McComas, Fire Marshal DATE: April 21, 1994 SUBJECT: EDMONDS THEATER AT 415 MAIN STREET On April 20, 1994 1 was informed by a citizen that the management of the Edmonds theater has been using the balcony in violation of your letter to the owner Mr Jacque Mayo dated October 12,1992. 1 made a copy of that letter and contacted the theater manager Mr Rubert Rine on April 20 1994 at 4:35 pm , Mr Rine stated that he was aware of the letter but that the balcony had been used in spite of the safety concerns. I advised Mr Rine that my visit on April 20 was intended to remind the management of the requirement to prohibit the use of the balcony until proper exiting can be provided and that any future violations would cause the city to bring legal action. Mr Rine said that he understood and that he would pass the information on to the owner,Mr Mayo. I will have the fire crews do walk through inspections to monitor compliance, I'll keep you informed. HALL MAYOR With regard to the second story balcony exit, I have reviewed Building Division files and discovered several letters outlining the City's position. Previous Building and Fire Officials determined the balcony exit was a life -safety hazard and under Section 104 of the Uniform Building Code closed use of the balcony subject to repair work that conformed to current codes. The most recent City letter dated 12/12/89 stated, "If you plan to open the balcony in the future, ...submit plans that ... address exiting, occupancy load (existing and proposed) and all other applicable requirements of City and Uniform Building Codes, (UBC). " The City received the stair plans on June 16th, 1992 and during the plan review process, applicable requirements of the code i.e., stair width, guardrail details, etc. were called out as required changes on the plans. Unfortunately, the approved plans and permit were not picked up, and your contractor undertook the work using unapproved plans. Consequently, when I made the site inspection on Tuesday, September 29th, I noted that the stair and guardrail do not comply to the code and therefore cannot be approved for use. Section 3306 of the 1988 UBC states that stairways serving an occupant load of 50 or more shall be not less than 44 inches in width, the rise of every step shall be not less than 4 inches and nor greater than 7 inches, and the run shall not be less than I I inches. Handrails are required to be 34 to 38 inches above the tread nosings on both sides of the stair and no openings greater than a 6 inch sphere are permitted. The landing on the exterior side of the door is required to be 44 inches in length and width. Attached are the structural calculations for your reference. Our analysis is based on the code required 100 pounds per square foot vertical live load for the exit landing, treads and stair stringers., A horizontal loading of 50 pounds per lineal foot was used to analyze the handrails. Our analysis with regards to the fire exit stair load capacity is as follows: 1. The stair stringer is adequate to support 100 pounds per square foot. 2. The stair treads are adequate to support 100 pounds per square foot. 3. The top exit platform and diagonal support brackets are adequate to support 100 pounds per square foot. The front and rear supports need strengthening. 4. The handrails, and posts are not adequate to resist the 50 pounds per lineal foot applied horizontally on the railings. Recommendations I It is WJA's recommendation that the handrail and handrail support posts be replaced with angles having a minimum size of 1-3/4" x 1-3/4" x 1/4" thick or 1-1/2" diameter standard pipe or other structural shapes of equal strength. 2. The top exit landing requires placing a 1-3/4' ' 'x 1-3/4" x 1/4" angle below the landing grating, on the theater door side and on the alley side. These angles should be welded to and span between the support brackets. 3.. The bolts anchoring the stair landing support brackets to the building wall should be tightened. Upon arrival they entered the business and found access to the upstairs exit obstructed with a chain and the east set of exit doors from the lobby onto Main Street secured with dead bolts. They also found exit lights inoperative throughout, the upstairs exit door obstructed to the point it would not fully C) open and access to the front exit doors partially obstructed by a chain. At the time of their inspection the 2 x 4 had been removed from the northwest ' exit. They contacted a Mike Howard who was the person in charge at the time of inspection and informed him of the code violations and unlocked the front doors and removed the chains prior to leaving at 2115 hours. Also, on June 8, 1985 1 attended a movie at your theatre and, while entering, observed that the front doors were all locked except for one leaf.' This practice is well documented in your inspec- tion file and requirements have been repeatedly conveyed to you by letter and through personal contact with persons in charge of your building. I recommend that "panic hardware" be provided for all four front doors. This would give you control of the entry point and at the same time assure unrestricted exit as is required by the Fire and Life Safety Code. Since maintenance of exits is an extremely important matter in a place of assembly and considering the history of the theatre, I regretfully inform you that future violation w-ill cause a cita- tion to be issued. Edmonds, Washington 98020 Dear Mr. Klein, March 301 1970 0 PRESENTING DISTINGUISHED FOREIGN FILMS THE WORLD'S FINEST SCREEN ENTERTAINMENT During the week prior to my leaving on vacation (3/19) 1 received phone calls from Mr. Bennett and Mrs. Brown and a memo letter from Mr. Bennett advising that we could count on operating the Edgemont Theatre -fully and uninterrupted through August 31, 1970. I requested again written substantiation of this from your department, and take your letter of March 23 to be intended as such. I would like to clarify certain points. I have read the section you forwarded re: the permit. I c,an some- what imagine the pressures on your staff. This permit I would deem the responsibility of the landlord., especially since it was enacted prior to our lease tenancy, and the building could not technically be leased for legal. operation without it. I am sure Mr. Bennett will pursue this if he has not done so already. My manager will have the additional "no smoking" signs posted and the additional fire ex*inguishers placed within the week. (Please notet4at on the date of inspection there were signs posted in the auditorium, lobby and