According to building permit records the apartment was constructed in 1967, permit #670068, for four units. Utility billing records list the apartment a - s having four units and there are no permits on file for the additional unit. The following are building division concerns: 1. If construction work has taken place to create the additional unit a building permit -would be -required; 2. If no construction work was done, a compliance inspection by building and fire would still be required to check for life safety, items (very similar to accessory dwelling unit inspections.) The permit fee is $30.00. The following are planning and engineering concerns: 1. Parking 2. Exterior changes? 3. Side sewer capacity 4. Upon review of our permanent files and Certificate of Occupancy provisions, we determined that we had been discussing the wrong street address. In order to clear up any confusion, I would like to review the permit history of the fourplex at 533 Elm Way. On March 6, 1967 Permit No. 670068 was issued to Highland Plaza for a three-story, four -unit apartment building to be constructed on lot 9 of Highland Park. A Certificate of Occupancy wasissued May 3, 1968 for this site, again for a four - unit apartment. The site is currently zoned RM-1.5., This designation is a subdistrict of the City's multiple family district and requires a minimum lot area per dwelling unit of 1,500., The original building permit application listed the square footage of the lot at that time as 6800+ square feet. Therefore, from the original application, it would appear that there is not sufficient lot area in order to justify the fifth un,it. You may wish to confirm the square footage calculation. If you find that that calculation is correct, your client has really only two choices; and I believe only one practical Mr. Dave Shenton April 10, 1986 Page 2 solution. While she is free to apply for a variance,,I am unaware of the existence of any special circumstances relating to the property which would justify such a variance. A copy of ECDC Chapter 20.85 is attached for your review. As you will see, it is structured in accordance with state law and requires the finding of special circumstances relating to size, shape, topography, location or surroundings of the property. It would appear that our situation falls directly within the prohibition of ECDC 20.85.010(a)(2) which states in part: 2. Special circumstances should not be predicated upon . . . any factor resulting from the action of the owner 0 r any past owner of the same property. Therefore, it would appear that your only practical solution is to remove the unit. I will forbear from prosecution for a period of thirty days from the date of this letter in order to permit you to review this matter with your client, to vacate the apartment and to permit application to the City for a building permit for the necessary alterations. I -hope this information will clear up our past discussions. If you require any further information or have any questions, please feel free to contact me at your convenience. Please advise your client, however, that in the event that this matter is not resolved within the time period given, we intend to prosecute. The Edmonds City Code provides for penalties of up to $2,000 a day for zoning code violations and each and every day a violation is a separate offense. B3 . .... .... a ............... . .... rl� I CHAPTER 20.85 VARIANCES 20.85.000 SCOPE A variance to any requirement of the zoning ordinance (Titles 16 and 17) except use and procedural requirements may be approved when the findings required by this chapter can be made. 20.85.010 FINDINGS No variance may be approved unless all of the findings in this section can be made. A. Special Circumstances. That, because of special circumstances relating to the property, the strict enforcement of the zoning ordinance would deprive the owner of use rights and privileges permitted to other properties in the vicinity with the same zoning. 1. Special circumstances include the size, shape, topography, location or surroundings of the property, public necessity as of public structures and uses as set forth in Section 17.00.030 and environmental factors such as vegetation, streams, ponds and wildlife habitats. 2. Special circum tances should not be predicated upon any factor personal to the owner such as age or disability, extra expense which may be necessary to comply with the zoning ordinance, the ability to secure a scenic view, the ability to make more profitable use of the property, nor.any factor resulting from the action of the owner or any past owner of the same property. B. Special Privilege. That the approval of the variance would not be a grant of special privilege to the property in comparison with the limitations upon other properties in the vicinity with the same zoning. C. Comprehensive Plan. That the approval of the variance will be consistent with the Comprehensive Plan. D. Zoning Ordinance. That the approval of the variance will be con- sistent with the purposes of the zoning ordinance and the zone district in which the property is located. E. Not Detrimental. That the variance as approved or conditionally approved will not be significantly detrimental to the public health, safety and welfare or injurious to the property or improvements in the vicinity and same zone. - 251 20.85.010 F. Minimum Variance. That the approved vaiiance is the minimum neces- sary to allow the owner the rights enjoyed by other properties in the vicinity with the same zoning. 