Each spring, this
mural shall be examined thoroughly for signs of fading due to ultra -violet rays or
dampness or weather damage. Any such damage will be immediately repaired in
consultation with artists hired by the Board of the Edmonds Mural Society.
On a final note, the Edmonds Mural Society is often asked about protecting murals from
vandalism, specifically "tagging." Surprisingly, the wealth of experience of mural
societies across the country all agree: tagging of murals is not a serious concern. It
almost never occurs. Then, too, on those rare occasions that tagging does occur, mural
societies have uniformly found that cost of repairs is relatively cheap. (Quite simply,
they paint over the tagging.)
Moreover, all the mural societies that we asked agreed that while there are anti -tagging
products available on the market, they are so expensive that their purchase is not justified
when repairs to the rare mural tagged are so inexpensively, and quickly, carried out.

Schedule for Development, Fabrication
and Completion
for Proposed Mural
Edmonds Entertains by Eflen Clark

Development:
This mural design was submitted to the Edmonds Mural Society in January 2012 in the
competition to select three murals to be mounted. At that time, by the date the artist
submitted the design, its development was complete.
Fabrication:
This mural is being painted on the west wall of 313 Main Street. Therefore, there is little
fabrication occurring.
Instead, the wall will be pressure -washed the week of June 24 - June 30.
A coat of primer will be applied early in the week of July 29 - August 4.
The mural itself, weather permitting, shall be painted during the week of August 5 -
August 11. If the weather is not appropriate for the painting of the mural during this
week, the Edmonds Mural Society will make arrangements for the painting of the mural
on a following week.
Completion:
During the week following the painting of the mural, it shall be coated with a UV -
protective sealant to minimize fading, dampness, or weather damage over the years.

how to paint sumi-e style and make impressionist paintings using primary colors. Teaching next-

Materials Quality and Durability
for Proposed Mural
Edmonds Entertains by Ellen Clark

This mural shall be painted using Nova acrylic paint and products, widely regarded as the
first choice of muralists; across the country. Nova Color Artists Acrylic Paints has been
made in Culverton, CA since the 1960s. Nova employs a tough, durable, 100% acrylic
resin suitable for use outdoors. No additives are needed for exterior use.
(By way of contrast: House Paints or craft paints are often made with a less expensive
and less durable latex or vinyl latex resin, designed to last 5- 10 years before recoating.)
The American Society for Testing and Materials (ASTM) standard D5098 rates the
lightfastriess of pigments (ie resistance to fading). Lightfastriess I is the highest rating,
and the majority of colors to be used in painting of this mural are rated 1.
In addition, the clear topcoat Nova Color #216 Exterior Varnish or Nova Color #206
Gloss Medium & Varnish designed for exterior use by Nova will be applied to the
completed mural to protect against dampness, fading due to UV rays or weather damage.
Nova Color Artists Acrylic Paints conform with federal art material labeling guidelines
and have been reviewed by a toxicologist. All colors except the cadmium colors (rarely
used in murals) are labeled as follows:
No health hazard labeling required.
Labeling conforms with ASTM D-4236.
Chicago Public Arts Group recommends Nova paint in the painting of exterior murals,
saying: "Many murals in Chicago have life spans of thirty years and more. With ongoing
restoration and publication efforts, these works of art will speak to local, national, and
international communities for decades to come."

WALL LEASE AGREEMENT
AGREEMENT BY AND BETWEEN THE EDMONDS MURAL SOCIETY AND STEPHANIE MAYO, MANAGING
MEMBER OF THIRD AVENUE SOUTH PROPERTIES
This Lease between Stephanie Mayo, Managing Member of Third Avenue South Properties as Lessor (herein
called "Wall Owner") and the Edmonds Mural Society, as Lessee (herein called the "Society", WITNESS THAT
The Society has a program for expanding public experiences with visual art by placing works of art in public
places and in places open to the view of the public; and
The Wall Owner desires to participate in such program and to lease to the Society a building wall under its control
for the display of a painted mural (hereinafter referred to as the "Work"), that will be open to the view of the public from
nearby public rights(s) of way;
NOW, THEREFORE, in consideration of the mutual covenants hereinafter contained, the parties hereto agree as
follows:
Article 1. Lease Propgrty. The Wall Owner hereby leases to the Society the entire west wall of the building (which space
is referred to hereinafter as the "Wall") located at the property described as follows:
Addressed 313 Main Street, Edmonds, Washington.
Article 2. Compensation and Payment Schedule.
The Society agrees to lease the space described in Article 1 for a sum of One Dollar ($1) per year paid in a lump
sum as compensation for the entire term of the lease. Lessor shall be paid by the Society for services related to this
Agreement only as provided hereinafter. Such payment shall be in full compensation for use of the Wall as described
herein. The total payment is subject to adjustment as set forth in Article 3a. Total payment shall be made as set forth
below:
Payment $5 Within ten (10) days of the execution of the agreement
Article 3. Duration. The term of this lease shall commence on July 1, 2012 and shall terminate on June 30, 2017, a
period of sixty (60) months, unless terminated earlier under special circumstances as subsequently provided.
a. Execution of the right of termination under special circumstances as subsequently provided, the Wall Owner
agrees that it will not intentionally destroy, obliterate, damage, alter, modify or change the Work, or in any way restrict or
obstruct its view from the general public from nearby public rights(s) of way during the lease term. The Wall Owner may
terminate this lease upon thirty (30) days written notice to the Society due to actual needs of the building for
reconstruction purposes or to erect a structure that restricts or obstructs the view of the Work or if sale of the building is
jeopardized by having the agreement in place.
b. The Wall Owner agrees not to post signs or posters of any kind on the same wall as the Work.
c. The Society is responsible for all routine cleaning, maintenance and/or repair of the Work.