upstairs hallway and restrooms. We rarely see these posted in closets and storerooms, but will be glad to cooperate.) Re: the projection booth any modifications thereto would again be the resonsl?bility of the landlord. Under our Union contract we can literally not set foot inside the projection booth, so I definitely do not wish to be in the middle of any jurisdictional dispute on this matter. It would seem, though, that if this is allowed to wait until September, the building owner could take care of this, as necessary, between tenancie@. The furnace roam and stairway -fire escape requirements are a matter of interpretation, I suppose. If the furnace room modifications were required immediately it would unquestionably knock out our heating plant for a period of time and disrupt our business. On the other hand, by May (and hopefully warm weather) the furnace gets minimal usage until after Labor Day. If this work were scheduled for June I or thereafter it could easily be done without interfering in our business operation. Please be assured that we will do everything oss-ible to coOperate with the buildi ownerls im ovement rogram so long as it d-oes not jeopargize our operffion, 2 0 I think I should be candid and acknowledge that the early March fire inspection and subsequent notice came within weeks after several strong beefs about our foreign film policy in Edmonds. These were oriented to a general objection of these films displacing Hollywood films, and to.an erroneous presumption t#at we,were going to move I ANI CURIOUS, YELLOW into the Edgemont. In earlier years the Seattle Theatre Boakd used the fire -building -health inspection systems as a lever to pressure their positions. Legal action finally stopped. this in 1964. But last June -July the practice was again prevalent as a splinter group of the John Birch Society activated a major ca.In CD .paign here against the abovementioned Swedish film. I replied to these complaints advising tftat we were terminating our operation oi the Edgemont on 8/31, pointing out that we had tried a policy of outstanding Hollywood family fare for two years (and nobody came), and stressing that our remainirg programming was to consist of a Festival of the more popular films that have played the last ten years.in the Ridgemont, Varsity and Edgemont theatres. From your letter, and kind willingness to work with the building owner in a staged upgrading, I now see this as a coincidental happenstance. Our primary concern, and validly, is to have fouddation to meet our obligations and d.o so without improper jeopardy (as woulid have been the case if we had -committed a 4/1-8/31 outla� and have been unable to fulfill it). But I trust that you can understand why this timing was also worrisome, especially in view of the 41� year delay. My earlier letter comments were directed to the more usual code applications. Generally, new codes are not made retroactive. (If this were the case in Seattle, half the theatres would be inoperative - and t1his only a minor facet of public assembly applications.) In such a case of retroactive application, I do not envy you the problem of non -discriminative enforcement. However, I believe Mrs. Brown to be one of the most progressive -minded of the downtown Edmonds property owners. She has been the bes.V�and most conscienteous of landlords, and I am sure you will find her most copperative. I am hopeful that the theatre can be reopened next Fall by a local management'; and that this time the community will support family programming. Tbis will depend of course on a major change in the public - from the present steMs quo where there is a big difference b6fteen what people say they want and,what they spend their money for. I would be remiss if I did not state in closing that in our 436 years of operating the Edgemont we have consistently found its municipal government operation out- standing, especially the police and fire departments. I shall attempt to categorically answer your letters dated respectively 1970 and March 12, 1970. 1.1arch 9, March 9, 1970 The permit mentioned is required in all Public Assembly occupancies and. has been in effect since August 2, 1965 when the City of Edmonds adopted Firg Prevention O�dinance Number 1123. The Fire Department, howeverg is limited in personnel and was unable to enact this particular section until mid-1969. All other items mentioned are covered below. ,-,arch 12, 1970 1 L. I am not aware nor particularly concerned which Fire oi� * building Codes were in effect when the building was constructed. What does concern me is that the building in it's present condition is below standards set for i.,iinimum 'Life Safety requirements. Tile Edmonds Fire Prevention Code sets minimum standards for places of ;-ublic Assembly. (Excerpt copy enclosed) I have been informed.by the owner.'s agent that major structural changes will not be required and that the necessary alterations should not inter- fere with normal theatre operations. 2. Your statement does not relate. The building does not correlate with present Codes not ' does it have approval of this Department which is a part of the governing municipal body. The Codes of the City of Edmonds relating to Life Safety are not always in agreement with liability coverage by insurance companies., 0 14r. James N. Selvidge Page Two 3. The Fire Department is aware which doors are presently equipped with . panic hardware and are simply stating that all required exits be so equipped but are exempting �he main front doors provided they are not locked when the building is occupied. Alsot not all items were listed as a violation; merely as being required or in proper operating condition. 5. Thank you. Such signs are being supplied to the owner's.agent. 6. This will bean elaboration: ANY equipmentg required or.noto that is placed or is existing in a building under jurisdiction of the Fire Department and is intended for fire protection or fire suppression shall be maintained in proper working order orp if not required and not so maintained$ shall be removed. The Fire Department is aware of regulations pertaining to nitro-cellulose products. In conclusion on the above itemag itwas stated In the Fire Department's letter March 9, 1970, that time extensions on Item #1 could and would be granted providing satisfactory progress towards Life Safety was noted. Item #2 has already progressed to the point that use of the balcony will be permitted at this time and shall continue to be used provided reason-� able steps are being taken to upgrade the fire escape to minimism standards.
