ECDC 18.82.130.0 authorizes the Development Services Director to "adjust the impact fees on a case -by -case basis based on the independent fee calculation, the specific characteristics of the development, and/or principles of fairness." ITE Code 833, (ECDC 18.82.120.V.),"Fast Food, no drive up" was determined to most closely describe the type of Land use, however, the corresponding trip rate was found to not be representative for this specific proposed establishment and location. Specifically, two "adjustments" were made to Table 4 "Impact Fee Rates". 1) The vehicular trip rate was reduced by 50% from 26.15 to 13.08. The justification for this is based on the site location. The location of this proposed development will likely generate a significant percentage of pedestrian oriented clientele based of it physical location in core downtown Edmonds district. 2) The pass -by rate was adjusted from the current nationally accepted industry rate of 48% for fast-food establishments to 80% for a coffee shop. The current ITE trip generation manual does not provide for a specific pass -by rate for the coffee shops nor were there any current studies available to confirm this, however, engineering judgment was used in this case that assumes that 4 out of 5 vehicular trips that patronize the coffee shop are existing trips already on the road network and correspondingly, I out of 5 are added new trips on the network. Overall, these adjustments translate to this coffee shop attracting 13 vehicular trips during the pin peak hour, with 10.4 being pass -by trips and 2.6 being new trips to the network. He felt the State law should be adopted as it was drafted and should not be modified in any way. He felt it had been drafted so as to be uniform throughout the state in its application and as to penalty. Other Council members explained to him that they, also, had felt as he did until.Municipal Court Judge Richard Thorpe had explained the rationale for giving the Court discretion to waive the mandatory one -day jail sentence under extraordinary circumstances., Councilman Gould noted that discretion is permitted if the penalty will cause physical or mental distress to the offender, but he did not find the terminology "extraordinary circumstances" definitive enough to warrant discretion, and he did not feel the law should be diluted. He commented that in other countries where*the mandatory penalty is required the law has proven to be a deterrent to drunk driving, and he felt the people should know that they will serve the penalty if they take enough alcohol to lose control. Council- woman Allen felt that the proposed ordinance provided for a mandatory jail sentence, and she asked that the Council receive copies of any of the written judgments that defer the sentence. She felt that if the Council then disagreed with the Judge's decisions or felt he was too lenient, then the ordinance could be changed. COUNCILMAN MOTION: CARNS MOVED, SECONDED BY COUNCILMAN NAUGHTEN, TO APPROVE ITEM (E) ON THE CONSENT 00 09 STREL'-T FILE Management Master Program and the Edmonds Policy Plan. Details of the proposal were provided in the Planning Commission minutes. The public portion of the hearing was opened, no one wished to speak, and the public portion was closed. Councilman Nordquist said he had received some telephone calls from neighbors in this area which appeared to support the recommendation of the Planning Commission. COUNCILMAN NORDQUIST THEN MOTION: MOVED, SECONDED BY COUNCILMAN CARNS, TO APPROVE THE SHORELINES MANAGEMENT SUBSTANTIAL DEVELOPMENT PERMIT FOR SM-2-79, PURSUANT TO P.C. RESOLUTION 627. MOTION CARRIED. APPEAL OF ADB DECISION ON APPROVAL OF FURNITURE STORE AT SOUTHWEST CORNER OF 5TH AND WALNUT (Baride Used Furniture - ADB-32-79) Councilman Carns advised that he had discussed with the City Attorney his position on this matter and the City Attorney had suggested that he not participate because of a possible Appearance of Fairness Doctrine violation. Councilman Carns disagreed with the City Attorney's opinion and explained that the applicant and he had done business over the years and the applicant is a close friend of Councilman Carns' brother. On the other hand an employee of Councilman Carns had spoken in opposition to the development at the ADB meeting. Councilman Carns said he would step down if anyone on the Council felt he should. Councilman Herb said he was sure Councilman Carns would be fair and objective but the whole point of the Doctrine is that if there is even a remote possibility of not being objective then a cloud is created. He felt Councilman Carns should step down. Councilmen Naughten and Nordquist also stated they felt he should step down. Councilman Carns then left the Council Chambers. Community Development Director John LaTourelle said this matter