d. In the event a person other than the Wall Owner erects a structure that, in the opinion of an authorized
representative of the Society, restricts or obstructs the view of the Work, the Society may terminate this lease upon thirty
(30) days written notice to the Wall Owner.
e. In the event the building upon which the Work is executed is sold during the term of
this lease agreement, the Wall Owner shall condition such sale upon the acceptance of and adherence to the terms of this
lease by the new building owner.
Article 4. Entire Agreement. This writing embodies the entire agreement and understanding between the parties hereto,

Article 5. Modification. No alteration, change or modification of the terms of the Agreement shall be valid unless made in
writing and signed by both parties hereto.
Article 6. Waiver. No waiver of performance by either party shall be construed, or operate as a waiver of any subsequent
default of any terms, covenants and conditions of this Agreement.
Article 7. Governing Law. This Agreement, regardless of where executed, shall be governed by and construed in
accordance with the laws of the State of Washington.
Article 8. Heirs and Assigns. This Agreement shall be binding upon and shall inure to the benefit of the Society and the
Artist and their respective heirs, personal representative, successors and permitted assigns.
Article 9. Dispute Resolution. All disputes or controversies that may arise between the parties with respect to the
performance, obligations or rights of the parties under this Agreement, including disputes as to the physical acceptability
of the work on the Wall or any alleged breach thereof, which cannot be otherwise settled shall go to binding arbitration.
Article 10. Notices. All notices, requests, demands and other communications which are required or permitted to be
given under this Agreement shall be in writing and shall be deemed to have been duly given upon the delivery or receipt
thereof, as the case may be, if delivered personally or sent by registered or certified mail, return receipt requested,

improvement at 313 Main Street, located within the Downtown Business (BD I) zone. As part of the
tenant improvement, the applicant has proposed to replace two of the three existing front doors with
windows, while retaining the existing door in the center.

The proposed project requires District -Based Design Review. Projects that remain under the SEPA
threshold are reviewed by staff with the building permit, and the design review is considered an
administrative Staff Decision subject to the requirements of ECDC 20.12 (District -Based Design Review)
and 20.95.040 (Staff Decision — No Notice Required).
Analysis:
Consistent building materials are proposed to be used for the replacement of the two existing doors with
windows. The new windows will be slightly smaller than the existing doors. The walls surrounding the
new windows will be finished to match the existing exterior walls. The proposal is consistent with the
design of the existing structure. A building permit for the proposed improvements will need to be
approved prior to construction.
Technical Review:
The Engineering Division, Building Division, and Fire Department have reviewed the building pen -nit
application (File No. BLD-2008-018 1) for this project. Any comments from these departments will be
provided as part of their review of the building permit application.
Public Comments:
Projects that remain under the SEPA threshold are reviewed by staff with the building permit, and the

The City has been notified that the Insurance Policy for the Street Use Permit at the
subject property is expired. Because a valid Certificate of Insurance is required for every
street use permit per the Edmonds Community Development Code 18.70.030, the permit
at the subject property is now invalid. We consider this matter to be of extreme
importance. Therefore, you must immediately provide a valid certificate of insurance or
you must remove the permitted use of a canopy over the sidewalk by January 20, 1998.
Failure to take action to resolve the matter shall result in dispatch of the City crew to
remove the canopy.

This is the second letter we have sent you regarding your Street Use Permit. The City has
been notified by your insurance company that the insurance policy for Street Use Permit
86-6 has expired. Because a valid Certificate of Insurance is required for every street use
permit (pursuant to Edmonds Community Development Code Chapter 18.70.030) the
permit at the subject property is now invalid. Therefore, you must immediately provide a
valid certificate of insurance or you must remove the permitted canopy -over existing
sidewalk. We consider this matter to be of extreme importance and I will be forced to
begin enforcement action unless we are immediately provided with the required
insurance.
Please be advised, City crews can and will be used to remove all un-permitted structures
from City right of way when a street use permit violation exists. It is not the City's intent
to cause you undue hardship however, compliance to the codes is mandatory to ensure
fair and equal treatment of all citzens.

The purpose of this letter is to inform you that the referenced street use permit for the canopy is
injeopardy of being revoked. The City Building Division has contacted you five times regarding
your oblig ation to maintain a continuous insurance policy for the canopy. The City was notified
by your insurance carrier last December that- the insurance policy was cancelled. Unless a
replacement certificate of insurance is immediately provided you leave the City with no choice
but to initiate the process to revoke the street use permit.
It is not the City's intent to cause you undue hardship however, compliance to the codes is
mandatory for the fair and equal treatment of all citizens. Unless a new policy is received by
August 14, 1998 the City shall be forced to take the necessary action to resolve this issue. Or, if
you no longer desire the street use permit you have the option to remove the canopy yourself by
the August 14, 1998 deadline.

applicant or the City of Edmonds, or any of its departments or employees, including but not limited to the defense

along the public sidewalk, shall be maintained. (e.g. measuring 44 inches from edge of street tree grates or
newspaper stands toward place of business.)
• Exterior fight Fixtures, bamers, signs and flags must provide for a minirnum clear zone of 7 feet above City
right-of-way.
• Clear Landings of 44 inches or no less than the width of the door (whichever is greater), measured toward the
street, shall be maintained on the exterior side of all required exit doors.
• Illumination from the city fight fixtures shall not be blocked.
• No objects shall be hung from the City fight standards.
• Tbree feet of clearance around fire hydrants, standpipes, P.I.Ws, manholes, water rneters, blowoffi, cleanouts
and valves shall be rnaintained.
Applicant shall repair/replace all damage to utilities or frontage improvements in City right-of-way per City
standards that is caused by or occurs during the permitted project.
