The City has approved a "reasonable accommodation" request on behalf of Samuel and Goldy Marsh for
their property at 503 — 6h Avenue South, Unit 3 (File STF20100025). The Marsh's have requested an
exception from the minimum required 10-foot side setback and from the maximum allowed 45 percent lot
coverage applicable to the Multiple -Family Residential, RM-1.5, zone in order to construct an 8 foot by 8
foot landing at the entrance to their condominium unit (on the southern side of the building) with a 27
foot long ramp extending west from the landing, as depicted in the site plan printed on the back of this
notice. In order to allow the ramp and landing to be in the setback and to cause the lot coverage for the
site to exceed 45 percent, the Marsh's are seeking reasonable accommodation from the strict application
of the Edmonds Community Development Code (ECDC).
ECDC Chapter 17.05 was enacted to authorize staff, when necessary, to reasonably accommodate the
statutory rights of the disabled under the Americans with Disabilities Act, the Fair Housing Act or the
Washington Law Against Discrimination. The purpose of the proposed ramp and landing is to provide
wheelchair and emergency access. As part of the approval process, the applicant is required to file a
covenant with the Snohomish County Auditor's Office that contains specific conditions; for example, the
accommodation is personal to the owner and does not run with the land, so when the owner no longer
resides at the residence or is no longer in need of the ramp and landing, the ramp and landing shall be
removed to meet the underlying zoning code by obtaining a demolition permit.
Section 17.05.020(C) of the ECDC requires public notice of a decision on a reasonable accommodation
request to be sent to all property owners within 300 feet of the subject site. Pursuant to ECDC 17.05.050,
a reasonable accommodation is not an administratively appealab * le decision. Interested persons — that is,
persons located within 300 feet of the building site — may appeal the reasonable accommodation by filing
a petition for review with Snohomish County Superior Court within 10 days of the date of mailing of the
written notice of decision. This letter serves as the written notice of decision.

The Marsh's have contracted with Chermak Construction to build an access
ramp for Sam. As you can see from the attached doctor's letter, Sam is in
immediate need of a ramp so he is able to safely come and go from his home by
wheelchair. On at least one occasion, the emergency aid professionals have had
to get him outside the building before being able to place him on the stretcher for
transport to the hospital.
The Marsh's are asking for "Reasonable Accommodations" as described in the
ECDC Chapter 17.05. This is for an exception on multifamily residential Code
16.30.030 for side setback of 10 feet and for lot coverage of 45%. Sam needs a
8'x8' landing at the top of the ramp to be able to negotiate a stretcher out the
main door in times of an. emergency and a 27' long ramp running along the
building to have the proper 1 in 12 ratio for his wheelchair. At the farthest point,
the ramp and landing would protrude no more the 8' into the setback.
The Marsh's have be made aware that when the use of the ramp is no longer
need, whether through moving or Sam's death, the ramp will need to be removed
and brought back into compliance within six months of sale of residence at their
expense. This would also include the removal and replacement of needed
landscaping (purchase or transplanting) to be brought back to original layout.
Anything that can be done to expedite the process would be greatly appreciated
by the Mash Family.

their property. A licensed side sewer contractor must be employed to
construct side sewers in the public' right-of-way.
b. The side sewer contractor assumes full reponsibility for each
installation for one year. I
C. Commercial establishment requires a minimum of a six inch (6")
side sewer line.
d. Side sewers may not be installed closer than thirty inches (30")
to any structure.
e. Side sewer lines must be laid at a minimum grade. of 2% (1.150)
and maximum grade of 100% (450). 0
f. No turn in side s8wer greater than 45 (1/8,bend) is 0 allowed
between cleanout. All 90 turns must be constructed of a 45 (1/8
bend) and wye with removable cap.
g. No down spouts, footing drains or floor drains can be connected
to side sewer system.
h. Pea gravel is required for bedding when installing sewer lines
through other than granular soil.
i. Cleanouts are required at 30"-60" from each plumbing exit line
and at minimum intervals of 100' along sewer line run.
j. Trenches within City right-of-way must be restored to original
conditions. Contractors shall be responsible for right-of-way failure
due to poor compaction of fill.
k. Side sewer must be left uncovered until inspected and approved
by the City'

