deteriorated sidewalks. A letter dated March 16, 1981 was sent to
residents that were required to repair the sidewalk abutting their
property. The improvement of sidewalks in need of repair.at the
expense of the abutting property owner is provided by City
Ordinance, Chapter 7.20 and Revised Code of Washingto'.n,"Chapter
i5.68.
The, areas needing repair have been.marked in paint on the . I
sidewalk adjoining your' property. 'Reconstruction permits'must be
obtained from the Building Depart ' meni at 501 Bell, -Street within 30
days upon receipt of this certified. letter. The fee for the
sidewalk repair has been waived 'by the -City of Edmond.s. In the
event these improvements are not completed w�ithin ninety (90) da,ys,'
upon receipt of this certified letter, the City will �inploy a
private contractor to perform the designated repairs and the City
will bill the abutting property owner.
This action is in response to many citizen requests and
pedestrian falling accidents,which have been increasing in recent.

removed from the sanitary sewer system as soon as possible. The
attached drawings indicate several solutions to this problem, one
of which should be applicable to your property.
The City has established this as a top priority project, and

On February 17, 1981, the Edmonds City Council passed Resolution 488 for
construction, reconstruction, and repair of deteriorated sidewalks. A letter
dated March 16, 1981 was sent to residents that were required to repair the
sidewalk abutting their property. A certified letter was also sent dated June
15, 1982. The improvements of sidewalks in need of repair at the expense of
the abutting property owner is provided by City Ordinance, Chapter 7.20 and
Revised Code of Washington, Chapter 35.69.
The areas needing repair have been marked in paint on the sidewalk
adjoining your property. Reconstruction permits must be obtained from the
Building Department located at 250-5th Ave. N. within thirty (30) days upon
receipt of this final notice. The permit fee for the sidewalk repair has been
waived by the City of Edmonds. In the event you have not obtained the
reconstruction permit within thirty (30) (lays, the City forces will commence
with the reconstruction of the sidewalk, and the City will bill the abutting
property owner.
This action is in response to many citizen requests and pedestrian falling
accidents which have been increasing in recent years as a result of sidewalk
deterioration and increased pedestrian traffic.

Dear Hank:
As per our discussion the afternoon of April 29, 1981, 1 am writing to
confirm with you my understanding of the status of the Building Permit
on the above mentioned building. I would like a confirmation of my
interpretation either from the City or the City Attorney so I might
be able to proceed with some confidence and security with our Building
Permit and Application.
It is my understanding that a Building Permit when applied for, pro-
vides for 180 days to implement that Building Permit to completion.
If, in fact, you have not completed the Building Permit and it has not
been approved within the 180 days, one must apply for an extension of
the application period which is in itself, 180 days long. I believe the
180 days period is called the Plan Check Period and if no Permit is is-
sued within that 180 days, the building official may extend the time
for action by the Applicant for a period of not exceeding 180 days upon
a request by the Applicant showing that circumstance beyond the control
of the Applicant has prevented action from being taken.
At the time that a permit is issued by the Building Department, the
$ bu- ing or work authorization by such permit must be commenced within
i
120 ys of the date of issuance of that Building Permit. The Building
e�rmjit itself is good for one year and that should you not complete con-
struction within one year of the issuance of that Building Permit, then
you must apply for an extension of' that Building Permit.
From what I can understand under Section 302 of the Uniform Buidling
Code, there is no time limit undex. which that building must be com-
pleted. However, if there is a period of suspension of a period of
120 days, during the construction time, then a new Permit must be
obtained.
From a practical standpoint, looking at my particular situation, it ap-
pears application was made December 23rd and was approved for applica-
tion. I have been approved by the City Council to proceed and the
Design Review Board has approved the overall design of the building
although they do desire to see color coordinates of the awnings to be

After reviewing the plans for the changes to take place at
5th and Main Street, Edmonds, I have the following requirements:
General Building Requirements;
1. Provide a dry standpipe in the north stair
enclosure. (City Code 19.75.015 D)
2. Provide fire extinguishers throughout the
building as indicated on the approved print.
Minimum fire extinguisher rating is 2:A,10:BC
dry chemical type.

1. The exit passageway connecting the new lease

with sections 3304 and 3311 of the 1979 UBC.

Gentlemen:
I have encountered a number of problems in my effort to
obtain a building permit to remodel the Fourtner Building at
Fifth and Main. The problems have centered around meeting
time deadlines for my application and how to satisfy the
off-street parking requirements set forth under the zoning
ordinance in effect at the time I applied for a building
permit. Although the building permit has been issued, it is
my understanding that the covenant for off-street parking
has not been approved by the City Council. In view of the
delays and additional expenses associated with the in lieu
of parking requirements and with the project as a whole, I

COVENANT FOR OFFSTREET PARKING
Agreement made this date between Jacque L. Mayo and
01A4611wht Mayo, husband and wife, hereafter referred to as
"owners", and the City of Edmonds, Washington, hereafter
referred to as "Edmonds".
WHEREAS, owners are remodeling certain property they
own in Edmonds, commonly known as the Fourtner Building and
legally described hereinafter, and
WHEREAS, owners have submitted a building permit
application, No. 810542to the Edmonds Building Department in
connection with the remodeling of the Fourtner Building, and
WHEREAS, pursuant to applicable City code, owners
are required to furnish 29 offstreet parking spaces as a
result of the remodeling, and.
WHEREAS, pursuant to applicable City code, the
Edmonds City Council has authorized owners to pay the sum of
$15,000.00 into the offstreet parking fund to satisfy the
requirements for 15 offstreet parking spaces, and
WHEREAS, pursuant to applicable City,code, owners
are able to satisfy the requirement to provide the remaining
14 spaces by execution of lease agreements with surrounding
property owners in a form and manner agreeable to the City,
and
WHEREAS, in order to maintain certain vested rights
claimed by the owner, the City must issue the building permit
to owner by December 21, 1981, and
WHEREAS, owner intends to fully comply with all
requirements of City code, including the requirement to pro-
vide 29 additional offstreet parking spaces, but due to time
constraints cannot provide the necessary lease agreements set
forth in the code, and
WHEREAS, owners have themselves proposed the terms
and conditions set forth herein and acknowledge that the City
has in no way required or coerced them into agreeing to the
terms set forth herein, now, therefore,
In consideration of mutual benefits and the cove-
nants and promises contained herein the parties agree as
follows:
1. Owners are owners of certain real property lo-
cated in the City of Edmonds, Snohomish County, Washington
and legally described on Exhibit A attached hereto and incor-
porated herein by this reference as if set forth in full.
2. Edmonds agrees to allow owners to satisfy the
offstreet parking requirements in the manner set forth here-
in. Owners shall deliver to the City a promissory note in
the principal amount of.$15,000,.00 with interest thereon at
the maximum legal rate per annum accruing on and after
December 21f 1981. The note�shall provide that it will be
due immediately upon commencement of the remodeling

