WASHINGTON, ADOPTING AN ALTERNATIVE LEGAL
DESCRUMON OF PROPERTY ANNEXED PURSUANT TO
ORDINANCE 2997 IN ORDER TO CLARIFY THE -
BOUNDARIES DUE TO A SCRIVENER'S ERROR IN A
DESCR]YnON "PROVED BY SNOHOMISH COUNTY,
PROVIDING FOR PUBLICATION OF THE LEGAL
DESCRIPTION AND THE RELATION BACK OF THE
CORRECTION AND FIXING A TIME WHEN THE SAME
SHALL BECOME EFFECTIVE.
WHEREAS, the City of Edmonds has by Ordinance 2997 annexed certain
property of the City of Edmonds known as the Aurora Marketplace Annexation, and
WHEREAS, the City of Edmonds prepared a legal description for such property
which was forwarded to Snohomish County for review, and
WHEREAS, Snohomish County substituted a revised legal description
recommending its adoption by the City, and
WHEREAS, the City of Edmonds in reliance upon Snohomish County's
suggestions adopted such legal description as a part of Ordinance 2997 annexing Aurora
Marketplace annexation, and
WHEREAS, it has been deter -mined that portions of the legal description are
ambiguous and should be corrected, and

WHEREAS, such corrections will not affect the territory shown on the pictorial
exhibits nor increase or decrease the property annexed by Ordinance 2997, NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. A revised legal description for the Aurora Marketplace annexation
adopted pursuant to Ordinance 2997 is hereby adopted as a correction of a scrivener's error
pursuant to the authority granted the City by RCW 35A.21.130 and 35.21.5W(3). The
corrected legal description amends and shall be substituted for Exhibit A of Ordinance 2997.
This amendment shall relate back to the date of adoption and effective date of Ordinance 2997.
Section 2. Effective Date. This ordinance, being an administrative action, is not
subject to referendum and shall take effect five (5) days after publication of an approved
summary thereof consisting of the title and publication of the legal description attached hereto
as Exhibit A and incorporated herein by this reference as if set forth in full.

The Critical Areas Checklist contained on
this form is to be filled out by any person
preparing a Development Permit
Application for the City of Edmonds prior
to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).

During review and inspection of the subject site.on February 13, 1995 it was found that the
site contains a Steep Slope Hazard Area pursuant to Chapter 20.15B of the Edmonds
Community Development Code.
Based on these findings, prior to submission of any development permit, you will be required
to submit the following for review by tile Planning Department:
1. Before any permit application may be applied for, submit to the Planning
Department a topographic survey prepared by a Licensed Land Surveyor delineating
Steep Slope Hazard Areas. Any slope over 30% with more than 10 feet of rise will be
classified as a Steep Slope Hazard Area. A 50 foot bUffer is required from both tile
top and toe of the slope. A 15 foot buil.ding setback is required from the 50 foot
.buffer.
2. If the results of the above survey determine the lot unbuildable, any
development which is not identified as an exception per ECDC Chapter 20.1513 must
receive a Reasonable Use Exception or a Variance pursuant to ECDC 20.15B. 180A and
20.15B.040C).
3. All proposed development of the subject lot must meet the requirements
of Chapter 19.05 of the Edmonds Community Development Code.
If the property owner wishes to apply for a specific development permit which they feel,
would not impact the Critical Areas located on the site, they may submit their proposal to
the Planning Department for review. If the Planning Department finds that the proposed
development permit will not adversely impact a Critical Areas or its buffers, a conditional
waiver may be issued on a project by project basis.
