The Critical Areas Checklist contained on this form is
to be filled out - by any person, preparing a
Development Permit Application for the City of
Edmonds prior to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable City staff to
determine whether any potential Critical Areas are, or
may be, present on the subject property. The
information needed to complete the Checklist should
be easily available from observations of the site or
data available at City Hall (Critical Areas inventories,
maps, or soil surveys).
An applicant, or his/her representative, must fill out

Subject: ACCESSORY DWELLING UNIT — 419 — 3RD AVE. N.
This particular property has had a history of complaints from nearby neighbors.
The complaints have ranged from parking disagreements to illegal construction.
After sorting out the concerns, I felt obligated to pass on some history that may be
helpful.
Originally, there was a concern that a remodel would turn this property into a
duplex. The plans did show an Accessory Dwelling Unit (Mother -in -Law Apt.) and
the City did require that a Conditional Use Permit be submitted and approved
before it would be allowed to remain. The then owner (Adam's) complied as
requested and was granted final approvals only to sell the property once the project
was completed. Today, a new owner (Deneau) has purchased the residence and
keeps it as a rental property. Ms. Deneau has been made aware of the neighbor's
concems and the City's regulations for Accessory Dwelling Units. Attached is a
letter from the Ms. Deneau agreeing to only use residence in a single-family manner
and not as a duplex.

Ave. N. I will be renting this home in the near future to a family who will occupy the
entire house. There is only one lease for the premises. Please make reference to this in

Per your request, I have researched the chronology of painting actions on the parking
strip at 419 3rd Ave. N. and found that all previous actions taken by the City have been in
conformance with its policies and procedures. The following is a summary of past and
current events:
1. The City installed the crosswalk prior to 1992, but the exact date is not known.
2. CT installed a bus stop located just south of the crosswalkron the west side of 3rd
Ave. N. Exact date -of this'event is unknown, but Gordy Hyde believes it to be in the
early 1990's. The City does have approval authority on location of bus stops.
3. The City painted the parking strip yellow just south of the crosswalk, and also to the
north, to provide the required view. clearance for ' the crosswalk. This action is
consistent with City policies. Date of the initial painting is unknown.
4. The current white striping was not done by.the City, according to my discussions
with Engineering and Public Works.
5. Last week, Engineering Division issued a work order to Public Works to paint the
parking strip in front of 419 3rd Ave. N. yellow. Public Works has executed the work
order. The curb is yellow!!
6. On September 14, 1998, the Edmonds City Council approved a three-hour parking
limit for the 400 block along 3' Ave. N. Homeowners living in this area could
purchase residential parking permits, which would allow them to park for more than
three hours at a time.
7. On October 1st, the City received the attached letterfrom the property owner at 419
3rd Ave. N.(Mr. Adams) requesting documents and correspondence on their property
related to parking.

Based on my recollections of what Mr. Adams said to you, the City could ask CT to
move the bus stop to the south if both CT and the City see this as beneficial. Even with
the yellow striping, Mr. Adams can temporarily park in that space to offload passengers.
At this point, I'm not sure what Mr. Adams wants. Even with the activation of three-hour
parking at this location, he can park all day where he parks now. Even with the yellow
stripin.g, he can offload passengers as he does now. The only way that the yellow stripe
would be removed is if the crosswalk were eliminated; this is a City decision.
Please let me know what the City should do next.

order.