authorized by the building permit, or -120'-days,-afteri—
issuance of the building permit, whichever first occurs.
3. Owners agree that if they do not satisfy.the
requirements of City code to provide an additional 14 off-
street parking spaces through purchase, lease or joint use
agreement, then they will allow no occupancy of the addi-
tional square footage added to the Fourtner Building, as
described on Exhibit A. Owners agree that all 14 spaces are
to be provided or there shall be no occupancy as provided
herein, and further agree that there will be no pro rata
occupancy for a lesser number of spaces provided.
4. owners agree that they will not allow occupancy
even on a temporary basis in the additional square footage
added to the Fourtner Building until they receive a valid
occupancy permit issued by Edmonds.
5. Owners agree that if the project is abandoned
without completion there shall hie no refund of the
$15,000.00.
6. Payment of the $15,000.00 nor execution of this
agreement shall not grant owners, their successors or assigns
any vested rights nor shall said payment be an admission by
Edmonds that owners have satisfied the offstreet parking
requirements imposed by City code.
7. Owners agree that in the event they satisfy the
14 additional offstreet parking spaces through joint use
agreement or lease agreement, the occupancy permits for the
building may be revoked by the City if, at any time, any of

the lease agreements or joint use agreements are not honored
by the third party granting owners the parking rights through
the use of such agreements.
8. Owners hereby release the City of Edmonds, its
officers and agents from any and, all claims for damages, lost
profits or other claim arising directly or indirectly out of
the above referenced building permit application, including
but not limited to all causes of action arising out of the
issuance or nonissuance of the building permit application
set forth above as well as any action taken by the City to
enforce the terms of this covenant.
9. Nothing herein shall be deemed to affect the,
City's ability to enforce the terms of its ordinances and
nothing herein shall be deemed to require the City to issue
the building permit sought under the building permit applica-
tion number set forth above, unless owners have complied
fully with all applicable ordinances and regulations of the
City with respect thereto.
10. Owners agree that if the City enforces the terms
of this agreement they will pay all costs, including reason-
able attorneys fees. The agreement to pay all City's costs
shall include action by the City to evict or prohibit any
tenant or person from the premises because of owners failure
to comply with any provision of this agreement.
11. This agreement shall be recorded in the
Snohomish County Auditor's office in the grantor/grantee
index with the owners being listed as grantors and the City

of Edmonds as grantee. This agreement shall be construed as
a covenant running with the land set forth on Exhibit A, and
shall be binding upon owners, their successors in interest
and assigns and all future owners of the property set forth
on Exhibit A. Owners shall bear all cost of recording.
. 12. Onwers shall advise the Planning Director, at
the time construction of the remodeling begins, of owners
efforts to secure leases and/or joint use agreements with
surrounding property owners in order to satisfy the 14 addi-
tional offstreet parking requirements. Thereafter owners
shall report on a bimonthly basis to the Planning Director
the efforts they have made in or -der to satisfy the offstreet
parking requirements.

This letter will serve as confirmation of our recent
conversation concerning the remodeling of a building of
Fifth and Main owned by Dr. Mayo. As you are aware, Dr.
Mayo has applied for a building permit to make a major re-
model of an existing building at Fifth and Main. The permit
application was made prior to -the effective date of the cur-
rent community development code. At the time the application
was made, the only item to be decided was how the Council
would determine to allow Dr.. Mayo to satisfy the off-street
parking requirements set forth under the zoning ordinances
in force at the time Dr. Mayo made his application. The
City Council subsequently held a public hearing and deter-
mined to allow Dr. Mayo to satisfy 15 of the 29 off-street
parking spaces required by contribution into the in lieu
parking fund. The other 14 spaces were to be provided
either on site, through joint use or through lease of exist-
ing off-street parking spaces. All of these alternatives
are, of course, authorized under the old code.
Dr. Mayo has sought to have the Council modify its
initial decision, but the Council has refused. However, the
Council did authorize Dr. Mayo to execute a covenant being
prepared by our office as well as sign a promisory note for
$15,000 payable when construction begins. The covenant would
insure that the 14 additional off-street parking spaces would
be required prior to occupancy of the remodeled building.
Section 303 (c) of the 1976 Edition of the Uniform Build-
ing Code provides that applications for which the permit is
not issued within 180 days following the date of application
will expire. The code provider, that an additional 180 day
extension may be granted by the building official. The build-
ing official has granted the extension, and the 180 day additional
period will end December 21, 1981. Under the code, the building
permit must be issued by that date or the application will

become void. Any subsequent applications for remodeling of
this property must meet the current zoning codes in all
respects.
Dr. Mayo's architect has inquired as to whether or not
it is possible to "fast track" a building permit application
in the City. Section 302 (a) of the Uniform Building Code
does provide that the building official may issue a permit
for construction of part of a building before the entire
plans and specifications have been submitted or approved.
However, it is our opinion -that while a permit may be
issued for a portion of the ap- lication, Dr. Mayo's applica-

tion for the entire project must be approved by the City
prior to December 211, 1981, or the entire applicatior will
become null and void. In other words, Section 303 (c) of the
code specifically provides -that unless the permit is issued
for the application within -the time period set forth therein,
the entire application expires.
Our opinion is based upon the wording of the Uniform
Building Code as indicated above. In addition our opinion is
based upon the fact that in this case, the building Dr. Mayo
proposes to erect is nonconforming as regards the current
zoning code. While Dr. Mayo may have vested rights to pro-
ceed under the pre-existing code, nevertheless, the City
Council as the policy making body of the City has determined
that buildings such as proposed by Dr. Mayo should not be
built hereafter in the City. Therefore, in order to give
effect to this policy, a party must not be allowed to "grand-
father" himself longer than is strictly allowed. Dr. Mayo
has already had one extension for submitting sufficient plans
and specifications to enable the City to issue the permit.
The City Council's determination of the off-street parking
requirements were made thi'sJaS-tsummer and Dr. Mayo was ad-
vised by letter about that same time Of the necessity of sub-
mitting additional information. Thus, Dr. Mayo has been
fully aware of the City requirements for a considerable amount
of time and as such is responsible for the current time problem
he faces.