This letter is a follow-up to the meeting I had with Steve.and Dennis
Hellegrave of Cornerstone Construction regarding coordinating
construction efforts between companies and to suggest the City do
the overlay on 6th Ave. S.
Per the discussion in the meeting, I see no problem adjusting your
catch basin at 6th Ave. S. and Walnut St. and installing a curb inlet
at the corner low point if the telephone conduit prohibits the
placement of the Type I catch basin.
I inspected the condition of 6th Ave. S. to determine if just an
overlay or total repair was needed. Based on what I saw, the road
surface needs to be reconstructed. If -you wish to have your portion of
6th Ave. S. repaired and paved at the same time 6th Ave. S. and Walnut
St. are overlaid, the cost will be $15/S.Y. for cutout and repair and
$5/S.Y. for paving. Thus, your total cost will be $2,667. The
appearance of a single overlay will do more to enhance the area and
provide more protection to the base than segmental resurfacing. If you
want the City to have the paving done, please let us know so that we
can coordinate the work. In addition, all of your utility work in the 41
street curb construction must be done by the end of July.

ADB-86-90: Proposal eliminates two parking stalls. Because the
impact is primarily upon the applicant, we would
recommend that bollards be placed at the driveway
opening and the area be designated as a short-term
loading zone or as parking for City vehicles.
V/ ADB-82-90:. Seven -foot wide sidewalk is required on street
frontages. A twenty -foot long landing at no greater
than 6% should be provided. The garage, as designed,
creates a sight triangle obstruction. The driveway, as
designed, will exceed 14%, which requires a waiver from
the City Engineer. The minimum aisle width in a two-way
parking lot is twenty-four feet.
ADB-88-90-.- We need cross sections through property and show
relationship of 100 year storm water level to proposed
building elevations. Applicant may have to provide to
the City an easement across the open space to enhance
fish habitat. Frontage improvements will be required on
76th Ave. W. or a fee assessed in -lieu of construction.
ADB-87-90:. 6th Ave. S. must be overlaid from Walnut St. landing at
6% or less, minimum 20 feet long required at exit.
Storm water tie-in should be coordinated with
neighboring development. New curb to be constructed on
6th Ave. S. with-7' sidewalk.
ADB-90-90: Parking spaces need to be delineated by ownership/use.
Traffic study -will be required to assess traffic
impacts. Existing temporary parking lot must have
drainage installed and be paved to City standards.
Provide detail of worst case parking stall showing
proposed slopes. Provide centerline of driveway
profile. Provide cross sections of property.

Final Approval
This application was considered by the Board at the September 5, 1990 meeting. Since
the time of that meeting, the applicant has submitted revised plans to address the
Boards concerns. The building has been lowered in height, and a landscape plan has
been submitted.
In response to a concern raised by the Board at the previous meeting, the Engineering
Department has re -reviewed the parking plan and has approved the 21 ft. driveway asile
in back of the parking spaces. Gordie Hyde of the Engineering Department has
indicated that the 21 ft. wide asile is permitted for one-way traffic.
A second concern was raised by the Board about new Federal Fair Housing handicapped
requirements that will affect new multi -family projects that are not occupied by March
13, 1991. The Federal requirements are not being enforced by local jurisdictions at
this time, but there are stiff fines to developers, architects, and financial
institutions who are involved with developments that fail to comply with the
requirements. A copy of the requirements has been acquired for the Board members to
review. The requirements exempt townhouse developments, and the applicant has
indicated that he has designed his proposal to comply with the exemption from the
requirements by providing two townhouse units, and two stacked units.
The following is an excerpt from the September 5, 1990 meeting minutes.
A. Site
1. Nature of Site - The subject site is a RM 1.5 zoned property that has 60 ft.
frontage on 6th Ave. S. on both the east and west sides of the site (6th Ave.
S. is a divided street at this point). The site has approximately 120 ft.
depth, and slopes moderately down from south to north. One single family house
currently occupies this property, and the house would be removed as part of the
proposal. No grading is indicated.
2. Surrounding Land Use and Zoning - The property immediately to the north is
presently vacant, but is proposed to be developed with a 4 unit apartment by a
different developer. That proposal was approved by the Board at the August 1,
1990 meeting. The properties across 6th Ave.-S. to the east and adjacent to
the south are zoned RS-6, and developed with single family residences. The
property across 6th Ave. S. to the west is zoned RM 1.5, and is developed with
townhouse apartments.
3. Access - Access to the site is planned via 6th Ave. S. on both the east and
west sides of the site. The access would be to an underground garage which
would have a one-way drive through. The entrance to the garage would be on the
west side, and the exit would be on the east side of the garage.
4. Off -Street Parking - Parking for eight vehicles, two per unit, is
proposed to be provided under the building. This amount of parking meets Code
standards.
Site Development Standards - Setbacks of 15' are required on the
east and west sides of the site, and 10' on the north and south sides. The
street and side setbacks are adequate as shown. Lot coverage is 45%, and is at
the maximum permitted.

