The Critical Areas Checklist contained on this form is
to be filled out by any person preparing a
Development Permit Application for the City of
Edmonds prior to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable City staff to
determine whether any potential Critical Areas are, or
may be, present on the subject property. The
information needed to complete the Checklist should
be easily available from observations of the site or
data available at City Hall (Critical Areas inventories,
maps, or soil surveys).
An applicant, or his/her representative, must fill out
the checklist, sign and date it, and submit it to the
City. The City will review the checklist, make a
precursory site visit, and make a determination of the
subsequent steps necessary to complete a development
permit application.
Please submit a vicinity map along with the signed
copy of this form to assist City staff in finding and
locating the specific piece of property described on
this form. In addition, the applicant shall include

Tenants have to show that they have an agreement with Research Technologies that allows them to sublet a parking
space that Research Technologies has leased from the City parking lot. They have to provide documentation of the lease
agreement in the form of a letter from Research Tech. that states the parking space number and that the Planning Division
will be notified if the lease is terminated. These lease agreements are in the street file. I should point out though, that not
every tenant has a parking space. Many share office space and it is the office area that requires the parking space - not
the actual tenant. I always check to make sure no new space is being utilized that does not already have parking
calculated for it (i.e. therapist B is sharing therapist A's office and therapist A has a parking agreement - so - therapist B
will not need an additional parking space). Please let me know if you have any questions. Thank you!

1 . Chairs are now shown at tables on floor plan. Floor plan now shows

2. Width of rear exit door is 36"; width of hall way to door is 54". Both front
and rear exit doors will have panic hardware installed. Drawing now
reflects all the above information.
3. Illuminated exit signs will be posted at both front and rear exits. This is
now indicated on the floor plan.
4. Enclosed please find copy of current lease agreement and copies of
all correspondence pertaining to the parking plan. We are working
with Steve Bullock, senior planner, City of Edmonds, on finalizing this,

Lessee agrees to maintain public liability insurance on the
Premises in the minimum limit $100,000. for property damage
and in the minimum of $300,000/$500,000. for bodily injuries
and death, and shall name Lessor as an additional insured in
both policies.

insurance policy is in full force and effect, that Lessor has
been named as an additional insured, and that the policy may
not be cancelled unless ten (10) days prior written notice of
the proposed cancellation has been given to Lessor.
20. SUBROGATION WAIVER: Lessor and Lessee each herewith and
hereby releases and relieves the other and waives its entire
right of recovery against the other f or loss or dainage aris-
ing out of or incident to the perils described in standard
fire insurance policies and all perils described in the "Ex-
tended Coverage" Insurance endorsement approved for use in
the state where the Premises are located, which occurs in, on
or about the Premises, whether due to the negligence of ei-
ther party-J, their agents , employees or otherwise.
21. DEFAULT AND REENTRY: If Lessee shall fail to keep and
perform any of the covenants and agreements herein contained,
other than the payment of rent and such failure continues for
thirty (30) days after written notice from Lessor, unless ap-
propriate action has been taken by Lessee in good faith to
cure such failure; Lessor may terminate this Lease and re-
enter said Premises, and sublet the whole or any part thereof
for the account of the Lessee upon as favorable terms and
conditions as the market will allow for the balance of this
Lease and Lessee -covenants and agrees to pay to Lessor any
deficiency arising from a re -letting of the Premises at a
lesser amount than herein agreed to. Lessee shall pay such
deficiency each month as the amount thereof is ascertained by
Lessor. However, the ability of Lessor to reenter and sublet
shall not impose upon Lessor the obligation to do so.
22. REMOVAL OF PROPERTY: In the event Lessor lawfully re-
enters the Premises as provided herein, Lessor shall have the
right, but not the obligation,, to remove all the personaL
property located therein and to place such property in stor-
age at the expense and risk of Lessee.

