Re: Conditional Use Permit Hearing For The Tree of Life Center
Dear Mr. Bowman:
Pursuant to our telephone conversation of May 19, 1987, we are requesting
a continuance on the Conditional Use Permit Hearing for the Tree of Life
center that is scheduled for Thursday, May 21, 1987. The grounds for
requesting the continuance is so that the Tree of Life Center has time to
address the issues raised in the City of Edmonds Staff Report some of which
had not previously been communicated to my client. We request that the
hearing be continued until Thursday, June 4, 1987.

A. Description of the Subject Property and Surrounding Area
The subject property is located on the northeast corner of
the intersection of 5th Ave. S. and Holly Drive. The lot
contains 11,583 square feet. There is an existing older
home located on the lot.
The Applicant intends to convert the existing building into
a church, a small office and bookstore. The bookstore and
office are presently occupying the building. The building
was formerly used as a small retail store.
Surrounding development is commercial to the north and
west. The area to the east is developed with single family
residences. The property immediately to the south is a
undeveloped.

C. Zoning Ordinance
The subject property, as well as the surrounding area to
the north, west,and south, is zoned BC. A church is
allowed as a conditional use permit in this zone.
The residential properties to the east are zoned RS-6.
The requested conditional use permit, as conditioned, does
not appear to conflict with the purposes of the Zoning
Ordinance or the BC zone.
D. Comprehensive Plan
The subject property and surrounding area is designated as
Commercial Business.
As conditioned, the proposed conditional use permit does
not appear to conflict with the purposes of the
Comprehensive Plan.
E. Not -Detrimental
The proposed use could impact the neighborhood from traffic
that may be generated by the church. Because of the
location of the existing building, parking is severely
limited on this site.
The church has secured a lease for parking at a nearby
restaurant, north of the subject property. The parking
agreement does not address how evening parking for classes
will be handled.
The parking requirements for the various uses proposed are:
1 space for the office use (432 sq.ft. /1 per 400
sq.ft.)
2. 1 space for the bookstore (108 sq. ft. approx./l per
200 sq. ft.)
3. 9 spaces for the church assembly area.
F. Transferability
The permit should not be transferable.
V. STAFF RECOMMENDATION:
The primary concern with this proposal is the severe lack of
parking for the proposed uses. Further, without exact detailed

plans of the building, the Fire Marshal and Building Official are
concerned about the church occupying the building. Their concern
centers upon insuring that proper exiting is providing in the
building, per the Uniform Building Code, 1985 edition.
Unless the parking concern can be resolved and detailed floor
plans are submitted for review and approval by the Building
Official, staff cannot support this proposal.

It is with pleasure that I respectfully submit a request for a
conditional use permit for the TLC Church of Religious Science -
Tree of Life Center - at the premises of 515 5th Avenue S.,
Edmonds, Washington.
At this time, our congregation has approximately 40 members with
7 youth. our statement of operations for the premises are as
follows:
The offices upstairs and the classroom are to be primarily used
for office functions, counseling, and small group meetings of
2-10 people.
The bookstore is to be used for retail.
The sanctuary is to be used for small group meetings and classes
of 2-30 people and Sunday services of 2-40 people.
The kitchen will be used for reception preparation and occasional
small potlucks of 2-20 people.
Most classes held on the premises will be in the evenings from
7-9 pm. off-street parking will be used.
The TLC Church has a notarized parking agreement with the Hong
Kong Gardens Restaurant parking lot for the duration of our 3 year
lease during the following hours:
Monday through Friday from 6:00am - 11:00 am
Saturdays from 6:00 am to 4:00 pm
Sundays from 6:00 am to 4:00 pm

THIS AGREEMENT made this day of May, 1987 between TREE OF LIFE
CENTER, INC., a Washington corporation ("Lessee"), and,,Jo/e
("Lessor").
RECITAL
Lessee and Lessor desire to enter into a written agreement for the lease
of certain parking facilities subject to the terms and conditions set forth
below.
NOW, therefore, the parties agree as follows:
1. Description of Property. Lessor hereby leases to Lessee that certain
property owned by Lessor, commonly known as is- 5710 119 Ve. &Ilftz

for use as a parking lot (the "Property"). The Property is more particularly 7R.42-e
described on attached Exhibit "A".
2. Term. The term of this Lease shall be for a period of five (5) years
commencing on the effective date hereof, unless sooner terminated as provided
herein.
In the event Lessee is not in default hereunder, Lessee, at Lessee's
option, may renew the term for successive additional five (5) year terms upon
one hundred eighty (180) days' prior written notice to Lessor. In the event
of any such notice by Lessee to Lessor, the parties shall execute a written
Lease Addendum to reflect each such extension of the Lease term.
3. Rent. Lessee shall pay as rental to Lessor the sum of /10(0

of May during each year of the original term and any extension.
4. Hours of Use. It is expressly understood and agreed by and between
Lessor and Lessee that Lessee is entitled to use the leased premises as a

time, on the premises or elsewhere, and Lessee shall pay the same without
demand being made therefor.