Mayor Harrison announced the presentation of a program entitled "Main St., U.S.A.,"
scheduled for the Chamber of Commerce meeting on Thursday, December 17, at Abigail's
Restaurant, at 8:30 a.m. This is a discussion of preservation and revitalization
ideas for downtown areas, a service of the Washington State Planning and Community
Affairs Agency.
Mayor Harrison referred to a recommendation from the Finance Director to authorize
Cliff Jackson to proceed on detail design of the Civic Center renovation at a cost
not to exceed $2,000, to be paid from interest earnings of the Library Construction
Fund No. 336. This item was deferred until the budget discussion.
Mayor Harrison asked City Attorney Wayne Tanaka to report on the negotiations with
Roger Hertrich for his portion of the SR E124 right-of-way. Mr. Tanaka said he had
met with Mr. Hertrich and conveyed the Council's offer. Mr. Hertrich is willing to
accept $7,000 (the Council offered $6,000) for the right-of-way and he would grant
slope easements if necessary. The Council decided to have an Executive Session
following this evening's meeting to discuss this. .

Councilmember Jaech said she had received a citizen suggestion that the Council
establish criteria for the various board appointees such as demonstration of interest
in the City, location of residence, occupation, age (to encourage more younger
participants), and ability. It was also suggested that interviews of the applicants
be open to the public so the public can ask questions. She said it should be stressed
to applicants that there is a lot of work involved so if they accept an appointment
they should expect that it will involve learning and time. COUNCILMEMBER ALLEN

Councilmember Jaech stated that some questions had been asked about the Council's
decision on Dr. Mayo's remodel of the Fourtner Building. She said she had done some
research and found the following: Dr. Mayo has an application for a building permit
which must be submitted by December 23, 1981 to vest his rights under the old Code.
He has to submit at that time the parking covenant to the City, the $15,000 promissory
note for in -lieu parking, and completed building plans. When these are submitted he
can get a building permit and then he has 180 days in which to start work on the
building. If for some reason he cannot start within 180 days he can apply for a six-
month extension and if he does start his building before it runs out but does not get
the building finished he can then apply for another one-year automatic extension.
That will give a total of two years on the existing permits, and if he should not get
it done in the second year but is working on it he could get another extension.
Councilmember Jaech felt he had more Dr less been given an open-ended extension in
which to provide the parking spaces and she also felt that he had not made a conscious
effort to get everything lined up, so she thought the covenant should be submitted to
the Council for review before it is given to him for signature. She felt the laws
were being bent for one individual and that it was not right, especially when he has
not made any effort of his own. She named other developments which had provided the
necessary parking and said the Code should be applied to Dr. Mayo the same as it has
been for everyone else. City Attorney Wayne Tanaka stated that the permit must be
issued by December 23, so he must get the information in to the staff in time for
them to review it by that date. Mayor Harrison thought there had been occasions when
the application was in by the deadline and that was accepted, but Mr. Tanaka said in
this case it is a matter of the Code changing and Dr. Mayo made application before
the new Code went into effect. He said that given the fact that the City has made a
policy determination to have land use and structures organized in a certain way, the
way his office would tend to look at -it would be if one loses vested rights one would
have to start all over. Mayor Harrison said another question was whether a fast
track application would be honored. Planning Director Mary Lou Block said they had
issued foundation permits separately but that was all, and City Engineer Jim Adams
said the same. Councilmember Gould asked whether it would be proper and what had
been the City's past practice. Councilmember Kasper responded that when fast tracks
had been made they had been done on the basis that they were complying with the Code
and were doing fast tracks because of the weather, and there was no change in the
Code. Natalie Shippen, in the audience, said the plans usually have to be ready
before the building permit is given and that it had been indicated that an ordinance
change or variance would be necessary to exceed the due date. She said items I and 2
of Dr. Mayo's letter did not constitute a parking plan; yet he was given an indefinite
period of time in which to comply. She asked why the parking plan was not required
at the same time as the structural plan. Mr. Tanaka stated that this was a remodeling
situation and the granting of the in -lieu parking and the leasing agreement constituted
the parking plan. Mrs. Shippen insisted that a parking plan layout had been required
of other developers and should be required in this case. Mr. Tanaka said in other
instances where people have run into such problems and when there has been good
reason to believe the person wou-id perform, the City has accepted other things. He
noted that in the case of a subdivision the person can bond for a road, and he said
this was similar to a bond as there is assurance that certain things will be done or

the applicant will not be able to occupy certain portions of his building, S�o from
that point of view it is not unprecedented. Mrs. Shippen stated that Dr. Mayo also
could not meet the 300' requirement and asked why he was getting this particular
special privilege. Mr. Tanaka responded that this was no different from others in
terms of being open-ended as any person can apply for an extension. Councilmember
Gould said he accepted as a plan the stattement that Dr. Mayo will lease so many
spaces and pay into the in -lieu fund for so many. Councilmember Naughten added that
the developments referred to that Were required to provide parking layouts were new
from the ground up, whereas this was a remodel. He said Dr. Mayo was not getting
away with anything, that his doors will not open unless the parking is provided and
there are economic forces which will make him get the work done. Councilmember Jaech
did not believe in two or three years if the parking were not provided that he would
be prevented from opening. A question was asked as to how long the leases would be,
and Mr. Tanaka said they would have to be in perpetuity unless the space is provided
somewhere else. Planning Director Mary Lou Block advised that what would be required
by December 23 in order to get the building permit was all the plans that are
necessary to complete the construction of the building, and there would be no fast
track in this case. Mrs. Shippen noted that in his letter Dr. Mayo had asked for an
extension of time, and Mr. Tanaka said that would take an ordinance and that had

