The Critical Areas Checklist contained on this form is
to be filled out by any person preparing a
Development Permit Application for the City of
Edmonds prior to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable City staff to
determine whether any potential Critical Areas are, or
may be, present on the subject property. The
information needed to complete the Checklist should
be easily available from observations of the site or
data available at City Hall (Critical Areas inventories,
maps, or soil surveys).

We have received your letter dated March 7, 2005 regarding your concerns about surface
drainage, ground water, and spray from the new sea wall at the Edmonds Bay Building.
When we met on March 18, 2004, we agreed to look into your concerns with our project
engineering consultant. You agreed to have your elevator maintenance contractor contact me to
arrange a time that we could meet on site and inspect the elevator pit, and to have your elevator
maintenance contractor provide us copies of any maintenance records he has that would indicate
his observations that will help us in our review of the situation. You also agreed to provide us
drawings showing the locations of water and other utility lines within and entering the building.
You mentioned in your letter that you have repaired a leak in one of your water lines. In addition,
shortly after our March 18, 2004 meeting, the City's Parks Maintenance Division dug four test
holes, approxitnately five feet deep, just west of the Edmonds Bay Building. The soil in these test
holes was dry. Also at our meeting, we had suggested that the water in the elevator pit should be
tested to see if that will help us determine the source of the water. If the City is to do this test, we
need access to the elevator pit to obtain a sample to test.
We have not yet been contacted by your elevator maintenance contractor or received the above
information, and thus, have not been able to inspect the elevator pit, obtain a sample of the water
to test, or initiate any further investigation of your concerns.
We will look forward to hearing from you or your elevator maintenance contractor and to receipt
of the above information.

On December 2, 1997, you sent a letter to Jeannine Graf, Building Official, citing why your proposed portico
at 51 W. Dayton St. should be allowed to be unprotected adjacent to a City -owned parking lot. Let me
attempt to clarify the City's position on this request.
Per the LIBC, public way is defined as "..any sfree4 alley orsimilarparcel of land unobstructed from
the ground to the sky which is deeded, dedicated or otherwise permanently appropriated to the
public for public use and having a clear width of not less than 10 feet� NebertheCiysoodenorthe
state building code allows the City, as the reviewing agency, to grant this request in that there is no "Public

Having cited all of the legal reasons, let me propose a way that the portco could be constructed. The City,
as the adjoining property owner, could allow you to construct the unprotected opening(portico), provided
that 51 W. Dayton St.'s property owner -of -record present a written letter to the City stating that this
property owner will cover this opening at such time as the City. as the adjoining property owner,
requests such as part of a development permit application condition. This letter must be received by
the City prior to issuance of the permit.

REVIEW OF PROPOSED EDMONDS BAY OFFICE BUILDING
REMODEL PLANS
Per your request, I have reviewed the plans which have been submitted for the remodel of the
Edmonds Bay Office Building and have compared the these plans with my Shoreline Permit
exemption letter issued for the project on June 6, 1997 (see Attached). Upon review of the
exemption letter and the current plans, I have concluded that the plans are consistent with my June
6th exemption letter, with the exception of the proposed portico.
My concern with the proposed portico is the same to which you outline in your e-mail of
December 8th (see Attached. If the portico is to be constructed over the adjacent property line,
then we can not issue permit until the applicant has established their legal rights to build over the
property line. However, John has informed me that Brad Butterfield stated that he has revised the
project plans to show that the portico will be entirely on the subject property and not connected to
the existing columns on the adjoining property. If this is correct, the project would be consistent
with the plans I reviewed in issuing my shoreline exemption letter of June 6th. If however, the
project has not been revised to locate the portico only on the subject property, then it would be my
conclusion, that we can not issue permit until the issue is resolved.

Jeff I am really concerned that the scope of work shown on plans for #97-301 are not in compliance with your
Shoreline exemption letter dated 6/6/97 for this project. Steve Butterfield has called at least three times
regarding the status and we will not issue the permit until we get your memo that the plans are in compliance
with your shoreline exemption letter. Note, they are removing the existing blue awning and building a heavy
timber portico which include.-s new concrete columns, there is exterior work on the second floor decks, they are
adding clock apertures, thLy will be pouring new deck footings, and I can't remem'Liar everything else but the
working bid is S384,634.
