Analysis 1. Design Standards. The Comprehensive Plan identifies the site as Downtown/Waterfront Activity Center — Downtown Convenience. The proposed sign satisfies the intent of the following goals and policies from the Comprehensive Plan: a. Downtown Design Objectives are found on pages 38-42 and are intended to encourage high quality, well designed projects to be developed in the downtown waterfront area that reflect the values of the citizens of Edmonds. b. "Provide clear signage to identify each distinct property or business and to improve orientation and way -finding downtown. " (page 39) c. In this case, the tenant frontage is 64 feet wide and the proposed sign is 16 square feet. The top of the sign will be approximately 13 feet above grade. For clarification purposes and ease of understanding (for me especially) I will address each "bullet" item in your August 28th letter. "Change of Use": the previous tenant before Community Solutions is the only one I can remember. They stored motorcycle tires for shipments. They employed approximately 7 people. When they moved we made no alterations to the space except putting in new toilets and sinks to replace those from original construction. We also did the normal cleaning and painting to get the space ready for the next tenant. • "Fire Wall Breach": I met with Mr. Tony Shapiro today. He is willing to help us with obtaining a permit. His company is apparently short handed. Therefore, he said it would take until approximately October 15th, 2006 to get to this. I have also scheduled a meeting with Fire Marshal Westfall on September 5 th , 2006 to review the fire wall breach. • "Toilet Rooms": Enclosed please find an affidavit stating the toilet rooms are original. However, the adjoining office/conference room remains in question. As you mentioned in your letter, we would like you to revisit the change of use issue as mentioned in the first bulleted item. Ideally, we would really like to meet the "exempt" status if at all possible and move on. It has been difficult for Howard Wilson -the owner, Shawn Monahan -of Community Solutions, and me to all understand the entire scope of the issue at hand. From an owner/manager perspective we have never had to submit architectural drawings since the building was built. in 1969. We dorealize the need to pursue permits if the "use" changes for.any of.our tenants. Uniquely, to date, this has not occurred. More specifically, Community Solutions is utilizing the same offices and warehouse space as the previous tenants (which occupied that same location since the building was c I ompleted). While in a meeting today with Mr. Monahan, he mentioned a previous meeting and ongoing talks he has had with Mr. Duane Bowman. In reviewing the correspondence that I have, it appears that Fire Marshall WestfaU acknowledges that the existing sprinkler system is adequate for the entire space. I see no mention from him of a fire door between offices. However, upon inspection of the wall Ann mentioned, we can install a self - closing fire door at that location. The bathrooms were obviously "as built" upon original construction due to the concrete sub floor. Once again, since use is not changing we see no reason, to demolish them and neighboring walls in order to install a "handicap accessible" bathroom. As was mentioned in our meeting, Community Solutions is a non-profit reaching out to the community of Edmonds in various and admirable ways. As landlord, we felt that they would be an excellent addition to the city. We chose them as tenants over higher qualified and higher paying tenants that would not have been a good fit here in downtown Edmonds. In fact, because of what they do, we subsidize a portion of their rent. In your letter dated August 15, 2.006, you wrote "that it is not the City's intent to cause undue hardship..." As owners, Mr. and Mrs. Wilson do not want any hardship. They built Highlands Park Apartments (now condominiums) in 1967, The Edmonds Center (Petosa's Family Grocer) in 1969, Olympic View Apartments and Sound View Apartments (303 Howell Way & 417 P Ave S., HUD Low Income Elderly properties) in 1976-1978. Since 1969, we all know that the building codes have changed dramatically. To require ownership to bring a CMU structure with limited parking to current code levels is impossible without displacement of tenants. We appreciate the intent of the Development Services - Department to achieve "equal and fair treatmenf' of all. Yet, these circumstances are understandably unique and therefore require unique treatment especially in light of the fact that the use has not changed since original construction. We have the following points of clarification: 0 As explained to you at the pen -nit counter on August 21", there are typically two situations that require building pen -nits; 1) when remodeling occurs (please refer to the City handout for exempt work) and, 2) when a change in use occurs (a change 'in occupancy group or within an occupancy group as described in IBC Section 302). To date the City has identified both situations applicable to Community Support Solutions as we have identified walls and rooms created that do not appear to be original (office, toilet room, conference room) and according to City license records, Community Solutions is a change in use from previous business uses in that space. If you desire my office to re -visit the change of use issue please provide a history of tenants within this space with a bnief description of the business use. 0 Regarding the fire wall breach in your building, as stated in City correspondence dated August 9, 2005 the City Fire Marshal discovered the fire wall breach but the violation is a Building Code violation which is under the administrative authority of the City Building Official and must be resolved under the issuance of a building permit. Stamped Architectural or Engineered plans are required in order for the City to issue a permit because the building exceeds 4,000 square feet (State Law for plan compliance —not a City code). The requirement for a permit is a State mandated Building Code that cannot be waived. Please do not initiate any work without first obtaining the required building pen -nit approval as in doing so would be a violation of code and is subject to penalties. It must be clear within the statement that this work was completed before original occupancy of the building was granted. The same would be true of the offices and conference room--t'f the building owners have the same position regarding these walls and room use. If the building owners know that the walls creating the offices and conference room were not original construction -- completed with the original occupancy of the building, then again, a building permit is required for this work with the same stamped plan requirements. The City acknowledges Wilson Investments economic assistance to a non-profit agency and the past projects Wilson Investments has developed within Edmonds --all with positive affects. However, the City is required to obtain building permits when permit approval is required and the building owners should rest assured that all commercial property owners within the City are treated equally with regard to the permitting process. The City is not requesting anything more of Wilson Investments than of any other commercial property owner. Regarding your last paragraph the City is not requiring the entire building to be upgraded to current codes. On the contrary as of our last plan review dated 6/12/06 the review comments have been limited to specific tenant space information. However, it is possible that when a remodeling permit or change of use permit is reviewed building code and accessible code upgrades may be required. Lastly, it 'is not appropriate for my office to comment on the whether or not the City Fire Marshal has determined if the existing fire sprinkler system for Community Support Solutions is adequate. In that letter I mentioned that the Fire Marshal believed a fire wall was breached with a door and we were searching for current building plans. The City has confirmed that the fire wall between Community Support Solutions and the tenant space to the south was breached with a door. Also during plan review of Community Support Solutions it has also been noted that interior office walls and toilet room have been created without first obtaining a City permit. In speaking with Mr. Sean Monahan of Community Support Solutions we believe that a former tenant most likely performed this work without a permit. Mr. Monahan has provided the City with a copy of a letter written to you dated 6/19/06 (copy enclosed for your convenience) that indicates he is turning the matter over to you as the building owners/responsible party in this matter. Under our State adopted Building Code laws there is no statue of limitations on the necessity of obtaining building permits. Even though the work may have been performed without your expressed approval or knowledge the City is obligated to require and issue a building permit.