had been heard by the ADB twice, receiving approval at the second hearing. Minutes of those meetings had been provided to the Council. Mr. LaTourelle read a letter from Warren LaFon, a,member of the ADB, in which he stated that he felt the design of this building to be of high quality and one of the best to come before the ADB in some time. Mr. LaFon stated further that this building is the only building in the area except for the Shoreline Savings Bank which has architectural merit and that the ADB made the only decision that could be made on this, on its own merit and not on past decisions. It was noted that Jack McClellan, the designer of the building being discussed, was present to represent the applicant. Assistant City Planner Mary Lou Block displayed drawings of the proposal. It had be redesigned at the request of the ADB after -the first hearing in order to lower it, and the height from the mean elevation was :31'6" or, measured from the sidewalk on 5th Ave., 29'6". For comparison, Ms. Block gave the heights of several buildings in the general area. The bank across the street and also on the west side of 5th Ave. measures 33' at the sidewalk, the Finnegan Apartments building at 4th and Walnut is 35', and the Raymond Apartments building is 33'. These are within viewing distance of the proposal, and there are also numerous buildings which are lower. Ms. Block approximated Milltown to be 30' high on the 5th Ave. side, possibly more. Mr. LaTourelle commented that the owners of the VonMax Restaurant had approached the City to discuss adding a second story to their building. lie also noted that the property on the west side of 5th Ave. is somewhat lower than that on the east side. The public portion of the hearing was then opened. A number of people spoke in opposition to the proposal, feeling it was too high and stating -it would take away their views and reduce their property values. In general they felt the maximum height should be 25'. Some stated that to allow this would create a,precedent and open the way for more tall buildings and Edmonds would then lose the quaintness and charm which the citizens valued. Speaking in opposition were Joe Calman, 524 Walnut; Louise Dwyer, 529 Holly; Jean Yost, 536 Walnut, William Mathias, 543 Holly; Steve Dwyer, 529 Holly; Joanne Childers, 546 Walnut; Jane Morck, 525 Holly; John McCoy, Pine St.; Joseph Dwyer, 529 Holly; and Cynthia Baker, 529 Walnut. Jack McClellan, designer of the building, said they had met all the criteria set by the Building Department, Planning Commission, and ADB, and they had no desire to create a hardship for anyone, but they wished to build on their property within the rights set forth in this City. Ken Mattson of 725 Daley, a member of the ADB, said if they were to go along with the immediate neighborhood's desires then the City would end up with a whole row of 25', flat roofed buildings, and that is not quaint or -desirable. He said the ADB had worked with the designer and owner at several meetings and they were extremely coopera- tive. He said this was one of the few buildings where the builders had gone out of their way and spared no expense and they had done a very good job, and to change their product at this point would be like sawing a classic painting in half to make it smaller and not block view. He said the City needs variety, the highs and the lows, and there are parameters within which a person can develop his property. He felt that if the Council were to find that 25' was better than the allowed height then that might be a spot rezone. Further, he advised the Council that if they had EDMONDS CITY COUNCIL MINUTES Page 3 - July 24, 1979 any reservations about this project he strongly recommended a Council/ADB work session so they could see what would happen if they cut the height arbitrarily, and they essentially would be telling the owner that other people have the 35' privilege but he does not. Carol McCrary, one of the owners of the subject property, said they were not providing a daylight basement as some of the speakers had suggested because of drainage --they had been told by Mr. Winters that they would cause him flooding problems if they used a daylight basement. She said the furniture they handle is unique and needs the height proposed for the upper floor. The public portion of the hearing was then closed. Councilman Naughten commented that, design -wise, this was a beautiful piece of work and the ADB had done a good job in reviewing it from all aspects. His position, however, was that this is a small community and the Council has to be sensitive to the impact such buildings have on the neighborhood. -He felt people values were more important than building design, especially when views were involved. He felt the profile of 5th Ave. was low and the roof of