SUBJECT: 535 HEMLOCKI- DRAINAGE PROBLEM
1. Investigated pluggage of Shellabarger Creek at south side
of Hemlock.
2. Pluggage apparently caused by gradual accumulation of
material in culvert. Pluggage apparently began with
board (1 x 8, about 3 feet long) jameed at bend in pipe.
Additional material included a small plant, firewood,
and extensive amounts of grass clippings and needles
A crewman speculated that someone was dumping in cre;k.
3. 'Pluggage was removed by excavation to the pipe (about 7
foot depth), breaking into pipe and cleaning.
4. Repairs are to include installation of manhole at bend.
5. Damage complaint was received from resident at 535 Hemlock.
Alleged damage included:

b. Cracking of garage slab and house walls due to

PLEASE TAKE NOTICE
that
Paul B. Ghenov and Ruth M. Ghen6v, his
wife, who
together now reside
at 535 Hemlock Way, Edmonds, Washington
98020, and
who have, for
six
months prior to the date of the accident,
resided at
535 Hemlock
Way,
Edmonds, Washington 98020, now claim
damages of
and from the
City
of Edmonds in a sum believed to exceed
$30,000.00,
arising out of
the following circumstances:
1. EVENTS.
The claimants, Mr. and Mrs. Ghenov, reside in a private residence
located at 535 Hemlock Way, Edmonds, Washington 98020. At approxi-
mately 12:30 a.m. on Sunday, May 10, 1981, the Ghenovs were sleeping
in their residence. It was a rainy evening and early morning. The
Ghenovs received a telephone call from the police of the City of
Edmonds. In this call a police officer advised them that the police had
been notified that the Ghenov's garage was being flooded by water. Mr.
Ghenov arose and went downstairs to see what was happening. At that
time, another police officer knocked at the entry door of the Ghenov
residence and advised him of the flooding. Mr. Ghenov looked in his
garage and noticed three to six inches of water continuously coming in
around and underneath the closed garage door, the water was flooding'
the garage area and eventually draining out between the foundation and
the concrete slab which forms the garage floor. Because of the rain
outside and the continuous flow of water, nothing really could be done
to stop the flooding at the time. Mr. Ghenov looked outside the home
and found a substantial amount of water flowing across Hemlock Way,
down his driveway and into his garage. He looked in back of his home
and found some of the soil settling.
The next day, Monday, May 11, 1981, he contacted the City of
Edmonds, and an employee of the City advised him that a stream runs
underneath Hemlock Way through a pipe, that the pipe is protected by a
screen, but that the screen had been clogged by a piece of wood or
pieces of wood and other similar debris such as grass clippings.
Apparently as a result of the clog the water was unable to flow through
the pipe underneath the street and instead backed up, overflowed the
street and flowed into the Ghenov residence. He was informed by the
City that a manhole cover would be installed so that the City employees
could check the screen and clean it periodically to prevent a similar
event from happening. Such manhole and cover was in fact later
installed.

The specific negligence complained of is the failure on the part of
the City to design and install an appropriate pipe for the transportation
of the water, the failure to design or install a method of checking the
screen for debris and the failure to maintain the water pipe and screen
properly so as to prevent what happened.
2. DAMAGES
The Ghenovs have suffered severe damages as a result of the
negligence of the City of Edmonds. Specifically, at the time of the
flooding, a portion of the Ghenov's garage was damaged in that the
pressure of the water bowed a portion of the foundation and footing of
the residence. However, the physical damage to the home as a result of
the water and the settling of the subsoil is much more severe.
Apparently the water pouring through the garage and draining out
beneath the Ghenov home has caused the subsoil to settle and shift and
as a result the home itself, together with its concrete foundation is
settling and shifting. This can been seen inside the house where the
walls are cracking and outside the house where the house is actually
tilting and can easily been seen where the siding is separating.
In an effort to evaluate his damages and to find out the cost of
repairing this problem, Mr. Ghenov retained the services or three
different contractors to give estimates. Photocopies of these estimates of
repair are marked as Exhibits and incorporated herein by this
reference. The estimates of repair are as follows: $18,972.00, $15,940-00
and $17,950.00. Each estimate is different based upon a difference in the
work to be performed. In addition, the Ghenovs have incurred damages
by: emotional distress, the loss of marketability of their home; a
decrease in the fair market value of their home. They have also
incurred labor costs for their own time in cleaning up the garage as a
result of the flood in the amount of approximately eight hours. The
damages set forth in this Claim are described as best as they are now
known. Additional damages may be discovered as the house continues to
settle.

