2. The Easement. The City currently owns an existing easement over, under,
and across Owner's property for street, alley, sidewalk, other
which is described in Exhibit "B" attached hereto and incorporated by reference.
3. The Encroachment. The City hereby covenants and ag . rees and grants its

to remain in a portion of the City right-of-way/easement. A plat map showing the location of
the encroachment is attached as Exhibit "C" and incorporated by reference. This Agreement
is subject to the following terms and conditions:
a. The encroachment shall be installed and maintained in a safe and
sanitary condition at the sole cost, risk, and responsibility of the owner and its successors in
interest.
b. The Owner shall agree at all times to indemnify and hold the City free
and harmless from any and all claims, demands, losses, damages or expenses resulting from
the construction, maintenance, use, repair or removal of the structure installed hereunder,
including any loss, damage or expense arising out of (1) loss or damages to property and, (2)
injury to or death of persons.
C. The Owner must remove or relocate any part of the encroachment
within ten (10) days or such other time as specified in the notice after mceipt of it from the
City Engineer, or the City Engineer may cause such work to be done and the reasonable cost
thereof shall constitute a lien upon the property. I
d. Whatever rights and obligationswere acquired by the City withrespect
to the easement shall remain and continue in full force and effect and shall in no way be
affected by city's grant of permission to construct and maintain the encroachment structure.
4. Entire Aereement. This Agreement constitutes the entire agreement between
the parties with respect to the subject matter hereof and supersedes and replaces all other
agreements, oral or written, between the parties with respect to the subject matter.
5. Notices. Any notice which is required or may be given pursuant to this
Agreement ' shall be sent mi writing by United States mail, first class, postage pre -paid,
registered or certified with return receipt requested, or by other comparable comm ial
means and addressed as follows:

6. Waiver. City's consent to or approval of any act or omission by Owner shall
not constitute a waiver of any other default by Owner and shall not be deemed a waiver or
render unnecessary City's consent for approval to any subsequent act by Owner. Any waiver
by City of any default must be in writing and shall not be a waiver of any other default
concerning the same or any other provision of the Agreement.
7. Successors and Assigns. This Agreement shall be binding and inure to the
benefit of the parties hereto and their respective legal representatives, successors, and assigns.
Owner agrees to micorporate this agreement by reference in any subsequent deeds to the
property, but any failure to do so does not invalidate this provision.
Capacity. Each party represents that the person(s) executing this Agreement
on behalf of such- party has -the authority to execute this Agreement and by such signature(s)
thereby bind such party.

Ultrasonic testing and anchor bolt inspection was performed on (8) angle bracket welds at 324
Main Street in Edmonds. The contractor was not onsite for this visit so plans were not available
for inspection. We found welds acceptable to AWS D1.1, on all (8) pieces. Sixteen anchor holes
were drilled to a depth greater than 4". 6" bolts are being used.
To the best of our knowledge, items inspected this date are in accordance with approved plans
and specifications.

SPECIAL INSPECTION AND TESTING AGREEMENT '
The project at 32,4--132,& INWIV 5-72�� issued under building
permit number - requires special inspection and/or testing per LJBC Chapter 17
and WAC Amendments 1 '702. The complete list of special inspections is attached to this document.
BEFORE A PERMIT CAN BE ISSUED: The owner and contractor and spedial inspector shall
complete this agreement and the attached structural test(s) and inspections schedule including the
required acknowledgments.
APPROVAL OF SPECIAL INSPECTORS: Each special inspector shall be approved by the
Building Official prior to performing any duties or inspections. Each special inspector shall submit
Statement of Qualifications to the Building Official for review. Special inspectors shall display
identification when performing special inspections on site. Special inspection and testing shall meet
the minimum requirements of UBC Chapter 17 and the following:
A. Duties and Responsibilities of the Special Inspecto
1. Observe Work
The special inspector shall observe the site work for conformance with the approved
(stamped) plans. and'sp�cifications and applicable workmanship provisions of the LJBC.
Architect or Engineer reviewed shop drawings may be used only as an aid to inspection.
§pecial inspections are to be performed on a continuous basis --meaning that the speci �1
!nspector is on site at all times observing the work requiring special inspection. Periodic
inspections, if any, must have prior approval by the City based on a separate written plan
reviewed and approved by the Building Official and the engineer or architect of record.
2. Report Non -conforming Items
The special inspector shall bring nonconforming items to the immediate attention of the
contractor and note all such items in the daily field report. Any item not resolved in a timely
manner shall be immediate cause of the special inspector to notify the Building Official of the
plan deviation, error, change or omission. It shall also be the duty of the special inspector to
promptly notify the engineer or architect.
3. Complete Daily Reports
Each special inspector shall complete and sign both the special inspection record and the daily
report form for each day's inspection. These records shall remain at the jobsite with the
contractor for review by the City Building Inspector.
4. Furnish Weekly Reports
The special inspector or in.spection agency shall furnish the City with weekly reports of tests
and inspections. The project engineer or architect, and others as designated shall also be
copied on reports. Weekly reports must include the following:
Description of daily inspections and tests made with applicable locations
List of all nonconforming items
Report on status of nonconforming items (resolved or unresolved)
Itemized changes authorized by the Architect, Engineer and City if not included in
nonconformance items
5. Furnish Final Construction Report
The s ecial inspector or inspection agency shall submit a final signed report to the City stating
that af] items requiring special inspection and testing were fulfilled and reported., And, to the
best of his/her knowledge the project is in conformance with the approved plans and
specifications, approved change orders and the applicable workmanship provisions of the
LTBC. Items not in conformance or unresolved items or any discrepancies in inspection
coverage, (i.e., missed inspections, periodic inspection when continuous inspections were
required, etc.) shall be specifically itemized in this report.