the proposed building provided no function except aesthetic design. Councilman Gould said the ADB had done a very fine job and he liked what they had done. He had attended the last ADB hearing on this issue and he noted that they had gone by their guidelines. He felt the issue now was one of policy and that there was something unique about the building height in this situation, that being the location of the building relative to the other residences in the nearby area. He noted that this building could be put in some areas of Edmonds that would not impact the area. He agreed that the Council should work with the ADB as suggested by Mr. Mattson, and he felt a change may be needed in the policies under which the ADB can operate. Councilwoman Allen said she had been in the applicants' present store and they do have large pieces of furniture. She noted that this site is a part of the commercial zone and the City has goals and policies regarding commercial land use. She agreed that the Council should meet with the ADB and that it should be done prior to making a decision on this matter. MRS. MOTION: ALLEN THEN MOVED THAT ADB-32-79 BE REMANDED TO THE ADB AND THAT THE COUNCIL INVITE THEMSELVES TO ATTEND THAT ADB MEETING. City Attorney Wayne Tanaka advised the Council Withdrawn of what actions they could take in this matter, after which COUNCILWOMAN ALLEN WITHDREW HER MOTION. Councilman Nordquist felt the Council possibly should have addressed, view sensitive areas previously, and he felt 25'- 26' height should be the maximum for this piece of property. Councilman Herb stated that the issue is that the City wants taste and taste means expense, and to justify that there has to be size. He thought it was important that this was the first time the ADB had actually communicated to the Council to urge them to approve something. It: bothered him that if this building were reduced to 25' a tasteful building would be lost. COUNCILMAN NAUGHTEN MOTION: THEN MOVED, SECONDED BY COUNCILMAN NORDQUIST, THAT THE APPLICANT BE ASKED TO MODIFY THE DESIGN TO A HEIGHT NO MORE THAN 25' FROM THE 5TH AVE. SIDEWALK AND TO RETURN THE PLAN TO THE COUNCIL FOR CONSIDERATION, THIS MOTION BEING MADE FOR THE REASONS HE STATED EARLIER. Councilman Gould noted that the Policy Plan refers to "other related problems" and he felt they were developing a new policy for the City. A ROLL CALL VOTE WAS TAKEN ON THE MOTION, WITH COUNCIL MEMBERS NAUGHTEN, NORDQUIST, AND GOULD VOTING YES, AND WITH COUNCIL MEMBERS HERB AND ALLEN VOTING NO. MOTION CARRIED. MOTION: COUNCILMAN NAUGHTEN THEN MOVED, SECONDED BY COUNCILMAN HERB, THAT A JOINT MEETING THE ADB BE SCHEDULED FOR SEPTEMBER 11 , 1979 TO REVIEW POLICY PLANNING. MOTION CARRIED. Councilman Carns then returned to the rostrum. HEARING ON PETITION REQUESTING ONE-WAY TRAFFIC, NO P%RKING AFTER 10:00 P.M., ETC., ON City Engineer Fred Herzberg discussed three possible plans which had evolved after the study of this situation. He displayed drawings to explain them and then recommended Plan C which he felt was the most feasible. This would make Caspers one way, eastbound, between 2nd and 3rd, no parking on the east side of Sunset, 4-hour parking on the west side of Sunset until 10:00 p.m., no parking on the west side of Sunset after 10:00 p.m., and no left turn from the ferry. The public portion of the hearing was opened. A large number of residents of Sunset Ave. spoke, describing the problems they have experienced, especially since the closing of the beaches at night. They described drinking, rowdiness, littering, obscene behavior, and destruction to their property, all on the part of young people cruising and parking on Sunset. Minutes of both hearings are attached, as well as the approved site plan and elevations. The concerns addressed in the letter of appeal were reviewed by the ADB at the May 2 meeting. Additional information was requested by the Board and at the July 5 meeting, ADB-32-79 was approved. There are no unique features on this site and it is surrounded by business and multi-family uses. The staff feels the proposal complies; with Policy Plan Section 208A, Downtown Concept, and Section 303A, Commercial Land Use. Therefore, the Community Devel- opment Department recommends upholding the ADB approval. NEL/le 1&r 1� ARCHITECTURAL DESIGN BOARD July 5, 1979 The regular meeting of the Architectural Design Board was called to order by Chai man Chauncey Wight at 7:35 p.m. in the Council Chambers of the Edmonds Civic Center. APPROVAL OF MINUTES Minutes of the regular meeting of June 6. 