7. Indemnity. Lessee shall assume all risks incident to the use of the
premises as a parking lot and shall indemnify Lessor against any loss, damage,
or expense resulting from personal injury or damage to, or loss of property
caused in any manner by Lessee, and against any loss, damage, or expense
resulting from injury to Lessee, its agents, or employees.
8. Termination. This Lease may be terminated by Lessee upon one hundred
eighty (180) :days' prior written notice in the event Lessee is no longer
required to maintain the leased premises as a parking facility under
applicable City of Edmonds zoning regulations, parking code, or other
applicable law.
9. Successor and Assigns. This Lease and the terms and conditions
hereof apply to and are binding on the heirs, successors and assigns of the
parties hereto.
10. Entire Agreement. This Lease constitutes the entire agreement
between the parties and may not be changed except by an instrument in writing
signed by the Lessor and Lessee.
11. Severability. If any term or provision of this Lease, or the
applicability thereof to any person or circumstances, shall to any extent be
invalid or unenforceable, the remainder of this Lease, or the application of
such term or provision to persons or circumstances other than those as to
which it is held invalid or unenforceable, shall not be affected thereby and
shall continue in full force and effect.
12. Governing_ Law, Venue/Attorney Fees. This Lease shall be governed by
the laws of the State of Washington. Venue in any action brought to enforce
the terms and conditions of this Agreement shall be in the Superior Court for
Snohomish County, Washington. In any action brought to enforce the terms and
conditions of this Lease, the party substantially prevailing shall be entitled
to an award of reasonable attorney's fees at trial and on appeal in addition
to all other costs.

I moved to Edmonds two years ago because I wanted a change from
the city environment and to have the experience of a smaller
community living. Since I continued to work and attend church
in Seattle, the only thing that changed was to become a commuter
living in the suburbs. Recently, however, I became employed in
Edmonds and now that my church has a "branch" (Tree of Life Church
of Religious Science) here��lso, I feel that I am becoming a part
of the community. All my needs are met right here in downtown
Edmonds and this provides me the opportunity to become more
involved locally and to give of my time and services to "my"

Bellevue and Everett ... which locations require considerable
driving for attendance.
The subject location is ideal. We, who know this area, love
Edmonds. The building and grounds will be well maintained.

way that it is difficult to even realise that they are of
a religious order in that -they have not attempted to promote
their beliefs on anyone that I know of.

As you will recall, Rev. Laurie Kiefer requested a continuation of the
hearing on the conditional use permit for a church at 515 5th Avenue
South until June 4, 1987. The continuation request asked for to allow
the applicant a chance respond to the concerns about evening parking
and exiting requirements.
Attached for your information is a copy of a lease for evening parking
at a nearby bank, an exiting plan, and a number of letters supporting
the conditional use permit request.
The Staff's concern with this application is parking. The new lease
agreement seems to address the evening parking needs of the church.
Staff would recommend that, if the Hearing Examiner should decide to
grant the conditional use permit, the following conditions be imposed:
1. The permit not be transferable.
2. That the church be required to maintain leased parking spaces
meeting the City of Edmonds parking standards.
3. All exte . rior improvements be approved by the Edmonds Architectural
Design Board.
4. The Applicant obtain and comply with all building permit
requirements for the interior remodel of the existing building.