Dear Jeannine,
Prior to the subject meeting, information was submitted to you by a building contractor who may
not have fully described the intended work. We would ask that you consider the additional infor-
mation and comments below regarding accessibility code as applied to this particular project.
In essence, the work entails replacing the existing north and partial east facade and parapets
that result in no change in use of the building. We believe the proposed scope of work should
be considered alterations and/or repairs not a "remodel" or "addition". No proposed work alters
any "elements" as defined by the U BC nor does any work affect any "path of travel" as cited
in the WAC provisions.
No primary function areas are repaired, altered or remodeled and therefore do not reduce existing
accessibility. Any proposed alterations are not for the eff ect of making the building or spaces
accessible or for that matter less accessible. Additionally, the work would not meet the code
definition of "substantial alteration".
We ask that you consider these comments in determining that this project is not required to meet.

2. The Easement. The City currently owns an existing easement over, under,
and across Owner's property for street, alley, sidewalk, other

3. The Encroachment. The City hereby covenants and agrees and grants its

to remain in a portion of the City right-of-way/easement. A plat map showing the location of
the encroachment is attached as Exhibit "C" and incorporated by reference. This Agreement
is subject to the following terms and conditions:
a. The encroachment shall be installed and maintained in a safe and
sanitary condition at the sole cost, risk, and responsibility of the owner and its successors in
interest.
b. The Owner shall agree at all times to indemnify and hold the City free
and harmless from any and all claims, demands, losses, damages or expenses resulting from
the construction, maintenance, use, repair or removal of the structure installed hereunder,
including any loss, damage or expense arising out of (1) loss or damages to property and, (2)
injury to or death of persons.
C. The Owner must remove or relocate any part of the encroachment
within ten (10) days or such other time as specified in the notice after receipt of it from the
City Engineer, or the City Engineer may cause such work to be done and the reasonable cost
thereof shall constitute a lien upon the property.
d. Whatever rights and obligations, were acquired by the City with -respect
to the easement shall remain and continue in full force and effect and shall in no way be
affected by city's grant of permission to construct and maintain the encroachment structure.
4. Entire Agreement. This Agreement constitutes the entire agreement between
the parties with respect to the subject matter hereof and supersedes and replaces all other
agreements, oral or written, between the parties with respect to the subject matter.
5. Notices. Any notice which is required or may be given pursuant to this
Agreement i shall be sent in writing by United States mail, first class, postage pre -paid,
registered or certified with return receipt requested, or by other comparable commercial
means and addressed as follows:

6. Waiver. City's consent to or approval of any act or omission by Owner -shall
not constitute a waiver of any other default by Owner and shall not be deemed -a waiver or
render unnecessary City's consent for approval to any subsequent act by Owner. Any waiver
by City of any default must be in writing and shall not be a waiver of any other default
concerning the same or any other provision of the Agreement.
7. Successors and Assigns. This Agreement shall be binding and inure to the
benefit of the parties hereto and their respective legal representatives, successors, and assigns.
Owner agrees to incorporate this agreement by reference in any subsequent deeds to the
property, but any failure to do so does not invalidate this provision.
.8. Capacity. Each party represents that the person(s) executing this Agreement
on behalf of such- party has the authority to execute this Agreement and by such signature(s)
thereby bind such party.

