replacement of a sanitary sewer fift station and appurtenances, over, across, through, and below the
-following described property, and the further right to remove trees, bushes, undergrowth and other
obstructions interfering with the location, construction, operation, maintenance, repair, reconstruction or
replacement of said sanitary sewer lift station and aRpurtenanc , together with the right of access to the
easement at any time for the stated purpose.
The easement hereby granted is more particularly described as follows:

SYSTEM SPECIFICATIONS
GENERAL
Furnish and Install a complaie pumping system as manufactured
by HYDR-O-MATIC Pumps, Ashland, Ohio. System shall Include
two newage grinder purpp, three 3900 mercury switch level
controls. discharge plumbing with hydraulically sealed discharge
flango. pump mounting plates with bottom rail supports, upper
rail supponfi,. lifting chain, pedestal mount and cord sealing
plate lor panel or NEMA IV junction box, to be Inqlallod In factory
fabricated basin with cover or on -site concrete basin. A NEMA IIIR
weatherproof control box shall be supplied. for- mounting at the
sump site or remote from the basin as roqulred� Structure and
dimensions to be as shown on drawing 9heet 1 of 1
OPERATING CONDITIONS
Each 1pump-shall have a capacity of -44!o:�, opm against.& total
head of (170 feet. Pump motor shall be 3 - hp.
1 — phase. 2-10 volts, 54::-20 rpm. �q t�d - cycle.

Separate specification for pump and motor.
SUMP LEVEL CONTROLS
Sealed float type mercury switches phall be supplied to control
sump level and alarm signal, It furnished. The mercury tube
switches shall be sealed In a solid polyurethano float for corrosion
and shock resistance. The support wire shall have a heavy
Neoprene jacket. A weight shall be attached to cord above the float
to hold switch In place In sump. Weight shall W.above the float to
effectively prevent sharp bonds In the cord when the float operates.
The float switches shall hang In the sump supported only by the
cord. Throo float switches shall be used to control level. One for
pump turn -on, one for pump turn-off, and one for both pumps turn -
on. A fourth switch shall be provided It with alarm. Float switches
shall be Model No. 3900.

Alarm light (or bell or horn) to be supplied In separate NEMA III
enclosure for mounting at the control box or remote from box. or
alarm light mounted on panel enclosure (200,230volt only). Alarm

turn-off setting and pump shall stop. Alternating relay shall Index
on stopping of pump so that log pump will sign on next operation.
If sump level continues to rise when load pump Is operating,
override switch shall anorg zo and start log pump. Both load sinli"j
lag pump shall operate together until low level switch turns off both
pumps. It level continues to rise when both pump& are operating,
alarm switch shall anorgize and signal the alarm. where used. It one
pump should fall for any reason. the second pump shall operate on
the override control and It level rlsos above overrido control, alarm
shall signal, where used. All level switches shall be adjustable for
level &ailing, from the surface.
ELECTRICAL CONTROL PANEL
Control panel shall have a NEMA IIIR weatherproof enclosure. A
look hasp shall be provided on door. A circuit brookor shall bo
provided for each pump pnd a magpoll i c startor with 3 log ovorlooO
protection for throe phase operation, or I log overload protection'
for single phase operation, shall be supplied for each pump. An
alternating relay shall be -provided to alternate pumpo.Qn each
successive cycle of operation. Sloners shall have auxiliary contact
to operate both pumps on overrido condition. An Interlock relay
shall be provided to*automatic-ally ro-connect-the control circuit In
case of circuit breaker trip on one pump. H-O-A switches and run
lights shall be supplied for each pump. Terminal strip shall be
provided for connecting pump and control wires. Additional
terminals shall be provided to connoct alarm. A-tran4formor shall
be supplied to give 24 volt control circuit. Panel Model No.
UL listed. Panel shall have relay with
dry controls for alam.telem. connection.
CHECK VALVE & PIPING
The discharge piping shall Include a HYDR-0-MATIC ball check,
valve with hydraulically soaloO discharge flange and a got@ valve
for each pump. Discharge from station shall be filled with two NPT
couplings. All piping external to the station shall be furnished and
Installed by the contractor.
SUMP BASIN
The factory fabricated basin, where furnished, shall have an Inside
diameter of loot and Inches., and a. Oolght
of foot and Inches. The basin cover shall
be Inches O.D. and — Inch thick. Basin, It stool.
and cover shall be sandbla4lod Inside and outside to remove
scale, slog, rust, etc., before painting. Basin, If stool, shall be
coated Inside and outside with tar base opoxy point for cor-
rosion resistance. , See plans

