prior to 1940. The applicant is in the process of restoring the
old building, and in the process has exposed previously covered
windows above the storefront. Due to the location of the
existing windows, the applicant can only place the proposed
projecting sign above the 14 foot height limit at a maximum
height of 18-feet 8-inches. Due to the proposed sip height the
application must receive variance approval and approval by the
ADB.

after visiting the site, the Hearing Examiner conducted a public hearing on the application. The

Carol Prichard said she agreed with the staff report, except she noted that the building is
older than indicated in the report.

No comments were offered by the general public.

FINDINGS OF FACT AND CONCLUSIONS
A. Site Description
1. Site Development and Zoning:
a) Facts:
(1) Size: The subject property is approximately 4,400 square feet in area (see Exhibit
A, Attachment 4).
(2) Zoning% The zoning of the subject property is Community Business (BC) (see
Exhibit A, Attachment 1).
(3) Terrain and Vegetation: 'Me subject property is flat and entirely developed with
buildings and pavement.

B. Edmonds Community Development Code (ECDC) Compliance
1. Compliance with ECDC Section 20.60 (Sip Permits)
a) Fact:
(1) The fundamental standards for locating sips for commercial endeavors in a BC
zone are set forth in Section 20.60.07O.C.
(2) The proposed projecting sign is 18'8" high, which is 4'9" above the allowable sign
height for wall mounted signs in the BC zone (see Exhibit A, Attachment 5).
(3) A summary of the proposed signage is as follows:

2. Compliance with requirement for a Variance
ECDC Chapter 20.15B. I 80.A, states an applicant may request a variance from the
standards of this Chapter pursuant to the procedures set forth in ECDC Chapter 20.85
(Variances). Chapter 20.85 of the ECDC sets forth the mechanism whereby a provision of
the Code may be varied on a case -by -case basis if the application of the provision would
result in an unusual and unreasonable hardship (see Exhibit A, Attachment 3).
a) F=:
(1) ECDC Section 20.85-010 establishes the decisional criteria with which a variance
request must comply in order to be granted by the Hearing Examiner. These
criteria include: a special circumstance must exist; no special privilege is granted;
the proposal is consistent with the Comprehensive Plan and the Zoning Code; the
proposal will not be detrimental and is the minimum necessary.
(2) Variances may be used to modify bulk standards. They may not be used to modify
use or procedural requirements.
b) Conclusions:
(1) Special Circumstances
The subject building is a historic building in the City of Edmonds. The architecture
of this historic building included clearstory windows above the large storefront
windows. In restoring the original character of the building the decision was made
to retain the clearstory windows and mount the proposed sign above them.
(2) Special Privilege
Approval of the proposed height variance for this stores sip would not be a grant
of special privilege in that the prior store at this location had a sign located 18'8"
above ground. There are also several other businesses in the immediate vicinity
along Main Street that have signs over 18' in height. These include Chantrelle's,
The Edmonds Movie Theater, The Papery and others.
(3) Zoning Code and the Comprehensive Plan
The subject property is designated on the Comprehensive Plan as a Commercial
Business area and zoned accordingly. Therefore the business and the proposed
sign are consistent with the Comprehensive Plan and the Zoning Code.
(4) Not Detrimental
The proposed sign will not be a hazard to the public health, safety or welfare, and
will not in any other way be injurious to surrounding properties or businesses.
(5) Minimum Required
Ile sign is being located at the first location on the facade of the building that
provides a solid surface to safely mount the sign above the existing windows.

(1) The Comprehensive Plan designates the subject property as Commercial/Business.
(2) Section 15. 15.030 of the ECDC encourages old buildings n-dxed with new, while
Section 15.30.010(F) states as an objective "to search for an acceptable means of
... old building restoration." Section 15.15.030(B)(2)(b) states that "sips should
be ... perpendicular to the building."
b) Conclusion: The proposed project is consistent with the Commercial/Business
designation in the Comprehensive Plan as well as the policies for development in the
downtown area.
D.. Technical Committee
1. Review by City Departments
a) Facts:
(1) The Engineering Division pointed out that'a Street Use Permit would be required.
(2) The Parks and Recreation Division pointed out that street trees will not be
trimmed to provide greater visibility to the proposed sign.
DECISION
Based upon the foregoing findings and conclusions, the application for a variance is approved,
subject to the following conditions.
1. This variance is to allow the proposal (see Exhibit A, Attachment 4).
2. This application is subject to the applicable requirements contained in the Edmonds
Community Development Code. It is the responsibility of the applicant to ensure
compliance with the various provisions contained in these ordinances.
3. The applicant must obtain a building permit prior to construction.
4. The permit is transferable.