SUBJECT: 535 HEMLOCK - DRAINAGE PROBLEM
1. Investigated pluggage of Shellabarger Creek at south side
of Hemlock.
2. Pluggage apparently caused by gradual accumulation of
material in culvert. Pluggage apparently began with
board (1 x 8, about 3 feet long) jamoed at bend in pipe.
Additional material included a small plant, firewood,
and extensive amounts of grass clippings and needles.
A crewman speculated that someone was dumping in creek.
3. Pluggage was removed by excavation to the pipe (about 7
foot depth), breaking into pipe and cleaning.
4. Repairs are to include installation of manhole at bend.
5. Damage complaint was received from resident at 535 Hemlock.
Alleged damage included:
a. Sediment in garage.
b. Cracking of garage slab and house walls due to
settlement.
Sketch shows path of water based on observation this day:

6. Advised resident that they could pull C.B. grate to catch
overflow waters should any water head their way again.
7. Any investigation should include check of Building Division
files regarding previous settlement.

SUBJECT: SLOPE STABILITY AT 535 AND 539 HEMLOCK WAY
At your request, we have inspected the bank adjacent to the creek
at the aforementioned residences. The bank appears to be fill,
and it is in excess of the permissible 2:1 slope. The top of the
bank at both houses shows cracks, indicative of soil movement.
Based on our field investigation, we are of the opinion that there
is -a potential for a slide at both residences.
Chapter 70 of the Uniform Building Code authorizes you to require
the home owners to stabilize the bank. This should be done in
order to protect the integrity of the drainage channel and insure
that the City is not liable for neglect.

The existing problems at this subdivision site have evolved
for over a year. Each time the contractor attempted to correct
a problem it resulted in a worse situation. At present, Hemlock
Way in the area of this development is a shabby sight.
Initially, Jay Bollinger contacted me at the Public Works
counter. He was inquiring into the engineering requirements for
the Gwinn subdivision so as to obtain building permits.
Through the course of events, three builders applied for
permits on four building sites. However, Jay Bollinger made
most of all the contact with the Engineering Dept. regarding
required improvements.
.As work progressed, and became substandard in the public
right-of-way, Jay Bollinger personally and continually assured
me that he would take care of the problems. To date, Jay Bollinger
has been working in the public right-of-way without a permit and
without inspections. The physical problems at the site are
worsening under his substandard work causing a large trench at
the entrance to the subdivision.
The subdivision bond was released by me considering that
the basic requirements had been met. Although some corrections
were needed at the time (and have since worsened due to building
activity), Jay Bollinger assured me that they would be corrected.
At that time, I told Jay Bollinger and Tony Pinto (the maker of
the bond) that I would release the bond. However, I stipulated
that the Engineering Division would not approve the building
permits for final occupancy until all problems had been cor-
rected. Both agreed.
At present, Jay Bollinger (the primary developer) claims

responsibility only for work under his own building permits (if
that much). He is now disclaiming any responsibility for work
in the right-of-way by saying that they are not his permits.
Also presently, Bob Bollinger is working in the right-of-
way without a permit in an attempt to gain occupancy for Paul
Ghenov. Mr. Ghenov is illegally occupying 535 Hemlock Way

with no water meter hook-up.
