The existing building has been used for commercial purposes for several decades. As a result, it has always had above ground power facilities. The power requirements of the new business, Shell Creek, create the need to upgrade the incoming service. There will be no change of location of incominLy service. height or quantity of poles, or quantity of wires, but simply upgrading the service one size (see attached). Esthetically there win be no change to the building or public utility if left as an overhead service. The current service is the shortest distance from the pole (approx. 35ft.) of any commercial building on the street. Maintaining overhead service would make for a cost effective and minimal impact upgrade. If the utilities were to be under grounded, there would be considerable disruption to the public right of way, not to mention the prohibitive expense of the project. The Edmonds City Code allows for a variance in situations where "finding that the cost of the underground installation is excessive in light of the benefits derived and outweighs the benefits to be gained by the public"(ECDC18.05.040). Edmonds Community Development Code provides for a variance "when replacing existing common utilities; provided, that the rebuilt or replaced structures do not expand the existing utilities use within the project area by 10%; said expansion to include the number and height of poles and the number of wires or cable carried thereon" (ECDC18.05.0006aiii). The encroachment shall be installed and maintained in a safe and sanitary condition at the sole cost, risk, and responsibility of the owner and its successors in interest. b. The Owner shall agree at all times to indemnify and hold the City free and harmless from any and all claims, demands, losses, damages or expenses resulting from the BE construction, maintenance, use, repair or removal of the structure installed hereunder, including any loss, damage or expense arising out of (1) loss or damages to property and (2) injury to or death of persons. C.- The Owner must remove or relocate any part of the encroachment within ten (10) days or such other time as specified in the notice after receipt of it from the City Engineer, or the City Engineer may cause such work to be done and the reasonable cost thereof shall constitute a lien upon the property. d. Whatever rights and obligations were acquired by the City with respect to the easement shall remain and continue in full force and effect and shall in no way be affected by city's grant of permission to construct and maintain the encroachment structure. 4. Entire Aereemen . This Agreeme ' nt constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all other agreements, oral or written, between the parties with respect to the subject matter. 5. A food preparation must have at least one integral drainboard. 5. The floor plan indicates an under counter handwash sink in the bar. Under counter handwash sinks are not acceptable. The handwash sink must be installed in such a manner as to provide clear and proper access to the basin and faucets for handwashing. 6. No handwash sinks are indicated on the floor plan for the restrooms. All restrooms must have at least one handwash sink. 7. A horizontal separation of at least 16 inches or a vertical partition 16 inches in height is required between the handwash sink on the cookline, #32 on the equipment list, and the food preparation areas. 8. Extra wall protection is required on walls behind sinks and food preparation tables. A 16-inch high backsplash of plastic laminate, fiberglass reinforced plastic or equal is acceptable. Floor to ceiling protection is required on wall behind dishwashers. Plastic coated hardboard is not acceptable. 9. The floor must be surfaced with a durable, nonabsorbent, easily cleanable material. 10. The ceiling above the food preparation areas must be nonabsorbent, smooth, and easily cleanable. 11. All licrht fixtures in food preparation and storage areas must be provided with covers or shatterproof bulbs. 12. Plumbing must meet state and local codes.
