property to permit the erection or maintenance of any sign, device, structure or vegetation in the following
circumstances herein set forth, and in the event of circumstances presently existing which by reason of
this section are now in violation of the Edmonds City Code, said person shall immediately remove the

B. The Grantee as a part of their ownership has certain designated legal parking spaces in
the parking lot adjacent to their building, as shown on the attached Exhibit A. They wish
to convert a parking space in this lot, to be used for the sighting of a trash enclosure.
C. The Grantor owns that certain real property located at 405 Fifth Avenue South,
Edmonds, WA 98020, with tenant known as the Beck's Funeral Home. The parking
spaces of the grantor's property at this location are also designated on Exhibit A.

TERM OF AGREEMENT AND NUMBER OF SPACES. The grantor party shall make
available one parking space on their property for the use of the grantee as follows:
The Grantor designates one space on the property located at 405 Fifth Avenue South, Edmonds,
Washington 98020 for use by the Grantee between the hours of 8:00 am and 9:00 pm , Saturdays
through Sundays, on a month to month basis, commencing on the Ist day of February, 2005 .
The Grantor, as designated on exhibit B, in his discretion may designate which space on his
property is available for the grantee's use.
4. LEASE AMOUNT. No consideration shall be paid.
5. USE: The parking space shall be used only for customer and employee parking of the grantee
during the hours set forth in paragraph 3 above and for no other purpose and at no other times.
6. HOLD HARMLESS NON -LIABILITY OF LESSOR: Neither party shall be liable to the
other party or their patrons or employees for any damage, loss or injury to the premises or to any
person or property on the premises. Except the ARBO tenants shall be liable on a no fault basis,
for any damage to Beck's building structure located on his property attributable to parking use
by the ARBO tenants. Each party agrees to indemnify and hold the other party harmless from
any and all loss, liability, claims, demands and actions of any kind arising from any authorized
parking in the space pursuant to this Agreement.
TERMINATION OF LEASE. The grantor may terminate this lease by giving 90 days advance
written notice to the Grantee, which termination may be with or without cause.
SUBLEASING OR SUBLETTING. Neither party shall have the right to sublease or sublet or
grant other use rights of any kind to parking stall acquired under this Agreement without the
other party's written approval.
9. NOTICES: All notices which may be required or desired to be made by one party to the other
may be made by either personal service or by certified mail, "return receipt requested," addressed
to the addresses as appearing above.
10. ATTORNEY'S FEES AND COSTS. tf this Lease is litigated or arbitrated for any reason,
including but not limited to, in order to determine the rights between the parties, the prevailing
party is entitled to reasonable attorney's fees and costs of such a'suit, including but not limited to,
attorney's fees incurred in advance of the litigation and including but not limited to, any attorney's
fees involved in Motions, Summary Judgment Motions, Declaratory Judgment actions, and the
like, and an appeal of any judgment or arbitration decision.

agrees that in the event that this agreement is terminated or if the joint use stall is otherwise no

Department. In such event, the grantee understands that they will have to acquire an alternate off
site parking stall. The grantor shall have no liability or responsibility to the City of Edmonds
whatsoever under this agreement and none to the grantee beyond the express terms hereof, in
regard to city parking requirements or regulations, and the grantee shall agree to hold harmless

The applicant has submitted plans for a parking lot expansion. The
proposal includes some parking spaces that exceed the 6% allowed by
City Code.
The proposed parking spaces,do exceed 6% only minimally, primarily less
than 7%. The existing street slope on Alder Street is very steep,
requiring the area of transition to exceed code. The existing drive
lane which will be retained functions adequately.
This waiver will not result in a condition that will pose a hazard to

AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 18-95. 02 0 (D) RELATING TO
PARKING LOT GRADES TO PROVIDE FOR MAXIMUM SLOPE
OF PARKING LOTS WITH WAIVER PROVISIONS TO A
MAXIMUM OF 14* AND FIXING A TIME WHEN THE SAME
SHALL BECOME EFFECTIVE.
WHEREAS, City Council finds that it may be in the
public interest to permit slopes greater than 6% to a maximum of
14% and in the interest of the public's health, safety or
welfarel NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds Community Development Code
Section 18-95.020(D) Grades is hereby amended to read as follows:
18-95.020 REQUIREMENTS
D. Grades. Maximum parking slopes shall be 6%;
minimum slope shall be 1%. The City Engineer
may waive the maximum slope requirement, up to
a maximum of 14%, if the applicant can
demonstrate that an increase in the slope
maximum will not result in conditions that may
pose a hazard or otherwise endanger the
public's health, safety or welfare.
1. The City Engineer shall consider the
following criteria, where applicable, in
reviewing an application for waiver:
a. The waiver request is not made for
the sole purpose of circumventing other
requirements of the Community Development

Gentlemen:
The City of Edmonds is currently experiencing a serious storm
water problem. our sewage wastewater treatment system is being
overtaxed by large volumes of storm water from roofs, drains,
driveways, and parking lots. If this water is not eliminated from
the system, the sewage treatment plant will require expansion much
sooner than it otherwise would.
A series of tests were completed, identifying your property
as one of the infiltration sources. This storm water must be
removed from the sanitary sewer system as soon as possible. The
attached drawings indicate several solutions to this problem, one
of which should be applicable to your property.
The City has established this as a top priority project, and
your cooperation is urgently needed. Please contact Dan Smith or
Jerry Hauth at 771-3202 for assistance prior to installation of
your modified system.

Dear Council Members;
I would like to propose to the City Council that the alley way
between Alder Street and Walnut Street be named BECK STREET, (PLACE9
LANE, ETC.) in memory of Mr. Steve Beck who passed away March 28, 1983.
The alley way runs next to Beck's Funeral Home which he started in
1952 and has been a part of this community since then.
The alley way is used by us and the people who border it and was -
paved a few years ago, paid for us and these people.
I would leave it up to the City of Edmonds whether it is named
BECK STREET, BECK PLACE9 BECK LANE9 ETC., whatever they think appro-
priate for such a roadway. Alsogif necessary we would be glad to pay
for any expenses incurred to erect the signs.

On February 17, 1981, the Edmonds City Council passed
Resolution 488 for construction, reconstruction and repair
of deteriorated sidewalks. A public hearing will be held
in the Council Chambers at the'Civic Center on April 21,1981
at 7:30 P.M. You are invited to attend thishearing.for
discussing repair of portions of deteriorated sidewalk /
abutting your property. The improvement of'sidewalks in
need of repair at the expense of the abutting propertv
owner is provided bv City Ordinance, Chapter 7.20 and
Revised Code of Washington, Chapter 35.68.
The areas needing repair have been marked in paint on
the sidewalk adjoining your proi)erty. Reconstruction and
repair of these sidewalks must be completed on or before
September 1, 1981. In the event improvements are 'riot*
completed within the above specified t-ime, the City will
perform and complete the improvements at the expense of the
abutting property owner.
This action is in response to many citizen requests
and pedestrian falling accidents which have been increasing
in recent years as a result of sidewalk deterioration and
increased pedestrian traffic.

The backflow prevention device in your water supply system
is due for annual testing as required by State Code WAC 248-
54-500. Our records show a total of one device in your
system. Please have the testing performed by a person holding
a certificate of competency as a cross connection specialist,
issued by the State Department of Social and Health Services
(telephone 464-7673).
If a device fails its test, please have the necessary repairs
made. Upon completion of a saftisfactory test, have the certi-
fied tester fill out the enclosed Test and Maintenance Report
and return it to this office within thirty days.
Additional information relative to this matter may be obtained
by contacting our Cross Connection Control Specialist at
775-2525, extension 226.