B. Building
1. Size - 401 x 861, or 3,240 sq. ft.
2. Height - Maximum proposed building height is 301 with a sloped roof. This

1. Exterior lighting: No exterior lighting is indicted on the plans.
2. Trash: Trash enclosures and recycling -areas are to be located on the north

3. Miscellaneous - No mechanical equipment is shown on the roof. Any
exterior Te—chanical equipment must be screened. Utility meters must be painted
to match the building.
D. Landscaping, Fencing, Rockeries
1. Landscaping - No landscape plan has been submitted for the preliminary
review, however a landscape plan will be submitted with the final plans.
2. Fencing - A cyclone fence is located along the north property
Ti�ne, and a 6 ft. cedar fence would be provided around the dumpster and recycle
areas. The applicant has not indicated any other fence on his plans.
3. Rockeries- 3 ft. rockeries are shown around the driveways.
E. Signs - None planned at this time.
F. Engineering Division Requirements
The Engineering Department has completed a preliminary review of the project and
has concluded that 6th Ave. S. on the west side of the site must be overlaid from
Walnut St. A landing at 6% or less, for a minimum of 20 feet long is required at
the exit. A storm water tie-in should be coordinated with neighboring
development. and that a New curb will be required and need to be constructed on
6th Ave. S. on both sides of the site with a 7 ft,., sidewalk.
These are preliminary comments, and additional comments may be generated as the plans
are finalized.
1. The following is required with a building permit:
--a utility development plan.
--bonding to City code.
2. Underground wiring is required.
3. If more than 500 cubic yards of earth are to be moved, a conditional use
permit -is required from the Edmonds Hearing Examiner.
4. A 7' sidewalk is required along east and west property lines.
5. An engineered drainage plan is required.

No landscape plan has been provided, and a landscape plan must be submitted for Board
approval at the next review.
Findings
1. Section 15.20.005 of the Edmonds Community Development Code contains policies for
multiple family development. The Board should review these policies, condition
approval where necessary, and must make the finding that the proposal is consistent
with the Comprehensive Plan and other adopted City policies. Since this property
abuts single family zoning the Board should pay particular attention to the
policies in Section 15.20.005 2.(b) and also 2.(c) 1) (attached).
2. The subject proposal needs to comply with the Engineering Department's requirements
for parking access and street improvements to comply with Section 18.75 of the
Edmonds Community Development Code.
3. Chapter 20.10 of the Code contains ADB review criteria. As called for in this
section, the Board should require curbs where landscaping meets driveway areas,
should review the building to see that it meets the basic design requirements and
must find that the proposal in general satisfies the criteria and purposes of
Chapter 20.10 of the Code.
DISCUSSION
The applicant, Rob Michel, 21010 76th Avenue West, described the proposed project and
said that a landscape plan will be provided as soon as possible. This is the last lot
in a multifamily zone that is adjacent to a single-family zone.
Rick Albright, 518 6th Avenue South, who lives immediately south of the project,
thanked the Board for its efforts in keeping him and his neighbors notified about
action on this proposal. He requested that the height of the building be lowered by
building a flat rather than a peaked roof, asked about a fence and/or landscaping
between the subject property and his, and asked if the rectangles shown on the south
side are planter boxes or surface features. He also asked if any variances would be
required for the building. Mr. Somers replied that they would not.
The Board had some questions about the parking lot: the plan shows a 21-foot back-up
area, which Mr. Michel said has been approved and several Board members thought should
be 24 feet. Board Member Hummel asked Mr. Somers to obtain a written answer from the
City on that.
Board Member Bylsma asked for more information on the grades and the impact of grading
on existing trees, and suggested that the building could benefit from additional
excavation so that it would be more cut into the site. He did not feel that the
attempts at modulation on the north elevation succeeded in breaking up the flat
plane. He found the east and west elevations to be satisfactory. The south elevation
appears boxy and needs modulation. Board Member Bylsma told the applicant that it is
necessary for a building that is in a position of transition from multifamily to
single-family to be broken up into a semblance of individual -appearing units in order
to blend with the smaller scale of the adjacent single-family homes. He suggested
that breaking up the roof line would help accomplish this.
Board Member Robertson noted that the entry to the building will be on its south side,
and suggested that the entrance be moved to its north side, leaving the single-family
neighborhood with less additional traffic. She also noted that the entrance will have
lights burning all night, which could negatively impact neighbors. Mr. Michel pointed