Councilmember Gould asked for a "tight package" to give them the best possible
assurance that the builder understands the requirements clearly.
Councilmember Jaech referred to last week's vote which resulted in the Council's not
confi ming the appointment of Gordon Hey to the M.A.A. position, and she said she had
voted against the man and not against the position of M.A.A., and she still felt an
M.A.A. was needed as an administrator. She said there appeared to be a difference
amongst the Council as to the definition of an M.A.A. and some felt a Personnel
Director is needed, but she felt it should be an M.A.A. She said to her a Personnel
Director was a person who drafts Job descriptions, posts notices of vacancies, does
preliminary screening of applications, administers the health plans --but does not
manage people. An administrator, however, is charged with the duty of actively
managing those human resources within the City and is charged with obtaining productivity
and does the evaluation, and it is his responsibility to see that the job goals are
accomplished. Further, he coordinates between the various departments and the Mayor,
and his job has a larger responsibility than that of a Personnel Director. She felt
that Georgia LaBelle already was doing the functions of a Personnel Director. Council -
member Hall agreed that the M.A.A. is all encompassing, rather than just being a
personnel person. Councilmember Allen offered a compromise, suggesting a Director of
Administration who would take care of personnel and other day-to-day things but not
necessarily have all the department heads reporting to him as they would ultimately
be responsible to the Mayor. She thought that in light of the budget crunch they
might hire somebody at a lower salary. Councilmember Hall responded that it sounded
like a "band -aid" measure. She asked what had changed inasmuch as the Council has
required until recently that an M.A.A. be hired. Councilmember Allen said the budget
projections of income are different from what they were a month ago. Councilmember
Naughten said he could not see a City of' this size being sacrificed in the area of
top management, and he thought a good M.A.A. could pay his own salary just in effi-
ciencies.
Mayor Harrison reminded the Council that there is a State ordinance covering how the
City will be run and the best they could do in describing an M.A.A. would be to fit
the position to that ordinance, but by trying to make him the administrator of the
City a conflict was created with which that person would not be able to live. He
stressed that the Mayor can be as dominant as he wishes and can completely lock the
hands of the M.A.A. He said a Mayor may wish to delegate everything, and the next
one may do that, but this one would not. Councilmember Gould agreed that the law
states the M.A.A. serves at the pleasure of the Mayor. Mayor Harrison then advised
the Council not to try to create somebody who will be a decision maker because that
will not exist under his administration. Councilmember Gould agreed that the Council
has to recognize that the person will work under the Mayor's direction. Councilmember
Allen suggested that the Job description be in the packets and be reviewed before the
next meeting, and she thought it not necessary to discuss it unless there are questions.
She did not want to hold up the process of selection. Councilmember Naughten clarified
the Council's position, that they want an M.A.A. and that the search for one should
be pursued. Mayor Harrison advised that he would not advertise again and he asked
that any recommendations be submitted to him.

Councilmember Naughten said he had received some telephone calls complaining about
the intensity of the new lights on the playfield across the street. Parks and.
Recreation Director Jim Jessel said this was the first night for the lights to be in
service and to see how they are aimed, and the next day a snorkel would be used there
to re -aim them, and some of the lights may have to be turned off., He said the people
who live directly on the playfield should expect that the lights will be on again and
that this had been a playfield for more than 40 years, with the lights being there 35
years --although they were not adequate. He noted that they had sacrificed height in
the poles because a whole new level of people would have had to look at the lights on
taller poles, but because the poles are shorter the angle of light is different. He
said the impact will be lessened when the angle is changed and they will get it down
to a minimum impact. The hours the lights are on are 5:00 - 11:00 p.m. and they
automatically go off at 11:00 p.m.
Councilmember Hall said she had received a call from a citizen who was going home
from nursing duty one night and was involved in a problem in the Westgate area and
she was followed by two cars so she drove to the Police Department and found no one
there. Councilmember Hall thought there should be someone on duty there and that the
person on duty should be one who carries a weapon, not just a clerk.
Councilmember Nordquist noted that Council committees were to be reviewed on January 12,
and he said some of the committees meet before that time. The confusion was clarified
in that the January 12 item will be to evaluate the structure of the City Council
Committees, not those committees to which individual Councilmembers are appointed by

BUDGET WORK SESSION - INCLUDING DISCUSSION OF WATER/SEWER RATES
The Council resumed the budget work session which had begun prior to the regular
meeting. Councilmember Nordquist left the meeting at this time, 9:30 p.m. Council -
member Jaech left the meeting at 10:05 p.m. Another budget work session was scheduled
for Sunday, December 13, 1981, from 1:00 to 5:00 p.m. The meeting adjourned at
11:05 p.m. The Executtive Session which had been set earlier was not held.

REGULATIONS PERTAINING TO BUILDING PERMIT APPLICATIONS RECEIVED
BEFORE JANUARY 1, 1981
Dear Jacque,
Your. letter in regard to this subject generated a real research
project. The questions you raise don't always have one definite
answer because of extenuating circumstances which may arise. However,
there are general regulations wKich apply to the three situations
you describe, namely: when a building permit has been applied.for;
when a building permit is issued; and when work has been started, but'
has been suspended for some reason. Iwill first prov*ide you,wi'th'the
general information on each topic and then address your specific situation.
Building permit applications and renewals are regulated by the
Uniform Building Code, 1979 edition, Section 301-304 and also as
amended in Chapter 19.00.010 of the Community Development Code as
follows:
1. Application: The regulation affecting an application for
which no permit has been issued is found in Section 19.00.010(D)
of the Community Development Code (attached and highlighted).
2. Permit issued: When a permit has been issued, it is
administered under the provisions of Section 303 (d) of
the Uniform Building Code (UBC), 1979 edition.
(Attached and highlighted).
3. Permit issued, work suspended: The situation which occurs
when a permit has been issued, but work has been suspended
or abandoned for 180 days or more is also covered in,
Section 303 (d) of the UBC, 1979 edition (attached and
highlighted). -
In your case you applied for a building permit on December 23, 1980.
So far the City has not issued nor has it approved your application.
Therefore, your present situation is addressed in #1 above. The extension
to the application period which you have requested would extend the
application period to December 18, 1981 (180 days from June 23, 1981).
No further extension of the application period would be allowed under
Section 19.00.010.