20.85.020 GENERAL REQUIREMENTS A. Review. The Hearing Examiner shall review variances as provided in Section 20.100.010.. B. Appeals. Any person may appeal a hearing examiner decision to the City Council as provided in Chapter 20.105. C. Time Limit. The approved variance must be acted on by the owner within one year from the date of approval or the variance shall expire and be null and void, unless 'the owner files an application for an extension of time before the expiration date and the city approves the application. D. Review of Extension Application. An application for an extension of time shall be reviewed by the Cocimunity Development Director as provided in Section 20.95.050. E. Location. The original permit #670068, was issued March 6th, 1967 for the construction of a four-plex. The project was finaled April 29th, 1968, with the Certificate of Occupancy granted May 3rd, 1968. Scn-etime after this the owner created another unit, no permit was issued for the work, and no City inspections were made. The Building Division sent a letter July 26th, 1985, asking for a re.sponse; her lawyer returned the call. See his letter dated August 9th, 1985. The Building Division sent two more letters, 11/19 and 12/12 requesting a written response, as of today we have had no response. If the Tenant is unmarried and should, during this tenancy, marry, all rights to occupancy are immediately terminated unless a new rental agreement is drawn satisfactorily in its terms to the Landlord, and signed by both parties to the marriage. 3. DEPOSIT Tenant agrees to pay the sum of $ 175*00 as a Security Deposit for the performance of Tenant's obligations hereunder. This Deposit does not limit Landlord's rights or Tenant's obligations. The sum shall be deposited by the Landlord in a trust account with Otd Na�tbnal Bank -_ — whose address is Main Manch Tenant understands that all or a portion of the Deposit may be retained by the Landlord upon termination of the tenancy and that a' refund of any portion of the Deposit to the Tenant, is conditioned as follows: 1. Tenant shall clean and restore Apartment to its condition at the commencement of this tenancy, (less normal wear and tear), as evidenced by the Apartment Inspection Report signed by the Tenant prior to occupancy. Tenant agrees that soilage is not normal wear and tear, and further agrees to have carpets and drapes cleaned to professional standards or request Landlord to do same at Tenant's expense, at the termination of the tenancy. 3. Tenant shall'return to Landlord all keys provided during the tenancy. 4. Tenant shall have remedied or repaired any damage to Apartment premises or furnishings to Landlord's satisfaction. 5. Tenant shall have replaced any lost or missing items of furnishings or equipment, including personal property of the Landlord, provided during the te.nancy. 6. Tenant shall have complied with all of the provisions of this rental agreement and other such rules and regulations as the Landlord may deem necessary. Within fourteen (14) days after the termination of the tenancy and vacation of the premises, the Landlord shall mail to'the Tenant's last known address, a full and specific statement of the basis for retention of any or all of the Deposit, together with the payment of any refund due the Tenant. The Landlord shall have the right to proceed against the Tenant to recover sums exceeding the amount of the Tenant's Deposit for cleaning, painting, or repairs to the property and replacement of lost or missing items, for which the Tenant is responsible, together with reasohable attorney's fees as provided by law. 4. ACCEPTANCE Tenant agrees to inspect the Apartment prior to occupancy and to complete, sign and return to the Landlord an Apartment Inspection Report, which will be provided him. The Tenant further agrees to the painting and cleaning rates itemized on the Apartment Inspection Report and understands that cleaning and painting required at the termination of the tenancy will be charged to the Tenant at the rates listed. 5. LATE CHARGE Tenant understands that if the total rent is not received by the seventh (7th) of the month or if a check is returned for any reason there will be a Ten Dollar ($10.00) charge in addition to the full amount of the rent. 6. NOTICE TO VACATE Tenant agrees that to terminate tenancy, twenty (20) days written notice must be given to Landlord prior to the end of a monthly term. According to the terms of this agreement, rent has been prorated to the first day of each calendar month. The Tenant understands that occupancy is on a month to month tenancy running from the first to the last day of each month. Example: Notice given on the 15th of one month would bind the tenancy until the last day, not the 5th day, of the following month. Landlord may terminate the tenancy, without reason, by delivering to the Tenant written notice at least twenty (20) days prior to the end of a monthly term. In addition the Landlord may give the following notices as circumstances may warrant: 1. Ten (10) day notice to comply with any of the terms of this agreement or vacate the Apartment. 27 Three (3)-day-notice, after -a default -in -the -payment -of rent,,to p4y,the rent in full or vacate the Apartment. 3. Three (3) day notice to vacate the Apartment for committ * ing a waste upon the —pr—em-ises, -setting up-or--carrying-on -any- unlawful business, or permitting or maintaining a nuisance on or about the premises. 7. LIABILITY Tenant agrees that all personal property in the Apartment shall be at the risk of the Tenant. Tenant further agrees not to hold the Landlord liable in any matter for/or on account of any loss or damage sustained by action of any third party, fire, water, theft, or the elements or for loss of any articles from any cause, from said Apartment or any other part of said buildings. Neither shall the Landlord be liable for any injury to the Tenant, his family, guests, employees or any person entering the apartment, building or property of which the Apartment is a part. 8. MAINTENANCE Tenant shall maintain the Apartment, parking area, patio and lanai, and storage area, including furnishings, appliances, floor coverings, and draperies in good order, and in a clean and sanitary condition. 9. ALTERATIONS Tenant agrees to do no painting or other decorating in the Apartment, or make any alterations, changes or additions to fixtures, locks or wiring without the prior written conseni of the Landlord.