CRITERIA OF PERMIT APPROVAL
The applicant shall follow the noted conditions on the building permit. For applications that do not require a
building permit the following criteria shall be maintained at all times.
> Provide safe pedestrian travel for sidewalk encroachments. Maintain a clear zone of 44 inches minimum.
See definition of clear zone below.
> Exterior light fixtures, banners and flags must be a minimum of 7 feet above City right-of-way.
> Maintain clear landings on the exterior side of all required exit doors of 44 inches or no less than width of
door, measured toward the street.
> No projections into City alleys are permitted unless the projection exceeds 15 feet above pavement
surface.
> Do not block illumination from City light fixtures or hang objects from City light standards.
> Architectural projections from buildings must be approved by the Design Board and conform to Uniform
Building Code requirements. A building permit shall be required for such projections.
> Maintain 3 feet of clearance around fire hydrants, standpipes, manholes, water meters, blowoffs,
cleanouts and valves.
> Bistro dining tables and chairs must be placed in accordance with City Ordinance No. 3293.
> Merchandise racks, espresso carts, flower planters, benches must not be located within the "clear zone".
> Ramps require a separate building permit and must conform to UBC standards.

2. The Easement. The City currently owns an existing easement over, under, and
across Owner's property for street, alley, sidewalk, other ZVA
which is described in Exhibit "B" attached hereto and incorporated by reference.
3. The Encroachment. The City hereb covenants and age d ants its

to remain in a portion of the City right-of-way/easelment. A plat map showing the lo'catioln of the
encroachment is attached as Exhibit "C" and incorporated by reference. This Agreement is
subject to the f6llowing terms and conditions:
a. The encroachment shall be installed and maintained in a safe and sanitary
condition at the sole cost, risk, and responsibility of the owner and its successors in interest.
b. The Owner shall agree at all times to indemnify and hold the City free and
harmless from any and all claims, demands, losses, damages or expenses resulting from the
mil
construction, maintenance, use, repair or removal of the structure installed hereunder, including
any loss, damage or expense arising out of (1) loss or damages to property and (2) injury to or
death of persons..
C. The Owner must remove or relocate any part of the encroachment within
ten (10) days or such other time as specified in the notice after receipt . . of it from the City
Engineer, or the City Engineer may cause such work to be done and the reasonable cost thereof
shall constitute a lien upon the property.
d. Whatever rights and obligations were acquired by the City with respect to
the easement shall remain and continue in full force and effect and shall in no way be affected by
city's grant of permission to construct and maintain the encroachment structure.
4. Entire Amemen . This Agreement constitutes the entire agreement between the
parties with respect to the subject matter hereof and supersedes and replaces all other
agreements, oral or written, between the parties with respect to the subject matter.
5. Notices. Any notice which is required or may be given pursuant to this
Agreement shall be ' sent in writing by United States mail, first class, postage pre -paid, registered
or certified with return receipt requested, or by other comparable commercial means and
addressed as follows:

6.. Waiver. City's consent to or approval of any act or omission by Owner shall not
constitute a waiver of any other default by Owner and shall not be deemed a waiver or render
unnecessary City's consent for approval to any subsequent act by Owner. Any waiver by City of
any default must be in writing and shall not be a waiver of any other default concerning the same
or any other provision of the Agreement.

7. Successors and Assigns. This Agreement shall be binding and inure to the
benefit of the parties hereto and their respective legal representatives, successors, and assigns.
Owner agrees to incorporate this agreement by reference in any subsequent deeds to -the
property, but any failure to do so does not invalidate this provision.
8. Capaci . Each party represents that the person(s) executing this Agreement on
behalf of such party has the authority to execute this Agreement and by such signature(s) thereby
bind such party.

We received your letter dated February 19, 2002 and the requested documentation on
building valuation for the above -referenced address. We have reviewed the documents
you have provided which indicate the building value to be between $150,000 and
$250,000. Based on Section 18.05.01 OB2 of the Edmonds Community Development
Code (ECDC), if the additions, alterations or repairs exceed 50% of the building value in
a year, the private utility service must go underground. Since the $27,500 estimate you
have provided for the total cost of the additions, alterations and repairs is less than 50%
of the building value, it is not required that your private electric utility service line be
placed un�lerground. An overhead private electric service will be acceptable.

Per your request I am providing my opinion of value fbr the above referenced building which You
are leasing. The property would sel! on today's market for between $450,000 and $550,000
dollars. Of that price approxiniately $275,000 to $300,000 would be attributable to land value
with the remak* value being placed on the improvements. As the improvements are
approximately 2,950 square fee, a $200,000 improvement valuatiOrl ($67.90 per square foot) is
within the range that an appraiser would value the improvernents.
Ther&re, it is my opinion that the valuation of the bmtovements is S1 50,000, with the
valuafion of the improvements being in the $200,000 to $250,000 range.