23. COST AND ATTORNEY'S FEES: If, by reason of any default

modification of the agreements contained herein except by
written instrument.
26. SURRENDER OF PREHISES: Lessee agrees, upon termination
of this Lease, to peacefully quit and surrender the premises
without notice, leave the Premises neat and clean and to de-
liver all keys to the Premises to Lessor.
27. HOLDING OVER: - If Lessee, with the implied or express
consent of Lessor,* shall hold over after the expiration of
the term of this Lease, Less ; ee shall remain bound by all the
covenants and agreements herein, except that the tenancy
shall be from month to month and rent shall be 125% of the
monthly rent then in effect.
28. BINDING ON HEIRS, SUCCESSORS AND ASSIGNS: The covenants
and agreements of this Lease shall be binding upon heirs, ex-
ecutors, administrators, successors and assigns of both par-
ties hereto, except as hereinabove provided.
29. USE: Lessee shall use the Premises for the purposes of:
__�Restaurant/Deli___�and for no other purposes, without
written consent of Lessor, at Lessor's sole discretion. In
the event Lessee's use of the Premises increases the fire and
extended coverage or liability insurance rates on the build-
ing bf which the Premises are a part, Lessee agrees to pay
for such increase.

fully observing and fulfilling the terms and covenants of
this agreement, shall have and be entitled to enjoy the
peaceful possession and quiet enjoyment of the leased pre-

31. NOTICE: Any notice required to be given by either
party to the other shall be deposited in the' United States
mail, postage prepaid, addressed to the Lessor at:

this Lease on behalf of said corporation represents and war-
rants that he is duly authorized to execute and deliver this
Lease on behalf of said corporation in accordance with a duly
adopted resolution of the Board of Directors of said corpora-
tion, and that this Lease is binding upon said corporation in
accordance with its terms. If Lessee is a corporation Lessee
shall -within thirty (30) days after execution of this Lease,
deliver to Lessor a certified copy of a resolution of the
Board of Directors of said corporation authorizing or ratify-
ing the execution of this lease.

STANDARD OPTION AGREEMENT
The Tenant shall have the option to be exercised only as
hereinafter provided, to extend the term of this Lease for an
additional —two f ive year terms_f ollowing the initial term
hereof, but only upon condition that there is no material de-
fault in the performance of any condition of this Lease at
the time of the exercise of each option or at the time of
commencement of each renewal period. The option shall only
be exercised by Tenant delivering written notice thereof to
the Landlord not less than - 120 — days prior to the expiration
of the original term and first option term. Upon such exer-
cise, this Lease shall be deemed to be extended without the
execution of any further Lease or other instrument. The
terms and conditions during the renewal periods shall be the
same as the terms and conditions during the original term of
this Lease, EXCEPT for MONTHLY BASE RENT which shall be nego-
tiated. The security deposit will continue to be held by the
Landlord as during the original term of this Lease. Under no
conditions whatsoever, is this Standard Option Agreement as-
signable, UNLESS authorized in writing by Landlord.
Base rent shall be at the then market rate for like building,
like business and like area. Should Lessee and Lessor not be
able to agree on the monthly base rent, each shall select a
Commercial Real Estate Broker (agent) as arbitrator. The two
arbitrators selected shall select a third arbitrator. The
parties hereto agree to be bound by the majority decision of
the arbitrators.
If rental rates are not agreed upon within 60 days prior to
the renewal date,' Lessee and Lessor shall chose their arbi-
tration candidates within seven days. The two arbitration
candidates shall have seven' days in which to choose the third
arbitration candidate. The arbitration committe shall have
no more than 40 days in which to reach a decision. If for
any reason, agreement has not been reached by the renewal
date, the new rate, when agreed upon, shall be retroactive to
the effective renewal date.