DISCUSSION
Board Member Hummel asked whether the staff report showing 7-foot sidewalks required
on both sides of the property is correct. The applicant, Rob Michel, 21010 76th Ave
W, said that the street on the east side is little more than an alley and that the
City is not requiring a 7-foot sidewalk on that side; there is not room for one and
one had not been required on the property directly to the north of his. Mr. Somers
said that if a 7-foot sidewalk is not feasible on the east side, the applicant should
petition the Engineering Department to waive that requirement; it does not affect the!
Board's approval of the site plan.
Mr. Michel described changes he had made, based on the Board's recommendations: more
modulation in the north and south elevations, more definition to individual units,
elimination of the raised porch area, and deletion of two of the entry lights.
Rick Albright, 518 6th Ave S, a neighbor of the project, spoke in favor of the changes
made in the plan and said that he agreed that a 7-foot sidewalk on the east side would
be inconsistent with the existing configuration.
Board Members Beck, Bylsma and Hummel complimented the applicant on the changes in the
design to accommodate the Board's suggestions and the desires of the neighborhood.
Board Member Robertson asked the applicant to specify what kind of laurel will be
planted and the spacing of the Hahn's ivy to meet Code. She asked that the azaleas
and rhododendrons be called out as,specific varieties, not just species, and that
specific varieties be grouped together to get a massed effect. The rhododendrons
should be behind the shorter material at the curb side with the taller material
behind; on the southeast, the rhododendrons should go on top of the rockery and an
azalea bed below. She suggested that the boxwood would work better behind the lawn
instead of in front and that Japanese holly might be a better choice that boxwood.

A. Site
1 . Nature of Site - The subject site is a RM 1.5 zoned property that has 60 ft.
frontage on 6th Ave. S. on both the east and west sides of the site (6th Ave. S.
is a divided street at this point). The site has approximately 120 ft. depth,
and slopes moderately down from south to north. One single family house
currently occupies this property, and the house would be removed as part of the
proposal. No grading is indicated.
2. Surrounding Land Use and Zoning - The property immediately to the north is
presently vacant, but is proposed to be developed with a 4 unit apartment by a.
different developer. That proposal was approved by the Board at the August 1,
1990 meeting. The properties across 6th Ave. S. to the east and adjacent to the
south are zoned RS-6, and developed with single family residences. The
property across 6th Ave. S. to the west is zoned RM 1.5, and is developed with
townhouse apartments.
3. Access - Access to the site is planned via 6th Ave. S. on both the east and
west sides of the site. The access would be to an underground garage which would
have a one-way drive through. The entrance to the garage would be on the west
side, and the exit would be on the east side of the garage.