We have received and reviewed your request for a variance of the underground utility installation
requirement as outlined in Section 18.05 of the Edmonds Community Development Code
(ECDC). We understand your request pertains to your plans to upgrade your existing private
overhead electiic utility service. The section of the ECDC that appears to apply to your situation
is 18.05.010 B.2, which may allow your private electrical service to remain overhead without a
vanance.
However, before we can make a determination if this section requires underground, additional
information is required. Under Section 18.05.010 B2, if additions, alterations or repairs exceed
50 percent of its (building) value in a one-year period, the private utility service shall be placed
underground. If the additions, alterations or repairs do not exceed the 50% threshold, the private
utility service may remain above ground.
Please provide this office with the value of the building and all improvement (additions,
alterations or repairs) costs so we can ascertain if this section of the code applies. Upon receipt
and review of the information, a determination will be made as to whether a variance request is
required.
Please note, if a variance is required, we will need specific cost information and supporting
justification to support a finding that the cost of the underground installation is excessive in light
of the benefits derived and outweighs the benefits to be gained by the public (ECDC 18.05.040).

The following letter is a request for a variance from the City of Edmonds to underground
upgraded utilities
The property and building in question are located at 526 Main Street, Edmonds. The
existing building has been used for commercial purposes for several decades. As a result, it
has always had above ground power facilities. The power requirements of the new business,
Shell Creek, create the need to upgrade the incoming service. There will be no change of
location of incominLy service. height or quantity of poles, or quantity of wires, but simply
upgrading the service one size (see attached). Esthetically there win be no change to the
building or public utility if left as an overhead service. The current service is the shortest
distance from the pole (approx. 35ft.) of any commercial building on the street. Maintaining
overhead service would make for a cost effective and minimal impact upgrade. If the utilities
were to be under grounded, there would be considerable disruption to the public right of
way, not to mention the prohibitive expense of the project. The Edmonds City Code allows
for a variance in situations where "finding that the cost of the underground installation is
excessive in light of the benefits derived and outweighs the benefits to be gained by the
public"(ECDC18.05.040). Edmonds Community Development Code provides for a
variance "when replacing existing common utilities; provided, that the rebuilt or replaced
structures do not expand the existing utilities use within the project area by 10%; said
expansion to include the number and height of poles and the number of wires or cable
carried thereon" (ECDC18.05.0006aiii).
Given this information our belief is that the City of Edmonds should grant a variance for a
utility upgrade at 526 Main Street, Edmonds.

CRITERIA OF PERMIT APPROVAL
The applicant shall follow the noted conditions on the building permit. For applications that do not require a
building permit the following criteria shall be maintained at all times.
> Provide safe.pedestrian travel for sidewalk encroachments. Maintain a clear zone of 44 inches minimum.
See definition of clear zone below.
> Exterior light fixtures, banners and flags must be a minimum of 7 feet above City right-of-way.
> Maintain clear landings on the exterior side of all required exit doors of 44 inches or no less than width of
door, measured toward the street.
> No projections into City alleys are permitted unless the projection exceeds 15 feet above pavement
surface.
> Do not block illumination from City light fixtures or hang objects from City light standards.
> Architectural projections from buildings must be approved by the Design Board and conform to Uniform
Building Code requirements. A building permit shall be required for such projections.
> Maintain 3 feet of clearance around fire hydrants, standpipes, manholes, water meters, blowoffs,
cleanouts and valves.
> Bistro dining tables and chairs must be placed in accordance with City Ordinance No. 3293.
> Merchandise racks, espresso carts, flower planters, benches must not be located within the "clear zone".
> Ramps require a separate building permit and must conform to LIBC standards.
Clear Zone Deflnition: Clear Zone refers to an area 7 feet in height and 44 inches in width providing a

a. The encroachment shall be installed and maintained in a safe and sanitary
condition at the sole cost, risk, and responsibility of the owner and its successors in interest.
b. The Owner shall agree at all times to indemnify and hold the City free and
harmless from any and all claims, demands, losses, damages or expenses resulting from the