The City of Edmonds is attempting to complete the annual Street Use
Permit billing and fee renewals. The business known as Chanterelle
Specialty Foods, under the ownership of Jochen Bettag, had been
approved for, and retained, two Street Use Permits. One is for the
business sign overhanging the sidewalk; the other for benches in front
of the business. If the business has changed ownership it will be
necessary for the new owner to either complete new applications for
Street Use Permits and pay the $25/permit fees, or remove the sign and
benches. If Mr. Bettag is still the owner of the business it will be
necessary for him to pay the $10 renewal fees per permit. Fees are due
and payable now.
Applications are available at the Building Department, 250 5th Avenue

current year and are currently set at $10. -Please remit fees within 15

I noted that your letter was addressed to "Electronics R&D". That is not the correct name of
our business. The correct name of the new business (partnership) we are starting is "Alignment
Sensors".
You are receiving this letter on letterhead from Research Technologies, which is one of the
partners in "Alignment SensoW'. Research Technologies is the managing partner of Alignment
Sensors and its designated business address. I have enclosed a copy of our license application for
your reference. Please ensure that your records are corrected to reflect the proper name of our
business.
Please note that "Alignment Sensors!'will not be adding any staff or employees. It was
formed to pursue a specific project with our other partner. Research Technologies will be doing all
of the design work for this partnership with its (Research Technologies) existing employees. I
wanted to explain this as other city departments have called and there has been some confusion
about what "Alignment Sensors!'does, who works for it, and how can it be that there are no
employees, etc. I hope this clarifies our status.

11. Parking Space Leases
In your letter you mentioned that Jochen Bettag has been leasing 4 spaces from SeaFirst
Bank to fulfill the required number of spaces for the upper floor unit. That is actually incorrect as of
some years ago.
In November of 1991, Jochen Bettag, then the owner of the building and the owner of
Chanterelle's restaurant on the first floor, sold the entire building to Dena Blatt of Anacortes. Since
that time Jochen has neither owned the building, maintained any business in it, nor maintained any
parking leases.
Since 1988 and prior to the sale, we paid Jochen for the use of 4 parking spaces - stalls 1-4,
Fourth AVE lot. During that time, he was leasing them from the City, not Seafirst. Prior to selling
the building, Jochen asked us if we desired to take over the lease on the parking spaces 1-4, 4th
AVE Lot. We did, as we would have to close our business if our staff had no off-street parking. WE
HAVE BEEN LEASING STALLS 1-4,4th AVE LOT, FROM THE CITY OF EDMONDS SINCE
NOVEMBER OF 1991. IT IS CRITICAL TO THE CONTINUANCE OF OUR BUSINESS THAT WE
BE ABLE TO CONTINUE TO LEASE THOSE SPACES.
Today, I spoke to Sandy, the Deputy City Clerk, and expressed concern that the City's
records may not reflect us as the lessee of the parking spaces discussed above. She reassured me
that if we have been paying for these spaces, we will have the right to continue to lease the parking
until we no longer wish to. I asked her if we could get assurance that we can continue to lease the
parking and if we could get a letter from the City verifying that we hold the right to lease those
spaces. She indicated she would research these matters and get back to me. If you have a[)Y
further guestions regarding parking, please call me immediately.
Ill. Will we have customers visiting the site?
We do not have any walk up customers as we are not a retail business. We do electronic design
work and development for large companies throughout the United States. The vast majority of our
interaction with them is via phone and facsimile. We have approximately 1 or 2 visits per month
from any of our local customers. Based on the extremely rare customer visits, I don't feel there is
any need to consider any parking requirements in addition to the 4 spaces we already have.

This Lease, made this 26th day of 4-;r� 1988, between M AY 19 88
RAINIER NATIONAL BANK, Lessor, and JOCHEN BETTAG, d/b/a
CHANTERELLES, Lessee.
1. The Lessor hereby leases to Lessee, and Lessee hereby
leases from Lessor those certain premises situated in the
City of Edmonds, Snohomish County, Washington, described as
follows:
The four parking spaces adjacent to 4th street on the
southeast corner of property owned. by Rainier National Bank
(The East Parking Lot).