Dear Mr. Bowman:
I would like to respond to the cause of the Edmonds Tree of Life Center
in obtaining permission to use the building at 515 South 5th. Ave. for
Sunday services.
I would in particular call attention to the influence this Church has
already made in the cotribution of attracting people to this community
that by and through their actions exemplify the desirable quality of
life in Edmonds. Their reflection to the community can be expressed
most visibly in their efforts to upgrade and beautify an otherwise
neglected eyesore building into a viable, functional building that
integrates well into the preservation of the downtown core of Edmonds.
The quality of life in a community is an expression of it's people.
I trust that the civic leadership of Edmonds is aware of this and will

This letter is to let you know how important the Tree of Life Church
of Religious Science is to me. And to especially stress it's being
located in Edmonds.
I have been an Edmonds resident for 8 years. In all that time it has
been necessary for me to drive all the way to Seattle to participate
in a church that supports my spiritual beliefs. That's not just on
Sundays but other days of the week when I want to partake in classes,
lectures, workshops and social events. It's very tiresome to have
to commute the distance. In addition, I do not have the opportunity
to enjoy our beautiful community when I am forced to leave it. Since
this church has established it's self I have become acquainted with
many people who live right here at home. We can come together in
minutes! And, we have been enjoying the abundance of great eating
places, shops and movies right here at home. I have discovered places
in downtown Edmonds I didn't even know existed. It feels wonderful
to share "my own backyard" with people who resinate with my spiritual
philosophy.
Having this church here has also meant more personal growth for me.
It is such a joy to be here I have taken the role of Program Coordinator.
This important function has been to difficult for me before due to the
time involved in traveling to and from Seattle. Now that my church is
right here I can work full time and carry on this function as well.
I now have opportunities for public speaking and leadership activities
that offer me some challenges. It's greatly rewarding to know that
I am serving the community in which I live. Because I have this
function it's particularly meaningful to me that our church be
allowed to run it's'programs from a single church home. Everything is
there, no need to haul things around from location to location.
I ask you to authorize the use of the facility at Fifth and Holly
and appreciate all your time and considerations on behalf of all
Edmonds residents. Thank you.

LIFE CENTERt INC., a Washington corporation ("Lessee"), and HONG KONG GARDENS
RESTAURANT, a sole proprietorship, ("Lessor").
RECITAL
Lessee and Lessor desire to enter into a written agreement for the lease
of certain parking facilities subject to the terms and conditions set forth
below.
NOW, therefore, the parties agree as follows:

1. Description of Property. Lessor hereby leases that certain
property owned by Lessor, commonly known as 505 Fifth Avenue South, Edmonds,
Washington, for use as a parking lot (the "Property"). The Property is more
particularly described on attached Exhibit "A".
2. Term. The term of this Lease shall be for a period of five (5) years
commencing on the effective date hereof, unless sooner terminated as provided
herein.
In the event Lessee is not in default hereunder, Lessee, at Lessee's
option, may renew the term for successive additional five (5) year terms upon
one hundred eighty (180) days' prior written notice to Lessor. In the event
of any such notice by Lessee to Lessor, the parties shall execute a written
Lease Addendum to reflect each such extension of the Lease term.
3. Rent. Lessee shall pay as rental to Lessor the sum of One Hundred
Dollars *00.00) per Yearr payable in advance on or before the Ist day of May
during each year of the original term and any extension.
4. Hours of Use. It is expressly- understood and agreed by and between
Lessor and Lessee that Lessee is entitled to use the leased premises as a
parking facility only at the following times and times of day:

or expense resulting from personal injury or damage to, or loss of property

8. Termination. This Lease may be terminated by Lessee upon one hundred
eighty (180) days' prior written notice in the event Lessee is no longer
required to maintain the leased premises as a parking facility under
applicable City of Edmonds zoning regulations, parking code, or other
applicable law.
9. Successor and Assigns. This Lease and the terms and conditions

between the parties and may not be changed except by an instrument in writing

Amended leases re: Parking
After due consideration of the evidence presented by the Applicant;
evidence elicited during the public hearing; and, as a result
of the personal inspection of the subject property and surrounding
areas by the Hearing Examiner, the following Findings of Fact
and Conclusions constitute the basis of the decision of the Hearing
Examiner.
FINDINGS OF FACT
1. The Applicant has requested approval of a conditional use
permit for the allowance of church -to be located at 515 -
Sth Avenue S, Edmonds, Washington 98020. (Staff Report)
2. The subject property is located on the northeast corner
of -the intersection of 5th Avenue S and Holly Drive., it
is a lot consisting of 11,583 square feet on which an existing
older home is located. It is the intent of -the Applicant
to convert -the existing structure into a church, a small
office and a books -tore. (Bowman testimony, Staff Report)
3. The building on site was originally used as a small retail
store. It currently used as a bookstore and office. (Bow-
man testimony)
4. The subject property is zoned Commercial Business (BC).
The properties to the north, west and south are also zoned
BC. (Staff Report)
5. The Edmonds Community Development Code (ECDC) 16.50-010 C2
allows community facilities as listed in the RN District
zoning classification to be considered a primary use requiring
a conditional use permit. ECDC 16.30.020 C2d classifies
churches as community facilities. Thus, in order for the
Applicant to use the property for church purposes, a conditional
use permit is required. (ECDC)
6. In order for a conditional use permit to be granted in the
City of Edmonds, the�criteria as set forth in ECDC 20-05.010
must be satisfied. That criteria includes:
A. The proposed use is consistent with the comprehensive
plan;
B. The proposed use in its location is consistent with
the purposes of -the zoning ordinances and the purpose
of the zone district in which the use is to be located,
and -the proposed use meets all applicable requirements
of the zoning ordinance;
C. The use as approved would not be significantly detrimental
to the public health, safety and welfare, nor to nearby
private properties or improvements. (ECDC)

