failure to complete the job due to such conditions shall not constitute a failure of consideration of this agreement and the

x. Contractor agrees to lift out shrubs, bushes,�or' plants, fences or walls, or rockery necessary for
completion of described work and owner agrees that any of these or other items necessarily re-
moved may be placed on land owned by the property owner as near to the place of the contractor's
work as possible; all without liability on the part of the contractor; and -contractor, using due care
in the performance of his work, shall not be held liable for any damage to these items.
2. Owner agrees to inform the contractor of any subsurface objects known to him, including but
not limited to water pipes, septic tanks, sprinkler systems"gas lines, telephone or electric lines and
owner agrees that contractor is not liable for striking any underground man-made object.
3- Owner expressly agrees that, should contractor in his work be unable to continue because of rock
or strata necessitating blasting to remove, contractor need not continue until owner pays for such
blasting or other means of removal necessary, or if a very large rock or other obstruction is encoun-
tered owner agrees to pay the extra material and labor necessary to detour around the object.
4. Should contractor encounter in. his work, underground springs, freshets, ground waters or sub-
surface waters or any other conditions which would necessitate special bedding for pipes and fit-
tings, owner agrees to pay contractor the additional cost thereof.
Contractor will perform his work in a workmanlike fashion, with as IJtt!e disturbance as possible
and shall be liable for his acts and the acts of his workmen constituting gross negligence. Delays in
performance of contractors w ' ork caused by strikes, acts of war, acts of nature, equipment break-
downs, or any delay beyond contractors control shall not be considered by owners as a breach of this
agreement.
6. Unforeseen plumbing or extensions needed will be at extra charge to owner.
7. This contract is for sanitary sewer only and storm sewer contract or any extra work agreed to
must be written in the space below.