If your permit is issued within the extended time limit, i.e. by
December 18, 1981, then the provisions outlined in #2 and #3 above
come into effect.
If your permit is not issued or approved within the time limits in
the Code, you would have to reapply and be governed,by the substantive
provisions of the Community Development Code as existing on the date
of your new application.

E. V-alidity. The issuance of a permit or approval of plans and speci-
fications shall not be construed to be a permit for, or an approval
of, any violation of any of the provisions of this code or any appli-
cable ordinance or law. No ' permit prosuming to give authority to
violate or cancel the provisions of this code or other ordinance or
law shall be valid, except insofar as the work or use which it
authorizes is lawful.
The issuance of a permit based upon plans and specifications shall
not prevent the Building official from later requiring the correc-
tion of errors in the plans and specifications or from preventing
building construction in violation of this code or of any other
ordinance of the City or other applicable law.
F. Expiration. Every permit issued by the Building Official under the
provisions of Title 19 shall expire and become null and void one
year from the date of issuance except as provided below:
1. Demolition permits required by Section 19.00.050 shall expire
180 days from date of issuance.
2. Permits for moved -in buildings required by Section 19.35.000
shall expire 180 days from the date of issuance.
Upon the expiration of any permit referred to in this section-, and
before any work may start again, a new permit shall be issued. The
fee shall be one-half the amount required for a new permit. No
changes are allowed in the original plans and specifications. The
suspension or abandonment may not exceed one year. otherwise, a
full fee shall be required.
G. Suspension or Revocation. The Building Official may, in writing,
suspend or revoke a permit issued under provisions of this code
whenever the permit is issued in error or on the basis of incorrect

file an application therefor in writing on a form furnished by the code en-
forcement agency for that purpose. Every such application shall:
1. Identify and describe the work to be covered by the permit for which
application is made.
2. Describe the land on which the proposed work is to be done by legal
description, street address or similar description that will readily identify
and definitely locate the proposed building or work.
3. Indicate the use or occupancy for which the proposed work is in-
tended.
4. Be accompanied by plans. diagrams, computations and specifications
and other data as required in Subsection (b) of this section.
5. State the valuation of any new building or structure or any addition,
remodeling or alteration to an existing building.
6. Be signed by permittcc, or his authorized agent. who may be required
to submit evidence to indicate such authority.
7. Give such other data and information as may be required by the
building official.
(b) Plans and Specifications. Plans. engineering calculations, diagrams
and other data shall be submitted in one or more sets with each application
for a permit. The building official caay require plans, computations an A
specifications to be prepared and designed by an engineer or architect
licensed by the state to practice as such.
EXCEPTION: The building official may waive the submission of plans.
calculations, etc., if tic finds that the nature of the work applied for is such
that reviewing of plans is not necessary to obtain compliance with (his code.
(c) inrorma(ion on Plans and Specifications. Plans and specifications
shall be drawn to scale upon substantial paper or cloth and shall be of suf-
ficient clarity to indicate the location, nature and extent of the work pro-
posed and show in detail that it will conform to the provisions of this code
and all relevant laws. ordinances. rules and regulations.
Permits Issuance
tSec. 303. (a) Issuance. The application, plans and specifications and
other data filed by an applicant for permit shall be reviewed by the
building of ficial. Such plans may be reviewed by other departments of this
jurisdiction to vcrify compliance with any applicable laws under their
jurisdiction. If the building official finds that the work described in an ap-
plication for a permit and the plans, specifications and other data filed
therewith conform to the requirements of this code and other pertinent
laws and ordinances, and that the fees specified in Section 304 have been
paid. he shall issue a permit therefor to the applicant.
When the building official issues the permit where plans are required, he
shall endorse in writing or stamp the plans and specifications -AP- 4
PROVED.". Such approved plans and specifications shall not be (,hanged,
modified or altered without authorization from the building official, and
all work shall be done in accordance with the approved plans.

The building official may issue a permit for the construction of part of a
building or structure before the entire plans and ipccifications for the
whole building or structure have been submitted or approved. provided
adequate information and detailed statements have been filed complying
with all pertinent requirements of this code. The holder of such permit
shall proceed at his own risk without assurance that the permi( for the en-
tire building or structure will be granted.
(b) Retention or Plans. one set or approved plans. specifications and
computations shall be retained by the building official for a period or not
less than 90 days from date of completion of the work covered thcrein; and
one set of approved plans and specifications shall be returned to the appli-
cant, and said set shall be kept on the site of the building or work at all
times during which the work authorized thereby is in progress.
(c) Validity of Permit. The issuance or granting of a permit or approval
of plans and specifications shall not be construed to be a permit for, or an
approval of, any violation of any of the provisions of this code or of any
other ordinance of the jurisdiction. No permit presuming to give authority
to violate or cancel the provisions of this code shall be valid.
The issuance of a permit based upon plans, specifications and other data
shall not prevent the building official from thereafter requiring the correc-
tion of errors in said plans, specifications and other data, or from prevent-
ing building operations being carried on thereunder when in violation of
this code or of any other ordinances of this jurisdiction.

