UNDEVELOPED SITE
The subject property is 60' x 110' with the 60' length along Bell Street and the 110'
length between Bell Street and the alley to the south. This property is slightly sloped
with a topographical change from + 0.00' at the NE corner of the subject property to
— 1.969' at the SW corner of the subject property. This elevation change takes place
over a distance of 125.37'. A vertical change of 1.969' over a distance of 68.14' with an
average slope of 2.890%.
The acreage of the subject property is:

The existing impervious surfaces presently on the subject site include an old house and
walkways, and a garage at the back of the lot. Only the existing house and garage will

Detention Reguirements
The added impervious surfaces are 4,529.168 sq ft. The RDFAC analysis was run for
both a 30" and 36" CMP pipe. The analysis indicates a total storage capacity of
162 cu ft in either case.

Detention will provided by a 36" CMP pipe. A section of 36" pipe 13' in length will
provide 91.892 cu ft of storage. Additional storage will be provided by a 48" Type 11
catch basin with restriction with a live storage depth of 3.085'. The Type I-L catch basin
adds 5.778 cu ft/ft x 3.00'ft - 17.334 cu ft. The storage of the entire 36" CMP detention
system is 164.092 cu ft, which is slightly in excess of the required 162 cu ft.

The flow to check is the 100 year storm, Qloo = 0. 13 cfs. From the formula
QWEIR = 9-739DH 3/2 ; where Q is in cfs, D is in feet(dia) and H in feet, an 6 inch riser can
discharge 1. 72163 cfs, with 6" of head Therefore 0. 13 cfs is a conservative discharge.
Downstream Analysis
Storm runoff from the subject project discharges into an under ground pipe system in the
alley. The runoff flow in the pipe system in the alley continues to the underground
system in 5 th Ave N. Flows continue along 5th Ave S to the connection with the
underground system in Dayton Street. Flows continue westerly in Dayton to 3rd Ave S,
then southerly in the underground pipe system in 3rd Ave S until they reach Shellbarger
Creek. Shellbarger Creek eventually discharges into the Sound.

his/her submittal of a develo

the City.
The purpose of the Checklist is to enable
City staff to determine whether any potential
Critical Areas are or may be present on the
subject property. The information needed to
complete the Checklist should be easily
available from observations of the site or
data available at City Hall (Critical Areas.
inventories, maps, or soil surveys).
An applicant, or his/her representative, must
fill out the checklist, sign and date it, and
submit it to the City. The City will review
the checklist, make a precursory site'visit,
and make a determination of the subsequent
steps necessary to complete a development'
permit application.
With a signed copy of this form, the
applicant should also submit a vicinity map
orplotplan for individual lots of the parcel
with enough detail, that City staff can find

On February 17, 1981, the Edmonds City Council passed Resolution 488 for
construction, reconstruction, and repair of deteriorated sidewalks. A letter
dated March 16, 1981 was sent to residents that were required to repair the
sidewalk abutting their property. A certified letter was also sent dated June
15, 1982. The improvements of sidewalks in need of repair at the expense of
the abutting property owner is provided by City Ordinance, Chapter 7.20 and
Revised Code of Washington, Chapter 35.69.
The areas needing repair have been marked in paint on the sidewalk
adjoining your property. Reconstruction permits must be obtained from the
Building Department located at 250-5th Ave. N. within thirty (30) days upon
receipt of this final notice. The permit fee for the sidewalk repair has been
waived by the City of Edmonds. In the event you have not obtained the
reconstruction permit within thirty (30) days, the City forces will commence
with the reconstruction of the sidewalk, and the City will bill the abutting
property owner.
This action is in response to many citizen requests and pedestrian falling
accidents which have been increasing in recent years as a result of sidewalk
deterioration and increased pedestrian traffic.

1. INTRODUCTION.
This matter is an appeal to a Notice of Violation issued by the City of Edmonds Building Division to
Appellants concerning the requirement to construct barrier free access in accordance with the
applicable provisions of the U niform Building Code. The parties to this appeal have previously
submitted an Agreed Order for Partial Disposition of this Appeal. The Agreed Order for Partial
Disposition has been approved'and entered by the Examiner. The parties now submit a stipulated
Agreed Order for Final Disposition of the Appeal. The terms of the stipulated final disposition are as
set forth below.
11. STIPULATED FACTS.
The parties stipulate to the facts underlying this appeal as set forth below:
1) On July 21, 1999, the City of Edmonds issued and served an Order to Correct Violations to
Marquis Financial and it office rs, pursuant to Edmonds Community Development Code (ECDC) §
20.110.040(A), relating to the alleged non-compliance of a building located at 506 Bell Street,
Edmonds, Washington, with the provisions of the ECDC and Washington State Uniform Building

