MOTION CARRIED., CONTINUED AGENDA R-7-78 VIRGINIA EVANS - Contract rezone from RMH to BC the property located at 520 Maple St. (Continued from July 19, 1978) Assistant City Planner Mary Lou Block showed slides of the 8-unit apart- ment building which the applicant proposed to rezone for office use. The applicant had indicated that office space at a reasonable rental rate was difficult to find in Edmonds and she therefore felt rezoning*this property would fill a need. There are eight parking spaces beneath the building. The site is not in an environmentally sensitive area. It is located at the crest of a hill and slopes slightly, but it is fully developed. There are.no streams or other elements on the property that would require special consideration. The land use on adjoining properties conforms very much to the Comprehensive Plan. To the north is RM, to the east is RM, to the south is RM, and to the west is BC. Parking would be short by three spaces for office use, and the Engineering Department indicated it would not be feasible to provide the extra stalls on the site. The applicant would have the option to pay into the City's. in -lieu parking fund, but the Engineering Department had indicated that since Maple,St. has only two-hour parking they would require on -site parking to City standards. The Engineering Department recommendation, therefore, was to deny the application because of insufficient parking.. The applicant wished to make her unit a real estate broker's office,, which use is excluded from Home Occupation Permits, so she did not have that option. Although the proposed rezone may increase traffic to some extent, the total impact on the environment should not be significant and a negative declaration had been made. Mrs. Block said the Staff recom- mended denial of the application, and she reviewed the rezone criteria. She said it would not conform with surrounding land uses, noting that it is surrounded on all sides.except to the viest by RM. She did not feel changes in the neighborhood would justify or substantiate the rezone. She noted that Old Milltown is developed across the street and some of the property is in an PJ1 zone. Regarding relative gain to the public, although the applicant had cited the need for office space in the community, Mrs. Block noted that the continued low vacancy rate for multiple -family dwellings indicated there also is a continued need for residential uses. She did not feel there had been substantial evidence to support a rezone. Chairman McGibbon indicated petitions had been received in opposition.to the rezone with signatures of.approximately 30-40.people living mostly on Maple St. The hearing was then opened to .the public. Virginia Evans, the applicant, said*her son and she own the Haples Apartments. She said Mrs. Block had stated the only 8C property around her was to the west and she said that is the way her property faces, overlooking a service station. She.felt it had lost its appeal as a nice, residential. apartment because of garbage trucks that park at.the station every.night. She said her property had room for three or four additional parking spaces but an existing greenbelt would have to be removed to accommodate the extra parking, so she felt a contribution to the in -lieu parking fund would be better. She said she had been unable to find office space for -her real estate busiriess at a reasonable price so she had takdn space in the Harbor Building.which she -indicated was more expensive than the IBM Building in Seattle, and she said a small,bus'iness, cannot afford such prices. She noted that there were nine signatures on the petition of persons not within the 80' required to be notified of the proceeding, and City Attorney Wayne Tanaka advised that that.was inot a pertinent point. Jessie Yost of 517 Alder said she had lived in her home since 1952 and at the time the apartments were built the Service station was located where it currently is and she thought trucks had been par'<ed .there during all those years. She felt to allow this rezone would just be opening the door to more comiflercial-buildings in their neighborhood, and she 'was opposed to the request. J. W. Goulder of 523 Maple said this would be encouraging business use on residential property and he was opposed to it. The public portion of the hearin'9 was then closed. The City Attorney then advised that this building has a pre-existing use and therefore the number of parking spaces required under the Code is eight, and merely to rezone it for another use would not cause a change in the parking requirement. Ile said if the new use only required 25', more parking they would not be required to comply with the parking requirement under the new ordinance which the Council had not passed as yet. He said the parking situation could be considered by the Coirimission, however. Members of the audience were asked to indicate by a show of hands how many were in favor of the proposed rezone, and there was no such indication except from the applicants. City Engineer Fred Herzberg said there is only 261�' along the west side of the property and 9' would be required for parking, leaving only,171j' for maneuverin 1 9 which was not sufficient. Commissioner [fall said she was concerned about the parking and she thought the greenbelt was very narrow. Coilaiiissioner Sittauer conimented that there may be a shortage of office spacein Edmonds,.but there also is very much a need for apartments, and he felt it would be a real hardship for the people living in the Maples Apartrients to have to look elsewhere for places'to live. lie felt such a piece of property which had been RMH for so long should remain so zoned. Mrs. Evans said Old Milltown was allowed to come in without adequate parking and she was now being penalized because they have an overflow. Chairman McGibbon noted that the applicant's primary purpose appeared to be to obtain office space for herself and he asked if that could be accommodated in a residen- tial area in some other way. Mrs. Block responded that the Code excludes real estate offices from the professional office category, p*robably because of the hours a�real estate office would be.open, and also because of traffic. She said the applicant had advised her that State law pro- hibited joint use of a dwelling as a broker's office and a residence. City Attorney I -Jayne Tanaka advised -that the Board of Adjustment could not grant a variance for a use that is prohibitpd-in a zone.