1979 had been distributed, MR. SPANFELNER MOVED, SECONDED BY MR. LaFON, TO APPROVE THE MINUTES OF JUNE 6, 1979. MOTION CARRIED. CONSENT AGENDA Ms. Luster asked that ADB-65-79 be moved to the Consent Agenda as all other signs would be removed from the building and the proposed sign would be the only one used and would be within the Sign Code requirements. MR. SPANFELNER MOVED, SECONDED BY MR. MATTSON, TO MOVE ADB-65-79 TO THE CONSENT AGENDA. MOTION CARRIED. Ms. Luster then commented briefly on the Consent Agenda items. Mr. Mattson expressed some concern regarding ADB-61-79 which would add a seagull to the "Welcome to Edmonds" sign at 5th Ave. S. and SR104. He asked the Board how "cute" they wanted to get with the City signs. Ms. Luster said the seagull had been donated and the Staff felt the incorporation of it into the sign was acceptable. MR. SELVIDGE THEN MOVED, SECONDED BY MR. SPANFELNER, TO APPROVE THE CONSENT AGENDA. MOTION CARRIED, WITH MR. MATTSON VOTING NO. The approved items on the Consent Agenda included the following: ADB-50-79 KINDERFATHER, CHAFFOS & DUNN - Review of landscaping for office and retail building at 121-Tt—hAve. N. (BC) ADB-61-79 CITY OF EDMONDS - Review of addition to "Welcome to'Edmonds" sign at 5th Ave. S. a SR104 ADB-65-79 LEON COUCHEE - GRAY MATTER Review of sign for record shop at 22617 76th Ave. W. (CG) Ms. Lusteradvised that ADB-64-79 had been withdrawn. CONTINUED AGENDA ADB-32-79 BAYSIDE USED FURNITURE - Review of west and south elevations for Tu—miture store at the southwest corner of 5th and Walnut St. (BC) At the last hearing on this item the Board had requested specific information and had suggested the building be lowered slightly if possible. The current plans indicated the grades at each corner of the building as requested and the west and south elevations were provided. The south elevation is a concrete/pumice block wall painted a light beige (this is a fire wall). The west elevation located the disposal cans. The east and north elevations had been reviewed previously. The first -floor was now at the same grade as the 5th Ave. sidewalk and the building will be 3'6" below the maximum building height at the top ADB-111-78 ADB-22-79 Of the dome skylight. Ms. Luster stated that the project appeared to comply with the Policy Plan sections 208A (Downtown Design Concept) and 303A (Cormiercial Land Use). She felt the the design would not have a substantial adverse effect on the area and that it would be compatible with this section of the City. She recommended approval because of the overall design and substantial compliance with Policy Plan sections 208A and 303A. The Board studied the plans, and Mr. Hintz commented that the applicant had addressed all of the concerns the Board had expressed at the last meeting and it appeared all the requirements were met. THEREFORE, MR. HINTZ MOVED, SECONDED BY MR. LaFON' TO APPROVE ADB-32-79. Action on the motion was delayed because several people in the audience indicated they wished to speak. Chairman Wight opened the discussion to the public and requested that the comments not be repetitious in view of the lengthy testimony taken at the last hearing. Milton Hassel of 717 4th Ave. S. said the height had not been reduced enough. He felt 25' should be the maximum and that the cha m of Edmonds could be easily destroyed by allowing the construction of buildings such as this. JoAnn Childers of 546 Walnut felt the height of this building would diminish her property value and her view. Jack McLellan, the designer for the project, said they had made every effort to keep this building as low as possible. Mrs. ,Childers suggested the storage area be placed in the basement to eliminate the top floor and he responded that the furniture has to be off-loaded in the alley area and basement storage would not be satisfactory. He said this building also has to be able to serve future needs. Steve Dwyer of 529 Holly said this proposed structure is only 150'- 180' away from the Magne Hagen condominium which was the subject of a court case which caused its height to be reduced. He felt no building over 25' in height should be constructed in this area. He said the bulk of the Shoreline Savings Bank is 26', the VonMax restaurant is 14'6", and this proposed building will be twice the height of the VonMax. The public portion of the hearing was then closed. Mr. LaFon stated that he knew of no policy or Code requirement that said they had to limit building heights to 25'. Joseph Dwyer of 529 Holly said the Policy Plan calls for two story buildings in the downtown area and that would not exceed 25'. Mr. LaFon then said this project was reviewed at the last meeting except for the two elevations and he found the design very compatible with the Policy Plan for the downtown area. He said the height is nominal and he saw no reason not to approve the proposal. THE MOTION THEN CARRIED. TEIGLAND STRUCTURES - Revision to elevations for salvage enclosure and parts saTe_s_a_t_72_M9 Highway 99 (CG) Ms; Luster said the exterior materials had been changed on this proposed