AGENDA
ADG-95-80 CITY OF EDMONDS - Review of library with concealed parking at 700 Main
Street (OS).
Mr. Cliff Jackson, head architect for the library project, gave a schematic
presentation of the plan including interior and exterior design. This plan
had previously received approval by the City Council pending review by the
Planning Commission. Mr. Jackson requested the Board's acceptance of the
schematic so that they coulld proceed with design development. He stated that
some minor changes may take place as the project is further refined; however,
that the project should be,completed within budget.
The Board commended Mr. Jackson for an excellent presentation. Chairman
LaFon expressed the only concern over the height of the structure. as it
will be 5 feet over the city code restrictions. There being no further
discussion, MR. SPAN FELNER,MOVED, SECONDED BY MR. KINDERFATHER, THAT
ADB-95-80 BE ACCEPTED AS PRESENTED. MOTION CARRIED.
ADB-96-80 CITY OF EDMONDS - Review of handicapped access to the existing Frances
Anderson Cultural and Leisure Center at 700 Main Street.(OS).
Using the model at hand, Mr. Cliff Jackson pointed out renovations proposed
to provide handicap access,to the existing Frances Anderson Center. MR.
KINDERFATHER THEN MOVED, SECONDED BY MR. SELVIDGE, TO ACCEPT ADB-96-80
AS SUBMITTED. MOTION CARRIED.
ADB-97-80 212TH STREET PLAZA ASSOCIATES - Review of sign for 212th Street Plaza
Business Par at 7416 212f—hStreet S.W. (CG).
The applicant was seeking final approval for a six foot high freestanding
sign to be situated west of the ramp entrance to the upper level of the
212th Street Plaza Building. Mr. Lewis described the sign as glue lam fir
with routed inset border. 'The lettering will be of white pine. The square
footage of the sign is adequate, and landscaping surrounding the sign has
been approved. Mr. Lewis presented a color sign rendering to the Board
for examination. MR. SPANFELNER THEN MOVED, SECONDED BY MR. KINDERFATHER,
TO ACCEPT ADB-97-80 AS SUBMITTED. MOTION CARRIED.
ADB-98-80 WASHINGTON MUTAL SAVINGS - Review of sign for drive-in window and directional
signs for par-Un-g—l"otat 8105 Lake Ballinger Way (CG).
Applicant was seeking approval to install one double -face internally
illuminated plastic pycon sign for a new drive-in window and five wooden
non -illuminated directional pole signs for traffic control. Mr. Lewis
presented slides of the site plan and sketches of the signs. Mr. John
Dittrich, sign contractor for the project, further detailed the proposal.
He stated that there was a traffic problem on the site, and that the
directional signs were needed to ease the situation. Board members
expressed concern over the number of "Do Not Enter" signs that would be
at the exit of the parking lot. IT WAS THEN MOVED BY MR. KINDERFATHER,
SECONDED BY MR. SPANFELNER, TO ACCEPT ADB-98-80 AS SUBMITTED, WITH THE
RECOMMENDATION THAT THE EXISTING "DO NOT ENTER" DIRECTIONAL SIGN BE
REMOVED. MOTION CARRIED.
The appl-icant was returning from the December ABD meeting with revised
plans for this project. This proposal was to remodel and expand existing
retail buildings located on the northwest corner of 5th and Main Street.
Mr. Lewis reported that the expansion will increase the square footage
total by 16,383 sq. ft., bring-Ing it to 30,525.5 sq. ft. gross floor area.
He stated that the applicant I!; willing to be flexible on landscaping. All
parking will be provided through contributions to the in -lieu parking fund;
however the exact number of spaces has not been determined at this point.
Mr. Lewis went over the existing site plan and the new planning layout for
the corner.

Chairman LaFon asked the applicant how additional parking needs would be
met. Mr. Johnson stated that this matter is being studied, but has not been
resolved as of yet. Board members expressed concern over what type of
lighting, signing, and awnings would be used. Also of concern was the type
of materials to be used for the exterior of the buildings at ground level .
Mr. Johnson stated that he was willing to be flexible on matters of detail,
and that he wants the project.to be as compatible as possible with surround-
i ng buildings. The hearing was opended to the audience.
Natalie Shippen of 1022 Euclid, asked Mr. Lewis what additional parking
would be required for this project. Mr. Lewis responded that it would depend
upon the intensity of usage of the building. He stated that he would calcu-
late the required parking1stalls for the existing structures and for the
proposed expansion and bring this information to the next hearing. Ms.
Shippen asked the Board whether models for major structures are required,
as they make it easier to visualize the project. Chairman LaFon stated
that although models would be very helpful, the Board has not made them
mandatory. No one else wished to speak. and the public portion of the

At the January 7, 1981 meeting Mr. Johnson was asked to return with samples
of materials, colors, lighting, trash enclosure and an updated review of
the parking from the staff. Mr. Lewis reviewed the site plan and elevations
of the project and stated that there are no changes in the main floor site
plan or exterior. The pro'posed trash enclosure will be located in the
loading area off of the al'ley. It will be a six foot high fence constructed
out of 6" bevel cedar siding stained to match the building. The materials
for the building will consist of the existing brick veneer on the front of
the building along Main Street and also along Fifth Avenue for the first
floor. Cedar siding will,be al. the very top in the enclosed corner of
of the building. A beigd stucco finish will be used on the rest of the
building to match the existing theatre. The cedar siding is to be stained
Olympic 916 or a weathered look type finish. The roofing material is a
Monray roof tile to be chestnut brown. Chairman LaFon asked that the
theatre front, with the guy wires and wood in windows, be upgraded and
Mr. Johnson stated thay they would do their best to clean it up. The
awning colors will be in pinks and oranges out of vinyl material. Chairman
LaFon stated that on the drawings for the corner entryway it shows arch
windows and doorways and on the sketch that was given to be board it showed
square windows, he asked why is that so. Mr. Johnson stated that the archway
was taken out and the window was squared off because this was the only area
that had arches and it didn't go well with the rest of the builiinq. Mr.
Johnson was asked to bring bark to the board samples of the material and
colors of the awnings. Mr. Lewis said that the parking calculatinns for
the existing building would require 104 parking spaces, there exists 0.
The proposed building wou:ld require 134 spaces. The applicant is proposing