On May 10, 1991, an engineering inspection was conducted at the subject
project site. Listed below are the deficiencies noted:
1) Parking stall width in front of building "B" not to City standards.
2) Two (2) parking stalls behind and one (1) to the west of building
"A" not to City standards.
3) Drain plug at base of stairs to garage, building "A", plugged.
4) Clean asphalt off of all manhole and utility covers.
5) Clean out sewer manholes.
6) Install locking nuts on manhole covers.
7) Grout around pipes in valve vault.
8) Grout all catch basin and manhole concretee extension rings.
9) Clean out debris from oil separator.
10) Downspout on south side of building "B" not connected to tight
line.
11) Downspout at southwest corner of garage to building "C" not
connected to tight line.
12) Install splash blocks at all downspouts around building "C",
which is not connected to tight line.

13) Secure chain link fence to posts.
14) Provide exterior lockable latch to gate at lift station panel
enclosure.
15) Enclosure around lift station panel not wide enough.
16) Lift station and system not tested.
17) As -built drawings required.
18) Clean out all catch basins.
19) Lift station telemetry not installed.
20) Repair defective areas of asphalt paving in front of building "A"
21) Parking stalls south of building "B" and building "C" garage (next
to concrete retaining wall) not to City standards.
Because the olef station and associated equipment have not been tested
to date, a separate punch list may be required. The test on the lift
station, scheduled for this morning, is only a partial test and is not
to be construed as a final test or acceptance of the system. After the
telemetry is in place, a complete test will be conducted on the lift
station.
Before we will consider any additional occupancies, the lift station
must be totally operational. We feel that four (4) weeks from today is
sufficient time to get the system completed.

The first letter, requesting street lights, has been forwarded to Bill
Stroud, Street Supervisor, as he is responsible for ordering street
lights if necessary.
The second letter dealt with a request to prune maple trees at the City
park. Pat Harris, Park Maintenance Supervisor, had indicated a
willingness to work with Mr. Thuesen's subcontractor to trim the trees,
which is Mr. Thuesen's responsibility. Apparently, Mr. Thuesen's
subcontractor has not responded to Pat Harris for coordination of the
effort.

Re: Temporary Occupancy request of April 25.
Mr. Thuesen:
I agree that you have made repeated requests for temporary
occupancy of your building at 428-434 3rd Avenue South (City Park
Condominiums) and that we have refused each time. Each time I
explained the project was not sufficiently complete to consider a
temporary occupancy. You do not seem to fully understand what our
policy is. Let me explain.
My staff agrees that our current policies have not changed
regarding inspections and occupancy in the past 10 or 15 years. My
staff tells me you have been though the process a number of times
in the past and do not understand your confusion. That policy is
as follows.
1. Once a request is made for "Final Inspection" or
"Permission to Occupy" the departments involved in the
permitting process are notified (the building department is
last to inspect). Each department must grant approval before
a Certificate of Occupancy is granted. The building department
inspection is usually not scheduled until the other
departments have conducted their inspection and have approved.
2. If a request is made for "Temporary Occupancy" the same
process is followed by my department. If each reviewing
department is willing to release (with or without conditions) ,
the building official may issue a Temporary Occupancy for a
limited period and with specific conditions.
So if all reviewing departments agree to a temporary occupancy the
building official may issue a temporary pursuant to Section 307(d)
of the Uniform Building Code (UBC) . It should be noted that the
UBC is a model code and allows for local interpretation. Section
307(d) is not a mandate but offers a method of granting a temporary
when justified - thus the use of the word MAY in the text.

In your particular case, the reviewing departments have not granted
permission to issue a temporary occupancy. Engineering and Planning
have reported that too much work remains to be completed to
consider a temporary. For that reason the building department has
not scheduled its final inspection and has yet to determine if the
building's life safety requirements have been met.
Again, I believe the policy is the same as it has always been. I
cannot agree to the issuance of a Temporary Occupancy until each
reviewing department agrees to allow that do be done. I hope this
will clarify the situation at City Park Condominiums.

lowering of the park access road adjacent to 430 - 3rd Ave. S. The
proposal, as I understand it, would have to be approved by the Parks
and Recreation Division, Arvilla Ohlde, Manager. My impression is that
changes to City parks have to be approved by the Planning Board as
well. I would recommend,,that you contact Ms. Ohlde regarding your
request.
I have talked with Ms. Ohlde regarding having the Park Division crews
trim the overhanging maple trees. I have given her Steve Gillis' name
and number as well.