construction, maintenance, use, repair or removal of the structure installed hereunder, including
any loss, damage or expense arising out of (1) loss or damages to property and (2) injury to or
death of persons.
C.- The Owner must remove or relocate any part of the encroachment within
ten (10) days or such other time as specified in the notice after receipt of it from the City
Engineer, or the City Engineer may cause such work to be done and the reasonable cost thereof
shall constitute a lien upon the property.
d. Whatever rights and obligations were acquired by the City with respect to
the easement shall remain and continue in full force and effect and shall in no way be affected by
city's grant of permission to construct and maintain the encroachment structure.
4. Entire Aereemen . This Agreeme ' nt constitutes the entire agreement between the
parties with respect to the subject matter hereof and supersedes and replaces all other
agreements, oral or written, between the parties with respect to the subject matter.
5. Notices. Any notice which is required or may be given pursuant to this
Agreement shall be ' sent in writing by United States mail, first class, postage pre -paid, registered
or certified with return receipt requested, or by other comparable commercial means and
addressed as follows:

6.. Waiver. City's consent to or approval of any act or omission by Owner shall not

any default must be in writing and shall not be a waiver of any other default concerning the same
or any other provision of the Agreement.

7. Successors and Assigns. This Agreement shall be binding and inure to the
benefit of the parties hereto and their respective legal representatives, successors, and assigns.
Owner . agrees to incorporate this agreement by reference in any subsequent deeds tothe
property, but any failure to do so does not invalidate this provision.
8. Capaci . Each party represents that the person(s) executing this Agreement on
behalf of such party has the authority to execute this Agreement and by such signature(s) thereby
bind such party.

Dear Mr. Abrahamson:
Your plans have been reviewed with the Rules and Regulations of the State Board of Health, and with
the policies of the Snohomish Health District. With the addition of the following, the plans are
approved.
1. The Health District operating permit application process must be completed prior to opening, for
business.
2. An indirect waste is required for the food preparation sink, mechanical dishwasher, ice machine,
running water dipper well, and equipment in which food is placed.
3. A reduced pressure backflow prevention device is required at the end of the copper water pipe
serving the pop dispensing system prior to the carbonation device.

4. A food preparation must have at least one integral drainboard.
5. The floor plan indicates an under counter handwash sink in the bar. Under counter handwash sinks
are not acceptable. The handwash sink must be installed in such a manner as to provide clear and
proper access to the basin and faucets for handwashing.
6. No handwash sinks are indicated on the floor plan for the restrooms. All restrooms must have at least
one handwash sink.
7. A horizontal separation of at least 16 inches or a vertical partition 16 inches in height is required
between the handwash sink on the cookline, #32 on the equipment list, and the food preparation
areas.
8. Extra wall protection is required on walls behind sinks and food preparation tables. A 16-inch high
backsplash of plastic laminate, fiberglass reinforced plastic or equal is acceptable. Floor to ceiling
protection is required on wall behind dishwashers. Plastic coated hardboard is not acceptable.
9. The floor must be surfaced with a durable, nonabsorbent, easily cleanable material.
10. The ceiling above the food preparation areas must be nonabsorbent, smooth, and easily cleanable.
11. All licrht fixtures in food preparation and storage areas must be provided with covers or shatterproof
bulbs.
12. Plumbing must meet state and local codes.

13. The ventilation system shall be installed and operated to meet applicable building, mechanical, and
fire codes.
A pre -operational inspection is required prior to opening for business. At the time of inspection the
construction of the food service establishment must be complete and all equipment must be in place.
Incomplete construction may result in a $130.00 reinspection fee. Contact the Food Program office a
minimum of one week in advance to schedule an appointment. This will ensure compliance with the
Rules and Re2ulations of the State Board of Health for Food Service Sanitation.
If there are any changes or additions to the approved layout or equipment, the Snohomish Health District
must be notified.

On February 17, 1981, the Edmonds City Council passed
Resolution 488 for construction, reconstruction, and repair.O'f
deteriorated sidewalks. A letter dated March 16, 1981 was sent to
residents that were required to repair the sidewalk abutting their
property. The improvement of sidewalks in need of repair at the
expense of the abutting property owner is provided by City
Ordinance, Chapter 7.20 and Revised Code of Washington, Chapter
35.68.
The areas needing repair have been marked in paint on� the
sidewalk adjoining your property. Reconstruction permits� must be
obtained from the Building Department at 501 Bell Street within 30
days upon receipt of this certified letter. The fee for the
sidewalk repair has been waived by the City of Edmonds. In the
event these improvements are not completed within ninety (90) days
upon receipt of this certified letter, the City will employ a
private contractor to perform the designated repairs and the City
will bill the abutting property owner.
This action is in response to many citizen requests and
pedestrian falling accidents which have been increasing in recent
years as a result of sidewalk deterioration and increased
pedestrian traffic.