ADB-12-81 S.S.G. CONSTRUCTION, INC. - Review of site and landscaping for parking lot
at 22828 100th Avenue West. (8N)
Mr. Lewis stated that this is essentially a remodel of parking lots for
Pizza Hut, Olson's Food Market and a proposed building site between the
Pizza Hut and the existing Albertson's. The parking has been calculated
for the largest possible building for that site. The proposal VM1 not
reduce the number of stalls provided for Olson's nor the Pizza Hut, it
will only be a different configuration. This proposal will allow increased
circulation throughout this site. A conditional use permit must he approved
for the amount of fill that will be required to level the two different grades
that now exist. Easement provisions between Albertson's, Pizza Hut, Olson's
and S.S.G. Construction will have to be reviewed and approved prior to
issuance of building permits. Mr. Lewis stated that the landscaping appears
to be adequate although there are no trees planned for any of the interior
planting areas, but staff would recommend some trees. The lighting is two
30 foot steel poles located in the planting areas with dual 250 watt high
pressure sodium lamps. Staff recommends that these lamps match the ones
that are existing in the Olson's parking lot. Engineering had stated that
there is a problem with the parking design plan in that the parking section
width for one-way traffic with 60 degrees angle parking is to be 54 feet,
the plan shows 52� feet. The width has to be increased to the city
standards and it can be done without changing the circulation design.
Chai man LaFon asked how high will the grade at Pizza Hut be raised. The
applicant stated that it will be raised about 1�', the sidewalk will be
changed and some of the steps up -to Pizza Hut will be eliminated, but will
not encroach into the landscaping that is existing. The drainage will be
improved by making these changes in the parking lot. Mr. Hintz asked the
applicant why the trees will be planted up against the Olson building and
not in the parking lot. The applicant stated that it was due to a visibility
standpoint and the big high wall needs something to cut the height down.
The trees that will be used are columnar maples. The main items in this
project is eliminating the retaining wall that now exists between Olson's
Motion and Pizza Hut and making access through all the parking lots. MR. HINTZ
MOVED, SECONDED BY MR. KINDERFATHER TO APPROVE ADB-12-81 STATING THAT IT
IS A GREAT PROJECT AND MEETS ALL THE CRITERIA. MOTION CARRIFD.
ADS-2-80 ALASKA NW PUBLISHING COMPANY - Review of lighting, siding and rooftop
landscaping for existing structure at 130 2nd Ave. S. (BC)
Mr. Lewis stated that this proposal received preliminary approval from the
ADB at the February 6, 1980 meeting. The applicant was then asked to return
with the lighting, roof landscaping, and trash enclosure plans. The board

with railroad tie stops. Board members reviewed the elevations of the
proposed restaurant and the samples of the materials to be used. Mr.
Lewis stated that the applicant would like to discuss the possibility of
using brick in place of the stucco on part of the east wall. Mr. Harrison,
representative for the applicant, asked the board if they.could approve of
brick as an alternate for part of the east wal I . He stated that it is
easier to attach the mansard roofing onto brick rather than'stucco and
the brick portion of the wall would be only underneath the roof. The brick
will be used -brick. Mr. Harrison stated that the stucco color is an off-
white. Mr. Lewis stated that the '12 parking stalls located in the alleyway
are accessible from James, 2nd and Main Streets. The alleyway is slender
but an extra five feet of turn around is provided. Mr. Harrison stated that
it is an existing crushed rock lot. MR. SELVIDGE MOVED, SECONDED BY MR.
HINTZ THAT ADB-27-81 BE APPROVED AS SUBMITTED AS FAR AS COLOR SAMPLES AND
INCLUDE THE ALTERNATE USED BRICK FACE ON THE EAST WALL UNDERNEATH THE MANSARD
ROOF. MOTION CARRIED.
ADB-99-80 RON JOHNSON - Review of awning materials for existing office and retail space
remodel at northwest corner of 5th Avenue and Main Street. (423 Main Street)
(BC)
Mr. Lewis stated that the applicant, is seeking final approval for site, eleva-
tions and landscaping for this project. At the March 4, 1981 meeting the
board moved to approve contingent upon the applicant submitting samples of
the canopy colors, plans for cleanup of the face of the theatre, and that the
City Council review the in -lieu parking alternative. There are three separate
color combinations proposed for the awning material; 1) blue and tan, 2) brown
and light tan, 3) light tan and light brown. Mr. Johnson then pointed out
to the board where the colors will be used. The blue and tan canopies will
be on the northeast corner of the project and also the southwest corner. The
tan and brown colors will be used on the corner of 5th and Main. The reason-
ing for the different colors is to distinguish between the different shops.
Mr. Johnson then asked the board members what they would like to see done as
far as the cleanup of the theatre. Mr. LaFon stated that the upper windows
be cleaned up rather than having the wood slats there. Remove the extra guy
wires. Mr. Johnson stated that the ladders will be removed, the electric
conduit will be consealed, screens will be fixed and the building will be
repainted to match the new structure. The awnings are vinyl and will have
bold stripes. MR. SPANFELNER' MOVED, SECONDED BY MR. LAFON TO APPROVE ADB-99-81

ADB-76-78 LOUISE ZENNAN - Review of revisions to approved elevations and site plan of
four-plex at 19515 80th Avenue West. (RM-24.)
Mr. Lewis stated that this item was appealed to the City Council. The City
Council remanded it back to the ADB for further consideration. The applicant
is seeking a reasonable compromise to gain final approval. Mr. Lewis then
showed slides of the project as to what has been completed so far and pointed
out what was to be built. Mr. Lewis stated that since the applicant was at
the ADB two months ago no further work has been done on the project. Land-
scaping has been added since the slides were taken and also the entry ways
and the pathways are more defined. On the rear elevation chimneys were
proposed and the entire building was to be stucco. On the front elevation
there were to be greenhouse type windows with an arched affect. Mr. Lewis
showed the board a landscape plan that shows how it has been planted but no
sizes are called out. Mr. Bennett, representative for the applicant, stated
that since the Council has reviewed the project he has had several chats with
Mrs. Zennan on the changes she made without the approval of the ADB. He said
Mrs. Zennan-has goofed in his opinion and the purpose tonight is to correct
those mistakes. Mr. Bennett stated that Mrs. Zennan can landscape as to
the approved plans with the help from planning staff and the ADB. He also
stated that he would like to get a punch list frqm the board as to what items
are'needed to be done or changed. Mr. Bennett stated that an arched affect
coul - d be created for the front windows by using curved boards. Tt is
extremely difficult to remove the siding to replace with stucco so Mrs.
Zennan will have to go by what the board recommends. On the original plans it
shows the fireplaces in the cneter of the building and due to a beam going
across it was not feasible to put the chimneys in. Mr. Bennett stated that
Mrs. Zennan was here tonight for help and guidance in correcting the mistakes
that were made. Mr. LaFon asked the board members if they had visited the
site and they all responded that they had. Mr. Herman asked if all the parking

reason to allow a 12' pole sign. Mr. Kinderfather agreed that it was
too high. The applicant said he was concerned about the window sign;
that he did not need the pole sign and the property owner should take

