We are writing to protest the proposed hot dog stand to be located outside. 409--Main St.
immediately west of our business at 411 Main St. We oppose the proposed hot dog stand
because we believe this business could. potentially violate at least three sections of the Edmonds
zoning code and perhaps more.
First, Section 16.45.030 of the zoning code, "Operating Restrictions," states that all uses shall be
carried on entirely writhin a completely enclosed building except for public utilities and parks,
off-street parking and loading areas, drive-in businesses and plant nurseries. We do not believe
the proposed sidewalk hot dog stand falls into any of these categories. Furthermore, we believe
the original intention of the planners in stipulating that all uses are required to be conducted
within an enclosed building is to reserve the existing quality and character of the neighborhood.
We do not feel a sidewalk hot dog stand is in keeping with the basic idea behind this regulation.
The above -quoted section of the zoning code discussing operating restrictions also has a sub
section titled "Nuisances," which states that all uses shall comply with Chapter 17.60,
"Performance Standards." We have examined this chapter and note under 17.60.010, "Standards,"
Item E, that the admission of obnoxious odors of any kind shall not be permitted nor the
admission of any toxic fumes or gases. Although the City of Edmonds zoning code does not
have a definition of the word obnoxious (which renders any interpretation somewhat subjective)
we believe that unhindered food smells as opposed to those found in properly ventilated
restaurants or other enclosed businesses could be termed obnoxious by a sufficient number of

people to raise questions about the overall benefits of such a business. Again, we believe the
presence of food smells emanating from sidewalk businesses would detract from the quality of
the neighborhood.
A second section of concern addressed in Paragraph 17.60.010 of the zoning code is addressed
under Item G, "Waste Disposal." This item states in part that liquid and solid waste, storage of
animal or vegetable waste which attracts insects or rodents or otherwise creates a health hazard
shall be prohibited. We believe the presence of food and food smells as well as the necessary
disposal of some items in the immediate vicinity, would not be in compliance with this portion
of the zoning code.
Our final concern involves Chapter 18.90 of the zoning code which covers sidewalks. In
18.90.030, "Sidewalk Standards," the table of sidewalk standards notes that sidewalks constructed
in this zone are required to be 7 to 10 feet in width. The sidewalks along Main St. were
constructed some time ago, although we believe the sidewalk standards would apply if the
installation of a new business on the sidewalk were to be considered.
The sidewalk width at the location of the proposed hot dog stand is about 10 feet 3 inches.
Assuming a cart width of approximately 3 to 4 feet, plus standing room for the vendor, we do
not believe there would be sufficient width to maintain the sidewalk standards as imposed in
Chapter 18.90 of the zoning code. We further believe there is a potential safety hazard due to
the volume of pedestrian traffic, especially between April and October due to visitors in the city
of Edmonds.
Also, the Sidewalk Standards section of the zoning code states that the planning director and city
engineer will be responsible for determining the width used for sidewalks. This section states
that the requirements of the sidewalk chapter may be waived if it can be demonstrated by the
permit applicant that there are special circumstances relating to topography or other factors which
make the construction of a sidewalk economically unfeasible or practically impossible. We do
not believe this is the case and reduction of the sidewalk in this instance would only be due to
the location of a sidewalk business.