F. Engineering Division Requirements
The Engineering Department has completed a preliminary review of the project and has
concluded that 6th Ave. S. on the west side of the site must be overlaid from Walnut
St. A landing at 6% or less, for a minimum of 20 feet long is required at the exit.
A storm water tie-in should be coordinated with neighboring development. and that a
New curb will be required and need to be constructed on 6th Ave. S. on both sides of
the site with a 7 ft. sidewalk.
These are preliminary comments, and additional comments may be generated as the plans
are finalized.
1. The following is required with a building permit:
--a utility development plan.
--bonding to City code.
2. Underground wiring is required.
3. If more than 500 cubic yards of earth are to be moved, a conditional use
permit is required from the Edmonds Hearing Examiner.
4. A 71 sidewalk is required along east and west property lines.
S. An engineered drainage plan is required.
No landscape plan has been provided, and a landscape plan must be submitted for Board
approval at the next review.
Findings
1. Section 15.20.005 of the Edmonds Community Development Code contains policies for
multiple family development. The Board should review these policies, condition
approval where necessary, and must make the finding that the proposal is consistent
with the Comprehensive Plan and other adopted City policies. Since this property
abuts single family zoning the Board should pay particular attention to the policies
in Section 15.20.005 2.(b) and also 2.(c) 1) (attached).
2. The subject proposal needs to comply with the Engineering Department's requirements
for parking access and street improvements to comply with Section 18.75 of the
Edmonds Community Development Code.
3. Chapter 20.10 of the Code contains ADB review criteria. As called for in this
section, the Board should require curbs where landscaping meets driveway areas,
should review the building to see that it meets the basic design requirements and
must find that the proposal in general satisfies the criteria and purposes of Chapter
20.10 of the Code.
DISCUSSION
The applicant, Rob Michel, 21010 76th Avenue West, described the proposed project and
said that a landscape plan will be provided as soon as possible. This is the last lot
in a multifamily zone that is adjacent to a single-family zone.
Rick Albright, 518 6th Avenue South, who lives immediately south of the project, thanked
the Board for its efforts in keeping him and his neighbors notified about action on this
proposal. He requested that the height of the building be lowered by building a flat
rather than a peaked roof, asked about a fence and/or landscaping between the subject
property and his, and asked if the rectangles shown on the south side are planter boxes
or surface features. He also asked if any variances would be required for the building.
Mr. Somers replied that they would not.

The Board had some questions about the parking lot: the plan shows a 21
area, which Mr. Michel said has been approved and several Board members thought should
be 24 feet. Board Member Hummel asked Mr. Somers to obtain a written answer from the
City Engineer on that.
Board Member Bylsma asked for more information on the grades and the impact of grading
on existing trees, and suggested that the building could benefit from additional
excavation so that it would be more cut into the site. He did not feel that the
attempts at modulation on the north elevation succeeded in breaking up the flat plane.
He found the east and west elevations to be satisfactory. The south elevation appears

boxy and needs modulation. Board Member Bylsma told the applicant that it is necessary
for a building that is in a position of transition from multifamily to single-family to
be broken up into a semblance of individual -appearing units in order to blend with the
smaller scale of the adjacent single-family homes. He suggested
that breaking up the roof'line would help accomplish this.
Board Member Robertson noted that the entry to the building will be on its south side,
and suggested that the entrance be moved to its north side, leaving the single-family
neighborhood with less additional traffic. She also noted that the entrance will have
lights burning all night, which could negatively impact neighbors. Mr. Michel pointed

ADDITIONAL DESIGN BOARD COMMENTS
Mr. Somers informed the BoarU of a letter from the Mayor requesting ADB comments on the
possibility of installing a sani-can adjacent to the AM -PM Minimart on the corner of 5th
and Dayton. The purpose would be to resolve the problem of people urinating on the side
of the building. It was the consensus of the Board that this proposal would not
necessarily solve the problem and that if public rest rooms are needed in the area,
permanent facilities could be considered. After discussion, Board Member Hummel moved
to advise the Mayor that the ADB is not in favor of installing a sani-can at the
corner of Sth and Dayton. The motion was seconded by Board Member Robertson and carried.
Mr. Somers reported on enforcement issues brought up by the Board:
The Page Realty sign was inspected by code enforcement technician John Bissell on
September 5, 1990. The sign in question is an open -house -type. sign which is posted in
the parking area and identifies the parking stall as reserved for the Page Realty
employee of the month. Mr. Bissell found it to be an incidental sign, which requires
permit but may be reviewed by the Board at its discretion. The Community Development
Code defines an incidental sign as "one which does not advertise or identify a good,
service, or business, and which is provided solely for the convenience of the public.
(Section 20.60.060(A))