building and the building would now be a steel structure. A brochure describing the building was submitted. The applicant said the west elevation -would remain masonry. Ms. Luster did not feel this change would downgrade the previously approved project, and she recommended approval. MR. LaFON MOVED, SECONDED BY MR. HINTZ, TO APPROVE ADB-111-78. MOTION CARRIED. .ROBERT PANTLEY - Review of elevations, site and landscaping for retail/restaurant building at 181 Dayton St. (CW) Assistant City Planner Mary Lou Block summarized previous actions which had been taken on this proposal by other bodies, including the Shorelines Advisory Board, the Planning Commission, the City Council, this Board, and the State Ecology Department. It had been approved by all except this Board which had given partial approval and had asked for further work In some areas. Ms. Block said the design of the structure and the landscaping were the major points to be reviewed this evening. Ms. Luster proceeded to review the project. noting that the parapet which had been proposed around the top of the building to screen the mechanical equipment had been deleted and the equipment will be contained in a 4' deep well to drop it below the roofline. The ductw6rk wil,l also be within the building so these will not be ARCHITECTURAL DESIGN BOARD Page 2 - July 5. 1979 must bear the seal and signature of a Ticensed structural engineer; (2) Topographic survey must be submitted for establishment of building height limitation; (3) Balcony rails mus.t be a minimum height of 3'6".; (4) One -hour fire wall separation required between the parking garages and the units; and (5) A minimum 32" clear exit width must be provided between columns and walls in the garages. Ms. Luster noted that there are existing single family homes on the east and west sides of this site, but the zoning is RM. There are RM units across the street. Chairman Wight noted that the Mugho Pines on the northeast corner would not create a screen. The applicant stated the building would be white stucco with everything else brown. The windows will be medium bronze anodized aluminum and the chimneys will be painted brown. The handrails will be brown wrought iron. Mr. Kinderfather felt there should be some unification in the design in that there appeared to be a number shapes involved. He suggested a flat roof for the entire building rather than a pitched roof on part of it. It was noted that there will be only an area I' wide on the east elevation, and Ms. Luster suggested the use of a fence to screen the cars, -ather than landscaping. MR. LaFON MOVED, SECONDED BY MR. KINDERFATHER, THAT ADB-81-78 BE RESUBMITTED WITH THE TOPOGRAPHIC SURVEY TO ESTABLISH THE BUILDING HEIGHT LIMITATION; THAT THE LANDSCAPE PLAN BE RESUBMITTED WITH THE NECESSARY CHANGES TO BRING IT UP TO CODE INCLUDING A FENCE ON THE EAST SIDE; THAT THE COLORS BE RESUBMITTED AS ALL BROWN TRIM, 014 STUCCO IS NOT GIV114G MUCH THOUGHT TO THE BUILDING; AND THAT,SOME THOUGHT BE GIVEN TO THE ROOF STRUCTURE AS THE FLAT ROOF AND PIECE OF SLOPED ROOF DO NOT GO TOGETHER. Mr. LaFon also a ' uestioned-whether this should not be a two -level site instead of three levels. Mr. Kinderfather felt the shapes of the elevations were confusing because there were so many different kinds of shapes and fenestrations. He felt it looked like three abutting buildings. He was concerned about the height limitation on the top floor. He said when the Code provides a 30' height limitation on a flat roof and 35' on a pitched roof it means to encourage pitched roof buildings in this particular zone because they are attractive and residential in character, but the solution presented had sort of gone around the back way and did not meet the intent of the ordinance although it complied with the letter of the law, The applicant said they had tried to do some things to make the building interesting because of the criticism they had received from the §oard on the previous submittal. He did not know whether they could put a pitched roof on the portion that was flat as it might restrict view.. He said they wanted a recreation room on the back of the building which was not on the original plans and that was why they added the back porch. He felt this design was a considerable improvement over the original plan. THE MOTION THEN CARRIED. It was suggested that this item be heard at a special meeting, and Mr. Hintz felt the applicant needed more direction from the Board as to roof design. MR. KINDERFATHER MOVED, SECONDED BY MR. MATTSON, THAT ADB-81-78 BE CONTINUED TO A SPECIAL MEETING TO BE HELD AT NOON, MAY 9, 1979, IN THE COUNCIL CHAMBERS (IF AVAILABLE). MOTION CARRIED. The applicant said if the height would permit a pitched roof would be put over the entire building. ADB-32-79 BAYSIDE USED FURNITURE - Review of