RECONSIDERATION AND APPEALS:
The following is a summary of the deadlines and procedures for filing reconsiderations and
appeals. Any person wishing to file or respond to a recominendation or appeal should contact the
Planning Department for further procedural information.
A. REQUEST FOR RECONSIDERATION:
Section 20.100.010.0 allows for the Hearing Examiner to reconsider his decision or
recorrimendation if a written request is filed within ten (10) working days of the date of the initial
decision by any person who attends the public hearing and signs the attendance register and/or
presents testimony, or by any person holding an ownership interest in a tract of land which is the
subject of such decision or recommendation. The reconsideration request must cite specific
references to the findings and/or the criteria contained in the ordinances governing the type of
application being reviewed.
B. APPEALS:
Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or
recommendation shall be made. 'Me appeal shall be made in writing, and shall include the
decision being appealed along the name of the project and the date of the decision, the name of
the individual or group appealing the decision, their interest in the matter, and reasons why the
appellant believes the decision to be wrong. The appeal must be filed with the Community
Development Director within ten (10) working days after the date of the decision being appealed.
C. LAPSE OF APPROVAL
Section 20.05.020.0 states 'Unless the owner obtains a building permit, or if no building is
required, substantially commences the use allowed within one year from the date of approval, the
conditional use permit shall expire and be null and void, unless the owner files an application for
an extension of the time before the expiration date.'

REQUEST FOR VARIANCE
We. wish to install a projecting, wall -mounted sign at our now business location, 318. Main
Street in downtown Edmonds. The code states that sips can be mounted to a heighth of 14 feet.
We are requesting a variance to place our sign at 18 feet, 8 inches.
1. HOW DOES THE PROPOSAL MEET THE SPECIAL CIRCUMSTANCE CRITERIA?
We are occupymg a historic budding on Main Street� formerly known as The Variety Store
and originally known as the, Co-op Feed store. The Variety Store had a 4 ft x 8 ft
projecting sign, mounted at 18 A 8 inches for many years. The budding is currently being
cleaned and repaired for our occupancy, targeted for February 1, 1996. As part of the
restoration, the false front of the building was removed due to deterioration, revealing the
original windows above the large storefront windows. The decision was made to leave the
windows exposed and to paint the store, making the front of the building appear similar to
the restored, historic budding next door that houses Chantreffe's restaurant. Our proposed
sign could be saffly mounted above the newly exposed windows.
2. EXPLAIN WHY THE PROPOSAL IS NOT A GRANT FOR SPECIAL PRIVILEGE.
Placing a projecting sign in front of our store is consistarit with the surrounding businesses.
In addition to Chantreffe!s Restaurant other businesses in the immediate vacinity have
projecting signs, such as The Rosebud, Edmonds Floral, Portraits Helen Reynolds, The
Papery and Main St. Optical. The Edmonds Movie Theatre, which is also a landmark, site
in Edmonds, has a large projecting sign mounted above the - 14 ft. level. We utilized the
City of Edmonds Building Design and Site Treatment Guide and found two references to
our situation. They are 15.15.030 (B)(1)(D) and 15.15.030 (B)(2)(A). These references
illustrate historic budding restoration and preservation, and show two mews of Chantrelle!s
restaurant as good examples. .

REQUEST FOR VARIANCE
We wish to install a projecting, wall -mounted sign at our now business location, 318 Main
Street in downtown Edmonds. The code states that signs can be mounted to a heighth of 14 feet.
We are requesting a variance to place our sign at 18 feet� 8 inches.

1. HOW DOES THE PROPOSAL NEET TBE SPECIAL CIRCMASTANCE CRITERIA?
We are occupying a histonc budding on Main Strect� formerly known as The Variety Store
and origin* known as the Co-op Feed Store. The Variety Store had a 4 ft x 8 ft
projecting sign, mounted at 18 A 8 inches for many years. The building is currently being
cleaned and repaired for our occupancy, targeted for February 1, 1996. As part of the
restoration, the false front of the building was removed due to deterioration, revealing the
original windows above the Large storefront windows. The decision was made to leave the
windows exposed and to paint the store, making the front of the building appear similar to
the restored, historic building next door that houses Chantrelles restaurant. Our proposed
sign could be saffly mounted above the newly exposed windows.
2. EXPLAIN WHY THE PROPOSAL IS NOT A GRANT FOR SPECIAL PRIVILEGE.
Placing a projecting sign in front of our store is consistant with the surrounding businesses.
In addition to Chantreffes Restauran� other businesses in the immediate vacinity have
projecting sigm, such as The Rosebud, Edmonds Moral, Portraits Helen Reynolds, The
Papery and Main St Optical. The Edmonds Movie Theatre, which is also a landmark site
in Edmonds, has a large projecting sign mounted above the 14 ft. level. We utilized the
City of Edmonds Building Design and Site Treatment Guide and found two references to
our situation. They are 15.15.030 (B)(l)(D) and 15.15.030 (B)(2)(A). These references
illustrate historic budding restoration and Preservation, and show two mews of Chantrelles
restaurant as good examples. -