It was the consensus of the Board that this sign is provided to advertise a business
rather than for the convenience of the public. Mr. Somers was requested to advise Page
Realty either to take the name of the business off the sign so that it says only
"Employee of the Month", or if the name of the business remains on the sign, Page Realty
shall apply for Board approval for the sign.
It is the opinion of the public works superintendent that the street tree that was
severely pruned in front of Jay's Minimart will not survive well. Since the problem was
that the tree blocked the sign, Mr. Somers suggested that a smaller tree or shrubbery be
planted there. The Board concurred. Board Member Bylsma asked Mr. Somers to follow up
on the problem of Lotto signs and neon beer signs in every window.
It appears that a business has been illegally operating in the duplex across the street
from Edmonds High School. There isn't any work currently going on, but an effort is

being made to locate the owner and any operations engaged in by the occupants will be
shut down.
Board Member Birch asked if any applications have been received on the Chevron Station
across from Edmonds High School, and Mr. Somers replied than none have.
Mr. Somers reported that the banner was removed from the Sail Inn Tavern.
The owner of the Centennial building has indicated that he will come before the Board to
ask to paint his rooftop equipment. He will bring with him photographs taken from the
condominium up the hill.
Mr. Somers provided Board members with copies of a letter from the Elm Place Homeowners
Association regarding trees in the PRD that were removed. He has given Mrs. Fosso of
the Homeowners Association until next Wednesday, September 12, to provide a replacement
landscaping plan or face enforcement action. He said there seems to be feeling in the
Homeowners Association that they are not obliged to do this. Board Member Bylsma
suggested to Mr. Somers that a letter to the Homeowners Association from the City
Attorney explaining enforcement of the City's landscape requirements might be worthwhile.
In response to a concern raised by Board Member Bylsma about illegal window signs in
downtown, Mr. Somers said that the code enforcement officer is going to be doing a sweep
of the downtown area for window signs and sandwich boards that are not in compliance
with the Code.
There was discussion among the Board of ADB-3-90, which was sent to the City Council
and, according to the City Council minutes of August 21, 1990, is being remanded back to
the ADB for further review. Board Member Hummel asked. Mr. Somers to provide the Board
with a brief summary of the City Council's concerns, to be included in the next Board
packet.
Board Member Robertson asked if the landscape guidelines have been approved as part of
the Code yet. Mr. Somers replied that they have not. Board Member Robertson asked Mr.
Somers for the latest version of the proposed guidelines, and said that she would
provide input into those guidelines.
The next meeting of the ADB, on September 19, will be in the conference room in the
Planning Department.
The meeting adjourned at 10:20 p.m.

granted pursuant to ECDC 17.05.040 to allow the construction of a handicapped -accessible ramp and landing
for access to the main entrance of the residence (Unit 3) as depicted in Exhibit A for the benefit of Mr. Marsh.
2. The Owner must inform all successors and assigns that the ramp and landing are constructed within the
minimum required 10-foot side setback from the south property line and that presence of the ramp and landing
cause the site to exceed the maximum allowed lot coverage of 45 percent applicable to the RM-1.5 zone.
3. The Owner must inform the City guilding Official in writing within 30 days of any change in property
ownership or when Mr. Marsh no longer resides at the residence.
4. The Owner must inform all successors and assigns that the reasonable accommodation for the ramp and landing
as depicted in Exhibit A is personal to Mr. Marsh and does not run with the land. If Mrs. Marsh or a
subsequent owner is in need of such accommodation, the Owner must reapply to the City for reasonable
accommodation of the ramp and landing within six months after Mr. Marsh no longer resides at the residence.
5. The Owner must remove the ramp and landing and return the landscaping to the condition that was previously
existing prior to construction of the structure or as otherwise approved within six months of when the structure
is no longer required for accessible egress. In the event that the structure is no longer required, the Owner must
obtain all required demolition permits for its removal prior to commencing that work.
6. The Owner must obtain a complete building permit for the ramp and landing in accordance with all
construction codes and ordinances in effect on the date of the application for the building permit. Any -and all
deficiencies noted during inspection of the ramp and landing must be corrected within 60 days of notification.