Although the purposes for BC zoned property do not specifically
address churches, the proposed use is not in conflict with
these purposes as set forth in ECDC 16.50.000. (Staff Report
and ECDC)

The comprehensive plan designation for the subject property
is commercial business. With proper parking arrangements
and adherence to the exterior improvements recommendation
approved by the Edmonds Architectural Design Board, -the
proposed use would not be in conflic t with the comprehensive
plan of the City of Edmonds. (Bowman testimony and Exhibit
1)
9.
On site there is not enough parking for the proposed church
operation. The parking requirements for the office use,
bookstore and church assembly area for the facility would
be approximately 11 spaces. These spaces are determined
through the parking standards for BC zone in -the City of
Edmonds.

The Applicant has signed leases with a local bank and local
restaurant. The lease with the local bank allows the Applicant
to use the parking facilities a't 424 - 5th Avenue S, Edmonds,
Washington, Monday through Friday 7:00 pm until 11:00 pm.,
and Saturdays and Sundays, 9:00 am until 12:00 am. The lease
with -the local�restaurant allows the Applicant -to use parking
facilities at 505 - 5th Avenue S, Monday -through Friday,
6:00 am until 11:00 am, and Saturdays and Sundays, 6:00 am
until 4:00 pm. With these leases the Applicant can provide
parking for her congregation during the -time services are
being held. (Exhibits 30, 31)
11. The location of -the parking lots -that are the subject of
the leases of the Applicant is close enough -to the Applicant's
property to adequately provide parking for the congregation.

12. TheApplicant has indicated that -the services of her church
will coincide with the hours available for parking at the
two lots -that are subject to -the lease. (Kiefer testimony)
13.
The Firemarshall and building officials originally voiced
concern over -the church occupying the proposed building.
Their interest in the property centered around the insurance
of proper exits per the Uniform Building Code 1985 edition
(Staff Report, Exhibit 1)
14.
The Planning Department of the City of Edmonds has recommended
an approval of the conditional use permi t subject to
conditions as set forth in a May 29, 1987 memorandum.

No opposition testimony was received.
CONCLUSIONS
1.
The application is for -the approval of a conditional use
permit for the allowance of a church at 515 5th Avenue
S, Edmonds, Washington 98020.
2.
Because the church is located in a BC zone, a conditional
use permit is required. The Hearing Examienr has jurisdic tional
authority to issue the conditional use permit.
3.
The criteria for review of the conditional use permit are
set forth in ECDC 20.05.010. With conditions, the request
satisfies the criteria.
4.
The requested conditional use permit will not be in conflict
with the zoning ordinances of the City of Edmonds, nor the
purposes of -the BC zone as set forth in ECDC 16.50.000.
5.
The requested conditional use permit will not be in conflict
with the comprehensive plan of the City of Edmonds, nor
the commercial business designation.
6.
The requested conditional use permit, with conditions, will
meet all applicable requirements of the zoning ordinances
of -the City of Edmonds.
7.
With conditions, the requested conditional use permit will
not be detrimental to the public health, safety and welfare,
nor to nearby private property or improvements. The Applicant
must continue to provide parking as set forth in the lease.

spaces meeting the City.of Edmonds -parking standards. Should
the Applicant renegotiate her leases or enter into new parking
leases, she must seek prior approval from the City of Edmonds
Planning Department.
3. All exterior improvements must be approved by the Edmonds
Architectural Design Board.
4.
The Applicant is to obtain and comply with all building
permit requirements for the interior remodeling of the existing
building.
5. The Applicant is to cooperate with -the Firemarshall and
building officials of the City of Edmonds. The improvements
that they require pursuant to the Uniform Building Code,
1985 edition, must be met.
