CORRESPONDENCE Mrs. Block reported a letter had been received from Clyde Dimmick, applicant in V-67-77, the first item on this evening-'s agenda, requesting a continuance to MR. (RMH) Mrs. Block said the Zoning Code requirement for this area is for a 20' rear yard setback. The applicant proposed to construct a cover for rear parking spaces which already exist in this area. The property Ave. There is angle parking to the front and side of the abuts 3rd e site, building. The 7 parking spaces in question are to the rear of th adjacent to the alley, and the applicant wished to cover those spaces. Mrs. Block displayed a slide of the alley and the parking spaces in question. The cover would end approximately 5' from the alley. Mrs. Block said this would not amount to a rezone and the building had been in existence since 1968. The owner intend s to change the property to condominium use and wants to cover these parking spaces for the new owners. Mrs. Block said oth er properties in the area must provide for the same do covered parking. The conditions setbacks, but many apartments provide did not exist because of actions of the owner, as the building was built by a previous owner. Mrs. Block said the Zoning Code allows parking in this ar ea but prohibits structures from encroaching into the setbacks. Strict adherence to the Zoning Code would preven t the applicant from covering the parking. Mrs. Block felt that if a cover were built under certain conditions, it should not be detrimental to the other property owners in the area. She said these conditions should include provision that no interfere with traffic maneuverability. She felt the requested posts would variance would be a minimum variance to a ilow provision of covered parking on the site . and, if properly developed, the use should be in harmony with the Zoning Code. Her recommendation was for approval, but with roofs to be cantilevered as much as possible so as not to cause the posts to be close to the alley. The public portion of the hearing was opened. The applicant said he felt his proposal would be for the betterment of the new owners who will be moving into the building. He said the alley was a deadend alley and he did not believe problems would be created by the construction of a roof over the parking. His application had indicated he wished to build covered carports or garages , and he was asked to state which he intended. He responded that he intended to do as described by Mrs. Block in her presentation. The public portion of the hearing was then closed. The applicant was asked if the alley was used as a turnaround. He replied that it was not; that, generally, only his tenants used it. He said the heighi of the roof would be as dictated by the Building Department. Mr. Hovde noted that the building sets back 2716" from the property line. He said a 241 turning radius is legal, even if the columns were right out at the edge. MR. She said the variance requ for 16 units. The Code requires 2,600 sq. ft. for the first unit and 1 unit. Area required for 16-units would 2,400 sq. ft. for each additiona ft. Mrs. Block be 38,600 sq. ft., and the area proposed was 38,440 sq. said this would not amount to a rezone and the special condition was the proximity of the area available to the required area. She said the area available was so close to the required area that strict enforcement would deprive the applicant of commonly enjoyed rights, and the lot configuration - to purchase by the applicant so they were and size were established prior ven the size of this property, she felt not a result of his actions. Gi it would create an unnecessary hardship to develop the site for only 15 units, and she said the site would accommodate the additional unit without difficultyas far as parking and required amenities were concerned. She felt granting of the variance would not be detrimental to the health, safety, and welfare of the neighborhood and that the.area being zoned RML ential for high traffic or congestion that a higher .did not have the pot density zoned property would. She felt the increase by one unit should not be detrimental and that the overall development would be similar with 15 or 16 units. She said it would be a minimum variance to make reasonable use of the landt and that it appeared that granting of the variance would be in harmony with the Zoning Code.