QD 2. The premises are to be used as parking for Lessee's
tenants, RESEARCH TECHNOLOGIES, and for no other business,
without the written consent of Lessor.
3. This lease shall be ongoing unless canceled by either
the Lessor or Lessee upon 30 days written notice.
4. Rental for said premises shal I be 0/, 4zoo
per year, paid in monthly amounts on the first of each
m,onth, commencing May 1, 1988.
S. In the event that the Lessor enters into an agreement
with the City of Edmonds or others for a lease on the whole
parking lot, this agreement shall be terminated upon
commencement of new lease.
6. The premises have been inspected and are accepted by
Lessee in their present condition, and Lessee will at all
times keep the premises neat and clean condition. If any
improvements are required under Local, State or Federal
ordinances, statutes, rules or regulations, compliance will
be at the sole cost and expense of the Lessor.
7. All personal.property on —said leased premises shall be
at the risk of Lessee. Lessor shall not be liable for any
damage, either to person or property, sustained by Lessee or
others caused by any defects now in said premises or
hereafter occurring thereon due to any accident or
occurrence from whatsoever cause on or about said premises.
Lessee agrees to defend and hold Lessor harmless from any
and all claims for damages suffered or alleged to be
suffered on or about the leased premises by any person, firm
or corporation. In order that this covenant and agreement
may be effective, Lessee hereby covenants and agrees to
maintain at all times during the term of this lease, public
liability insurance on the premises herein desc-ribed '
equivalent to that business insurance carried upon Lesse.e's-

event that Lessee fails to insure said premises as agreed
Lessor retains the right to obtain equivalent insurance

all driveways as established shall be free of permanently
parked cars.

consider the attached application in two parts. The first one,
to allow Chanterelle Specialty Foods, Inc. to use the sidewalk on
the north side of the building at 316 Main St. for placing 4 park
style benches and 2 clay flower pots. The second portion.
subject to the approval by the ADB, would consider theplacement
of tables and a sandwich board on the sidewalk (with the under-
standing that either the sandwich board or the tables would be
used at any single time, never both at once).

The City of Edmonds is attempting to complete the annual Street Use
Permit billing and fee renewals. The business known as Chanterelle
Specialty Foods, under the ownership of Jochen Bettag, had been
approved for, and retained, two Street Use Permits. One is for the
business sign overhanging the sidewalk; the other for benches in front
of the business. If the business has changed ownership it will be
necessary for the new owner to either complete new applications for
Street Use Permits and pay the $25/permit fees, or remove the sign and
benches. If Mr. Bettag is still the owner of the business it will be
necessary for him to pay the $10 renewal fees per permit. Fees are due
and payable now.'

apparent that Mr. Bettag would need to provide for additional parking
for his project. This determination was based on the following analysis
of parking need:

Retail area = 1,248 sq. feet @ 1/300 = 4.16 spaces
Seating area = 281 sq. feet @ 1/200 = 1.40 spaces
Mfg. @ 1 per 2 employees for 3 empls.= 1.50 spaces
Office = 156 sq. ft. @ 1/800 .19 spaces

Total = 11.12 spaces
Mr. Bettag has provided five spaces for parking at the rear of his
building. This leaves a deficit of six spaces. He has provided the

remaining three spaces.
We have agreed to issue a temporary certificate of occupancy for the
main floor only, as he has adequately provided parking for that level.
Mr. Bettag understands that he must make arrangements for parking for

As we discussed, I have had bids and requested drawings
for the Fire Marshall in order to take care of the items

receive the drawings, I will forward them -to you for your
approval so that we can start on the improvements.
The cost will probably be around $14,000. This is quite a
large sum and because of the economy and the unavailability of
money to lend, it will take us at least six months to finance

As a result of field inspection and a review of Fire and
Building Code requirements for the present use and occupancy
of this structure, the following have been established as
the minimum corrections necessary to meet life safety standards:
1) Provide 2 exits from the second floor, with the
second exit at the north (Main Street) end of the
building.
2) Obtain a State of Washington permit for the
elevator or hoist.
3) Provide a one hour separation between the silk
screening area and the balance of the building,
and comply with Electrical and ventilation re-
quirements of the Fire Code.
4) Provide striped lines on floor delineating clear
exit pathways thru storage and manifacturing areas.
5) Post load limit signs on floor loaded'over 50
pounds per square foot. Provide engineering
documentation to confirm posted loads.
6) Provide a monitered fire detection system for the
entire structure, in accordance with Fire Dept.
requirements.
Please submit plans and specifications detailing these re-
quirements, for city review before May 1, 1980.