April 14, 1975
On April 9, 197S, Mr. Ken Kukuk, a Cross -Connection Control Specialist
for the City of Edmonds, conducted a cross -connection control inspection
of your facility. During this inspection, several problem areas were
noted and the necessary corrections are as follows:
1. Main service line: To prevent backflow into the City's potable
water supply, a reduced pressure backfiow prevention device
shall be installed. This device shall be installed before the
service line branches to serve other areas within the building.
2. Service sink in the Embalming Room: To comply with Cross -
Connection Prevention Rules and Regulations, a reduced pressure
backflow preventer shall be installed on both the hot and cold
water lines leading into that area.
3. Kitchen type sink in Embalming Room: This requires the instal-
lation of an atmospheric vacuum breaker to prevent back siphonage
into the supply lines within your premise.
4. Service sink in basement: An atmospheric vacuum breaker shall be
installed on the outlet on this unit to prevent back siphonage
into the supply lines within your premise.*
S. Exterior lawn and shrub sprinkler system: An atmospheric vacuum
breaker shall be.installed six (6) inches above the highest
sprinkler head.
Attached please find (a) excerpts from the "Accepted Procedure and
Practice in Cross -Connection Manual," which will indicate proper instal-
lation procedure. Also attached is (b) the March, 1975, copy of the
"Approved Cross -Connection Control Devices" accepted by the State of
Washington, Department of Social and Health Services and the City of Edmonds,
and (c) a copy of the City of Edmonds Ordinance #1711, requiring the
installation of backflow prevention devices.
Mr. Kukuk will be making a final inspection on June 2, 1975, which
we feel gives you sufficient time to make the necessary plumbing corrections.
If there are any questions concerning these corrections, please contact
the Water/Sewer Department at 775-252S, extension 226.

The Ruies and Reguiations of the State.Board of Health regarding Public Water
Supplies relating to cross-connection'control require the installation of
cross -connection control devices under certain conditions (WAC 248-54-4709

DECLARING CROSS CONNECTIONS WHICH ENDANGER WATER
QUALITY UNLAWFUL AND REQUIRING THE INSTALLATION OF
BACKFLOW PREVENTION DEVICES; REQUIRING PRIVATE
WATER SUPPLY SYSTEMS TO CONFORM WITH APPLICABLE
ORDINANCES OF THE CITY OF EDMONDS; ADOPTING STATE
STANDARDS FOR WATER SUPPLIES AND CROSS CONNECTION
CONTROL REGULATION; DECLARING EXISTING UNLAWFUL
CROSS CONNECTIONS TO BE PUBLIC NUISANCES AND
PRESCRIBING A PROCEDURE FOR ABATEMENT OF SAID
NUISANCES.
WHEREAS, the City Council of the City of Edmonds, Washington,
has dete ' rmined that certain cross connections in the public water
supply pose a potential hazard'to water quality within said city,
and
WHEREAS, the installation of backfiow prevention devices
to counteract back pressure or prevent back siphonage into the
public water system are necessary for the public health, welfare
and safety, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, Do
ORDAIN AS FOLLOWS:
Section 1. Chapter 6.16 of the Edmonds City Code is
hereby amended by adding to said chapter, the following sections,
Section 6.16.200 Definitions:
1. Backflow: A flow, other than the intended direc-
Ti�onof flow, of any foreign liquids, gases, or
substances into the distribution system of a
public water supply.
2. Backflow Prevention Device: A device approved
by xe S Lte of Was i-ngton, Department Of Social
and Health Service.s.or such other state depart-
ment as shall have jurisdiction over the subject
matter, and by the American Water Works
Association, used to counteract back pressure or
Prevent back siphonage into the distribution
system of a public water supply.