commercial retail project at the southwest corner of bth Ave. and Walnut St. (BC) Ms. Luster said this review was for final approval of elevations and the site plan. The Staff previously had suggested one of the curb cuts on Walnut be removed but on further consideration they felt the additional curb cut would not be detrimental to the overall site and it would alleviate some of the potential problems that might arise at this location. She said the proposed landscaping should make the site more attractive from the view across the street. She felt the new elevations were an improvement over the previous ones and that this building would be compatible with the bank across the street. The fire wall had been lowered which improved the impact of the building. The exterior materials will include wood with liaht colored textures, and a dark colored metal roof (if the material cannot be obtained it ARCHITECTURAL DESIGN BOARD Page 2 - May 2. 1979 will be shingled). Ms. Luster felt the window treatments were good and the overall design would blend with the area. She noted that the site slopes a great deal to the west. 11. is surrounded by business zoning. Utility meters and trash enclosures were not shown. The south elevation will be backed up to an existing building and the west elevation will be on an alley. Those elevations were shown and Mr. Kinderfather commented that the applicant should be commended for them. He asked, however, if the building needed to be designed at 35' at the skylight. The applicant responded that most ofthe furniture is imported older furniture which is very large, and they need the 10' height on the retail floors to show off the furniture. Several people in the audience indicated they wished to speak, so Chairman Wight opened the discussion to the audience. Milton Hassel of 717 4th Ave. S. said he was speaking on behalf of a number of concerned citizens to express concerns over the height of the building. He said they were aware of the fact that Bayside Furniture is an asset to the business community of Edmonds but they felt the height of this building should be lowered because of social and community considerations. He said the proposed height would be in direct Contrast to the other buildings in the block and would not enhance the aesthetic quality of the environment of that particular area. He felt it was important to retain the aesthetic charm of the downtown area of'Edmonds. He suggested that the entrance to the store go into the second story, with the first story beino below the grade as the grade on Walnut would encourage that kind of construction. He also quoted a recent court ruling which indicated additional restrictions could be placed on height and, further, ". . . if certain members of the ADB were of the opinion they had to 'rubber stamp' a plan just because it met the other zoning code requirements, then thev were in error." He presented a petition in opposition to the height of this building which he said contained 232 signatures. He also submitted photograp�s reflecting the heights of buildings in the area which were lower than the proposed building. Patti Price of Patti's Place on 5th Ave. felt the new building would be an asset to the community but it was too high. She pointed out also that most of the buildings in that area were low. Joseph Dwyer of 529 Holly Dr. noted that Edmonds Lumber, Edmonds Garden Center, and the Radio Shack all have underground storage and he suggested Bayside Furniture could do the same as their proposed second floor is planned mainly for storage. Chairman Wight then closed the audience discussion. Mr. LaFon felt there had been a tremendous change to the good from the previous submittal, but he felt more information was necessary before giving final approval. Only two elevations had been submitted and he felt the other two were necessary. He also felt the main floor might be lowered somewhat. He noted that it appeared to be a little above grade and it might be possible to lower it a bit, and he thought that- should*be investigated. Mr. Kinderfather said he would like to see a building section to see if there is any way to reduce it, but he felt the building would be fitting for that location. Mr. Spanfelner said he would like to see elevations of the existing soil. MR. LaFON THEN MOVED, SECONDED BY MR. SPANFELNER, TO GIVE PRELIMINARY APPROVAL TO ADB-32-79 SO FAR AS DESIGN, MATERIALS, AND COLOR. Mr. Mattson then asked the Board members if there was anyone on the Board who felt he had to "rubber stamp" any proposal because it met other zoning code requirements, as inferred earlier'by Mr. Hassel. There was a negative response, and Mr. Mattson asked that the record so indicate. THE MOTION THEN CARRIED. The applicant said he would speak with his client and try to reduce each floor by 1'.