Violations established a compliance date of August 2, 1999.
2) On August 3, 1999, the City issued and served a Notice of Civil Violation to Marquis
Financial and its officers, pursuant to ECDC § 20.110.040(B). Such Notice of Civil Violation
imposed civil penalties in the amount of $100.00 per day for each and every day from the date of
issuance of the Notice of Civil Violation that the building remained in non-compliance with
provisions of the ECDC and Washington State Uniform Building Code as specified in the Order to
Correct Violations.
3) On August 10, 1999, Marquis Financial timely commenced an appeal to the issuance of the
Notice of Civil Violation, pursuant to ECDC § 20.110.040(C).
4) On October 27, 1999, the parties submitted an stipulated Agreed Order for Partial Disposition
that resolved all issues upon appeal, save one issue concerning the interpretation of the requirements
of WAC 51.40.1103.2.2 pertaining to whether an accessible route of travel must be provided from
Bell Street to the structure. The parties agreed to seek an interpretation of WAC 51-40-1103.2.2 from
the Washington State Building Code Council in this regard. The question of whether or not such
access would be required from Bell Street was reserved until such time as that interpretation would
be issued.
5) On or about November 2, 1999, the Examiner approved and entered the Agreed Order for
Partial Disposition. Said Agreed Order is attached as Attachment "A".
6) On or about December 1, 1999, the Washington State Building Code Council issued
Interpretation NO. 99-14, attached to this Agreed Order as "Attachment B". Such interpretation
provides that Marquis Mortgage may satisfy the requirements for barrier free access by provision of a
connecting route of travel from any public way used for pedestrian access to the primary entrance of
the building.
111. STIPULATED FINAL DISPOSITION.
The parties stipulate to the following findings and conclusions pertaining to the remaining
issue upon this appeal:

1) That the Hearing Examiner has proper jurisdiction over this appeal pursuant to Edmonds
Community Development Code Chapter 20.110.
2) That the structure presently occupied by Marquis Financial at 506 Bell Street, Edmonds,
Washington, is subject to the requirements, as in effect upon January 8, 1998, of the Washington
State amendments to the Uniform Building Code pertaining to barrier -free accessibility as adopted in
Chapter 51-40 WAC.
3) That since issuance of the Notice of Civil Violation, Marquis Financial has submitted
applications for the required permits to construct the necessary improvements to bring the structure
into compliance with the barrier free accessibility requirements. Such permits have been issued and
construction of the required improvements is presently under way.
4) That pursuant to State Building Code Interpretation No. 99-14, Marquis Mortgage may
satisfy the requirements for barrier free access by the provision of a path of travel connecting the
primary entrance of the building to any public way used for pedestrian access.
5) That the alleyway adjacent to the property owned by Marquis Mortgage is public right-of-way
used for pedestrian and vehicle'access and is therefore a "public way" as defined in WAC Chapter
&V In, 11
6) That Marquis Mortgage may satisfy the requirements for barrier free access by the provision
of a path of travel, meeting accessible route requirements, connecting the adjacent alleyway to the
primary entrance of the building as described in Paragraph 111(3) above. No further barrier free
access improvements shall be required regarding the subject property, other than those referred to
Paragraph 111(3) above, and the previous order entered herein.

2 Based upon the agreement and stipulation of the parties to this appeal, the appeal is

On February 17, 1981, the Edmonds City Council passed Resolution 488 for
construction, reconstruction, and repair of deteriorated sidewalks. A letter
dated March 16, 1981 was sent to residents that were required to repair the
sidewalk abutting their property. A certified letter was also sent dated June
15, 1982. The improvements of sidewalks in need of repair at the expense of
the abutting property owner is provided by City Ordinance, Chapter 7.20 and
Revised Code of Washington, Chapter 35.69.
The areas needing repair have been marked in paint on the sidewalk
adjoining your property. Reconstruction permits must be obtained from the
Building Department located at 250-5th Ave. N. within thirty (30) days upon
receipt of this final notice. The permit fee for the sidewalk repair has been
waived by the City of Edmonds. In the event you have not ' obtained the
reconstruction permit within thirty (30) days, the City forcesi will commence
with the reconstruction of the sidewalk., and the City will bill the abutting
property owner.
This action is in response to many citizen requests and pedestrian falling
accidents which have been increasing in recent years as a result of sidewalk
deterioration and increased pedestrian traffic.

sidewalk repair has been waived by the City of Edmonds. In the
event these improvements are not completed within ninety (90) days
upon receipt of this certified letter, the City will employ a
private contractor to perform the designated repairs and the City
will bill the abutting property owner.
This action is in response to many citizen requests and
pedestrian falling accidents which have been increasing in recent
years as a result of sidewalk deterioration and increased
pedestrian traffic.