3* Cross -Connection: Any physical arrangement
whereby a public water supply is connected,
directly or indirectly, with any other water
supply system, sewer, drain, conduit, pool,
storage reservoir, plumbing fixture, or other
device which contains or may contain contaminated
water, sewage, or other wastes or liquids of
unknown or unsafe quality, which may be capable
Of imparting contamination to a public water
supply as a result of backflow.
Section 6.16.210 Cross -Connections Declared Unlawfull
The installation -or maintenance o a cross-co-n-n-e-c-t-1-on-,
which in the opinion'of the Mayor's Administrative
Assistant or any staff member that he shall designate
who is qualified in protection of municipal water
quality, will endanger the water quality of the potable
water supply of the City of Edmonds, is hereby declared
to be unlawful.
Section 6.16.220 Backflow Prevention Devices to be

shall be installed and maintained by the service
customer on any service connection to the City of Edmonds
water supply system where said backflow prevention

Section 6.16.230 Requlation of Private Water Supplie . s-
Use or operation of a private water supply system,
contrary to the provisions Of the ordinances of the
City of Edmonds, or the Laws of the State of Washington
or the rules and regulations of the State Board of
Health regarding public water supplies where said
private system is served by the City public water

time to time, be amended in the future, are hereby
adopted by this reference as if set forth in full.

shall be subject to abatement in accordance with the
following procedure:
1. In the event that the M.A.A. or his designee
determines that a nuisance as herein Provided does
exist, written notice shall be sent to the person in
whose name the water service is established under the
records of the City of Edmonds Water Department, or
alternatively, a COPY of such written notice shall be
Posted on the premises served.
2.. The notice shall Provide that the nuisance
described herein shall be corrected within thirty days
(30) of the date said notice is mailed Or posted on
the premises.
3_ In the event said nuisance is not abated
Within the prescribed time, water service to said
premises shall be discontinued.
4. In the event that the nuisance, in the opinion
Of the M.A.A., or his designated representative,
presents an immediate danger of contamination to the
public water supply, service'from the City water supply
system to the premises may be terminated without prior
notice, provided, however, notice will be posted on
the premises in the manner heretofore provided at the
time said service is terminated.
Section 6.16.260 Penalties: In addition to the remeditq
set f0r�heiein, a�nypeirson found guilty Of violating"
any of the provisions of this chapter shall be subject
to the penalties as set forth in Section 5.12.170 of the
Edmonds City Code.

1'. All work and materials shall be in complete accordance with the Specifications and Stan,
dards of the City of Edmonds and APWA Standards and Specifications (1981).
2. The Contractor shall be.responsible for verifying the location and depth of all buried
utilities prior to beginning construction. Locations� of said utilities as shown on the
plan are based on the best records available and are subject to a degree of unknown
variation.
3. For aid in utility location call 1-800-562-6478, prior to beginning construction.
4. Conflicts shall be brought to the attention of, the Engineer and shall be resolved prior
to proceeding with construction.
5. The Contractor shall make minor adjustments in the field during construction, as nec-
essary, in order to produce a finished project consistent with the intent of the Plan.
6. The Contractor shall keep two sets of Plans on site at all times for recording os-built
information; one set shall be submitted to the Engineer at completion 'of construction.
7. City of Edmonds shall be provided with a set of os-built plans at completion of install-
otion for approval, which indicates the location of all site improvements including the
side sewer laterals or tees, water lines and other pertinent information.
8. All construction is subject to t , he inspection by the City of Edmonds and the Contractor
shall notify the City of his schedule in sufficient time to permit inspection prior to
and during V'lork.
9. The Cotnroctor shall be responsible for obtaining all permits for road & utility constr.

10. The Contrac i ' tor shall notify the City of Edmonds Engineering Dept. prior to performing
construction work within the City of Edmonds right-of-way.
11. Storm drdin�pipe shall be concrete, rubber gasketed ASTM C14-2 of 14 GA galvanized steel
or 14 GA alluminum helical corrugated metal pipe with watertite connecting bonds. Steel
shall be galvanized and treatment I asphalt coated (12" may be 16 ga,).
12. Bedding for pipe shall be Class "B" per ARIA Standard Plan No. 62 (pea gravel from 4"
below pipe to springline, trench width 40" minimum, or 1-1/2 times pipe diameter plus
18" whichev6r is greater). (Backfill shall be placed in 6" layers compacted to 95*/* of
maximum dens'ity).