I conducted an inspection of the subject site this morning to determine
if your performance bond could be released on the following work said
to be complete:
1) Concrete retaining walls
2) Rockery
3) Storm/sewer lines and catch basins
4) Sewer pump station
Based on the inspection, the concrete retaining walls, the storm/
sanitary sewer systems, and the catch basins are not 100% complete.
Partial payment cannot be made on the above items and, therefore, money
for those items cannot be released. I am recommending $1,800 be
released for the rockery and $24,000 be released for the pump station.
When the pump station is operational, I will recommend releasing the
remainder of that portion of the bond.
The total amount of the performance bond that I'am recommending for
release is $25,800.

Since construction commenced this past week on the property North of
City Park, a dangerous situation has arisen regarding construction
vehicles parking adjacent to the park road exit. This is creating a
blind area where drivers exiting the park cannot see vehicles traveling
on Third Avenue.
I have discussed this with the on -site Project Manager but the
situation still persists. Could you please discuss this with your
Project Manager and all subcontractors doing work at this location? I
would recommend holding vehicles back at least forty five feet on
either side of the exit.

As you requested yesterday I have verified the grading quantities
on Bjorn Thuesen's City Park Apartments. The calculations in our
file show 2631 cubic yards of cut and 937 cubic yards of fill,
based on average end areas of plotted cross sections. Therefore
the 3,600 cubic yard figure in the grading permit application is
accurate.
I have also modified the drainage and grading plans to provide dual
culverts in the swale as requested. One copy of each of these
sheets are hereby forwarded. Let me know if there is anything else
you need.

In regards to acceptance of the new Lift Station for sanitary waste
for the Third Ave., Park Apartments.
We have inspected this facility and found the following changes are
needed in order to finalize this project. These changes are currently
being worked on and should be completed in no time.
1. Brackets for floats are to be relocated by pump tech
incorporated as per City requests.
2. Locking nuts on electrical panel are missing.
When these changes are completed the City will grant full acceptance of
the lift station. These changes are to be completed in two weeks.

in response to your request of May 13, 1 have compiled a list of corrections forwarded to me as a result of
inspections on your site. I will break the list into two categories; 1. Those items that must be completed
before a Temporary Certificate of Occupancy will be issued and , 2. Those items that have been
identified to date that must be completed be for a final occupancy will be granted.
REQUIREMENTS FOR ISSUANCE OF
TEMPORARY OCCUPANCY
BUILDING DEPARTMENT:
The Building department is willing to approve temporary occupancy at this time.
FIRE DEPARTMENT:
On 3/12/91 the Fire Department granted permission to occupy Building #B. The records do not indicate
any other building has been approved. At this time only building #B may be occupied.
PLANNING DEPARTMENT
The Planning department is willing to grant temporary occupancy at this time, with conditions.
PUBLIC WORKS DEPARTMENT
During an inspection this morning (5/14/9 1), Public Works partially tested operation of the lift station on
the site. The lift station is apparently operational, but the telemetry has not been installed. Since there is
adequate storage capacity for one (1) unit in the event of system failure, temporary occupancy for one (1)
unit can be granted at this time.
ENGINEERING DEPARTMENT:
After inspection this morning (5/14/9 1), the Engineering Department is now willing to grant a temporary
occupancy, with conditions.