RON JOHNSON -,Conceptual review of preliminary design of a remodel of
the northwest'corner at 5th and Main St.
Mr. Johnson said this is the half -block from the theater to Durbin's
and the plan is to remodel the entire building which is one-story
in height presently. The remodel will create essentially a two-story
structure with a third story at the back half of the corner. The
first floor will remain primarily the same except that the existing
drug store eventua ' Ily will be removed and broken up into smaller
spaces. The second floor will be primarily offices with some retail
if possible. There will be a light well in the middle of the structure.
'the theater buildi'ng will be left the same except that the theater
will be smaller. The overall height for the three-story structure is
32', being two story at the outside and sloping to the third story at
the inside. Mr. Bowman advised Mr. Johnson that this would have to be
reviewed under a SEPA determination. Mr. Johnson said the required 22
parking stalls all' would be provided by payment into the in -lieu
parking fund. i
Chairman LaFon advised him that this is a predominant corner of the
City and will take' a lot of study and understanding of how it works
inside as well as�out. He said he would have specific comments on
materials. Mr . S�,anfelner said he saw two different styles of architecture
in the same building--viestern and old Engish. Mr. Mitchell did not
think what was shown in the drawing fit the corner, altho0gh it would
be good somewhere�else. Chairman LaFon was concerned about the fascia,
but he said the project had some conceptual merit. He noted that he
had not yet seen a�ny "in -lieu" parking and that bothered him, so he
felt the applicant should try to attain some of the parking. Mr.
Spanfelner observed that he always can park within two blocks of
where he is going. Mr. Bowman said a committee is looking at the
downtown area to find a parking lot. Chairman LaFon said he did not
think there is a parking problem today, but there will be in the
future. He did not think anyone had looked at the long-term effects
on this part of town.
ADB-23-80 GO 'N JOY - Review of rooftop equipment screening (from Consent Agenda)
No representative of the applicant was present. CHAIRMAN LaFON MOVED,
SECONDED BY MR. SPANFELNER, TO DENY ADB-23-80 and that the applicant
resubmit. Mr. Kinderfather asked why they were not recessing the
equipment as originally proposed, and he felt if a screen were going
to be on the roof it should be continuous. Mr. Spanfelner observed
that the 7-Eleven stores put their equipment inside the building. THE
MOTION CARRIED.

December 31, 1993, and to date we have not received neither your "in -lieu parking fee" of $4,200.00
nor confirmation that you are leasing spaces elsewhere within the Downtown Business Area (BC Zone).
Therefore, you are currently in violation of Chapter 17.50 of the Edmonds Community Development
Code. By 5:00 p.m. January 28, 1994 you must either pay the "in -lieu parking fee" of $4,200.00, Qr

Business Area. Failure to take action by the aforementioned date shall require this office to take the

required by the Uniform Plumbing Code and City policy.

maintenance problems on the sanitary'sewer serving the
building.

An application had been received for a Street use perinit from Chez Claude Restaur-
ant for outside dining for the summer months. City Engineer Larson projected a
drawing of the concept on the screen. The area proposed for use would include
half of the sidewalk and a portion of the parking area in front. of the theatre.
The Engineer noted that the application had been reviewed and approved in concept,by
the ADB and the Park Board. �he Police Dept. had no objection;.Public Works was
concerned only with maintenance of the proposed planters; and the Fire Dept. had
reported that there was nothing in the code to prevent this concept. Approval was
therefore recommended.

City Attorney John Wallace advised Mr. Steinman, when fie complained that he would
not have use of that road, that he had invaded.the city right-of-way without per-
mission in the first Place, and therefore the road was not legally put in.
QUESTION OF COUNTY SEWER CONNECTION TO CITY LINES -
City Councilman Gould introduced Dale Hoggins, 21326-95th. Ave. W., who��stated that
he is.just a block outside city limits, having septic tank problems, and'would
like to connect to city sewer. Mr. Hoggins said he favored annexation to the city
if it were possible; that lie would have been annexed with the previous "bellins
Gardens" annexation off 220th, but that some neighbors on one side of the street
in his area were against it. Therefore, all were left out of that annexation.
City.Engineer Larson noted that it was the Policy of the city, set by previous
councils, not to allow connection to city sewers unless -you were inside city limits
or a public facility, such as a school or hospital. He explained that there were
three options open: the elej�tion method of annexation; the petition process with
10% letter of intent and then signatures of 75'% of assessed valuation; or the third
method open to code cities, which can initiate.annexations in cases where 80% of
the boundaries are contiguous to city limits. Annexation could be done by resolu-
tion of council, and in.se ' ptic tank cases could go on the h ' ealth hazard. It was
brought to council attention that the county had recently refused a building permit
in that area because of the perc test, and that it would be well for the Health

An application had been received for a street use permit from Chez Claude Restaur-
ant �for outside dining for the surinier months. City Engineer Larson projected a
drawing of the concep . t on the screen., The area proposed for use ' would include
half of the sidewalk and a portion of the'parking area in front of the theatre.
The Engineer noted that the application had been reviewed and approved in concept by
the ADB and the Park Board. The Police Dept. had no objection;.Public Works was
concerned only with maintenance of the proposed planters; and the Fire Dept. had
reported that t * here was nothing in the code to prevent this concept. Approval was
therefore recommended.

the follo�ving comments and suggestions are submitted by the Park Main-
tenance and Street Departments.
Park Maintenance: 11ho will be responsible for the maintenance of
the planters? Who will be -responsible for any vandalism?
Street Department: The restaurant will be responsible for sweeping
the area in which our Street Sweeper cannot reach. (See attached
sketch.) This must be done each Monday and Friday. We presume
the Fire Department is aware! this would eliminate a "Fire Zone"
and related comments should be included in their review of the
plans.

Re: Street Use Renewal Fee Permit #93-3

As required by City Ordinance #2972, Street Use permit renewal fees are now
collected every three years instead of yearly. The first effective billing date was l/l/96
however, due to staff shortages, the City was unable to send out this billing for the
period 1/96 to 1/99. Please remit renewal fees in the amount of $25.00 to the City, of
Edmonds, c/o Building Division, Permit Specialist, 250 5th Avenue North, Edmonds,
Washington 98020 within 15 days date of this letter.
If this permit is no longer applicable i.e., you no longer utilize that portion of the City
right-of-way granted under the street use permit; please notify the Building Division in
writing so that we may cancel the permit. As permit holder it is your responsibility to
inspect the permitted use for safety hazards on a yearly basis.
As a reminder your Certificate of Insurance will expire on 3/14/98. Please continue to
send us updated renewal certificates.