CONDITIONS THAT WILL BE PLACED
ON TEMPORARY OCCUPANCY
1. Install lift station telemetry by June 15, 199 1, as required by Engineering and Public Works..
2. An application must be submitted to ADB by May 2 1 st for changes made in the following
areas:
a. Landscaping installed does not match the approved landscaping plan.
b. Installation of unscreened mechanical equipment contrary to approved plans.
c. Changes made to exterior lighting. Approved plans indicate nine (9) exterior light
fixtures, but only five (5) were observed on site.
d. Brick pavers shown on plans were not installed.
3. A permit is required for the fence adjacent to 3rd street that was not shown on the plans. This
fence appears to be in the city right-of-way and will have to be moved or a street use permit will
have to be obtained.
4. Problems have been identified with the approved parking plan and must be resolved before
final occupancy can be granted:
a. Four parking spaces were under sized and may not be counted if they do not meet
Engineering standards.
b. The second handicapped stall shown on the approved parking plan has not been
provided.
c. Two spaces were not properly striped.
CONDITIONS FOR FINAL OCCUPANCY
The following items are those that, to date, have been identified as corrections required before a FINAL
OCCUPANCY will be granted.
FIRE DEPARTMENT:
All building on site must be inspected by the fire department and approved for occupancy before a final
occupancy will be granted. Currently only building #B has been approved for temporary occupancy.
PLANNING DEPARTMENT:
The planning department has forwarded a list of corrections to be satisfied before a final occupancy will
be issued. These corrections include:
1. ADB approval of all landscaping changes that have been made.
2. Approval and compliance with the required fence permit.
3. Insure the required parking has been provided.
ENGINEERING DEPARTMENT:
The Engineering Department has forwarded a correction list to the Building Official after their site
inspection. They asked that no final occupancy be issued until the following items have been completed;
1. All drains and sewer manholes must be cleaned of all dirt and debris.
Tlie on site sanity sewer lift station control panel is not accessible. Tlie existing enclosure is
too narrow to allow for access to the "Power Disconnect Switch".
3. The lift station alarm system has not been tested.
4. Current configuration of check valves in the lift station does not allow for alternative by-
pass. If one by-pass fails the system will fail.
5. Parking stalls at the side and rear of Building A and in front of Building B shall be in
compliance with city parking standards.
6. Open plugged drain at the base of stairs to garages Building A.
7. Install locking nuts on all manhole covers.
8. Grout pipes, in valve vault, that run to lift station.
9. Grout all catch basins and manhole extension rings including grate at rockery near stream.
10. Clean out oil separator and all catch basins.
11. Connect downspout on south side of building B and southwest comer of building C to storm
water tightline.
12. Secure chain link fencing to fence posts.
13. Provide a locking latch on lift station gate and widen east side of enclosure an additional 30
inches from its original position.
14. Provide required as built drawing of existing utility development.
15. Install lift station telemetry by June 15, 199 1. (will be noted as a condition of the
Temporary Occupancy).
16. Repair asphalt paving on south side of building A.
PUBLIC WORKS DEPARTMENT:
The Public Works Department has forwarded a correction list to the Building Official after their site
inspection. They asked that no final occupancy be issued until the following items have been completed;
1. Telemetry for the lift station must be installed, tested and fully operational-
2. The generator hook-up must be compatible with the city generator and the motors must be
in the right polarity.

7. Our architect incorrectly used another city's requirements
for back -out width. Our final plans will show the required
42 feet by simply moving our rockery and parking area the
required distance north, along our north property line and
by moving the sidewalk westward along the east side of
Building B.
8. A slope profile will be submitted for Ci'ty approval with
application for building permit, however, by spending a
few minutes on the preliminary site grading plan submitted
to you, you will see a gently sloping parking lot where,
for example, the 120 ft. on the north side of Building B
will slope from 31 ft. down to 28 f-t, a mere 2-2%. You can
determine that easily by comparing the basement floor eleva-
tion to the numbers in front of the garages and by the top
inverts of the catch basins.
9. There will be no earth removed to other locations and/or
brought into the site. The grading plan balances the
quantities.
10. Building A has 4 double garages and I single total of 9.
Building B has 3 double garages and 9 singles total of 15.
Building C has 8 single garages - total of 8.
In addition to the above, we have open parking spaces of 26.

only 8 feet in width. Some of the stalls

PIERMIT COUNTER
1. Telemetry from Stead & Baggerly must be hooked up per City
of Edmonds requirements.' Must be hooked to 110 control
breaker so if turned off, alirm will sound at shops.
2. Generator must be hooked up correctly to accept City portable
generator and motors are to be in right polarity.
3. Valve vault must be hooked up with proper drain to wet well
and provided with a check valve that is accessible so
maintenance can be performed in wet well.
4. Fence is to be constructed around electrical panels (61 in
height with full gate opening on south side t� allow access
for maintenance). Must have 3' working space on sides and
back from furthest extremity of electrical boxes.
5. Manhole lid on valve vault must be reset and mudded so as to
allow no leakage around base and must be aligned with opening.

Gentlemen:
Enclosed is my check in the amount of $100 to apply to
account 102-11100. 1 am the owner of the house, but
it is rented. Apparently around Christmas time a little -
used downstairs toilet was left running. The problem
was not detected and corrected until you notified the
tenants in February of an appa"rent leak, which you
assumed to exist because of the unusually high meter
reading.
I ask that you waive the balance of the bill due to the
unusual- circumstances. I would point out also that
the toilet which had been left running empties into a
septic tank, not into the sewer.. so no additional bur-
den was placed on sewage treatment facilities.
